HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/08/2007MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, May 8, 2007 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, May 8, 2007, at 9:31 a.m. at the Otter Tail County Government Services Center with Commissioners Dennis Mosher, Chair; Bob Block, Roger Froemming, and Everett Erickson present. Vice-Chair, Syd Nelson, was absent. Approval of Agenda Motion by Froemming, second by Erickson, and unanimously carried to approve the Human Services Board Agenda of May 8, 2007, as mailed. Approval of Minutes Motion by Block, second by Froemming, and unanimously carried to approve the Human Services Board Minutes of April 24, 2007, as presented. Emergency Preparedness Public Health Director, Diane Thorson, attended an Emergency Preparedness Conference recently and presented the Code Ready Campaign to the Board. The Code Ready Campaign focuses on educating the public on the need to have emergency supplies on hand such as batteries, first aid supplies, bottled water and stored food. Emergency Services Director, Tiny Holm, will facilitate completion of a Continuity of Operations Plan which will be submitted to Homeland Security. PHN, Ann Gibbs, has completed the first draft of the Pandemic Flu Outbreak Plan. There will be 20 minute messages regarding Emergency Preparedness given through the local TV stations in many different languages. Code Ready information will also be incorporated into the monthly Safety Newsletter to inform County employees. Human Services Contract Renewal Motion by Block, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between the County of Otter Tail and Gull Harbor to provide Intensive Residential Treatment & Crisis Stabilization Program for adults who have severe emotional disturbance. Funding sources are Medical Assistance, PMAP, and the County of Financial Responsibility. HS Legislative Update Human Services Director, John Dinsmore, submitted a Legislative Update from MACSSA dated May 7, 2007. He noted that County-Based Purchasing did not get included in the Health & Human Services final bill. Mr. Dinsmore identified a movement in the legislature to cover more people under Minnesota Care proposed changes as well as challenges that exist with the MFIP Program and proposed county performance penalty. Correspondence Acknowledged Chairman Mosher acknowledged a letter from an Audit Coordinator regarding the findings from the 12/31/05 Human Services audit wherein there are no applicable unresolved findings; therefore, there will be no need to submit a Corrective Action Plan. OTC Board of Commissioners' Minutes May 8, 2007 Page 2 Children's Local Advisory Council Report The Children's Mental Health Local Advisory Council reported on the current structure of the committee and their goal of supporting positive family relationships to create healthier children. Kathy Lorsung, Chairperson of the LAC, brings consumer issues to the committee. Psychologist, Eldon Linscheid, spoke of the importance of early intervention and State of Minnesota Nursing Consultant, Sue Ewy, spoke about State and regional partnerships and three days of training recently provided regarding children's mental health. Mr. Dinsmore presented Eldon Linscheid with an appreciation plaque for his many years of service in the mental health field and with the Children's MH Local Advisory Council. Mr. Linscheid has been a member of the Council since its inception in 1989. Bills & Claims Motion by Erickson, second by Block, and unanimously carried to approve the Human Services bills and claims as presented. Vice-Chairman, Syd Nelson, was absent. Approval of Agenda Motion by Erickson, second by Froemming, and unanimously carried to approve the County Board agenda of May 8, 2007, with one added discussion item as follows: Drug Court Training Approval of Minutes Motion by Froemming, second by Erickson, and unanimously carried to approve the County Board minutes of May 1, 2007, as mailed. Approval to Pay Bills Motion by Block, second by Erickson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Lead Agency Resolution OTC Board of Commissioners' Minutes May 8, 2007 Page 3 Authorizing Execution of Agreement Otter Tail County Resolution No. 2007 -41 Commissioner Erickson offered the following and moved its adoption: Be it resolved that the Otter Tail County Sheriffs Office enter into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety for the project entitled SAFE & SOBER COMMUNITIES during the period from October 1, 2007 through September 30, 2008. The Sheriff of Otter Tail County is hereby authorized to execute such agreements and amendments as are necessary to implement the project on behalf of the Otter Tail County Sheriff's Office and to be the fiscal agent and administer the grant. Commissioner Froemming seconded the resolution which, upon being put to vote, was