Fir Avenue, Fergus Falls, MN Tuesday,December16,2008 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, December 16, 2008, at 9:30 a.m. at the Otter Tail County Government Services Center with Commissioners Syd Nelson, Chair; Everett Erickson, Vice-Chair; Bob Block, Roger Froemming and Dennis Mosher present. Approval of Agenda Motion by Mosher, second by Erickson, and unanimously carried to approve the Human Services Board agenda of December 16, 2008 as presented. Approval of Minutes Motion by Froemming, second by Block, and unanimously carried to approve the Human Services Board minutes of November 25, 2008 as presented. West Central Regional Juvenile Detention Center Probation Director, Chuck Kitzman, reviewed the WCRJC's deficit issue. He reported that the projected deficit for 2008 has decreased from $230,000 to $170,000. Based on the new projected deficit, Otter Tail County's share for 2008 is reported as $25,670. Mr. Kitzman reports that Otter Tail County has spent $51,120 for secure detention in 2008 with a total secure detention budget of $65,000. He reviewed the funding mechanism, in 1994, that allowed various counties to provide dollars to one entity to build a juvenile detention facility. Otter Tail County became a member county to the WCRJC in Moorhead at that time. Several handouts were provided and discussion continued regarding the previous budget shortfall, difficult economic conditions, the need for quarterly financial reports from the facility, and potential for Douglas County to include some juvenile beds in their jail construction project. DWI Services Agreement Motion by Mosher, second by Block, and unanimously carried to authorize the appropriate county officials' signatures to execute an "Agreement for Professional Services Between State of Minnesota, Seventh Judicial District and Otter Tail County Probation" for funding of services provided under the DWI Court program. Public Health Department Public Health Director, Diane Thorson, postponed the Personnel Discussion agenda item pending future revenue information. Ms. Thorson recommended waiting until year-end to transfer funds from the reserves into the Public Health budget for the Nurse Family Partnership program. Ms. Thorson reported that Dr. McGovern's Dental Office at the Westridge Mall will be the permanent site for a dental clinic to service low income clients in the area. Grants over $500,000 have been secured to begin modifications of the site. Ms. Thorson also briefed the Board on a recent State Community Health Services Advisory Committee (SCHSAC) meeting and reported on various health issues in the State. She stated that a commissioner from Otter Tail County should serve on the SCHSAC with the Public Health Director serving as an alternate. OTC Board of Commissioners' Minutes December 16, 2008 Page 2 County Burial & Funeral Allowance Policy Human Services Director, John Dinsmore, presented the current County Burial & Funeral Allowance Policy in conjunction with Minnesota Statute 261.035, the Human Services Department recommendation to retain the current rate structure and rationale for that recommendation. Lengthy discussion took place regarding county paid funeral and burial services with individuals who work in the Funeral Home business. They stated that the cost of funerals has increased recently and a rate increase has not been approved by Otter Tail County since 2004. Motion by Mosher, second by Froemming, and unanimously carried to approve the current Otter Tail County Human Services Funeral Allowance Expenses as submitted with an increase of 25% for Professional Services for the Adult and Child Funeral and Burial Expenses. Request for Undue Hardship Mr. Dinsmore submitted a handout regarding Case #601346 as it relates to a Request for Undue Hardship. The handout reviewed the sequence of events, the purchase price of the property (asset in this case), and the estimated market values for the property. The Human Services Department consulted with the County Assessor and the Land & Resource Management Administrator to ensure that the respective policies and guidelines do not conflict with one another. Motion by Froemming, second by Block, and carried with Mosher and Erickson opposed, to approve the Human Services Department recommendation that the Request for Undue Hardship in Case #601346 be denied. Motion by Froemming, second by Nelson, and unanimously carried to authorize the appropriate County Officials' signatures to execute the Acceptance of a Grant Award Agreement for $24,000 for the period of January 1, 2009 through December 31, 2009 for the PSOP Program. Drug and Alcohol Testing Program Safety Director, Tiny Holm, reported that Minnesota Counties Insurance Trust (MCIT) has canceled the County's Drug and Alcohol Testing Program for the CDL Drivers License and requested that Lakes Country Service Cooperative take over this program. Motion by Froemming, second by Block, and unanimously carried to accept LCSC to take over the County's CDL Drug and Alcohol Testing Program at an approximate cost of $900 per year . . '', ,';:.' Present were all five seated Commissioners, County Attorney, County Coordinator, Highway Engineer, and Board Secretary. Extension for Filing a Final Plat At 11 :25 a.m. Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners opened to the public. Land & Resource Administrator, Bill Kalar, presented a request for a filing extension for the proposed Final Plat entitled "Stall's Subdivision". Motion by Erickson, second by Block, and unanimously carried to approve a filing extension to June 19, 2009 for filing the Final Plat entitled "Stall's Subdivision", Section 13 of Star Lake Township; Star Lake (56-385). Motion by Froemming, second by Block, and unanimously carried to approve the Final Plat of Delbert and Brunhilde Thalmann entitled "Thalmann Third Addition to South Oaks", a 2 lake lot subdivision located in Section 1 of Otter Tail Township; Buchanan Lake (56-209). RESOLUTION TO REQUEST OTTER TAIL COUNTY HOUSING AND REDEVELOPMENT AUTHORITY PARTICIPATION IN VIKING LIBRARY SYSTEM FINANCING Otter Tail County Resolution No. 2008 -69 BE IT RESOLVED By the Board of Commissioners of Otter Tail County, Minnesota, as follows: 1. This Board hereby determines to request that the Otter Tail County Housing and Redevelopment Authority issue revenue bonds under Minnesota Statutes, Sections 469.152 to 469.165 (the "Bonds") in the approximate amount of $1,200,000 to finance a library system headquarters facility (the "Project") to be leased by the County from the Housing and Redevelopment Authority and subleased to the Viking Library System. The principal and interest on the Bonds will be paid from lease payments to be made by the County and sublease payments by the Viking Library System. The County shall work with Otter Tail County Housing and Redevelopment Authority to prepare proposed documentation, to set a sale date and make application to rating agencies. Closed to the Public -Labor Negotiation Strategies At 12:12 p.m., Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of discussing labor negotiation strategies relative to the GSC Technical and Highway Maintenance Units. Present were all five seated Commissioners, County Attorney, County Coordinator, and Board Secretary. Chairman Nelson declared the meeting recessed for a Personnel Committee Meeting at 12:48 p.m. Reconvene At 2:00 p.m., Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners reconvened and opened to the public. Chairman Nelson was absent at 3:03 p.m. Request to Attend a Highway Conference Motion by Erickson, second by Block, and unanimously carried to authorize the Highway Engineer to attend the 2009 American Traffic Safety Services Association (ATSSA) Conference February 2, 2009 through February 4, 2009 in San Jose, CA. The conference is sponsored by the Mn/DOT. Final Payments Approved Motion by Mosher, second by Erickson, and unanimously carried to approve Final Payment per Final Estimate #8, in the amount of $124,071.10, payable to Central Specialties, Inc. for completion of C.P. 07:116B & C.P. 07:125B-T. Maintenance Agreement No. 93703 for State Costs for Solar Powered Stop Sign Beacons At the Intersection of TH No. 106 and CSAH No. 52 Resolution No, 2008 -70 BE IT RESOLVED that the County of Otter Tail enter into an agreement with the State of Minnesota, Department of Transportation for the following purposes, to wit: OTC Board of Commissioners' Minutes December 16, 2008 Page 6 Provided Maintenance for the new Solar Powered Highway Stop Sign Beacons on Trunk Highway No. 106 at County State Aid Highway No. 52 in accordance with the terms and conditions set forth and contained in Agreement No. 93703, a copy of which was before the Board. BE IT FURTHER RESOLVED that the proper county officers be and hereby are authorized to execute such agreement and any amendments, and thereby assume for and on behalf of the County all of the contractual obligations contained therein. He stated that the 5 year Highway Plan will be reviewed and opened to public discussion for years 2010 to 2016 because of price increases. Lake Elevation Report Mr. West presented lake elevations for Johnson and Vinge Lakes and the South Turtle Lake system