Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, December 23, 2008, at 9:30 a.m.,
at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners
Everett Erickson, Vice-Chair; Bob Block, Roger Froemming, and Dennis Mosher present. Chairman
Syd Nelson was absent.
Approval of Agenda
Motion by Froemming, second by Block, and unanimously carried to approve the Board of
Commissioners agenda of December 23, 2008, with the following additions:
Closed session for Labor Negotiation Strategies
10:55 a.m. -Final Plat Approval
Commissioner Mosher -Clarification of Previous Motions
Approval of Minutes
Motion by Froemming, second by Block, and unanimously carried to approve the Board of
Commissioners meeting minutes of December 16, 2008, as presented.
Approval to Pay Bills
Motion by Mosher, second by Froemming, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
60 Bed Chemical Dependency Facility
Physical Plant Manager, Rick Sytsma, requested approval of Change Order Number 26 for the
construction of the 60-Bed CD Facility. Motion by Mosher, second by Block, and unanimously carried
to approve Change Order Number 26, in the amount of $13,662.51, for Construction Project No. 0601
(CD Facility). Discussion followed regarding issues with a sub-contractor on the project.
Equipment Approval
Mr. Sytsma requested approval of a John Deere Mower to be used at the Government Services
Center with the GSC mower being transferred to the Ottertail Operations Center and approval of a
scrubber for the Ottertail Operations Center. Motion by Froemming, second by Block, and
unanimously carried to approve the purchase of a John Deere 1420 28HP Gas Front Mower, at a cost
of $24,361.07 and a Nobles EZ Rider HP Scrubber, in the amount of $13,939.79.
Otter Tail County Facility Master Plan
Mr. Sytsma reported that a long range facility plan has been completed involving the assessment of
all facilities including time spent with Department Heads and considering future space needs.
Architect, David Shultz, presented the Otter Tail County Facility Master Plan -2008 booklet and
briefed the Board on the plan with a power point presentation. The greatest needs identified were at
the County Courthouse. Mr. Shultz presented a handout dated October 7, 2008 which identifies
Proposed Phase I Budget for the Courthouse site with an estimated cost of $3,410,000 and upgrades
at the GSC building at an estimated cost of $425,000.

Final Plat
Motion by Erickson, second by Mosher, and unanimously carried to approve the Final Plat of Ronald
& JoAnn Bina entitled ''RJ Estates" consisting of 1 lake lot and 3 backlots located in Section 3 of Star
Lake Township; Star Lake (56-385).
Recess & Reconvene
At 10:59 a.m., Vice-Chair Erickson declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 11 :05 a.m.

RESOLUTION OF THE COUNTY BOARD OF

Otter Tail County Resolution No. 2008 -71
County Commissioner Mosher presented the following resolution:
WHEREAS, the Commissioner of Natural Resources of the State of Minnesota, has made
application under authority of M.S.A. Section 282.01, subd. 1, on behalf of the Department of Natural
Resources, a state agency, for release of the following described lands from the trust in favor of the
taxing district:

WHEREAS, it appears that there is need for such lands and the applicant desires to obtain
such lands for conservation purposes:
NOW, THEREFORE, BE IT RESOLVED, that the petition of said Commissioner of Natural
Resources of the State of Minnesota, be granted and that the above described lands be and hereby
are released from the trust in favor of the taxing district to the State of Minnesota Department of
Natural Resources.
The resolution was seconded by County Commissioner Block and upon vote, was
unanimously adopted.

Transfer of Ditch No. 16 Funds
Motion by Mosher, second by Froemming, and unanimously carried to approve an inter-fund loan with
a six percent interest rate, in the amount of $10,000.00 from the General Fund to County Drainage
System No. 16 for the purpose of funding the calendar year 2008 year-to-date cost of $8,335.27.
Payable 2009 Otter Tail County Gross and Net Property Tax Levy Resolution
Otter Tail County Resolution No. 2008 -72
The following resolution was offered by Commissioner Froemming who moved for the adoption of
Otter Tail County's payable 2009 Gross and Net Property Tax Levies:
WHEREAS, the Otter Tail County Board of Commissioner on Monday, September 15, 2008 adopted
Otter Tail County's proposed Payable 2009 Gross and Net Property Tax Levy,
WHEREAS, the proposed levy adopted by the Otter Tail County Board of Commissioners was less
than the maximum allowable levy to qualify for exemption from the public hearing requirements; and
WHEREAS, the Otter Tail County Board of Commissioners recognizes the requirement to adopt Otter
Tail County's final payable 2009 Gross and Net Property Tax Levy no later than Saturday, December
27, 2008, and the Otter Tail County Board of Commissioners is required to certify Otter Tail County's
final payable 2009 Gross and Net Property Tax Levy to the County Auditor's office on or before
Monday, December 29, 2008.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
levies for the payable year 2009, upon the taxable net tax capacity of the property of Otter Tail
County, the following amounts as detailed below:

