Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, April 17, 2007, at
9:30 a.m. at the Otter Tail County Government Services Center with Commissioners
Dennis Mosher, Chair; Bob Block, Roger Froemming, and Everett Erickson present. Vice-
Chair Syd Nelson was absent.
Approval of Agenda
Motion by Froemming, second by Erickson, and unanimously carried to approve the County
Board Agenda of April 17, 2007, with the following additions:
10:15 a.m. -South Turtle Lake Project
10:20 a.m. -Solid Waste Department Correspondence
11 :45 a.m. -County Coordinator
Approval of Minutes
Motion by Froemming, second by Erickson, and unanimously carried to approve the County
Board Minutes of April 10, 2007, as mailed.
Approval to Pay Bills
Motion by Block, second by Erickson, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
April as Organ & Tissue Donor Month
Kay Johnson, representing 2nd Chance "A Gift of Life" and Life Source, provided facts about
organ and tissue donation and the constant need for donors. There are currently 94,775
patients on the National Waiting List. She requested approval of the following proclamation
to create donor awareness:

Commissioner Froemming offered the following and moved its adoption:
WHEREAS, when individuals donate their organs, the lives of up to 7 people can be saved
and donation of tissue can save or enhance the lives of up to 50 others, and
WHEREAS, in the United States more than 95,000 people are waiting for an organ
transplant, while 17 people _die each day waitin'g, and
WHEREAS, we call upon health care professionals, volunteers, educators, government
agencies, faith-based and community groups, and private organizations to help raise
awareness of the urgent need for organ and tissue donors throughout Otter Tail County.

NOW, THEREFORE, WE, the comm1ss1oners of Otter Tail County, by the virtue of the
authority vested in us, do hereby proclaim April to be "Organ and Tissue Donate Life Month"

donation and transplantation and consider becoming a potential lifesaving donor and sharing
your decision with your family members.
Commissioner Block seconded the resolution, which, upon being put to vote, was
unanimously adopted.

Correctional Officers' Week Proclamation
Otter Tail County Resolution No. 2007 -30
Commissioner Erickson offered the following and moved its adoption:
WHEREAS, one week each May is officially designated as Correctional Officers' Week by the
American Jail Association. This year, Correctional Officers' Week is May 6-12, 2007:
WHEREAS, the Sheriffs Office supports the proposition that the men and women who
perform the difficult task of supervising the County's inmates deserve this recognition;
WHEREAS, the Sheriffs Office recognizes that Corrections staff are professionals equal in
status and importance to other professionals in the effective administration of justice;
THEREFORE, BE IT RESOLVED, that we, the Otter Tail County Board of Commissioners,
do hereby acknowledge the week of May 6-12, 2007 as "Correctional Officers' Week" in
Otter Tail County in honor of the dedicated professionals who supervise the County's inmate
population.
Commissioner Block seconded the resolution, which, upon being put to vote, was
unanimously adopted.

At 9:49 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 9:54 a.m.
Application for Cancellation of Forfeiture
Otter Tail County Resolution No. 2007 -31
Upon motion by Froemming, second by Erickson, and unanimously carried, the Otter Tail
County Board of Commissioners adopts the following resolution:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, on September 18, 1968, a County Auditor's Certificate of Forfeiture was issued
on the following legally described parcel:
East 93' of Lot 22 Block 2
Soule's 2nd Addition to Deer Creek, Minn.
WHEREAS, on September 19, 1968, a County Auditor's Certificate of Forfeiture was
recorded with the Otter Tail County Recorder on Pages 569 though 572, Book 67 of
Miscellaneous and more specifically noted as Document Number 480764.
WHEREAS, the above referenced legal description can be found on Page 571 Book 67 of
Miscellaneous.
WHEREAS, the Otter Tail County Auditor has reviewed the tax liens books for the period of
1960 through 1970, which are located in County Auditor's storage room in the Government
Services Center basement, and
WHEREAS, the Otter Tail County Auditor has also reviewed the tax rolls for the period of
1960 through 1970, which are located at the Otter Tail County Historical Museum in Fergus
Falls, Minnesota.
WHEREAS, the Otter Tail County Auditor's review of the above referenced documents (liens
book marked redeemed and tax rolls marked paid) strongly supports a position that past due
taxes on the above referenced parcel for the period 1961 through 1968 were paid prior to the
filing of the above referenced County Auditor's Certificate of Forfeiture.
WHEREAS, it is important to note the following: 1.) the above described parcel was not
offered for sale at a public tax forfeited land sale after 1968, 2.) there is no evidence that the
parcel was repurchased, and 3.) the tax rolls indicated that the parcel remained in private
ownership after the County Auditor's Certificate of Forfeiture was filed.
NOW, THEREFORE BE IT RESOLVED, that the above legally described parcel was
erroneously included in the County Auditor's Certificate of Forfeiture dated September 18,
1968, as recorded in the Otter Tail County Recorder's office on September 19, 1968, on
Pages 569 through 572 of Book 67 and as more specifically known as Document Number
480764.

