Pursuant to adjournment, the Otter Tail County Board of Commissioners
rret Wednesday, November 7, 1990 • Olainnan Olson called the rreeting
to order at 9: 37 a.m., with Commissioners, Lindquist, Nordgren,
Hovland and Olson present; Carrmissioner Nelson arriVJng later.
Motion was made by ~rt Hovland, seconded by Andy Lindquist and car-
ried, to approve the minutes of the October 31st rreeting, with a cor-
rection to shCM that Hovland was absent to attend an insurance trust
meeting.
Richard West, County Engineer, appeared before the Board and discussed
utility penni ts • Motion was made by An&.z Lindquist, seconded by Hub
Nordgren and carried, to grant blanket authorization to Mr. West for
the consideration and approval of utili"bJ pennits. ,·
Mr. West also discussed miscellaneous purchases, asking for guidelines
as to what can or cannot be. purchased wi. thout prior approval. 'Ihe
Board, under general consent, indicated approval of purchases of up
to $1,500 without board authorization.
Mr. West also reported on state approval of projects. No action.
SHOOIDER BLAClcr'OPPING 'Ihe matter of black-topping of the shoulders on county roads was dis-
cussed. No action.
ROAD VIEWI:t-K; Dates were set for the annual fall viewing of the county road construc-
tions for the year.

RESOLVED by the Board of County Canmissioners of Otter Tail County
Minnesota, that
WHEREAS, in accordance with a procedural agreement between the Minne-
sota Departrrent of Natural Resources and the U. S. Fish and Wildlife
Service dated May 23, 1962, certification by the Couno.1 Board of can-
missioners for aQ:luisition of lands by the U. S. Fish and Wildlife
Service is requested, and
WHEREAS, representatives of the U. S. Fish and. Wildlife Service rret
with the County Board on November 7, 1990 r_:and infonred said Board
that a waterfCMl easement had been secured fran Byron K. Osander on
I.Dts 4 and 5, Section 26-132-42,
NCW, THEREFORE, BE IT RESOLVED, the County Board does hereby grant
approval of the aforerrentioned aQ:luisition by the u. S. Fish and
Wildlife Service. ·

the following resolution was adopted:
RESOLVED by the Board of Comty Comnissioners of Otter Tail County
Minnesota, that
In acrordance with a procedural agreement between the Minnesota Depart-
ment of Natural Resources and the U. s. Fish and Wildlife Service
dated May 23, 1962, certification by the Co1111ty Board for acquisition
of lands by the U.S. Fish and Wildlife Service is requested, and
WHEREAS, representatives of the u. S. Fish and'.Wildlife Service met
with the County Boaro on November 7th, 1990•.·and infonred said Board
that a waterfavl easement had been secured from Gacy Misegades, et al,
on the E½NW¼ of Section 29-133-38, except the south 1.0 rods,
NOt-v, THEREFORE, BE rr RESOLVED, the Comty Board does hereby grant
approval of the aforementioned aa:iuisition by the U. s. Fish and
Wildlife Service.

Camnissioner Lindquist donated a beautiful, framed picture of Phelps
Mill to the County for placenent in the County Board Room.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to approve the Trail Assistance Program for lake Runners Sna-mtabile
Trail Association, state appropriation of $13,000, and the Chainnan
of the Board and the County Audi tor were ··· instructed to execute the
agreerrent on : .behalf of Otter Tail County.
County Attorney Senyk discussed the agreerrent with the City of Fergus
Falls regarding the solid waste collections and the language changes
that need to be made in the agreements with the other counties in the
Joint Powers including the minimum requirements that go i.I:ito effect
on May 1, 1991 arid the penalties charged. No action taken.
By'1'general consent, Attorney Senyk was instructed to phrase a state-
rrent directed to Canmissioner Nelson who, on November 6 ,· 1990, w::>n
a seat inthe Minnesota House of Representatives, and the follaving
staterrent was issued:

its heartfelt and sincere congratulations to one of its a.vn nembers,
Sydney G. Nelson, upon his election to the Minnesota House of Repre-

