Call to Order
The Otter Tail County Human Services Board convened Tuesday, March 13, 2007, at
9:32 a.m. at the Otter Tail County Government Services Center with Commissioners
Dennis Mosher, Chair; Syd Nelson, Vice-Chair; Bob Block, Roger Froemming, and
Everett Erickson present.
Approval of Agenda
Motion by Nelson, second by Block, and unanimously carried to approve the Human Services
Board Agenda of March 13, 2007, with the following change:
Cancel the Contract Renewal Agenda Item
Approval of Minutes
Motion by Erickson, second by Froemming, and unanimously carried to approve the Human
Services Board Minutes of February 27, 2007, as presented.
Court Services Department
Court Services Director, Chuck Kitzman, provided membership of the Otter Tail Family
Services Collaborative effective June, 2006. He stated that the Collaborative's annual
meeting is scheduled at 6:00 p.m. on June 5, 2007, at Thumper Pond. Mr. Kitzman also
reported that the Court Services Advisory Board will meet on Tuesday, March 20, 2007, at
4:00 p.m. and Commissioners are invited.
OTTER TAIL COUNTY FOOD STAMP ENHANCED FUNDING
March 13, 2007
Otter Tail County Resolution No. 2007 -16
Upon a motion made by Nelson, seconded by Block, and unanimously carried, the following
resolution was offered by the Otter Tail County Human Services Board:
o WHEREAS, Minnesota is receiving additional federal funding due to the state's
high accuracy rate in operating the Food Support Program.
o WHEREAS, each of the 87 Minnesota counties will receive these funds for
program improvement.
o WHEREAS, Otter Tail County has already received our enhanced funding,
totaling$ 17,835.71.
o WHEREAS, Guidelines for expending the funds have been set forth by the
Minnesota Department of Human Services, as follows: " to be used to maintain
or improve administration of the Food Stamp or Minnesota Family Investment
Programs ... There are no requirements for counties to match this money. It is
a bonus for outstanding performance."
o WHEREAS, we must submit a written report to the Minnesota Department of
Human Services indicating how we will expend the funds.

□ WHEREAS, The Otter Tail County Department of Human Services has
determined that utilization of such funds will be used, in part, to fund an
additional financial worker position, renovation of our New York Mills income
maintenance program offices, or both.
□ WHEREAS, Said recommendations are being presented to the Human Services
Board on March 13, 2007.
NOW, THEREFORE, BE IT RESOVLVED, that the Otter Tail County Human Services Board
recognizes and expresses gratitude and appreciation to all members of the Income
Maintenance Unit Programs. The receipt of this Food Stamp Enhanced Funding is due to the
excellent performance of all staff who are responsible for providing food stamp services and
benefits to residents of Otter Tail County.

Volunteer Transportation Program
Human Services Case Aide, Laura Hillman, updated the Board on the Volunteer
Transportation Program. She reported that there are 65 volunteer drivers who have driven
68,741 miles providing needed transportation for County residents, mostly for medical
appointments. Health care providers reimburse mileage and administrative costs for the
program.
Child Abuse Prevention Proclamation
Otter Tail County Resolution No. 2007 -17
Upon a motion made by Erickson, seconded by Block, and unanimously carried, the following
resolution was offered by the Otter Tail County Human Services Board:
WHEREAS, child abuse prevention is a community problem and finding solutions depends
on involvement among people throughout the community;
WHEREAS, the effects of child abuse are felt by whole communities and need to be
addressed by the entire community.
WHEREAS, effective child abuse prevention succeeds because of partnerships created
between parents, practitioners, schools, faith communities, health care organizations, law
enforcement agencies, and the business community.
WHEREAS, family-serving, youth-focused prevention programs offer positive alternatives for
young people and encourage parents and youth to develop strong ties to their communities;

WHEREAS, all citizens need to be more aware of child abuse and neglect and its prevention
within the community, and be involved in supporting parents to raise their children in a safe,
nurturing society.
NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners
hereby proclaim April 2007 as Child Abuse Prevention Month in Otter Tail County, and call
upon all citizens, community agencies, religious organizations, medical facilities, and
businesses to increase their participation in efforts to prevent child abuse and neglect,
thereby strengthening the communities in which we live.

Legislative Update
Human Services Director, John Dinsmore, provided handouts regarding proposed legislative
bills/actions as follows: "AMC/MACSSA/MICA About the Child Safety Act (HF1290/SF1508)"
and "Minnesota Association of County Social Service Administrators Legislative Update,
March 12, 2007".
Bills & Claims
Motion by Nelson, second by Block, and unanimously carried to approve the Human Services
bills and claims as presented.