BE IT FURTHER RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves of the County Auditor's Application for Cancellation of Forfeiture of the above
legally described property and request that the Minnesota Department of Revenue accept

Classification of Tax Forfeited Land and Request for DNR Approval
Otter Tail County Board Resolution No. 2007 -32
Upon a motion by Erickson, second by Froemming, and unanimously carried, the Otter Tail
County Board of Commissioners adopts the following resolution:
WHEREAS, The County Board of Commissioners of the County of Otter Tail, State of
Minnesota, desires to offer for private sale the following described parcels of land that have
forfeited to the State of Minnesota for non-payment of taxes:
Parcel 22-000-99-0506-000
Long View Acres
Lot 3 and an undivided 1/13 interest in Reserve Lot A
Tax Forfeited August 13, 1992
WHEREAS, said parcel of land have been considered and viewed by the County Board of
Commissioners and has been classified as non-conservation lands as provided for in
Minnesota Statutes 282.01, and
WHEREAS, on Thursday, March 8, 2007, the Otter Tail County Land and Resource
Department stated that the above described parcel is an unbuildable lot due to substandard
lot size (40,700 square feet) and substandard lot width (108.72), and
WHEREAS, on Tuesday, April 10, 2007, Elizabeth Township passed a motion approving the
sale of the above described property at a private sale to adjacent landowners, and
WHEREAS, on Thursday, March 8, 2007, the Otter Tail County Land and Resource
Department stated that Lot 3 is a substandard back lot based on the lot size requirements of
the Otter Tail County Shoreland Management Ordinance and is an unbuildable lot due to
substandard lot size (40,700 square feet) and substandard lot width (108.72), and
WHEREAS, the highest and best use of the above described property can be achieved by
adding it to an adjoining parcel thereby increasing the usability and value of one of the
adjoining properties.

NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners
hereby certifies that the above referenced parcels of land have been considered, visually
viewed on a map and complies with the provisions of Minnesota Statutes 85.012, 92.461,
282.01 Subd. 8 and 282.018 and other statutes that require the withholding of tax-forfeited
lands from sale.
BE FURTHER RESOLVED, That the Otter Tail County Board of Commissioners hereby
request approval from the Minnesota Department of Natural Resources for the private sale to
adjacent landowners of the above described property.

Motion by Froemming, second by Block, and unanimously carried to approve the following
applications for the issuance of an Otter Tail County Credit Card:

amount of $20,000.00, to the East Otter Tail Soil and Water Conservation District for the

