Call to Order
The Otter Tail County Human Services Board convened Tuesday, October 23, 2007, at 9:30 a.m. at
the Otter Tail County Government Services Center with Commissioners Dennis Mosher, Chair;
Syd Nelson, Vice-Chair, Bob Block, Roger Froemming and Everett Erickson present.
Approval of Agenda
Motion by Froemming, second by Nelson, and unanimously carried to approve the Human Services
Board agenda of October 23, 2007, as mailed.
Approval of Minutes
Motion by Erickson, second by Block, and unanimously carried to approve the Human Services Board
minutes of October 9, 2007, as presented.
Safe Communities Grant
Public Health Director, Diane Thorson, reported that the Safe Communities Grant Contract has been
received, signed and sent back to the State. The grant was approximately $25,000. The Public
Health Department has contracted with Jane Patrick for the coordination work for the grant and also,
subcontracted with Permanent Family Resources for child care clinic services.
Dog Bite Hearing
At 9:35 a.m., Chairman Mosher opened a Public Hearing under the Otter Tail Animal Health Control
Ordinance relating to a border collie cross dog, named Lady, owned by Anita Johnson. County
Attorney, David Hauser, reviewed the facts in the case, and it was determined that in fact, two dog
bites did occur on May 1, 2007, and on September 4, 2007. Two dog bites constitutes the finding that
the dog, Lady, is a danger to the public and the response to protect the public was discussed. Public
Health Director, Diane Thorson, stated that she was notified by the dog owner that the Pelican Rapids
Police Department requires that this dog not be in the city limits. Michael Sonmor, also present at the
meeting, stated that he is the new dog owner of Lady and his property is off Highway 59 by 2½ to
3 miles. Motion by Erickson, second by Block, and unanimously carried to direct the County Attorney
to draft Findings and Order that the ownership of the dog, Lady, is transferred from Anita Johnson to
Michael Sonmor of Erhard, MN, that the dog will be kept away from highways, and will be euthanized
if another dog bite occurs.
Court Services Department
Court Services Director, Chuck Kitzman, provided statistics for the monthly adult-juvenile caseload
dating from 1991 to present. Caseload numbers are increasing; however, the juvenile caseload has
decreased with the adult caseload increasing. Discussion took place as to possible reasons for this
trend. Mr. Kitzman reported 2007 Secure Detention Costs to-date of $74,323.00 and a Secure
Detention 2007 Budget of $54,000, creating a current deficit of $20,323.00.
Human Services Quarterly Report
Human Services Director, John Dinsmore, and Business Director, Leon Anderson, presented the
Human Services Third Quarter Fiscal Report. The report shows a budget deficit of $1,298,900.00.
Mr. Anderson explained that tax revenues will be received in the fourth quarter to bring the budget
close to a neutral position for year end 2008. Discussion took place regarding various programs and
related budgets.

Human Services Contracts
Motion by Mosher, second by Block, and unanimously carried to authorize the Chairman's signature
to execute a contract between the County of Otter Tail and Harmony Larson for the period of July 1,
2007 through June 30, 2008. Harmony Larson provides residential services under the waivered
program for elderly or disabled individuals.
Motion by Froemming, second by Nelson, and unanimously carried to authorize the appropriate
County official's signatures to execute the following contract amendments to provide a 2% cost of
living adjustment effective October 1, 2007:

Motion by Nelson, second by Froemming, and unanimously carried to approve the County Board
minutes of October 16, 2007, as presented.
Approval to Pay Bills
Motion by Erickson, second by Block, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Vergas Multi-Use Trail Project
Motion by Erickson, second by Block, and unanimously carried to authorize the Chairman's signature
to execute a Contract between the County of Otter Tail and Ulteig Engineers, Inc. for the Vergas
Multi-Use Trail TH 228 -Park View Drive to City Beach/Park, S.P. 56-090-005.
Second Amendment to Lease -U.S. Bank
Motion by Block, second by Froemming, and unanimously carried to authorize the appropriate County
officials' signatures to execute the Second Amendment to the Rental Lease between the County of
Otter Tail (Landlord) and U.S. Bank National Association (Tenant) for the period of January 1, 2008
through December 31, 2010.
Chemical Dependency Facility Sublease
Motion by Nelson, second by Block, and unanimously carried to authorize the appropriate County
officials' signatures to execute State of Minnesota Sublease No. 11464 (draft dated 10/19/07)
between the County of Otter Tail and State of Minnesota for the Chemical Dependency Facility.

Motion by Block, second by Froemming, and unanimously carried to authorize the purchase of 24.41
acres of land for the proposed Fergus Falls Transfer Station at a cost of $158,665 and, additionally
the 2nd half taxes of $142.00.

Staffing Discussion -Detention Facility
Motion by Froemming, second by Erickson, and unanimously carried to authorize the Sheriff to fill a
vacant Corrections Sergeant position by the promotion process and advertise for two full time
Correction Officer positions and develop a full time Corrections Officer eligibility list for future
openings.
Ottertail Operations Center Change Order
Motion by Nelson, second by Block, and unanimously carried to authorize Change Order No. CO-2 for
the Ottertail Operations Center Construction Project (No. 0603), in the amount of $24,778.95, for
various general construction changes.
County Credit Card Approval
Motion by Nelson, second by Froemming, and unanimously carried to approve the following
application for an Otter Tail County Credit Card:

Commissioner Froemming offered the following and moved its adoption:
WHEREAS, the City of Fergus Falls has submitted for consideration by the Otter Tail County
Board of Commissioners an Application by a Governmental Subdivision for Conveyance of Tax-
Forfeited Land for an Authorized Public Use, and
WHEREAS, the following described parcel forfeited on Monday, July 21, 2006:

West Half of State Su blot 4 of the West Half of Section 2 South of Railroad

WHEREAS, the City of Fergus Falls desires to acquire this parcel for the purpose of creating a
public garden area and as such, will be considered public park property, and
WHEREAS, the Otter Tail County Board of Commissioners has reviewed the above noted
application of the City of Fergus Falls, dated Monday, October 7, 2007, for the conveyance of the
above-described property for an authorized public use.
NOW THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby recommends to the Minnesota Department of Revenue that the application as submitted by
the City of Fergus Falls be granted.

Payment Approval
Motion by Nelson, second by Froemming, and unanimously carried to approve payment, in the
amount of $1,143.00, to NACO (National Association of Counties} for membership dues for calendar
year 2008.
Petition for County Ditch #25
Auditor, Wayne Stein, presented a Petition and attached Engineering Report requesting an outlet into
Otter Tail County Drainage Ditch #25 on behalf of the Little McDonald, Kerbs and Paul Lakes
Improvement District.
Recess
At 12:05 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break.
Closed to the Public
At 1 :08 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners reconvened and closed to the public for purposes of discussing labor negotiation
strategies relative to the Nurses Professional and Human Services Support Specialist Unions.
Present were all five seated Commissioners, Public Health Director, County Attorney, County
Coordinator and Board Secretary.
Adjournment
At 2:18 p.m., upon conclusion of the closed session, Chairman Mosher declared the meeting of the
Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, October 30, 2007.