Approval of Minutes
Motion by Nelson, second by Erickson, and unanimously carried to approve the County
Board minutes of March 6, 2007, as mailed.
Approval to Pay Bills
Motion by Erickson, second by Froemming, and unanimously carried to approve payment of
the County Board bills per Attachment A of these minutes.
Proposed Chemical Dependency Facility
Attorney, Kent Mattson, reported that negotiations for a lease agreement between the State
of Minnesota and the County for the County to lease the proposed CD building are taking
place. Mr. Mattson discussed the increased cost of construction of the building and
equipment to approximately 6.1 million, proposed funding mechanisms for operating
expenses, programming, and capital improvements, and negotiations for language to
decrease the risk for the County. County Attorney, David Hauser, stated that the County is
taking on a liability if the State would opt out of operating the CD Program before the building
is paid for, so some protection is needed. Mr. Mattson noted that there is no precedence for
the State to create collaborative arrangements in this manner and then opt out of the
agreement. The matter will be further discussed next week with hopes of executing a lease
agreement.
Correspondence Acknowledged
Chairman Mosher acknowledged receipt of a letter from Anoka County regarding State
control over the court systems as it relates to statute language and revenue and fines that are
collected. The County Attorney will draft a letter in response to these issues.
Blue Heron Bay Discussion (DNR Proposed Acquisition)
Blue Heron Bay Developer, Jim Erickson, explained that Phase Ill of the BHB property was to
be acquired by the Trust for Public Land and transferred to the DNR. He stated that there are
bureaucratic issues with the DNR as it relates to the appraisal of the Phase Ill property
completed in 2006 before the Conditional Use Permit was issued. Mr. Erickson presented a
draft letter to the DNR from the County encouraging the completion of this transaction. DLA
Members, Terry Sullivan and Don Fendrick, spoke in favor of putting this property into public
land and additionally, encouraged a buydown of units on Phase I & II based on the 9 units
used in Phase Ill when the initial appraisal was completed. Lengthy discussion continued.
Commissioner Nelson expressed concern, on behalf of Dead Lake Township, as to who was
going to build the road to service BHB and who would be responsible to pay for it.
Mr. Erickson stated that Dead Lake Township would build the road and BHB Development
would pay for it. Commissioners requested that the County Attorney draft a letter that could
be sent to the DNR from Otter Tail County and present it for the Board's consideration next
Tuesday.

At 11 :48 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a Solid Waste Committee meeting and lunch break. The
meeting was reconvened at 1 :00 p.m.
Solid Waste Department Staff Request
Motion by Nelson, second by Block, and unanimously carried to authorize Recycling Worker,
Darren Meyer, to work out of classification temporarily, at a Grade 10 as a Recycling
Operator.
Perham Resource Recovery Project
Solid Waste Director, Mike Hanan, presented Wadena County's request for all counties to
meet with the City of Perham so the City can explain their expansion project. Motion by
Froemming, second by Erickson, and unanimously carried to approve a Special County
Board meeting with other counties involved with the Perham Resource Recovery Facility at
10:00 a.m. at the Long Prairie Board room.
Mr. Hanan provided a handout Entitled "Perham Resource Recovery Project -Expansion,
Otter Tail County Concerns". He briefed the Board on the following: 1) the need for a long
term contract with Stearns County, 2) need for a long term contract with Bongards for steam
sales, 3) method of funding an expansion of the facility, 4) the proposed reduction from
12.4% to 5% liability for the facility for the City of Perham, and 5) owner/operator relationship.
Shoreland Management Ordinance Revision Discussion
Land & Resource Director, Bill Kalar, presented a handout entitled "Land & Resource
Suggestions for Shoreland Management Ordinance Revisions" dated March 13, 2007.
Mr. Kalar recommended five changes to the SMO dealing with 1) Impervious Surface, 2) Lot
Size, 3) Resorts, 4) Clusters, and 5) Language Changes. Motion by Block, second by
Froemming, and unanimously carried to authorize Land & Resource Director, Bill Kalar, to
proceed with the ideas presented and include the revisions in a draft SMO to be ready for a
public hearing on the proposed changes next July or August.
Final Payments for Highway Projects
Motion by Nelson, second by Block, and unanimously carried to authorize Final Payment
(estimate No. 6), in the amount of $11,696.45, payable to AAA Striping Service Co. of
Rogers, MN, for completion of C.P. 06:TM, County Wide Traffic Marking Project.

