Chairman Olson called the meeting to order at 9:31 a.rn. with all rrembers present. Motion was made by Bert Hovland, seconded by Hub Nordgren and unani- rnml1siy carried, to approve the minutes of the November 14th meeting, as mailed. Jess 'Iharpson, rnenber of the otto Ta.vn Board, appeared before the Board regarding the communications ta.ver being constructed in Section 31 of otto Ta.vnship. After consideration, notion was made by Hub Nordgren, seconded by Bert Hovland and carried, with Andy Lindquist abstaining, to rescind the resolution pertaining to the consideration of an alter- nate site for said tower, passed on November 14th. Adopted at Fergus Falls, MN this 21st day of November, 1990. 'Ihe matter of the Deutsch vs Holt Lake was again discussed with Attorney Wally Senyk who presented a letter from the Departirent of Natural Re- sources stating a change in nane would not be considered by the DNR because of the length of tirre the lake had been knavn as "Deutsch" lake. Attorney Senyk advised the Board not to take any action until hearing further fran Mr. Holt. Andy Lincquist discussed the proposed food service contract for the county jail, stating a reccmnendation is to be made by the jail committee on December 28th. 'Ihe matter of the alternative foDTIS of the solid waste incineration agreement with the City of Fergus Falls was again brought before the Board for consideration, with notion made by Bert Hovland, seconded by Hub Nordgren and carried1with Andy ilirnflquist and Sydney Nelson voting "no", to approve the concept presented in the alternative fonil.S of the incineration agreerrent with the City of Fergus Falls Joint Powers Agreerrent, and direct the County Attorney to finalize the language presented for approval by the otter Tail County Board and the negotiating corrrni ttee, and prepare final fo:ms cif · .the amend- ments for signatures of the parti~ipating counties. :/ ,, \; -'.(--RECYCLING --AGREEMENT 'F ST. After consideration, notion was ma.de by Hub Nordgren, seconded by Andy Lindquist and unani- mously carried, to approve the agreement as submitted arid the 01.iinnan of the Board and·the County Auditor were authorized to.execute said agreerrent on behalf of Otter Tail County. The matter of the deli ve:ry of Todd Coilllty 's solid waste, split between the Fergus Falls incinerator and Quadrant,was again discussed with no action taken. Larry Krohn advised the Board of county employees who-have been selec- ted to participate in the Leadership program in the City of Fergus Falls. M::>tion was made by Andy Lindquist, swconded by Bert Hovland and 1ID.animously carried, to approve reimburserrent:of $175.00 for the county employees selected upJn successful completion of the program. Pursuant to published notice thereof, at 2 :00 p.m. 1a hearing was held for the purpcse of receiving .dmput on proposed arrendrcents to the Otter Tail ColID.ty Public Health Food and Beverage Ordinance. A·fter listen- ing to the various interested_ parties , the hearing was closed at 2:17p.m •• Rick-West, County Engineer, discussed miscellaneous correspondence received, i:nol:.uding a request by Jerry Schmidt to clean and maintain a county ditch on County Road #116, in Section 30 of Fergus Falls TCMil- ship, as original grade. No action taken. Upon notion made by Bert Hovland, seconded by Andy Lindquist and unani- rrously carried, the follCMi.ng resolution was adopted: RESOLVED by the Board of County Commissioners of otter Tail Cotn1ty, Minnesota, that WHEREAS, on May 9, 1990, the Cotn1ty Board accepted the bid of Little Falls Machine, Inc., Little Falls, in the arrount of $22,320.00 for snCJN rerroval equiprrent, and WHEREAS, said equipnEnt has been delivered to-the satisfaction of the ColID.ty Board at a total cost of $21,960.00 due to the County transpor- ting trucks for rrounting, NCW, THEREFORE, BE IT RESOLVED, the Cotn1ty Audi tor is hereby authorized and directed to issue a warrant in the arrotn1t of $21,960.00 payable to Little Falls Machine, Inc. , in full payrrent thereof. Adopted at Fergus Falls , MN this 21st day of November, -1990. Engineer West presented a request of November 17, 1989 for a speed zone study on CSAH #67 in the City of New York Mills.. M::>tion was made by Sydney Nelson.and seconded by Andy Lindquist to pro~d with the study, but was withdrawn prior to vote, to obtain the necessary reso- lution. for action at a 01later date. Engineer West discussed the requirerrent by.MnOOI' that in 1992 certifi- cation will be required for certain employees in various capacities • Motion was made by Andy Lindquist, seconded by Sydney Nelson and unani- rrously carried, to authorize two people from the highway department to attend three sessions. Engineer West discussed the current MnOOr "Adopt .a Highway Program" , stating individuals and organizations have voiced an-interest in such program on county roads. No action taken. .t I HALF SECT'ION MAPS HEALTH BENEFITS REI'IRED OFFICIALS BILIS APPROVED County Board -3 -November 21, 1990 Upon ItOtion made by Hub Nordgren, seconded by Bert Hovland and unani- nously carried, the folloong resolution was adopted: RESOLVED by the Board of County Ccmnissioners of Otter Tail County MinrEsota, that t-HEREAS, oonsistent with tie Minnesota legislative mandate to abate lanq.f ills, Otter Tail County prarrotes integrated solid waste manage- nent prograrrs inclu:iing waste reduction, recycling and incineraticn; and W-IEFF.AS, state agency supi:ort is critical to assure irrplerrentation of local policy and planning; and WHEREAS, the Minnesota Pollution Control Agency (MPCA) consistently steps outside of its role as a regulator and invol~ itself in planning decisions; and WHEREAS, the MPCA is imable to respond in a ti.rrely manner to t=ennit applications resulting in significant and costly delays; and WHEREAS, over three years ago· the Minnesota legislature designated ash fran waste to energy facilities as special waste t=ending rules and such rules are not even available in draft form; and · WHEREAS, in drafting propcsed Air Ccrrbuster rules, the Mi.nneso~ Pollution Control Agency has develq:>ed prq,osed rules rrore strin92r1t than EPA proposed federal rules and in sare instances without tedi- nical basis and without any regard to · ecancmic impact; and WHEREAS, Minnesota faces a btrlget deficit of significant proportions and the eonarni.c burden of nore stringent requirerents than the EPA will be overly burdensarre and provide little additional benefit to the Stateof Minnesota since neighboring states' policies are rot as strin- gent and airborne pollutants fran industrial manufacturing outside of Minnesota is causing pollution to Minnesota's lakes and forests; KM, THEREFORE, BE :DI' RESOLVED, that Otter Tail Cotmty stralgly sup- ports and req;iE:5i-S the Association of Minnesota Counties to supi:ort legislation that will:· -------- a) Require the MPCA to accept EPA propcsed rules and guidelines for air carbustor rules and not seek to adopt additional unnecessary, no.re stringent and costly rules for existing waste to energy facilities in Minnesota; and b) Establish legislatively that incinerator ash be pennanently classified as a special waste; and c) Limit the MPC1\ to regulating and enforcing pollution contrnl nEasu.res and not interfering with local government planning that has been approved by rret.rq>oli tan or state a~ncies; and d. Ra:juire without exception, a reasonable response time on penni t applications to avoid cc:stly delays and tmcertainty to Counties i.nplenenting integrated solid waste systers. The matter of ralf-section maps was discussed with a recarmendation that the ccmnittee established nEet with Rich West and Mel O. Olson to attempt a resolve in the preparation of half-section maps. The matter of health benefits for retired election officials to equal health benefits of regular oounty employees was discussed with no action taken.
