HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/15/2007MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, May 15, 2007 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, May 15, 2007, at 9:31 a.m. at the Otter Tail County Government Services Center with Commissioners Dennis Mosher, Chair; Syd Nelson, Vice-Chair; Bob Block, Roger Froemming, and Everett Erickson present. Approval of Agenda Motion by Nelson, second by Erickson, and unanimously carried to approve the County Board Agenda of May 15, 2007, with the following addition: Under Land & Resource Director Items -Request for Approval of Final Plats Approval of Minutes Motion by Froemming, second by Block, and unanimously carried to approve the County Board Minutes of May 8, 2007, as mailed. Approval to Pay Bills Motion by Erickson, second by Block, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Approval of Hospital Van Drivers to be County Employees Veterans Services Director, Jourdan Sullivan, requested that eight Hospital Van Driver volunteers be classified as intermittent employees similar to the current Bailiff positions. Motion by Erickson, second by Froemming, and unanimously carried to designate eight current VSO Hospital Van Driver Volunteers as intermittent Otter Tail County employees as described above. Drug Court Update County Attorney, David Hauser, briefed the Board on Drug Court training. Many interested parties attended the three day training. He discussed positives and negatives of the Drug Court systems in other counties. A presentation regarding Drug Court may be the next step in the process of starting the program in Otter Tail County. Liguor License Applications Motion by Nelson, second by Froemming, and unanimously carried to approve the following applications for license: Battle View Landing Henning, MN St. Lawrence Church Perham, MN Zorbaz of Little Pine Lake, Inc. Perham, MN On-Sale Wine License On/Off-Sale 3.2 Malt Liquor Temporary On-Sale 3.2 Malt Liquor Sunday -August 5, 2007 On-Sale Liquor and Sunday Liquor OTC Board of Commissioners' Minutes May 15, 2007 Page 2 Private Sale of Property Motion by Erickson, second by Block, and unanimously carried to establish Friday, June 29, 2007, as the sale date for the private sale of the following described parcel of tax forfeited property and to establish the opening bid price for said sale at $3,700 plus special assessment certified prior to and after forfeiture: Parcel 22-000-99-0506-000 Lot 3 and an Undivided 1/13 Interest in Reserve Lot A Long View Acres Tax Forfeited August 13, 1992 Otter Tail Water Management District Board Motion by Nelson, second by Froemming, and unanimously carried to appoint Cynthia Dean of Battle Lake, MN, to a four year term on the Otter Tail Water Management District Board. Cynthia Dean would be replacing Dave Thompson effective June 1, 2007. Credit Card Application Motion by Mosher, second by Erickson, and unanimously carried to approve the following application for a County Credit Card: Rebekah Jane Lee Human Services $1,000.00 Limit Recess & Reconvene At 10:23 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of Commissioners recessed for Committee Meetings. The meeting was reconvened at 11:00 a.m. Planning Commission Recommendations Preliminary Plat -"Echo Bay Estates''/Homeland Investment Co. No. 1: Motion by Erickson, second by Nelson, and unanimously carried to approve the Preliminary Plat known as "Echo Bay Estates" consisting of 9 lots with conditions as recommended by the Planning Commission. The property is described as Pt of GL 1 & pt of NE¼ NE¼ (21.72± AC), Section 20 of Dunn Township; Fish Lake (56-768), GD & Unnamed Lake (56-771) NE. Conditional Use Permit-Mariorie Latham Tst: Land & Resource Director, Bill Kalar, stated that the Planning Commission recommended denial of the request to replace the existing stone and mortar wall with retaining wall blocks. Contractor, Terry Lee, stated that the Planning Commission had an issue with compatibility; however, after an additional viewing of the site, he states that there are 6-7 lots to the East that all have similar type of retaining walls with stone or block holding the water back. He stated that his assessment of the amount of beach was about 8 ft. not 2 ft. as mentioned by the Planning Commission. He suggested that the block not be dug out as the depth is hard to tell, but requested rebuilding the wall and placing the blocks on top. Mr. Kalar spoke in favor of a riprap type of alternative as block retaining walls often fail. Another option would be the planting of vegetation which is a new concept with some consultation expertise available through the SWCD. Motion by Block, second by Erickson, to table this Conditional Use Permit request of Marjorie Latham Trst to replace a retaining wall until after Mr. Kalar OTC Board of Commissioners' Minutes May 15, 2007 Page 3 has another opportunity to view the area. The Chairman called for a vote. Motion passed 4 - 1 with Mosher opposed. The property is described as Pleasure Park Beach