Call to Order
The Otter Tail County Human Services Board convened Tuesday, January 13, 2009, at 9:17 a.m. at
the Otter Tail County Government Services Center with Commissioners Everett Erickson,
Roger Froemming, Doug Huebsch, and Lee Rogness present. Commissioner John Lindquist was
absent.
Year 20091 Otter Tail County Human Services Board Chair
County Attorney, David Hauser, requested nominations for the CY2009 Otter Tail County Human
Services Board Chair. Motionlby Froemming, second by Rogness, and unanimously carried to elect
Commissioner Everett Erickson as the Otter Tail County Human Services Board Chair for 2009.

Year 2009 Otter Tail County Human Services Board Vice-Chair
Chairman, Everett Erickson, assumed the chair and requested nominations for the CY2009 Otter Tail
County Human Services Board Vice-Chair. Motion by Huebsch, second by Rogness, and
unanimously carried to elect Commissioner Roger Froemming as the Otter Tail County Board Vice-
Chair for 2009.

Board agenda of January 13, 2009 as mailed.

Motion by°Froemming, second lby Huebsch, and unanimously carried to approve the Human Services
Board minutes of December 30, 2008, as mailed.
I Committee of the Whole
Commissioners discussed the protocol on paying and approving bills and budget procedures. County
Attorney, David Hauser, discl1ssed general powers of the Board in delegating certain items for
' payment and responsibility in tt;e process. If an expenditure is to be made outside of the budget, the
initial step in the process would be to meet with the Budget Committee. Commissioner Rogness
stated that State revenue needs to be looked at in relation to how the County plans that revenue
stream into its expenditures. I ·
Probation Department
WCR Juvenile Center: I
Probation Director, Chuck Kitzman, reported Otter Tail County's share of the 2008 deficit at the
WCRJC to be less than $24,000. Discussion took place regarding budgets. Mr. Kitzman plans to
return to the Board January 27, 2009 to request payment.
Probation Advisory Committee:
Mr. Kitzman briefed the Board regarding the Probation Advisory Committee and provided a handout.
Members serve three year term's and meet about three times annually.

DWI Court Agreement:
Motion by Rogness, second by Froemming, and unanimously carried to authorize the appropriate
County Officials' signatures to execute an Agreement for Professional Services between the State of
Minnesota Seventh Judicial District and Otter Tail County Probation for the period of October 1, 2008
through September 30, 2009. This agreement is for a $90,000 grant for the State DWI Court Program
with matching funds of $23,300 provided by the Probation Department.
Public Health Department
Public Health Director, Diane Thorson, submitted handouts including "Summary of Powers and Duties
contained in Minnesota Statute 145A.03-145A.10" and "Areas of Public Health Responsibility and
Essential Local Public Health Activities". Ms. Thorson briefed the Board on the Powers and Duties of
local public health agencies, the Community Health Board, CHS Advisory Committee, Emergency
Preparedness Committee, and the Department's current ordinances .
. Human Services Worksite Labor Management Committee
Human Services LMC Co-Chairs, Barbara Jongeling and Kay Brown, provided a handout of LMC
accomplishments and upcoming topics the committee is continuing to discuss throughout 2009.
Human Services Contract Renewals
Human Services Director, John Dinsmore, provided an orientation packet to the Agency's programs
and services. He reported a total of 128 programs and provided a listing of all Human Services
contracts. Out of the 17.5 million dollar Human Services budget, approximately 8.5 million dollars are
spent on contracts to purchase services. Motion by Froemming, second by Rogness and

The Otter Tail County Board of Commissioners convened Tuesday, January 13, 2009, at 11:12 a.m.,
at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners
Everett Erickson, Chair; Roger Froemming, Vice-Chair; Doug Huebsch, and Lee Rogness present.
Commissioner John Lindquist was absent.

Motion by Rogness, second by Huebsch, and unanimously carried to approve the Board of

Motion by Froemming, second by Huebsch, and unanimously carried to approve the Board of

Recess & Reconvene
At 11:14 a.m., Chairman Erickson recessed the meeting of the Otter Tail County Board of
Commissioners for a Highway Committee meeting. The meeting was reconvened at 11 :34 a.m.

At 11 :37 a.m., Chairman Erickson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss pending litigation regarding Breitbach Construction
relevant to the construction of the Fergus Falls Transfer Station. The closed session is authorized by
attorney-client privilege, Chapter 13D.05 Subd. 3b. Present were Commissioners Erickson,
Froemming, Huebsch, and Rogness, the County Attorney, Solid Waste Director and Board Secretary.