Approval of Contract-Seasonal Highway Supplies
Motion by Froemming, second by Block, and unanimously carried to authorize the
Chairman's signature to execute a contract between the County of Otter Tail and Wadena
Asphalt, Inc. of Wadena, MN, for East Otter Tail Seasonal Supply of Hot Mix Bituminous
Material for the 2007 construction season, subject to the approval of the County Attorney.
DNR Dam Safety Program -Grant Agreement
Otter Tail County Resolution No. 2007 -33
Upon a motion by Mosher, second by Froemming, and unanimously carried, the Otter Tail
County Board of Commissioners adopts the following resolution:
IT IS RESOLVED that the Otter Tail County Board of Commissioners, hereinafter referred to
as the "Applicant", act as legal sponsor for the project described in the Department of Natural
Resources Dam Safety Program grant application.
IT IS FURTHER RESOLVED that the Applicant has the legal authority to apply for financial
assistance, and the institutional, managerial and financial capability to carry out the project.
IT IS FURTHER RESOLVED that the Applicant has not violated any federal, state, or local
laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other
unlawful or corrupt practice.
IT IS FURTHER RESOLVED that upon approval of its application by the State, the Applicant
may enter into an agreement with the State for the above-referenced 'project, and that the
Applicant certifies that ii will comply with all applicable laws and regulations as stated in the
grant agreement.
NOW, THEREFORE, IT IS RESOLVED that Richard West, County Engine!'lr, is hereby
authorized to execute the Dam Safety Program grant agreement and act as the Applicant's
authorized agent for the purpose of administration of the grant.

South Turtle Lake Project
Crooked Lake Outlet/County Ditch No 21 Project
Highway Engineer, Rick West, reported that the Highway Department is working on obtaining
the easements necessary for the South Turtle Lake Project. He stated that the culvert under
Highway 122 is running about 5" deep and will be slowed down to 3" deep. South Turtle
Lake is up significantly and possibility of pumping until the project can be accomplished was
discussed. Mr. West reported completion of the project, in the best case scenario, as the end
of May -middle of June, timeline. The possibility of declaring temporary pumping by the

South Turtle Lake Improvement District as part of the total Storm Sewer Project was
discussed.
Mr. West briefed the Board on the Crooked Lake Outlet/County Ditch No. 21 project and the
potential need to close County Highway 18 temporarily.
Proposed Transfer Station
Solid Waste Director, Mike Hanan, provided correspondence he had received from the
Minnesota Pollution Control Agency. He presented a draft response to this correspondence
and requested the Board's permission to send the draft letter. By consensus, the Board
supported the draft letter with a few clarifications. Mr. Hanan also briefed the County Board
regarding the permit and public notice process.
Agriculture Research Update
University of Minnesota Extension Service Regional Educators, Doug Holen and
Phil Glogoza, briefed the County Board on agriculture throughout the Northwest Regional
Center. They described many agriculture projects including pesticide application training,
disease management, winter wheat production, soybean production, soil science, water
management and biofuel production.
Planning Commission Recommendations
Conditional Use Permit -Mike & Wanda Beaton:
Motion by Froemming, second by Block, and unanimously carried to approve a Conditional
Use Permit for topographical alterations for a new home site as submitted in a revised plan
dated March 6, 2007, with conditions as recommended by the Planning Commission. The
property is described as Survey Lots of GL 10, 87.8' on Lk (called Lot 11A) & Survey Lots of
GL 10, 100' on lake x 110' in rear called Lot 12A & pt of Lot 13A, Section 7 of Hobart
Township; Scalp Lake (56-358), RD.
Preliminary Plat-"Twin Island Estates"/Ted Bergeron:
Motion by Erickson, second by Froemming, and unanimously carried to approve the
Preliminary Plat of Ted Bergeron known as "Twin Island Estates" as presented on the revised
drawing/plan received at the April 11, 2007, Planning Commission meeting and consisting of
13 single family residential lots with a condition as recommended by the Planning
Commission. The property is described as Pt GL 3 & 4 (47AC), Section 30 of Edna
Township; Big McDonald Lake (56-386), RD and Archie Lake (56-1629), RD.
Conditional Use Permit -Middle Leaf Pleasure Grounds CIC #43/Red Barn Investments:
Motion by Block, second by Froemming, and unanimously carried to deny a Conditional Use
Permit for improvements at this resort due to lack of Applicant representation, as
recommended by the Planning Commission. The property is described as Trs in GL 3, 4 & 5
being pt of Middle Leaf Resort including abandoned Rd (.72 AC) and Lots 6, 7, 8 & 9 Blk 5
Leaf Lakes Pleasure Grounds, Section 22 of Leaf Lake Township; East Leaf Lake (56-116),