Motion by Froemming, second by Erickson, and unanimously carried to authorize Final
Payment (estimate No. 13), in the amount of $115,330.64, payable to Mark Sand & Gravel
Co. for S.A.P. 56-601-45 etc., for work completed on CSAH No. 1 from Fir Avenue East and
North.
2006 High Water Costs
Highway Engineer, Rick West, summarized the 2006 high water/flood damage costs and
reported a total cost of $520,803.83.
A RESOLUTION REQUESTING
COMPREHENSIVE ROAD AND TRANSIT FUNDING IN 2007
Otter Tail County Resolution No. 2007-18
Commissioner Nelson offered the following and moved its adoption:
WHEREAS, all Minnesota Counties and the State of Minnesota in general benefit from an
efficient and adequately funded transportation system that offers diverse modes of travel; and
WHEREAS, due to budget constraints, and increased construction costs, counties are
increasingly deferring maintenance on their 30,000 miles of county state aid highways,
15,000 miles of county roads, and over 7,000 bridges; and
WHEREAS, local cost participation requirements for trunk highway projects are putting undue
pressure on county highway budgets; and
WHEREAS, the main source of funding, County State Aid Highway Funding is declining and
property taxes, and local bonding are having to shoulder more of the burden; and
WHEREAS, the recently approved constitutional amendment that phases in dedication of 100
percent of the motor vehicle sales tax (MVST) for transportation purposes will address only a
fraction of the transportation funding needs in Minnesota, and total MVST revenues are not
meeting projections; and
WHEREAS, transportation analysts in consultation with the Minnesota Department of
Transportation (MnDOT) estimate Minnesota will have to invest an additional $1.5 billion per
year in transportation infrastructure for the next ten years in order to meet identified needs;
and
WHEREAS, transportation infrastructure maintenance and improvement costs significantly
contribute to rising property taxes; and
WHEREAS, lack of state funding has delayed regionally significant road construction and
reconstruction projects across Minnesota; and
WHEREAS, Minnesota's transportation system is failing to meet the capacity needs
necessary to sustain population growth and promote economic development; and
WHEREAS, congestion, inefficient transportation systems and lack of transportation choices
lead to greater dependence on foreign oil, increased environmental degradation, and
economic disadvantages for Minnesota's businesses and residents; and

WHEREAS, many rural roads are not built to modern safety standards and are not meeting
the needs of industries that depend on the ability to transport heavy loads,
NOW, THEREFORE, BE IT RESOLVED, by the Otter Tail County Board of Commissioners
that Otter Tail County requests that in 2007 the Minnesota Legislature pass a comprehensive
transportation funding package that permanently increases dedicated funding for
transportation; and
BE IT that in 2007 FURTHER RESOLVED, by the Otter Tail County Board of Commissioners
that Otter Tail County requests Governor Tim Pawlenty allow a comprehensive transportation
funding package that permanently increases dedicated funding for transportation that is
passed by the Legislature to become law; and
BE IT FURTHER RESOLVED, by the Otter Tail County Board of Commissioners that Otter
Tail County supports funding options including, but not limited to, the following:
o An increase in the gas tax of 10 cents phased in over a two year period.
o Indexing of the gas tax;
o Increases in vehicle registration taxes;
o Trunk highway bonding of $100 million per year over a 10-year period;
o General obligation bonding for local roads and bridge;
o Authority for counties to levy up to a ½ percent increase in the state sales tax
dedicated for transportation purposes; and
o Authority for counties to levy up to $20.00 wheelage fee; and
o Authority for counties to impose a transportation impact fee; and
BE IT FURTHER RESOLVED, by the Otter Tail County Board of Commissioners that Otter
Tail County defines a comprehensive transportation funding package as an initiative that
permanently increases dedicated funding for state and local road and transit systems in
Greater Minnesota and the Metropolitan Area.
Commissioner Block seconded the motion, and upon being put to a vote, was adopted as

County Highway Department as presented.
Highway Agreement with Midwest Testing
Motion by Nelson, second by Erickson, and unanimously carried to authorize the Highway
Engineer to enter into an agreement with Midwest Testing for soil boring work in the City of
Perham on CSAH No. 51 & CSAH No. 98, in the amount of $2,200.00, for work being
completed in conjunction with a larger City Project.
Cost Sharing Agreement-Tower Road and Bridge Project
Motion by Froemming, second by Block, and unanimously carried to authorize the
Chairman's signature to execute a Joint Agreement between the City of Fergus Falls and
Otter Tail County for engineering costs of approximately $910,003.00, for the Tower Road
and Bridge Project. The City of Fergus Falls is the lead agency on the project with the bridge
being funded with federal dollars and local costs split 50/50 between the City and County.

At 2:50 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. At 3:00 p.m., Chairman Mosher declared the
meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of
discussing labor negotiation strategies relative to the Collective Bargaining Unit that includes
the Treasurer, Assessor, Recorder, Auditor and Land & Resource offices, the Collective
Bargaining Unit for the Facilities Operations Group, and the Human Services Bargaining

Units. Present were all five seated Commissioners, the County Attorney, County
Coordinator, Recording Secretary, Assessor, Recorder, Land & Resource Director, Auditor,
Treasurer, Human Resources Director, and Physical Plant Manager. At 4:08 p.m.,
Commissioner Block was absent from the meeting.
Adjournment
Upon conclusion of the closed session at 4:15 p.m., Chairman Mosher declared the meeting
of the Otter Tail County Board of Commissioners adjourned until Tuesday, March 20, 2007.