County Board -3 -November 7, 1990
Jerry Neseth, East otter Taii Soil & Water Conservation District,
together with supervisors from said district, appeared before the
Board requesting support fran the County Board on their project
proposal application for "East otter Tail Irrigation Water Managerrent".
AFter consideration, motion was made by Sydney Nelson, seconded by
Andy Lindquist and unimimously carried, to support the project and
the Chairman of the Board was authorized to execute the agreement
on behalf of otter Tail County.
The Board received infonnation from the County Sheriff, Gary Nelson,
stating OSHA requires Hepatitis B Vaccinations for all errployees,
or, !deputies in the Sheriff Depa.rt:nent, who may be exrnsed to blood,
body fluids or needlestick in,·.the, :course of their duty. The cost
for such irrmuni2lation would be between $3,500 and $3,800, total.
Motion was made by Bert Hovland, seconded by Andy Lindquist and carried,
Nordgren "no'' , to approve the OSAH requirement that all Sheriff Dept.
errployees have said shots and pa.id for by the County.
The Board discussed changes in position of two individuals in the
Sheriff Department of two existing patrol officers to two Sergeants.
No action taken.
Rick Sytsma, Maintenance Supervisor, reported m::xlifications to the
steam boilers servicing the courthouse are necessacy, stating the
cost for replacerrent of parts to the two boilers \'.Quld be $3,000.
Motion was made by Bert Hovland, seconded by Hub Nordgren and unani-
mously carried, to grant approval.
Sytsma also infonred the board that a personnel lift is necessa:ry,
particularly in the jail area. Mr. Sytsma was instructed to obtain
quotations and present to the building camnittee.
Representatives of the User Commi. ttee, Wayne Stein spokesman, appeared
before the Board reporting <Dn~the "Notice of Proposed Property Tax
for 1991", said notices being mailed November 9th, as required by
the Department of Revenue. No action taken.
Douglas Johnson, Departnent of Public Health, reported on conderrm.ation
of a building on the South 40' of the East 16 ' of IDt 1, and the South
40' of the West 4' of I.Dt 2, Block 1, Soule's Add'n to the City of
Deer Creek, stating the City of DeernCreek would like to aaiuire this
tax forfeited parcel. Motion was made by Hub Nordgren, seconded by
Sydney Nelson and unaninously carried, to allav the City of Deer Creek
to purchase said parcel, setting the price at $1.00 on the condition
the City pays all costs for demolition of the building.
Motion was made by Bert Hovland, seconded by Sydney Nelson and unani-
rrously carried, to approve payment in the amount of $17,100 to Bob
Resset, Inc. , representing 95% of the total amount due on the construc-
tion of the recycling building in Perham, retaining $900 .00 until
completion of the project.

Upon notion made by Hub Nordgren, seconded by Bert Hovland and carried,
the following resolution was adopted:
RESOLVED by the Board of Cotmty Comnissianers of otter Tail County
Minnesota, that
WHEREAS, the County of otter Tail, as owner of the Northeast Otter Tail
County mixed municipal solid waste land disposal facility, is required
tmder Minn. Stat. Section 116 .07, Subd. 4h, and Minnesota Rultes, Part
7035.2695, to provide evidence of financial assurance for the Northeast
Otter Tail County mixed municipal solid waste land disposal facility,
and the Cotmty of otter Tail acknowledges the jurisdiction of the Min-
nesota Pollution Control Agency in this matter;
NOW, THEREFORE BE IT RESOLVED that there is created in the Otter Tail
County treasmy a dedicated long-term care crust ftmd, and that rroney
in this fund shall be held in trust and may only be used to pay for
closure, postclosure care, or contingency action as specified in Min-
nesota Rules, part 7035.2605 to 7035.2655, and in the pennitCs) that
apply to the facility referenced above, and that desposits into the
fund shall confonn with the requirements of Minnesota Rules, part
7035.2720, and that no disbursements from the fund shall be made with-
out the written pennission of the camn:i.ssioner of the Minnesota Pol-
lution Control Agency, and that the Cotmty of Otter Tail is botmd to
reimburse the Minnesota Pollution Control Agency for any legal and
administrative costs incurred in actions taken to force the County to
act on this resolution, and that the money needed to make such reim-
bursements shall not be taken fran the dedicated long-tenn care trust
fund, and that Steve Andrews, Treasurer, and his successors in office
shall be the fund's trustee and shall be responsible for making all
reports required under Minnesota Rultes, part 7035.2720.

Chainnan Olson declared the meeting adjourned at 2:15 p.m.
Vice Chairman Bert Hovland opened the meeting again at 2:17 p.m.,
for the purpose of considering the bills for approval.
Motion was made by Hub Nordgren, seconded by Sydney Nelson and car-
