Pursuant to adjounurent, the Board of Collllty Commissioners of Otter
Tail Collllty Minnesota met Wednesday, Jlllle 6, 1990. Chainnan Olson
called the meeting to order at 9:31 a.m., with all rrernbers present.
M:>tion was made by Bert Hovland, seconded by Sydney Nelson and 1.lllani-
rnously carried, to approve the minutes of the May 23rd meeting, with
the correction that Sydney Nelson, Hub Nordgren and Larry Krohn were
appointed by the Chainnan to explore the possibilities of a manager
of the environrrental department of the COllllty.

rnously carried, to approve a Land Surveyor's Certificate of Correction
to the plat of Preston's West Acres, which was filed cm August 25th,
1980.

MC to cover the cost of the cost allocation plan for Otter Tail

The Board, having previously advertised for bids to be received for
surfacing the lot at the recycling center in the City of Fergus Falls,
proceeded to open bids which were found to be as fella.vs:

After consideration, motion was made by Bert Hovland, seoonded by
Andy Lincquist and unanirrously carried, to award the contract to Mark
Sand & Gravel, Fergus Falls, MN, including options at a total cost of
$22,560.00.

WHEREAS, on April 11, 1990, the Co1.mty Boru::fd accepted the bid of
Fargo CUlvert Co., Fargo, ND in the amo1.mt of $10,817.50 for
seasonal culvert supplies, and
WHEREAS, the above contract has now been carpleted tot.he satisfac-
tion of the Co1.mty Board at a total cost of $13,487.50, an increase
of $2,670.00 due to additional culverts ordered,
NCW, THEREFORE, BE IT RESOLVED, the County Audi tor is hereby autho-
rized and directed to issue a warrant in the amo1.mt of $13,487.50

amo1.mt of $500.00 for rerouting and regarding a ta,mship road on
co1.mty right-of-way in Trondhjem Ta,.,nship.
Members of the Employees Canmittee appeared before the Board and dis-
played enployee recognition plaques for years of service which are to
be distributed to the approximately 170 enployees within the near
future. No for:mal action taken.

unanirrously carried, the following resolution was adopted:
RESOLVED by the Board of County Ccmni.ssioners of Otter 1.Tail County
Minnesota, that
WHEREAS, the Board of.Camrni.ssioners of Otter Tail County recognizes
the need for joint utilization of law enforcerrent facilities, equip-
rrent and personnel in the event of errergency and necessity, and
WHEREAS, the Boards of County Camni.ssioners of the following counties:
Douglas , Otter Tail, Wilkin, Traverse, Grant, Yellow Medicine, Stevens ,
Lac Qui Parle, Kandiyohi, Chippewa, Todd, Pope, Meek.er, Renville,
Big Stone, Redwood., McCleod, Bra-m, Sibley, and Swift recognize a
similar need for joint utilization of law enforcerrent facilities,
equipnent, personnel in the event of errergency and necessity, and
are desirous of joining in such joint utilization, and
WHEREAS, the County of Otter Tail, pursuant to Minnesota Statute
4 71. 59, may agree, through action of its governing body, to jointly
and cooperatively exercise any paver, with other govenurental units,

WHEREAS, in furtherance of the afores a.id purposes, the otter Tail
county Board of Ccmnissioners endorses the Joint Agreerent document.
which is attached hereto and incorporated by reference herein,
IT IS HEREBY RESOLVED, that the appropriate county officials of
otter Tail County are authorized to ~cute said Agreerent and to
thereafter fo:rward said Agreerent and a copy of this resolution
to the other above-narred counties for ;their consideration and
approval.

Representatj_ves of the Sheriff's Department, Richard Kausler, John
Halvorson and Joe Peloquin, appeared before the Board, discussed
the joint pc:Mers agreement, radio equipnent quotations, and the
report on inspection of the county jail by the Departnent of Cor-
rections , with Chairman Olson comrrending the department for the
excellent report by the: ·Department of Corrections.
Joe Merz , Maine Tavnship, appeared before the Board and expressed
concerns regarding envirornrental issues, medical waste disposal
problerrs , the MPCA hearings , urging the county to establish
specific guidelines. No action taken.
Malcolm Lee, Land & Resource ~.anagerrent Director, appeared before
the Board and discussed the county's I.Deal Water Plan and the pro-
posed irnplerrentation. No action taken.
Comnissioner Nelson introduced correspondence from the AM: relating
the the rule making process allowing the various State agencies to
establish rules and :regulations that have the full force and effect
of law, requesting that the AM: be allowed to, as :recamrcended by
the General Governrrent Corrmi ttee, to hire additional staff to :re-
seardl and rronitor the rule making process. No action taken.
Wally Senyk, County Attorney, discussed new legislation as it per-
tains to grasshopper control. No action:·.taken.
Upon notion made by Bert Hovland, seconded by Andy Lindquist and
unanirrously carried, the following bills were allowed:

JOINT POWERS AGREEMENT
FOR INTERCOUNTY USE OF SHERIFF FACILITIES, EQUIPMENT AND PERSONNEL
THIS AGREEMENT made and entered into between the parties undersigned on the
date below written, each acting by and through its Board of County
Commissioners, pursuant to provisions of Minnesota Statutes 471.59,
WITNESSETH:
1. It is the purpose of this agreement to provide for the joint and several
use of law enforcement facilities, equipment, and personnel of the counties
below participating in this agreement in the event of emergency and necessity
arising in any one of the contracting counties. The use of such personnel,
equipment, and facilities shall be exercised in accordance with the laws of the
State of Minnesota relating thereto.
2. The sheriffs of the respective counties are hereby authorized to enter
into such mutual agreement relating to matters contemplated by this agreement as
may be necessary and desirable in the circumstances and for the purpose of
preserving law and order in the several counties affected hereby.
3. When the sheriff of one of the participating counties determines that
assistance is required, by reason of necessity and emergency, for the purpose of
law enforcement within said county, the sheriff of said county is authorized to
request such assistance as he may determine necessary from the sheriff of any
other participating county. The sheriff of the county receiving such request is
authorized to furnish to the county initiating the request such assistance, in
the form of personnel and equipment, as he may determine is available without
jeopardizing his ability to preserve the peace in his own county.
4. Upon reporting for duty to the sheriff of the county initiating the
request, all deputy sheriffs of the assisting counties shall be sworn in as
deputies of the county initiating the request, pursuant to the provisions of
Minnesota Statutes 387.14, 387.22 and 471.59, Subd. 12.
5. When a county responding to a request supplies law enforcement officers
to a county initiating a request, such officers shall be under the sole
direction and control of the sheriff making such request during the period of
assistance. Said officers shall be paid by the county receiving the request,
shall be protected by the worker's compensation of the county receiving the
request, and shall otherwise be deemed to be performing their regular duties for
the county receiving the request.
6. A county receiving a request shall be responsible for its own personnel,
equipment and supplies for injuries or death to any such personnel or damage to
any such equipment or supplies, except that unused equipment and supplies shall
be returned to the county receiving the request by the county initiating the
request when circumstances permit this to be done.

7. This Agreement shall be in full force and effect from the 1st day of
, 19 , through the day of--,----,,-' 19 • This Agreement may be -r-en_e_w_e~d-annually by the participating Boards of County Commissioners. Any
participating County may terminate its involvement in this Agreement upon
written notification to all other participating counties of a duly adopted Board
of Commissioners' Resolution withdrawing from this Agreement.
