Fir Avenue, Fergus Falls, MN June 9, 2009 9:15 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, June 9, 2009, at 9:16 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Everett Erickson, Chair; Roger Froemming, Vice-Chair; John Lindquist, Doug Huebsch and Lee Rogness present. Approval of Agenda Motion by Lindquist, second by Rogness, and unanimously carried to approve the Human Services Board agenda of June 9, 2009 as mailed. Approval of Minutes Motion by Froemming, second by Huebsch, and unanimously carried to approve the Human Services Board minutes of May 26, 2009 as mailed. Committee of the Whole Discussion Commissioner Rogness attended the Open House for the Becker County Courthouse addition. He shared a handout showing the layout of the Courthouse addition which included a very high tech courtroom system. Mr. Rogness shared some remodeling ideas that could be used in other counties. Discussion took place regarding the recent District IV AMC meeting and the State budget shortfall. Dog Bite Hearing Pubic Health Director, Diane Thorson, submitted an educational handout about animal bite hearings and explained the process. County Attorney, David Hauser, stated that under the Animal Bite Ordinance, the Board of Commissioners must determine if the animal is a danger based on the situation. He stated that the dog in this case, a 1 year-old Boxer, is owned by Tanya Kline. The Public Health Department presented evidence that the dog bites occurred, one on April 26, 2009 and the other, three days later on the right and left calf. Tanya Kline agreed with the evidence in the case. Lengthy discussion then took place for a solution to keep the public safe. Motion by Lindquist, second by Rogness, and unanimously carried to require that the Boxer owned by Tanya Kline must be on a runner in the back of the yard when outside and must be supervised by an adult when children are in the yard. If Ms. Kline moves into a City, because there are more people that could come into contact with the dog, the dog must be kept in a kennel when out doors. Documentation of shots will be provided to the Public Health Department and the dog is quarantined at this time. RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT Otter Tail County Resolution No. 2009 -35 Commissioner Rogness offered the following resolution: Be it resolved that Otter Tail County Public Health enters into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety for the project entitled Toward Zero Deaths Safe Roads during the period from October 1, 2009 through September 30, 2010. OTC Board of Commissioners' Minutes June 9, 2009 Page2 The Public Health Director is hereby authorized to execute such agreements and amendments as are necessary to implement the project on behalf of Otter Tail County Public Health and to be the fiscal agent and administer the grant. Commissioner Huebsch seconded the motion to adopt the above resolution, and upon being put to a vote, the resolution was unanimously adopted. Erickson, Human Services Board Chair West Central Regional Juvenile Center Probation Director, Chuck Kitzman, provided several handouts; 1) WCRJC handout explaining the location of the facility and the programs provided, 2) member county bed usage from 2004 -2008 along with a detailed budget, and 3) a cost comparison if Otter Tail County used other facilities. Mr. Kitzman reported on a recent WCRJC meeting held on May 28, 2009 with the four member counties that use the facility the most -Otter Tail, Becker, Clay & Douglas. In 2008, the facility ended the year with a budget deficit and Otter Tail County's share was $23,924.00, which was paid. Budget deficit is again a concern because the WCRJC budget is based upon 18.5 beds; however they are averaging a 16.5 bed capacity. In discussions about other detention centers, it became evident that other facilities are more diverse than the Moorhead facility and use other programs to assist in paying for the total facility. Discussion continued including a proposal to require the four main counties to guarantee a certain number of beds. County Coordinator, Larry Krohn, stated that Otter Tail County is not contractually bound to financially guarantee usage. Budget line items were discussed. Mr. Kitzman submitted a list of questions to be answered by WCRJC at an upcoming meeting scheduled for June 18, 2009. Development Disabilities Report Human Services Supervisor, Deb Sjostrom, and staff submitted a Development Disabilities Report and explained the various programs. She defined waiver services and stated that they will be reduced by 2.58% and expressed concern for the impact on the providers. The family managed respite care program has a budget of $20,000 and now serves 10 families who are allotted 24 hours per month at a rate of $6.00 per hour. Erickson, Human Services Board Chair Call to Order The Otter Tail County Board of Commissioners convened Tuesday, June 9, 2009, at 11:00 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Everett Erickson, Chair; Roger Froemming, Vice-Chair; John Lindquist, Doug Huebsch and Lee Rogness present. Approval of Agenda OTC Board of Commissioners' Minutes June 9, 2009 Page 5 Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of June 9, 2009, with the following additions: Reports -Gou nty Attorney Minnesota Rural Counties Caucus Update Approval of Minutes Motion by Froemming, second by Huebsch, and unanimously carried to approve the Board of Commissioners meeting minutes of June 2, 2009, as mailed. Approval to Pay Bills Motion by Rogness, second by Lindquist, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Wind Energy Conversion System Prairie Wind Energy LLC President, Terry Carlson, introduced a proposed wind energy project to be located in the southeast corner of Otter Tail County. He provided several maps showing 40 proposed wind tower locations and an informational letter. Mr. Carlson stated that owners of the project have been working with state and local agencies to ensure