NOW, THEREFORE, BE IT FUTHER RESOLVED, that the Otter Tail County Board of

to spread these levies against the taxable net tax capacity of the property of Otter Tail County.

Payable 2009 Otter Tail County Housing and Redevelopment Special Taxing District
Gross and Net Property Tax Levy Resolution
Otter Tail County Resolution No. 2008 -73
The following resolution was offered by Commissioner Mosher who moved for the authorization of the
Otter Tail County Housing and Redevelopment Special Taxing District 2009 Gross and Net Property
Tax Levy:
WHEREAS, the Otter Tail County Housing and Redevelopment Authority is a special taxing district
under the provisions of Minnesota Statute Chapter 469, and

WHEREAS, the Otter Tail County Housing and Redevelopment Authority, had requested a Payable
2009 Gross and Net Property Tax Levy of $357000, and
WHEREAS, the Otter Tail County Board of Commissioners on Monday, September 15, 2008, adopted
the Otter Tail County Housing and Redevelopment Authority's request of $357,000 as the proposed
Gross/Net Property Tax Levy for Payable Year 2008, and
WHEREAS, the Otter Tail County Board of Commissioners recognizes the requirement to adopt the
special taxing district's Payable 2009 Gross and Net Property Tax Levy no later than Saturday,
December 27, 2008, and the Otter Tail County Board of Commissioners is required to certify Otter Tail
County's final payable 2009 Gross and Net Property Tax Levy to the County Auditor's office on or
before Monday, December 29, 2008.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners, after
consideration and discussion by the Otter Tail County Budget Committee with the Otter Tail County
HRA, hereby authorizes/adopts, on behalf of the Otter Tail County Housing and Redevelopment
Authority, a final Payable 2009 Gross and Net property tax levy of $357,000 and hereby certifies the
same to the County Auditor's office to be spread against the taxable property of the Otter Tail County
Housing and Redevelopment Authority.

Resolution Adopting the Calendar Year 2009 Budget
Otter Tail County Resolution No. 2008 -74
The following resolution was offered by Commissioner Mosher who moved for the adoption of the
calendar year 2009 budget for the General Fund, for the Budgeted Special Revenue Funds, and for
the Debt Service Fund.
WHEREAS, the Otter Tail County Board of Commissioners on Monday, September 15, 2008, adopted
a proposed calendar year 2009 budget for the General Fund, for the Budgeted Special Revenue
Funds, and for the Debt Service Fund, and

WHEREAS, the Otter Tail County Board of Commissioners recognizes the requirement to adopt Otter
Tail County's final calendar year 2009 budget for the General Fund, for the Budgeted Special
Revenue Funds, and for the Debt Service Fund no later than Saturday, December 27, 2008 and also
recognizes the requirement to adopt the final calendar year 2009 budget after the adoption of the final
payable 2009 Gross and Net Property Tax Levy.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners adopts
the amount of $70,453,717 as the County's calendar year 2009 budget for the General Fund, for the
Budgeted Special Revenue Funds, and for the Debt Service Fund, as summarized in Attachment B
and as detailed in the budget documents filed with the County Auditor's office.
The above resolution was seconded by Commissioner Froemming and carried with the members of
the Otter Tail County Board of Commissioners voting as follows:

At 11 :50 a.m., Vice-Chair Erickson declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 11 :59 a.m.
Approval to Purchase Pavement Management Software
Motion by Mosher, second by Froemming, and unanimously carried to authorize the Highway
Engineer to purchase Pavement Management Software at an approximate cost of $5,800.00 payable
to GoodPointe Technology, Inc. of St. Paul, MN. Payment for this purchase will be from the 2008
Highway Department Operational Budget under a line item for software upgrades and engineering
equipment supply purchase.
Final Payment
Motion by Block, second by Mosher, and unanimously carried to approve Final Payment per Final
Estimate No. 5, in the amount of $25,523.91, payable to AAA Striping Service Co. for completion of
2008 County Wide Traffic Marking.
Tower Road Bridge
Motion by Block, second by Froemming, and unanimously carried to dedicate the proposed Tower
Road Bridge, over the Otter Tail River extending Tower Road, in honor and in memory of the
POW-MIA Veterans.
Closed to the Public
At 12:12 p.m., Vice-Chairman Erickson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss pending litigation related to the construction of the
Fergus Falls Transfer Station. The closed session is authorized by attorney-client privilege, Chapter
13D.05 Subd. 3b. Present were Commissioners Erickson, Block, Froemming, and Mosher; Assistant
County Attorney, Kurt Mortenson; County Coordinator, Solid Waste Director, and Board Secretary.
At 1 :00 p.m., Vice-Chairman Erickson declared the meeting closed to the public for discussion
regarding sale of the portable office building located at the Pelican Rapids Transfer Station. The
closed session is authorized under Chapter 13D.05 Subd. 3(c) (1). Present were Commissioners
Erickson, Block, Froemming, and Mosher; Assistant County Attorney, Kurt Mortenson; County
Coordinator, Solid Waste Director, and Board Secretary.

At 1 :06 p.m., Vice-Chair Erickson declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 1 :11 p.m. in open
session.

AS400 High Availability Agreement
MIS Director, Tim Brand, reported that the funding for the High Availability & Disaster Recovery
project for the City/County AS400 Computer System is eligible for funding from the County's
Compliance Fund.
Government Aid __
County Coordinator, Larry Krohn, reported that he was notified that government program aid for Otter
Tail County was decreased by $476,000 for the 2008 budget.
Otter Tail County Hours of Operation
Motion by Mosher, second by Froemming, and unanimously carried that, effective April 1, 2009, the
hours of operation for Otter Tail County general offices will be 8:00 a.m. to 4:30 p.m. with a one-half
hour lunch break.
County Hiring Freeze
Commissioner Mosher stated that the hiring freeze motion from the last Board of Commissioners'
meeting needs clarification. He noted that the purpose of the freeze is to avoid layoffs as long as
possible and he offered the following motion which was seconded by Commissioner Block. Effective
January 1, 2009, Otter Tail County will implement a hiring freeze, with law enforcement positions and
positions currently in the hiring process exempt. All other positions to be filled must be presented to
the Personnel Committee and the Board of Commissioners for approval Motion carried unanimously
Commissioners Compensation and Committees Per Diem Resolution
Otter Tail County Resolution No. 2008 -75
Commissioner Erickson offered the following and moved its adoption:
WHEREAS, Minnesota Statutes 375.055 provides that County Commissioners may receive per diem
payments and reimbursement for necessary expenses incurred in performance of the duties of the
office and shall receive compensation of annual salaries, as set by resolution of the County Board;
and
WHEREAS, the current per diem rate for County Commissioners is $60.00; and
WHEREAS, the current per diem rate for County Committees, excluding Ditch Viewers, is $60.00; and
NOW, THEREFORE, BE IT RESOLVED, that the per diem rate for Otter Tail County Commissioners
and County Committees, excluding Ditch Viewers, is established at $60.00 with necessary mileage
reimbursement set at the IRS rate of $0.55 per mile effective January 1, 2009.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the annual salary for Otter Tail County
Commissioners shall be established as $31,851.00 effective January 1, 2009. This is a 0% increase
over the annual salary for Otter Tail County Commissioners in 2008.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the annual benefits compensation for
CY2009 will be set at $875.00 per month, the same as non-union and most union employees.

Closed to the Public -Labor Negotiation Strategies
At 1 :40 p.m., Vice-Chairman Erickson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for purposes of discussing labor negotiation strategies relative to
the GSC Technical Union. Present were Commissioners Erickson, Block, Froemming, and Mosher;
Assistant County Attorney, Kurt Mortenson; County Coordinator, and Board Secretary.

Upon conclusion of the Closed Session, at 1 :46 p.m., Vice-Chairman Erickson declared the meeting
of the Otter Tail County Board of Commissioners adjourned until Tuesday, December 30, 2008.