unanimously adopted. Program for an outstanding job relating to the kids and facilitating their involvement. Drug Court Training Attorney, David Hauser, briefed the Board on a seminar in Moorhead that will be attended by Probation Officers, Attorneys, Judges, and others in the Corrections Field to learn how other counties have established Drug Court. He stated that Stearns County received grants and the Drug Court program did require additional staff. He stated that the County Board will receive a report from the attendees. Motion by Froemming, second by Mosher, and unanimously carried to authorize Commissioner Everett Erickson to attend this Drug Court Training along with the other County personnel. Approval of License Applications Motion by Froemming, second by Erickson, and unanimously carried to approve .the following applications for license: Elizabeth General Store Elizabeth, MN Tom's Amoco Henning, MN Vee Villa Resort Prtner Wee Villa Lodge Fergus Falls, MN Tobacco Off-Sale 3.2 Malt Liquor On/Off -Sale 3.2 Malt Liquor OTC Board of Commissioners' Minutes May 8, 2007 Page 4 Bid Opening -2007 County Wide Traffic Marking After previously advertising for bids, the Highway Engineer opened the following bids for the 2007 County Wide Traffic Marking project as follows: Vendor Traffic Marking Services, Inc. Maple Lake, MN Tri-State Striping, Inc. West Fargo, ND Bid Amount $209,653.46 $216,065.12 AAA Striping Service Co. $222,884.70 Rogers, MN Motion by Mosher, second by Block, and unanimously carried to award C.P. 07:TM, 2007 County Wide Traffic Marking Project to the low bidder, Traffic Marking Services, Inc. of Maple Lake, MN, in the amount of $209,653.46. South Turtle Lake Storm Water Sewer System Project Assistant Highway Engineer, Chuck Grotte, briefed the Board on the South Turtle Lake Storm Water Sewer System Project. Attorney, David Hauser, stated that the Board can waive the strict requirement of the bid conditions as the project is an emergency because of the potential damage to property and is in the best interest of public health, safety, and welfare to proceed with a shortened bidding period. Motion by Erickson, second by Block, and unanimously carried to establish the Bid Opening for the South Turtle Lake Storm Water Sewer System Project at 1 :00 p.m. cin May 30, 2007. Motion by Block, second by Erickson, and unanimously carried to authorize this project to move forward as described to protect damage to property. Crooked Lake Outlet Project Viewers' Report Ditch Inspector, Randy Wasvick, handed out the Crooked Lake Viewers Report dated May 4, 2007. Lengthy discussion took place regarding the acreage, the fact that these dollars will be spread out over the entire Ditch No. 21 System, and the upcoming Public Hearing for the project. Ditch No. 37 Mr. Wasvick reported on a concern by Underwood Mayor, Bert Kinzler. Ditch No. 37 comes out of a wetland in Underwood, flows to a manhole, then flows along one street and under CR 35 and into another wetland. Mr. Wasvick reported that from the manhole along the street and under CR 35, the pipe was too small and a larger pipe was installed. The Mayor stated that this is a County Ditch and has asked that the County pay for part of the cost for the installation of the larger pipe. Lengthy discussion took place regarding the situation. A meeting with the Mayor of Underwood, County Attorney, Ditch Inspector, and Assistant Highway Engineer will be scheduled and a report brought back to the County Board. Recess & Reconvene At 11 :36 a.m., Chairman Mosher recessed the meeting of the Otter Tail County Board of Commissioners for a Personnel Committee meeting, Budget Committee meeting and lunch break. The meeting was reconvened at 1 :15 p.m. OTC Board of Commissioners' Minutes May 8, 2007 Page 5 U.S. Fish & Wildlife Acquisition of Lands US Fish & Wildlife Realty Specialist, Don Kleven, requested certification of a fee purchase acquisition of lands of approximately 160 acres in the SE quarter of Section 32 of Nidaros Township. This property will add to the waterfowl production area that adjoins the property to the North. · 11 consists of approximately 100 acres of cropland and the balance in wetlands and woods. Mr. Kleven reported that the property currently is taxed at $872 per year and through shared revenue, the U.S. Fish & Wildlife Service will be paying $1,332.00 annually. Motion by Froemming, second by Block, and unanimously carried to certify the following acquisition of land by the U.S. Fish & Wildlife Service: Arneson, David 0., et al T. 132N. R. 39W. 5th P.M. Section 32, SE¼ Adjournment At 1 :20 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of Commissioners recessed for a Solid Waste Committee meeting and at 1 :30 p.m., Chairman Mosher declared the Otter Tail County Board of Commissioners' meeting adjourned until 9:30 a.m. on Tuesday, May 15, 2007.
