January 8th, 1991
Pursuant to Statutes, the Board of County Commissioners of Otter Tail County
Minnesota met Tuesday. January 8th, 1991, with Commissioners Malcolm Lee, Andy
Lindquist, Bill Stone and Mel 0. Olson present. Position of the First District
Commissioner vacant.
County Auditor Wayne Stein called the meeting to order. The Honorable Judge Thomas
Stringer administered the oath to the Commissioners, County Attorney and County
Auditor. The County Auditor stated that the first order of business was the selection
of a Chairman for the year 1991. Motion was made by Malcolm Lee, seconded by
Andy Lindquist, to select Mel 0. Olson as Chairman for the year 1991 . The motion
carried with Commissioner Olson abstaining.
Chairman Olson assumed the Chair and called for a motion to select the Vice Chairman.
Motion was made by Bill Stone, seconded by Malcolm Lee, to select Andy Lindquist as
Vice Chairman for the year 1991 . The motion carried with Commissioner Lindquist
abstaining.
Motion was made by 8111 Stone, seconded by Andy Lindquist and unanimously carried, to
approve the minutes of the December 26th, 1990 meeting with the following correction
Motion was made by Bill Stone, seconded by Andy Lindquist and unanimously carried, to
grant special aid to Henning Township in the amount of $500.00 for additional grading
along County Road 16.
Larry Krohn, County Coordinator and Wally Senyk, County Attorney spoke regarding
this issue. Motion was made by Malcolm Lee, seconded by Bill Stone and unanimously
carried to approved the use of a corporate surety bond to satisfy the statutory
requirements of giving bond to the State for each of the county officials in the amounts
required by the statute and to authorize the County Coordinator to assure that the form
of the bond is suitable to meet statutory requirements. The following Minnesota
Statutes provide the bonding requirements for each elected position. Minnesota Statute
375.03-Commissloners in the amount of $10,000 to the State, Minnesota Statute
384.02-Counly Auditor in the amount of $20,000 lo the Stale, Minnesota Statute
385.02-County Treasurer In the amount as County Board directs lo the State,
Minnesota Statute 386.01-Counly Recorder in the amount of $5,000 lo the Slate,
Minnesota Statute 387 .0 I-County Sheriff In the amount of $5,000(minlmum) to the
State and Minnesota Statute 388.0 I-County Attorney in the amount of $1,000 to the
State.
Upon motion made by Andy Lindquist, seconded by Bill Stone and unanimously carried,
the following resolution was adopted:
The following dates are established as the dates the County Board shall meet during the
year 1991 to conduct county business, with the full day's meetings commencing at
9:30 a.m., the afternoon meetings of the county board commencing at 12:30 p.m.,

Upon motion made by Bill Stone, seconded by Malcolm Lee and unanimously carried, the
following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that
the sum of thirty cents ($.30) be paid out of the Revenue Fund of the County for every
pocket gopher killed in said County during the year 1991 in cases where the townships
in which pocket gophers were so killed shall provide for the payment of an additional
bounty of forty cents($ .40) for each pocket gopher so killed.
RESOLVED further that said payment of such bounty shall be made by the County Auditor
upon certificates executed by the Chairman of the Town Board of said township setting
forth that the pocket gophers were duly presented to the Chairman of such Board and
that the township had issued and delivered to each claimant a town order for seventy
cents ($.70) for each pocket gopher so killed.

Upon motion made by Malcolm Lee, seconded by Andy Lindquist and unanimously
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that
WHEREAS, It ls provided In Minn. Stat. 282.05 for the apportionment of proceeds from
the sale of tax-forfeited lands, and
WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing
districts pursuant to Minn. Stat. 282.08, and
WHEREAS, Minn. Stat. 282.08(4)(b) provides that the County Board may set aside 20%
of the proceeds remaining after the value of public improvements, special assessments
and bond issues levied on the property have been paid, for acquisition and maintenance
of county parks and recreational areas, and
WHEREAS, Otter Tail County has parks and recreational areas which would benefit by
such an apportionment,
NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds
from the sale of tax forfeited lands for acquisition and maintenance of parks and
recreational areas from the proceeds available after making the necessary statutory
disbursements, said proceeds to be disbursed according to law.

Motion made by Malcolm Lee, seconded by Andy Lindquist and unanimously carried, to
appoint Carl Johnson and Vic Petterson Jr. to the Planning Commission for a three year
term expiring December 31, 1993.
Motion made by Bill Stone, seconded by Andy Lindquist and unanimously carried, to
appoint Dave Trites to the Planning Commission for a three year term expiring
December 31 , 1993.
The Board, having previously advertised for bids to be received for printing and
publishing of the county board minutes, legal notices, delinquent tax list and the
county's annual financial statement, proceeded to open bids which were found to be

RESOLVED by the Board of County Commissioners of Otter Tall County Minnesota, that
Commissioners Andy Lindquist and Bill Stone be appointed to represent the Otter Tail
County Board on the Otter Tail County Extension committee for the year 1991.

