Call to Order
The Otter Tail County Board of Commissioners Convened Tuesday, January 30, 2007, at 9:30 a.m. at
the Otter Tail County Government Services Center with Commissioners
Dennis Mosher, Chair; Syd Nelson, Vice-Chair; Bob Block, Roger Froemming, and Everett Erickson
present.
Approval of Agenda
Motion by Nelson, second by Block, and unanimously carried to approve the County Board Agenda of
February 6, 2007, as mailed.
Approval of Minutes
Motion by Erickson, second by Nelson, and unanimously carried to approve the County Board Minutes
of January 30, 2007, as presented.
Approval to Pay Bills
Motion by Nelson, second by Froemming, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Approval of Hauler's License Applications
Motion by Nelson, second by Block, and unanimously carried to approve the following applications for
solid waste hauler's license for year 2007:

Motion by Block, second by Erickson, and unanimously carried to approve the MPCA Household
Hazardous Waste Funding Agreement effective March 1, 2007.
Ditch No. 16
Otter Tail County Ag/Ditch Inspector, Randy Wasvick, presented to the County Board pictures that
were taken while he was investigating Ditch No 16. Motion by Froemming, second by Block, and
unanimously carried to deny the petition from landowners, having investigated and the ditch is in
working order.

Recess & Reconvene
At 9:57 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 10:04 a.m., with
Commissioner Nelson absent.
2007 Permit Fees
Land and Resource Management Director, Bill Kalar provided the Board with a handout comparing
the current permit fee schedule with increase percentages. Mr. Kalar discussed with the Board
raising permit fees to help cover rising costs.
Lake Reclassification
Mr. Kalar provided information to the Board following up on a previous discussion with the Board on
the concern that some of the lakes within the county are inappropriately classified. Land & Resource
looked at lakes that were a 150 acres or less. There are 200 General Development Lakes and 16
recreational development lakes that fit into the category of 150 acres or less. Mr. Kalar handed out a
map that showed distribution of these lakes throughout the county. Discussion followed.
Sewage System Abatement Program
Mr. Kalar provided the Board with an update on the Sewage System Abatement Program. Discussion
followed.
Recess & Reconvene
At 10:45 a.in., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a committee meeting. The meeting was reconvened at 11 :06 a.m., with
all Commissioners present.
Facility Master Plan Discussion
Physical Plant Manager, Rick Sytsma and Architect, David Shultz presented the Board with a Facility
Planning and Implementation History outline and Criminal Justice Facility Planning and
Implementation Pivotal Decision Outline. Discussions followed regarding what has been
accomplished up to this point, plans currently in progress, and plans that will need to be implemented
in the future.
Minnesota County Engineers Association (MCEAl
2006 Outstanding County Engineer Award
Don Theisen, President of the MCEA and Dave Robley, Vice President of the MCEA, presented Rick
West with the Minnesota County Engineer Association, 2006 Outstanding County Engineer award.
Recess
At 11 :54 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a committee meeting and lunch break.
Public Hearing -South Turtle Lake Storm Water System Project
At 1 :02 p.m., Chair Mosher announced that the meeting was convened for the purpose of conducting
a public hearing and considering a resolution regarding the South Turtle Lake Storm Water System
Project.
County Attorney, David Hauser, stated that before the Board is a proposal to create a storm water
sewer system, which the county authorized to do under Minnesota Statute No. 444.075 and the
county has been asked to exercise its authority to create such a system under the statute. The cost
of the project will be assessed to the landowners that will benefit from the entire project and therefore
requires a public hearing. David Hauser read for the record a letter from DNR Area Hydrologist, Terry
Lejcher containing information regarding the history of the climatology in the area including South
Turtle Lake. Mr. Hauser also read two letters addressed to the Board from landowners Boyd and
Janice Froemke, and landowners Mike and JoEllen Thacker stating that they supported the project.
County Engineer, Rick West, spoke on the scope of the project. The project will be an underground
pipeline drainage system that will run from South Turtle Lake; under Hwy 210; ending in Pomme De

Terre. There will be a control structure at the end of South Turtle for adjusting the down stream flow.
The project is estimated to cost $350•,000. Mr. West reviewed the draft of the Operations Plan
detailing the water surface levels, runout elevations, ordinary high water elevations and the proposed
drawdown elevations of both North and South Turtle Lakes. Drawdown time is estimated at ten
months.
Ag and Ditch Inspector, Randy Wasvick explained how the Ditch viewers determined who would
benefit from the project.
Chair Dennis Mosher asked if anyone was opposed to the project, and no one in attendance objected
to the project.
At 2:00 p.m. Chair Dennis Mosher closed the public hearing and reconvened the regular session of
the county Board.
South Turtle Lake Storm Water Sewer Project Resolution
Otter Tail County Resolution No. 2007 -10
WHEREAS, a public hearing was held on February 6, 2007 at which time the county board received a
report from its Engineer, Richard West, and a report from Randy Wasvick, the Ditch Inspector who
was involved in the determination of benefits to property in South Turtle Lake Storm Sewer system;
and
WHEREAS, the proposed Storm Sewer System is necessary to protect property on South Turtle
Lake, which would otherwise be subject to a potential 9 foot increase in the water level of the lake,
causing great destruction to property; and
WHEREAS, the system is anticipated to cost $350,000, it is cost effective, the storm sewer system is
feasible, and it is in the best interest of the property owners affected; and
WHEREAS, the methodology used to calculate the individual assessments was based upon the
actual increase in market value of the property by having the storm sewer system in place,
NOW, THEREFORE, IT IS HEREBY RESOLVED: that Otter tail County proceed with the South
Turtle Lake Storm Sewer System and assess the property owners in accordance with the assessed
benefits as determined, which assessed benefits were included in the notice.
BE IT FURTHER RESOLVED: that the assessments may not exceed the total of $350,000 unless
additional hearings take place.

Credit Card Approval
Motion by Nelson, second by Froemming, and unanimously carried to approve the application for an
Otter Tail County Credit Card (maximum limit of $500) for Scott Ellingson, in the Land and Resource
Department.
Amendment for Approval
Motion by Froemming, second by Erickson, and unanimously carried to approve the amendment for
additional $5,000 in funds for road improvement to the Ethanol Plant.
Contract Approval
Motion by Nelson, second by Erickson, and unanimously carried to approve a contract with Lakeland
Mental Health for court ordered evaluation services.
Adjournment
At 2: 15 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, February 13, 2007.