Lots 62 & 63, Section 4 of Otter Tail Township; Otter Tail Lake (56-242), GD. Conditional Use Permit -Nathan & Jennifer Weixel: Motion by Erickson, second by Block, and unanimously carried to deny a Conditional Use Permit for Nathan & Jennifer Weixel to create an elevated sand area for the reasons listed in the May 9, 2007, Planning Commission minutes. The property is described as Lot 4 Blk 2 Mooring Stone Addition, Section 16 of Dunn Township; Fish Lake (56-768), GD. Conditional Use Permit -David & Margret Aaberg: Motion by Erickson, second by Froemming, and unanimously carried to remove rotted timber cribs and restore the bank back to the original natural slope and replant to native vegetation with a condition as recommended by the Planning Commission. The property is described as Lot 8 Stony Bar Estates, Section 32 of Lida Township; Lake Lida (56-747), GD. Preliminary Plat and Conditional Use Permit -"Birchwood Park'1/Jean Kirby: Motion by Erickson, second by Block, and unanimously carried to approve the Preliminary Plat known as "Birchwood Park" consisting of a maximum of 8 lots as presented in the revised plan and a Conditional Use Permit to construct a road to service the plat with conditions as recommended by the Planning Commission. The property is described as Pt GL 10 (5 AC) & Lot 1 O lying S & W of Hwy 41 ex tr (15 AC), Section 9 of Star Lake Township; Star Lake (56-385), GD. Conditional Use Permit-Rav Sazama: Motion by Nelson, second by Block, and unanimously carried to approve a Conditional Use Permit to build a driveway as presented. The property is described as GL's 3 & 4 ex tr & N½ SE¼, NE¼ SW¼ & SW¼ NW¼, Section 13 of Edna Township; Ceynowa Lake (56-337), GD. Conditional Use Permit-Matthew Volkers: Motion by Froemming, second by Block, and unanimously carried to approve a Conditional Use Permit to build a driveway and excavate for a walkout basement for a house with conditions as recommended by the Planning Commission. The property is described as a 5.16 acre tr in GL 3 AKA tr 16, Section 18 of Everts Township; Silver Lake (56-302), RD. Lake Runners Trail Association Otter Tail County Resolution No. 2007 -42 Commissioner Erickson offered the following and moved its adoption: WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the review and approval of the County Attorney. THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In- Aid Trail Systems as they exist for the Lake Runners Trail Association and proposed extensions of Grant-In-Aid Trails with the aforementioned condition. THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In- Aid Trail Systems as they exist for the Prairie Snow Drifters Snowmobile Club and proposed extensions of Grant-In-Aid Trails with the aforementioned condition. This is necessary because the federal government operates on a fiscal year from October to October. Approval of Final Plats Motion by Erickson, second by Block, and unanimously carried to approve the Final Plat of William and Marjorie Haggart entitled "Haggart's Addition" consisting of 2 backlots in Section 4 of Dunn Township; Pelican Lake, 56-786. OTC Board of Commissioners' Minutes May 15, 2007 Page 5 Motion by Erickson, second by Froemming, and unanimously carried to approve the Final Plat of Michael Phillips entitled "Lorene Shores" consisting of 2 lake lots in Section 11 of Elizabeth Township; Long Lake, 56-784. Motion by Nelson, second by Erickson, and unanimously carried to approve the Final Plat of Charlie Kirchenwitz entitled "Charlie's Beach 2nd Addition" in Section 28 of Edna Township; Tenter Lake, 56-348 and North Rice Lake. Summer Staff Motion by Nelson, second by Erickson, and unanimously carried to authorize the Recorder to proceed with hiring a summer position in the Recorder's Office for data entry of information that will match the microfilm images already in the computer system. Technology Funds will be used to pay for the summer position. Recess & Reconvene At 11 :46 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. At 1 :08 p.m., Chairman Mosher reconvened the meeting with Commissioners Mosher, Froemming, Block, and Erickson present and Vice- Chair Nelson absent. Minnesota Counties Insurance Trust 2007 Member Report MCIT Account Executive, Bruce Underdahl, presented the 2007 Member Report for Otter Tail County. Mr. Underdahl discussed the value of being proactive in the area of risk management, MCIT's financial strength, workers compensation, and the issues surrounding Joint Powers Board and Mutual Aid Agreement arrangements. Closed to the Public At 1 :36 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of discussing labor negotiation strategies relative to the Public Health Nursing Unit and a request to form a new Clerical Unit in the Public Health Department. Present were Commissioners Mosher, Erickson, Block, and Froemming, the County Attorney, County Coordinator, and Recording Secretary. - Adjournment Upon conclusion of the closed session at 2:02 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, May 22, 2007.