Commissioner Mel 0. Olson be and Is hereby appointed as member of the West Central
Area Agency on Aging for the year 1991 .

following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tall County Minnesota, that
The applications of the American Legion Post 30, for a gaming operation at Wee Villa
Resort and Last Resort in Elizabeth Township, be approved and
BE IT FURTHER RESOLVED, that the Gambling Control Division waive the 60 day waiting
period In the issuance of said permit.

Upon motion by Andy Lindquist, seconded by Malcolm Lee and unanimously carried, the
following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, the County Board accepted the quotes of Steve's Cycle and Marine, Fergus
Falls In the amount of $11,740 for boat and water equipment, and
WHEREAS, said equipment has been delivered to the satisfaction of the County Board
at a total cost of $11,740.
NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and
directed to issue a warrant in the amount of $11,740 payable to Steve's Cycle and
Marine , In full payment thereof.

to deny forgiveness of penalty on late payment of the 1990 tax by Thomas G. Birkey.
Motion was made by Andy Lindquist, seconded by Bill Stone and unanimously carried,
to approve the 1991 appropriation for the Mn Red River Valley Development
Association in the amount of $600.00.
Motion was made by Andy Lindquist, seconded by Mel 0. Olson and unanimously
carried, to appoint Bill Stone and Malcolm Lee to serve at the canvassing board on
January 11th, 1991.

to accept the order appointing the County Public Defenders for 1991 at a total cost of

unanimously carried, to place all delinquent taxes into judgement, and the following report of
the County of Otter Tail, State of Minnesota, of uncollected mobile home taxes for the year 1990
is presented:

BE IT KNOWN, that the County Board of Otter Tail County, Minnesota did meet in session on the
8th day of January , 1991 that at sa1d session the County Auditor of said County delivered to said

County Attorney Wally Senyk spoke to the Board regarding the Second Amendment.to
the Agreement with the City of Fergus Falls for Solid Waste Incineration; Indicating
that he has received from the City of Fergus Falls the executed agreement. Action on
this agreement Is tabled until next week to allow the new board members an
opportunity to examine the agreement. _ .
County Attorney Wally Senyk discussed with the Boardthe progress:on the Pelican
Rapids Recycling Building. Indicating that a party wall and maintenance agreement
will be Incorporated as a condition of the deed and these conditions will become
covenants that will run with the land. Motion was rriade by Malcolm Lee, seconded by
Andy Lindquist and unanimously carried to authorize County Attorney Senyk to
proceed with the-purchase of the building and the execution of the agreements and
deeds with Mr. Jerry Leaf and Mr. Roger Schleske. Mr. Schleske is the contract for
deed holder and Mr Leaf is the fee owner of the building.· County Attorney Senyk isto
determine If all legal requirements have been met.
Motion was made by Malcolm Lee, seconded by Andy Lindquist and unanimously carried
to authorize the payment of $20,000 from the Solid•Waste Fund for the purchase. of the._
Pelican Rapids Recycling Building and to make application to,the Office:ofWaste · · >\
Management for a reimbursement of this payment.

County Engineer West presented to the County Board the Proposed 1991 Seal Coat
Projects for the Board's review. Requesting that these projects be approved at the
January 23rd meeting.
County Engineer West discussed with the County Board the revisions made to the
highway department's sanding policy. Stating that the policy reflects what the current
sanding practices of the department are. Requesting approval of this policy at a latter
date.
Motion was made by Andy Lindquist, seconded by Malcolm Lee and unanimously carried,
to approve payment for the renewal of pesticide license for 11 employees of the
Highway Department at a cost of $10.00 per person, for a total cost of $110.00.
County Engineer West discussed with the County Board the annual vehicle inspections
that will be required on vehicles with a gross vehicle weight in excess of 26,001
pounds effective April 1st, 1991 .
Motion was made by Malcolm Lee, seconded by Andy Lindquist and unanimously carried,
to approve payment for 15 employees to attend a meeting regarding the requirements
for the annual vehicle Inspections at a cost of $45.00 per person for a total cost of
$675.00,
Upon motion made by Malcolm Lee, seconded by Andy Lindquist and unanimously carried
the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that
WHEREAS, on May 3, 1989 the County Board accepted the bid of Mark Sand and Gravel,
Fergus Falls, Mn, In the amount of $1,726,967.50 for grading, aggregate base,
bituminous base and surface, concrete curb and gutter on S.A.P. 56-601-34, and
WHEREAS, the above contract has been completed to the satisfaction of the County
Board at a total cost of $1,986,483.22, an Increase of $259,515.72 due to added work
by supplemental agreements • 1 thru •6 and change order # 1
NOW, THEREFORE, BE IT RESOLVED, the County Auditor Is hereby authorized and
directed to issue a warrant in the amount of $19,064.08 to Mark Sand and Gravel Co.,
in final payment thereof.

