Pursuant to adjourrnnent, the Board of County Ccmnissioners of Otter
Tail County Minnesota met Wednesday, [)ecernber 19, 1990. Chainnan
Olson called the meeting to order at 9 : 31 a.m. , with all members
present.
Motion was made by Bert Hovland, seconded by Andy Ll.ndquist and unani-
mously carried, to approve the minutes of the [)ecember 12th meeting
as mailed.
Upon motion made by Bert Hovland, seconded by Hub Nordgren and unani-
mously carried, the following resolution was adopted:
RESOLVED by the Board of County canmissioners of otter Tail County
Minnesota, that
WHEREAS, in accordance with a procedural agreement between the Minne-
sota [)epart:nent of Natural Resources and the U.S. Fish and Wildlife
Service, dated May 23, 1962, certification by the County Board of Com-
missioners for acx;ruisition of lands by the U.S. Fish and Wildlife
Service is requested, and
WHEREAS, representatives of the U.S. Fish and Wildlife Service net
with the County Board on [)ecember 19, 1990 and infonned said Board
that a purchase agreerrent had been secured fran Robert J. Bowers on
the following described property:
The ffi,jl.,.JIB¼, and that part of the NE¼NE¼SW¼ described by ITEtes and
bounds as follows: Beginning· at the northwest comer of the ND-~SW¼,
thence east along the subdivision line approximately 660 feet to the
northeast comer of the NW--.JIB¼SW¼, thence southwesterly approximately
792 feet to a stake on the subdivision line, thence northerly along
the subdivision line approx. 396 ft. to the P.O.B., contairiling 3.0
acres more or less, all in Section 12-136-44.
NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby grant
approval of the aforerrentioned purchase by the U. s. Fish and Wildlife
Service.

WHEREAS, in accordance with a procedural agreement between the Minnesota
[)epartment of Natural Resources and the U. S. Fish and Wildlife Service,
dated May 23, 1962, certification by the County Board for aCX!Uisition

WHEREAS, representatives of the U.S. Fish and Wildlife Service net

County Board -2 -Decernber 19, 1990
Mike Hanan, Solid Waste Officer, appeared before the Board and dis-
cussed various solid waste items, including budget for the year 1991,
recycling vs incineration or landfilling, marketing recyclables and
the recycling building in Pelican Rapids • Chairman Olson appointed
La:r:y Krohn, Mike Hanan, Wally Senyk, Andy Lindquist and r-191 Olson to
a camnittee to negotiate a new contract for recycling. Lyle Rosenow
was also appointed as an ex-officio member without a vote.
Diane Thorson and Gerald Fredrick, Reclassification Ccrcmittee, appeared
before the Board relative to a reclassification of the financial
accountant position in the auditor's office. Motion was made by
Sydney Nelson, seoonded by Andy Lind::p.ri.st and unanimously carried,
to approve a re-classification of said position 1:0 a Range 17.
The reclassification cormnittee also presented a reclassification of
a WIC clerk, reccmrending a Range 9 , which was approved upon motion
made by Andy Lindquist, seconded by Bert Hovland and unanimously
carried.
Motion was made by Hub Nordgren, seconded by Sydney Nelson and unani-
mously carried, to table action on a request by the City of Fergus
Falls for forgiveness of penalty on late paym:nt of tax on property
the city acquired from the Famers Union Marketing in June of 1990.

Minnesota, that
WHEREAS, on the 3rd of October, 1990, the County Board accepted the
bid of Bab Resset Construction, Pelican Rapids, MN, in the anount of
$18,950.00 for construction of the recycling building in the City of
Perham, and
WHEREAS, the above contract has na.v been corrpleted to the satisfaction
of the County Board at a total cost of $20,200.00 an increase of
$1,250.00 due to Change Order 'No. 1,
NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized
and directed to issue a warrant in the amount of $3,100.00 to Bab
Resset Construction, as final payment thereof, subject to submission
of the required waivers as requested on state and federal withholding.

mously carried, to approve payment in the anount of $1,400.00 to the
AMC representing registration fees for the AMC conference for Wayne
Stein, Syd Nelson, Hub Nordgren, Rick West, Tom Fawcett, Larry Krohn,
Bert Hovland and Sylvia Bergerud.

The matter of control ddS the dust on the tavnship road sei:ving the
Henning transfer station was again discussed, both as to dry and
wet calcium chloride application. Figures will be available December
20th, and the engineer will meet again with the Tavnship of Henning,
and the City of Henning, with a road count to be taken in 1991.
Engineer West infonred the board that a public infonnational meeting
is to be held January 15, 1991, at the Dalton fire hall, in connection
with proposed road construction of CS.AH #82.
The winter sanding policy was presented to the Board.
Engineer West inforned the Board that used sign posts are available
from M-R Sign Company, at a savings of from 30% to 40%. West was
instructed to proceed, after getting clearanae from the County At.tor-
ney.