Preliminary Plat & Conditional Use Permit -"Oakwood Shores" (Changed to "Oakwood Shores on

Motion by Mosher. second by Erickson. and unanimously ca·rried to approve a Preliminary
Plat entitled "Oakwood Shores On Silver Lake" · (Developer -Secluded Land Co.) as
presented in a revised plan dated March 15. 2007 and to approve a Conditional Use Permit
to service the plat. The property is described as GL 1 ex NL Y 1320' & pt GL 2 & 3 lying N &
W of cent. C.A.R.#4 (47.45 AC) and E1/2 NW1/4 & NL Y 1320' of GL 1 (120 AC), Section 17,
Everts Township; Silver Lake (56-302), RD.
Conditional Use Permit-Terry L. Jensen Sr:
Land & Resource Director, Bill Kalar, stated that this CUP is for operating a marine repair
business and the Planning Commission approved the request with three conditions.
Attorney, John Halling, representing Gordon and Marjean Hanson, referred to a letter of
objection dated April 13, 2007, and urged the Board of Commissioners to deny the
application for the reasons stated in the letter. Property owner, Carol Swiontek, objected to
signage and setting a precedence of allowing this type of business in a typically residential,
shoreland area. Terry Reard, property owner across the lake, urged objection to the CUP
because of precedence of a marine business on the lake. Applicant, Terry Jensen, stated
that there will not be signage. He presented pictures of the property and stated that he has
been doing some housecleaning. Mr. Jensen stated he would be doing this work on a one-
on-one basis and by appointment. He stated that 22 out of 24 dwellings on his road are in
favor of the business and that there are 85 positive signatures of people in favor. Motion by
Froemming, second by Block to deny the Conditional Use Permit request of Terry L. Jensen
Sr. to operate a marine repair business for the following reasons: 1) Marine repair business
is incompatible with the surrounding area and not appropriate to have a mechanics garage
that has potential to spill oil, gas, grease, antifreeze and hazardous materials. 2) This
business has the potential for noise pollution because of the power tools and testing of
motors that would be necessary. 3) There is not sufficient room for storage for boats and
trailers that are part of this kind of a business and could result in congestion. 4) The County
Board is charged with maintaining clear water around the lakes. The property is described as
Pt GL 5 bg 1012' S of NW cor, (.36 AC), Section 11 of Maine Township; Pickerel Lake

Preliminary Plat & Conditional Use Permit -"Sisters Three'1/Jane Meads et al & Caro/lee
Vernon Balloun:
Motion by Erickson, second by Block and unanimously carried to deny the Preliminary Plat
entitled "Sisters Three" and to deny the Conditional Use Permit for a road to service the plat
for the reasons as stated in the Planning Commission minutes dated April 11, 2007. The
property is described as Pt of GL 5, (formerly Lake View Resort), Section 3 of Nidaros
Township; Stuart Lake (56-191), RD.
Conditional Use Permit-Hobart Township/Tim Courneya:
Motion by Erickson, second by Block, and unanimously carried to approve a Conditional Use
Permit for topographical alterations as presented in a revised drawing (received at the
April 11, 2007, Planning Commission meeting) with conditions as recommended by the
Planning Commission. The property is described as Gov't Lot 11, Section 7, tract in the SLY
pt of GL 7 easterly of East Lake Seven Road, Section 8 and East Lake Seven Road in Hobart
Township; Scalp Lake (56-358), RD.
Approval of Labor Agreement
Motion by Froemming, second by Block, and unanimously carried to authorize the
appropriate County officials' signatures to execute a Labor Agreement between the County of
Otter Tail and the Minnesota Teamsters Public and Law Enforcement Employees' Union,
Local No. 320 representing the Facilities Maintenance Employees for the period of January 1,
2007 through December 31, 2007.