County Engineer West presented the preliminary draft of the Otter Tail County Adopt
-A-Highway Program for the Board's review. Stating that the States program was
used as a guideline.
Motion was made by Andy Lindquist, seconded by Bill Stone and unanimously carried to
authorize Rick Stysma to proceed with ordering a replacement door and an electronic
eye for the law enforcement garage, the cost of the replacement door not to exceed
$2535.
Motion was made by Andy Lindquist, seconded by Malcolm Lee and unani_mously carried
to uphold the decisions of the Planning Commission on the following applications for
conditional use permits:
Roger Petersen-Remove dirt for better drainage and fill for addition.
John Moe-Allow the shooting range with conditions as approved.
Kent Thompson-Prepare building site for house construction with conditions as
approved.
Motion made by Malcolm Lee, seconded by Andy Lindquist and unanimously carried, to
authorize the Land and Resource Department to proceed with the hiring procedures for
the Inspector and clerk position.
Bill Kalar discussed with the County Board the county water plan and asked the Board to
give him some direction as to how they would like him to proceed. He will be sending
questionnaires to various agencies to see what type of programs are already in place.
Dennis Christensen informed the County Board that another grant cycle is now under
way and that the Fergus Falls HRA would like the County to consider preparing and
submitting another application by September 1, 1991. Motion was made by Andy
Lindquist, seconded by Malcolm Lee and unanimously carried to authorize Dennis
Christensen to proceed with the preparation of the grant application with the cost not to
exceed $4,500.

following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that
Dr. D. Lazelle Michaelis be appointed as the Otter Tail County Coroner.

Chairman Olson Indicated that various committee appointments would be made at a
future meeting date after the County Board members have had a chance to review the
various committees and provide to Chairman Olson a list of the committees they are
Interested In serving on.
Upon motion made by Malcolm Lee, seconded by BIil Stone, and carried, the following
resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, the time required for the County Auditor to prepare the agenda and minutes
for the regular meetings of the Board of County Commissioners takes the Auditor away
from more pressing duties; and
WHEREAS, Minnesota Statute Section 375.49, Subd. 2(f) provides that the County
Board may by resolution direct the County Coordinator to assume the responsibilities
of Clerk of the County Board; and
WHEREAS, Larry Krohn has previously been appointed as County Coordinator, pursuant
to Minnesota Statute 375.48; and
WHEREAS, It is in the best Interests of the efficient administration and management of
Otter Tail County that the County Coordinator be assigned the duties of Clerk of the
County Board, so as to relieve the Auditor of the burden of preparing the agenda and
minutes for the regular meetings of the Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED, that the County Coordinator of Otter Tall County,
Larry Krohn, shall serve as Clerk of the County Board of Commissioners, pursuant to
Minnesota Statute Section 375.49, Subd. 2(f), and the County Auditor shall no longer be
held responsible for the duties as Clerk to the Board Imposed by Section 384.09.
Adopted at Fergus Falls, Minnesota, this 8th day of January, 1991.
Motion made by BIil Stone, seconded by Andy Lindquist and unanimously carried, to
appoint Teresa Parker to a three year appointment to the Viking Library System
Governing Board to fill the position vacated by Jan Bennison who is unable to accept the
appointment for personal and family reasons.
Motion made by Andy Lindquist, seconded by Malcolm Lee and unanimously carried, to
proceed with the hiring procedures for the legal secretary and clerical positions.
Larry Krohn reported on a request from Arvfd Thompson, District Director A.M.C.
regarding the appointment of a replacement to serve on the general government
committee to fill the position vacated by the resignation of Sydney Nelson. By general
consent the County Board tabled action on this appointment for a full board.
Larry Krohn reported that we received a response regarding the County·s challenge to
the 1990 census. No significant changes as a result of the County's challenge.

ADJOURNMENT
Upon motion made by Andy Lindquist, seconded by Bill Stone and unanimously carried,
the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tall County, Minnesota, that
All financial institutions meeting statutory requirements and representatives in Otter
Tail County be and are hereby designated as depositories of county funds.
Steve Andrews, Otter Tatl County Treasurer, be and ls hereby given authority to
Invest county funds as funds may be available to Invest.

At 3:35 p.m., Chairman Olson closed the meeting to the public for the purpose of
discussing labor negotiations for the county's union group and to discuss the recycling
program management agreement.
At 4:57 p.m., with no further business, Chairman Olson declared the meeting adjourned
until the afternoon of January 15th, 1991.