nously carried, to authorize County Engineer West to attend the
National County Engineer's Conference in Cincinnati, Ohio, February
10th through the 13th •

nousl y carried, to authorize Engineer West to attend the meeting of
the state engineers fran January 28th through 31st at Brainerd.
Upon notion made by Hub Nordgren, seconded by Bert Hovland and unani-
nously carried, the folloorig resolution was adopted:
RESOLVED by the Board of County Corrmissioners of Otter Tail County
Minnesota, that
WHERF.AS, on October 31, 1990, the County Board accepted the bid of
King .Mechanical Systerrs & Service, Inc., Detroit Lakes, MN in the
amount of $17,802.00 for the heating system in the New York Mills
garage, and
WHEREAS, the above contract has har.r been co:rrpleted to the satisfaction
of the County Board at a total ccst of $17,802.00.

directing that the otter Tail River not be :considered for state desig-
nation as a canoe and tubing trail; and
WHERE'A5, ·. since 1913, the Otter Tail River has been danmeld in Section
19 of Auiral Ta-mship and water has been diverted frr.m the river chan-
nel through Hoot and WrightLakes for comrercial use at the Hoot Lake
hydroelectric facilities owned and operated by Otter Tail Paver Cc::m-
pany; and
' WIEREAS, the diversion of water from the Otter Tail River is subject
to the judicially inpa;ed requirerrent that there be left "at all
tines in the channel of said river sufficient water for all public
and darestic uses; " and
WHEREA.5, Otter Tail Paver Crnpany has vollll1tarily installed an opening
into the Diversion Dam whidl provides for a :mini.mum flew of 15 cubic
feet per second at all tines in the dcwnstream dlannel of the river and
has successfully cperated this cpening since 1975, without evidence of
a::mplaint fran landa.-mers along the river; and
WHEREAS, the flew of water diverted through Hoot and Wright lakes im-
proves the quality ofrthe water in those lakes which are utilized ex-
tensively for :recreational purpcses by the nurrerous lakeshore property
cwners and other nembers of the public; and

i WHEREAS, the City of Fergus Falls obtains water for its municipal water
supply fran Wright Lake: and
WHEREAS,• the Minnesota Departnent of Natrural Resources had insisted
that as a condition of obtaining a license for their hydroelectric
facilities, Otter Tail Power greatly increase the water flew in the
downstream channel to "enhance" the fisheries and recreational poten-
tial of that channel: and
'WHEREA.S, the requirerrent of the Departnent of Natural Resources will
reduce·the,flcw of water through Ibot and Wright Lakes and will nega...,
tively :inpact the water:qµality and reduce the recreational uses of
those lakes far no:re than any benefit which may be e}q?erienced in the
downstream channel of the otter Tail River: and

WHEREAS, there are nearly 100 Otter Tail County t:mq;>ayers residing an
Hqot • and Wright Lakes, near 1the City of Fergus Falls, whose property
values will be reduced if the water qualify of Hoot and Wright Lakes
deteriorates, with a resulting :reduction inthe ~ collected by
Otter Tail County and local taxing districts: and
WHEREAS, the City of Fergus Falls may experience serious municipal
water quality problem;, particularly in high algae seasOI')S, if water
quality in Wright Lake deteriorates from reductions in water flew; and
. WHEREAS, the existing recreational ~t:retches of the Otter Tail River
are not extensively utilized because of the large mmber of recreational
opportunities existing an the nurrerous public lakes in otter Tail
County: and
' WHEREAS, in 1990, otter Tail Paver Crnpany pa.1.d property~ for the
Hoot Lake Porer Plan to Otter Tail County and local taxing districts
of $1,173,203.00, inclti:ling ~ $519,000.00 to School District #544,
whidl property taJ<eS would. be greatly. reduced if the Hoot Lake plant
were to close as a result of the reduction in the water flew diverted
to the plant,.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board does
hereby decl~ its oppostion to the Minnesota Department of Natural
Resources' requirement that the flew into the Otter Tail River channel
past Diversion Dam be greatly increased, because any potential bene-
fits from such action are overwhelmingly outweighed by the negative
consequences that will :result.

request .that the Federal Energy Regulator Commission proceed-to license
the otter Tail Power Hoot Lake hydroelectric facilities without re-

construction. An environment impact statement was requested by the

County, stating such statement is required only in certain circlITIStances~
and since the county has no building or zoning cede, there was a ques-

By general consent, the Board accepted a definiti-on as presented of
screen houses, effective December 19, 1990.
Larry Krdln, County Coordinator, discussed the matter of insurance
premium increases on dependent coverage, presenting a letter from
sans i :employees in the Department of Human Services requesting the
County Board consider paying a portion of the January premium to
alleviate scree of the stress on the employees in the increased
dependent coverage costs. No action taken.
Krohn reported on an increased oost of the Employee Assistance Pro-
gram propa;ed for 1991. The Board instructed Krohn to return to
Lakeland M::!ntal Health Center and attempt an increase of no rrore
than 4%.
Krohn advised the Board a mediation hearing on ·January 24, 1991,
on the I..aw Enforcerrent union group.

ried, to approve advertising for the p:>sition of financial accountant
in the auditor's office.
Motion was made by Bert Hovland, seconded by Andy Lindquist and car-
ried, to approve payrrent of $570.00 to Tinjim Appraisal Service,
for appraising costs in connection with tax court.
Carrmissioner Hovland gave his last report·-.on the Insurance Trust