Recess & Reconvene
At 12:20 p.m., upon conclusion of the closed session, Chairman Erickson declared the meeting of the
Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at
1:00 p.m.
Leadership Cohort Group
Leadership Cohort member, Judy Siggerud, explained how the group fosters connections between
departments that can result in tangible cost savings for the County. Cohort members reviewed the
2009 leadership plans and invited commissioners to attend as part of the Leadership Group. The
group will include 20 employees. Motion by Rogness, second by Huebsch, and unanimously carried
to authorize Chairman, Everett Erickson and Commissioner, John Lindquist, as members of the
County Leadership Cohort Group for 2009.

Otter Tail/Wadena Community Action Council
Motion by Froemming, second by Rogness, and unanimously carried to appoint Syd Nelson of
Sebeka, to serve on the Otter Tail/Wadena Community Action Council.
Court Ordered Evaluations
Motion by Huebsch, second by Froemming, and unanimously carried to authorize the appropriate
County Officials' signatures to execute a Purchase of Service Agreement for Evaluation Services for
Otter Tail County Court Administration for the period of January 1, 2009 through December 31, 2009.
The contract is executed with Lakeland Mental Health Center, Inc. of Fergus Falls, MN as the provider
for Court Ordered Evaluation Services.
Iverson Lake Project Discussion
Jeff Langen of Houston Engineering, updated the Board on infonmation gathering that has occurred
regarding the Iverson Lake High Water Issue. Mr. Langen provided the following: a site map showing
a potential outlet for Iverson Lake, information regarding volume of water, discharge rate, approximate
time it would take to drop the water level a certain amount on Iverson Lake, and how much lakes
downstream would rise to develop a scope of the affect. Iverson Lake is about 4 ft. from the top of
CSAH 25 currently. Discussion took place about lowering Iverson Lake to the DNR Ordinary High
Water Lever (OHWL) which is 7-8 ft. Mr. Langen estimated that it would take about 18 months for
noticeable changes with this outlet plan. Highway Engineer, Rick West, stated that enough modeling
needs to be completed to give the public an idea of what to expect as far as impact at the next public
meeting.
RESOLUTION
For Agreement to State Transportation Fund
Local Road Improvement Program Grant Terms and Conditions
Otter Tail County Resolution No. 2009 -05
Upon motion made by Rogness, seconded by Froemming, and unanimously carried, the following
resolution was adopted:
WHEREAS, Otter Tail County has applied to the Commissioner of Transportation for a grant from the
Minnesota State Transportation Fund for construction of Local Road Improvement S.A.P. No.
56-622-07; and
WHEREAS, the Commissioner of Transportation has given notice that funding for this local road
improvement project is available; and
WHEREAS, the amount of the grant has been determined to be $84,388.00;
NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby agree to the terms and
conditions of the grant consistent with Minnesota Statutes, Section 17 4.52, Subdivision 5, and will pay
any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State
Transportation Fund any amount appropriated for the road project, but not required.

Final Payment for Highway Project
Motion by Erickson, second by Huebsch, and unanimously carried to approve Final Estimate No. 4, in
the amount of $10,009.34, payable to Hough, Inc. for completion of the Vergas Multi-Use Trail,
S.P. 056090-005, F.P. TEA)( 5608 (078).
Building Project Update
Physical Plant Manager, Rick Sytsma, reported January 12, 2009 as the date of substantial
completion for the 60-Bed Chemical Dependency Treatment Center in Fergus Falls. An Open House
is scheduled on January 29, 2009. Mr. Sytsma presented a Sustainable Design Award that was
received from the North Dakota Ready Mix & Concrete Products Association for the Otter Tail
Operations Center located in Ottertail City.
Board of Adjustment
Motion by Froemming, second by Huebsch, and unanimously carried to re-appoint the Board of
Adjustment members for 2009 as follows: Michael Harris, Randall Mann, Paul Larson, R. Stephen
Schierer, and Carl Zick.
Addition to December 30, 2009 Minutes
Motion by Froemming, second by Rogness, and unanimously carried to add the following sentence to
the December 30, 2008 Board of Commissioners' Minutes under the Heading of Lake Olaf Project:
"The additional work required by Houston Engineering for the preparation of the EAW-Phase 1 is not
to exceed $5,000.00."