that the project is ready to proceed to the Public Utilities Commission. He asked for a resolution of support for the project to comply as a C-BED (Community Based Energy Development) project. Land & Resource Director, Bill Kalar, expressed concern with the Board authorizing a Resolution of Support for the project because the Board is also the regulatory authority for two proposed towers located in the shoreland area (1,000' from a lake). In support of wind energy and economic development, a motion was offered by Huebsch and seconded by Froemming to adopt a resolution of support for the project as submitted which does not preclude required County regulations. Chairman Erickson called for a vote. The motion failed with Rogness, Lindquist, and Erickson opposed. Commissioner Rogness stated that he is comfortable with the concept but felt the resolution, as presented, goes beyond the concept. Request for Forgiveness of Penalty Treasurer, Steve Andrews, presented a forgiveness of penalty request, in the amount of $13.05, from Greg Hennen (parcel No. 58000990533000). Evidence was submitted that showed the tax payment was taken from Mr. Hennen's account on May 15th with a bill pay system through Wells Fargo Bank; however, the bank did not mail the payment to the County until May 17th . Tax payments received after the May 15th deadline are assessed a penalty. Motion by Erickson, second by Froemming, and unanimously carried to deny the forgiveness of penalty request, in the amount of $13.05, because the County did not make an error. Commissioners suggested that Mr. Hennen request that the bank reimburse the penalty amount if they were in error. Wetland Conservation Act Appeal Land & Resource Administrator, Bill Kalar, reported that the Board of Water & Soil Resources (BWSR) has reviewed the David Stock WCA appeal and remanded the decision back to Otter Tail County for additional information. The proceedings need to be completed within 60 days of the date of the letter from BWSR. Mr. Kalar identified July 28, 2009 as the 60 day deadline date. BWSR has requested that the Technical Evaluation Panel produce a revised written report dealing with the cropping history. The David Stock WCA appeal will be scheduled on July 21, 2009. OTC Board of Commissioners' Minutes June 9, 2009 Page 6 Memorial Day Program Funds VSO Director, Bernie Gamber, addressed a request from the American Legion Post #17 Commander, Chet Nettestad, for a $300 grant from the Memorial Day Program funds. There are 17 Posts and each Post receives $100 per year for Memorial Day funding. The State legislature has increased the amount of funding the County may provide for Memorial Day funding from $2,000 to $3,500; however, the funds are not provided by the State, but rather from County funds. Mr. Gamber recommended that, due to the current economic situation, that the Memorial Day Funding remain the same. No action was taken. The issue may be considered at the next budgetary session. Land Surveyor's Certificate of Correction to Plat Motion by Froemming, second by Lindquist, and unanimously carried to approve, as prepared by Glenn Howe, Professional Land Surveyor (MN License No. 178725) the attached Land Surveyor's Certificate of Correction to the Amended Plat, Sub-Division of Reserve Lots A, B, C, & D of Haggstrom Beach located in Section 12 of Maine Township and attached hereto as Attachment B. OTC Board of Commissioners' Minutes June 9, 2009 Page 7 Reconvene in Closed Session At 1:12 p.m., Chairman Erickson declared the meeting of the Otter Tail County Board of Commissioners reconvened and closed to the public to discuss a pending law suit relative to the 60-Bed Chemical Dependency Treatment Center located in Fergus Falls. The closed session is authorized by attorney-client privilege, Chapter 13D.05 Subd. 3b. Present were all five seated Commissioners, County Attorney, County Coordinator, Physical Plant Manager, and Board Secretary. Payment Request for CD Facility Construction Upon completion of the closed session at 1 :55 p.m., Physical Plant Manager, Rick Sytsma, requested payment of Pay Request No. 18 for the 60-Bed Chemical Dependency Treatment Facility, in the amount of $277,300.79. Motion by Rogness, second by Lindquist, and unanimously carried to approve payment to Comstock Construction, Inc. of Minnesota, in the amount of $277,300.79, for completion of the construction of the Chemical Dependency Treatment Facility (project No. F27543), based on claims submitted by the contractor and as recommended by the project architect. Approval of Highway Contracts Motion by Huebsch, second by Lindquist, and unanimously carried to approve a Highway Construction Contract between the County of Otter Tail and Asphalt Surface Technologies Corporation, AKA, ASTECH Corp. of St. Cloud for the 2009 County Wide Seal Coat project (S.A.P. 56-601-47 & Etc.) as recommended by the Highway Engineer. Motion by Froemming, second by Rogness, and unanimously carried to approve a Highway Construction Contract between the County of Otter Tail and AAA Striping Service Co. of St. Michael for the 2009 Maintenance Traffic Marking (C.P. 09:TM & C.P. 09:209TM) contingent upon the approval of the County Attorney. The contract amount is $287,004.64 and includes the City of Fergus Falls and various townships. Approval for Out of State Conference Motion by Rogness, second by Erickson, and unanimously carried to authorize the Highway Engineer to attend the National Rural ITS Conference in Oregon August 23-27, 2009. The Minnesota Local Road Resource Board will be paying all expenses related to this conference. High Water Discussion Discussion took place regarding County Road #24 and the various options to reduce the flooding. The Highway Engineer met with MnDOT on May 27'h and discussed the Iverson Lake high water issue. Minnesota Rural Counties Caucus Commissioner Froemming handed out a information from the MRCC and a proposed resolution to be discussed at the next regular County Board meeting.
