Fir Avenue, Fergus Falls, MN Tuesday, December 15, 2009 9:15 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, December 15, 2009, at 9:15 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Everett Erickson, Chair; Roger Froemming, Vice-Chair; John Lindquist, Doug Huebsch and Lee Rogness present. Approval of Agenda Motion by Froemming, second by Lindquist, and unanimously carried to approve the Human Services Board agenda of December 15, 2009 as mailed. Approval of Minutes Motion by Huebsch, second by Froemming, and unanimously carried to approve the Human Services Board minutes of November 24, 2009, as presented. Keys to lnnervision Probation Director, Chuck Kitzman briefed the Board on the Keys to I nnervision program, administered by Lakeland Mental Health Center, for children and their parents. Motion by Rogness, second by Froemming, and unanimously carried to authorize the Chairman's signature to execute an agreement between the County of Otter Tail and Lakeland Mental Health Center to administer a multi- system adolescent chemical dependency program for the period of January 1, 2010 to December 31, 2010. The program serves twenty to twenty-five families with total cost of $275, of which, $50 is charged to the family. Coordinator on Aging Contract Public Health Director, Diane Thorson, briefed the Board on a contract from the Land of the Dancing Sky which provides $30,500 towards Otter Tail County's Aging Coordinator position. She submitted a handout describing the performance measures and outcomes for the position in assisting seniors and caregivers. Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County officials' signatures to execute a grant contract between the County of Otter Tail and the Land of the Dancing Sky for services provided to seniors. The federal funding, in the amount of $30,500 is supplemented with a local match of approximately $40,000 depending on expenses for mileage and program supplies. Pandemic Flu Vaccine Clinics Ms. Thorson reported that the Minnesota Department of Health has decided to open the availability of vaccine to all people. She reported that 13 clinics are planned to administer the vaccine. Public Health Department staff will be going to the schools to immunize children. Otter Tail County has received over 9,000 doses of vaccine. Ms. Thorson estimated a 25% to 40% saturation rate. Otter Tail County has also contracted with MeritCare and Lake Region Hospital to administer H1N1 vaccine. OTC Board of Commissioners' Minutes December 15, 2009 Page 2 State Health Rankinas Ms. Thorson reported that Minnesota has dropped to 6t"in the country for overall State health rankings due to determinants of health. Determinants of health are factors such as tobacco use, obesity, housing, and poverty. County profiles will be released in February of 2010 to compare Otter Tail County with other counties throughout the State. The Minnesota State Health Commissioner's advice is to invest in prevention to stop rising health care costs. Discussion took place about how to make exercise and healthy choices available to employees, schools, and other residents of the County. There are nine Health Maintenance Organizations that serve all Minnesota counties. Otter Tail County currently has three health care providers; Blue Plus, Medica and UCare. The RFP will be posted by the State on February 8, 2010 and health plans will submit proposals. The final decision will be made on June 17, 2010 with open enrollment the following September. Mr. Dinsmore provided information regarding the public programs that are included in the State RFP. He also reported that in 2008, approximately 57 million dollars has been spent for public health care in Otter Tail County. RESOLUTION Maintenance Cooperative Agreement between Otter Tail County and MN DNR Central Lakes State Trail Maintenance Otter Tail County Resolution No. 2009 -62 Commissioner Huebsch offered the following and moved its adoption: WHEREAS, pursuant to Minnesota Statutes 84.026 and 471.59, subd. 10, the State is empowered to engage such assistance as deemed necessary and the State is in need of routine maintenance services on the Central Lakes Trail in Otter Tail County, AND WHEREAS, Otter Tail County is agreeable to provide the routine maintenance services as described in the Maintenance Cooperative Agreement for an annual rate of $1,100.00 per mile. BE IT RESOLVED, that Otter Tail County will provide the maintenance services as per the Maintenance Cooperative Agreement expiring June 30, 2011 at the annual rate of $1,100.00 per mile on the Central Lakes Trail. BE IT FURTHER RESOLVED, the County Board Chair and the County Board Clerk are hereby authorized and directed for and on behalf of the County of Otter Tail to execute and enter into an agreement with the MN Commissioner of Natural Resources prescribing .the terms and conditions of same Maintenance Cooperative Agreement for the routine maintenance of the Central Lakes Trail expiring June 30, 2011. , Commissioner Rogness seconded the resolution and, upon being put to vote, the resolution was unanimously adopted. Erickson, Board of Commissioners Chair Highway Projects Motion by Froemming, second by Huebsch, and unanimously carried to authorize the Chairman's signature to execute the Contract and Performance Bonds for Subsurface Inc. of Moorhead, MN for completion of a culvert project over County Ditch No. 21 in Section 16 of Sverdrup Township on CSAH 18. Motion by Rogness, second by Lindquist, and unanimously carried to approve Final Payment to AAA Striping Service Co., of St. Michael, MN pursuant to Final Estimate No. 4, in the amount of $14,817.63, for completion of the County Wide Traffic Marking project (C.P. 09:TM). OTC Board of Commissioners' Minutes December 15, 2009 Page 5 Motion by Erickson, second by Froemming, and unanimously carried to authorize the Chairman's signature to execute an agreement between the State of Minnesota Department of Natural Resources and the County of Otter Tail. Otter Tail County will provide construction engineering services for the DNR for an overlay on the Maplewood State Park entrance road to the west parking and camping area at a cost of $40,000. Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County officials' signatures to execute an agreement between the County of Otter Tail and Braun lntertec for a Geotechnical Evaluation for a Bridge Replacement and Road Reconstruction project on CSAH 72 over the Otter Tail River (S.P. 56-672-04). County Ditch #37 Land & Resource Administrator, ,Bill Kalar, presented a map of Ditch #37. He referred to an area (indicated by yellow on the map) that has been approved for cleaning and tile replacement upstream from Onstad Lake and an area north of Bass Lake (indicated by pink onJhe map) .that has a broken tile which was authorized for repair. Mr. Kalar received a phone call from the contractor in regards to a problem south of Onstad Lake (indicated in blue on the map). Motion by Lindquist, second by Huebsch, and unanimously carried to repair broken tile in the area south of Onstad Lake subject to borrowing from the General Fund for the cost of repair. A Wetland Conservation Act technician concurred with the maintenance work as long as the bottom is not altered when cleaning out the area. The final work on Ditch #37 is planned for completion next spring. 2010 Natural Resources Block Grant Motion by Lindquist, second by Huebsch, and unanimously carried to approve the FY2010 Board of Water and Soil Resources (BWSR) Block Grant Agreement and authorize the Chairman's signature for the period of July 1, 2009 to June 30, 2011. The motion also approves the 2010 Block Grant distribution dated December 15, 2009 as presented by the Land and Resource Administrator. INCREASE WETLAND CONSERVATION ACT FUNDING FOR COUNTIES OUTSIDE OF THE 11 COUNTY METROPOITAN AREA Otter Tail County Resolution No. 2009 -58 Commissioner Huebsch offered the following and moved its adoption: WHEREAS, in 2007 through 2009, the 11 county metropolitan area received an increase in Wetland Conservation Act (WCA) funding for enforcement related violations; and WHEREAS, baseline funding for Soil & Water Conservation Districts (SWCDs) and Local Government Units (LGUs) outside of the 11 county metropolitan area has not increased since 2004; and WHEREAS, producer participation in ttie USDA Farm Program is no longer a valid exemption under the WCA; and WHEREAS, agricultural drainage activity on cropland in greater Minnesota has increased significantly due to many factors; and WHEREAS, DNR wetland enforcement flights are being conducted on a regular basis in greater Minnesota, .leading to an increase in enforcement issues for LGUs and SWCDs. OTC Board of Commissioners' Minutes December 15, 2009 Page6 THEREFORE, BE IT RESOLVED, MASWCD work with the Minnesota State Legislature, Minnesota Board of Water and Soil Resources (BWSR) and Association of Minnesota Counties (AMC) to lobby for enhanced funding for SWCDs and LGUs outside of the 11 county metropolitan area experiencing increased workloads related to WCA enforcement issues. Commissioner Froemming seconded the resolution and, upon being put to vote, the resolution was unanimously adopted. State Grant Agreement Motion by Lindquist, second by Huebsch, and unanimously carried to authorize the Chairman's signature to execute a Grant Agreement between the State of Minnesota and the County of Otter Tail which provides $10,000 to Otter Tail County for overtime DWI and seat belt violation enforcement. Recess/Closed to the Public At 11 :26 a.m., Chairman Erickson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. At 11 :30 a.m., Chairman Erickson declared the Board of Comi:nissioners' meeting reconvened and closed to the public for purposes of discussing labor negotiation strategies relative to the Human Services and Nursing bargaining units. Present were all five seated Commissioners, the County Attorney, County Coordinator, Human Services Director, and Board Secretary. Recess/Closed to the Public At 12:50 p.m., Chairman Erickson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. At 1 :00 p.m., Chairman Erickson declared the meeting reconvened and closed to the public to evaluate the performance of MIS Director, Tim Brand pursuant to M.S. Chapter 13D.05 Subd. 3. All five seated commissioners were present for the evaluation. A summary of performance conclusions will be provided at the next regular County Board meeting. Reconvene At 1 :44 p.m., Chairman Erickson declared the meeting of the Otter Tail County Board of Commissioners reconvened in open session for the remainder of the scheduled agenda items. Clerk Everett Erickson, County Board Chair OTC Board of Commissioners' Minutes December 15, 2009 Page 13 Watershed Information Power Point Board of Water and Soil Resources (BWSR) Conservationist, Pete Waller provided a power point presentation regarding the history, purpose and procedure to establish a watershed district. This informational gathering process is a result of a request, from Wilkin County, to establish a Watershed District encompassing the middle portion of Wilkin County and several townships in Otter Tail County located on the Otter Tail River watershed. After viewing the presentation, questions and concerns from the County Board were addressed. These items included discussion regarding: 1) boundaries of the watershed district and who determines the boundaries 2) other ways to deal with flooding issues without establishing a watershed district 3) what is the benefit for the landowners in Otter Tail County 4) recognition of where the problem is and what is contributing to the problem 5) tax is ad valorem for administration of a watershed district; however, projects can be based on benefited property 6) standards for approving or not approving a watershed district 7) problems with creating another layer of government 8) the possibility of Soil and Water Conservation Districts doing the same type of projects as a watershed district 9) watershed districts have the ability to establish rules and permits 10) the relationship between overland flooding affecting culverts and roads vs flooding from water that flows into rivers and streams as it relates to a watershed district 11) citizens located within the proposed watershed district need to know how they are affected ( cost) 12) direction of water flow cannot be controlled and therefore, there is no responsibility for that flow The Board agreed to listen to a presentation by Buffalo-Red River Watershed District Administrator, Bruce Albright regarding the opportunities for watershed districts to obtain grants to complete projects. The Board requested that Highway Engineer, Rick West; Land & Resource Administrator, Bill Kalar; and GIS Coordinator, Brian Armstrong; attend the upcoming presentation.