including North Turtle Lake, South Turtle Lake, Fiske Lake, and Long Lake. The North and South Turtle Lake drainage system will continue to operate through the winter. AS400 High Availability Agreement MIS Director, Tim Brand, requested approval of an agreement between Otter Tail County and the City of Fergus Falls in support of the High Availability & Disaster Recovery project. The cost of equipment to support the project was estimated at $54,178.00 with an additional annual maintenance cost of $6,000. Mr. Brand requested use of Compliance Fund dollars to cover the cost of this enhancement. Motion by Block, second by Nelson, and unanimously carried to authorize the appropriate County Officials' signatures on the AS400 High Availability Agreement and Heppner Consulting Inc. proposal for additional equipment to be installed contingent upon the confirmation of appropriate use of Compliance Fund dollars for this expense. Absentee Ballot Review Services Motion by Mosher, second by Froemming, and unanimously carried to authorize the County Board Chair and the County Board Clerk to sign the agreement between the State of Minnesota, acting through its Office of the Secretary of State and the County of Otter Tail for absentee ballot review services for previously rejected absentee ballot envelopes returned by voters pursuant to Minnesota Statutes, Chapter 203B. Payment Approvals Motion by Mosher, second by Erickson, and unanimously carried to approve payment, in the amount of $953.00, payable to MeritCare for medical examination services for Case No. 08021451 as provided under the provision of Minnesota Statute 609.35. Motion by Block, second by Erickson, and unanimously carried to approve payment, in the amount of $2,697.87, to Young and Associates, from the Capital Improvement Fund for services provided for the 60-Bed Chemical Dependency Health Center project. University of Minnesota Extension Programs Motion by Mosher, second by Block, and unanimously carried to authorize the County Board Chair to sign, subject to the review of the County Attorney, the agreement between the University of Minnesota and County of Otter Tail for providing Extension programs locally and employing Extension staff during the period of January 1, 2009 through December 31, 2009. The agreement is for an Ag Educator and two 4-H Program Coordinators for a total cost to Otter Tail County of $213,200.00. Fund Transfer Motion by Froemming, second by Mosher, and unanimously carried to approve a transfer, in the amount of $264,744.51, from the Capital Improvement Fund to the Road and Bridge Fund for the purpose of reimbursing costs incurred on C.P. 08: 132B. Payment Approval Motion by Mosher, second by Erickson, and unanimously carried to approve Final Payment, in the amount of $1,665.47, from the Ottertail Operation Construction Fund to Cooper's Office Supply for furnishings provided at the Ottertail Operation Center. Mileage Rate Auditor, Wayne Stein, reported that the Internal Revenue Service mileage rate effective January 1, 2009, will be $0.55 per mile. Otter Tail County will follow the IRS rate. Planning Commission Reappointment Motion by Froemming, second by Block, and unanimously carried to reappoint David Trites to the Otter Tail County Planning Commission for a three year term beginning 01/01/2009. OTC Board of Commissioners' Minutes December 16, 2008 Page 8 Cost of Living Adjustment for Non-Union Employees Motion by Mosher, second by Erickson, and unanimously carried to authorize a 3% COLA for non- union employees effective January 1, 2009. County Hiring Freeze Motion by Mosher, second by Block, and unanimously carried to impose an Otter Tail County hiring freeze with the exception of law enforcement effective January 1, 2009. County Hours of Operation Motion by Mosher to set the hours of operation for general offices for Otter Tail County from 8:00 a.m. to 4:30 p.m. allowing one-half hour lunch break for employees. Discussion followed. Commissioner Mosher withdrew the motion. Reduction in the County's Fleet of Vehicles Motion by Mosher, second by Froemming, and carried with Block opposed, to reduce Otter Tail County's fleet of vehicles by 10% over the next three years. Present were Commissioners Erickson, Block, Froemming, and Mosher, County Attorney, County Coordinator, Auditor, Assessor, Land & Resource Management Administrator, Treasurer, Recorder, and Board Secretary. Adjournment At 3:30 p.m., upon conclusion of the Closed Session, Vice-Chairman Erickson declared the meeting of the Otter Tail County Board of Commissioners adjourned until 10:30 a.m. on Thursday, December 18, 2008.
