HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/21/2006MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, November 21, 2006 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, November 21, 2006, at 9:32 a.m., at the Otter Tail County Government Services Center with Commissioners Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Syd Nelson, and Bob Block present. Approval of Agenda Motion by Mosher, second by Block, and unanimously carried to approve the County Board agenda of November 21, 2006, with the following additions: 10:35 a.m. -Public Health Contract Approval 10:45 a.m. -Personnel Committee Meeting Weitland Appeal Information Bill from Everts Township i"pproval of Minutes Motion by Nelson, second by Block. and unanimously carried to approve the County Board minutes of November 14, 2006, as presented. Approval to Pay Bills Motion by Block, second by Mosher, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Bioscienc,9 Tax Free Zone Designation City of Fergus Falls Economic Development Committee Chair, Don Westra, requested approval of a resolution in support of a BioScience Zone in the City of Fergus Falls. He stated that there are currently 66 acres to be designated for this zone and this is the application process to be included in the program. Otter Tail County Commissioners Bioscience Zone Resolution to Participate and Designate Property for Tax Free Zone Designation Otter Tail County Resolution No. 2006 -80 Commissioner Mosher offered the following and moved its adoption: WHEREAS, the Otter Tail County Board of Commissioners has a desire to promote development of bioscience and health related industries within the county boundaries, and WHEREAS, the State of Minnesota through the Minnesota Department of Employment and Economic Development has created the Bioscience Zones to promote biotechnology and health sciences industries, and WHEREAS, Otter Tail County desires to participate in a regional application, administered and drafted by the City of Fergus Falls and West Central Initiative, and OTC Board of Commissioners' Minutes November 21, 2006 Page 2 WHEREAS, the Otter Tail County Board of Commissioners has reviewed the Bioscience Zone requirements and agrees to provide the applicable tax exemptions within the designated bioscience subzones, and BE IT RESOLVED, the Otter Tail County Board of Commissioners upon careful consideration and review hereby approve the following specified properties to be included in a regional application for a Bioscience Zone through the City of Fergus Falls and the West Central Initiative Fund. V l Ce -~ ,.,_.,.._, Roger Froemming, Board ofComlnissioners Chair Green Acres Discussion Assessor, Bob Moe, presented a Green Acres Property Tax Fact Sheet printed from the Minnesota Department of Revenue website which explains Green Acres to the public. Mr. Moe pointed out that the DOR requires assessors to value property at its estimated market value. Market value reflects the greatest potential use of the land, known as the "highest and best use". Urban sprawl and proximity to a lake causes land to increase in valuation. Agricultural property; however, can be given a deferment under the Green Acres law to pay the agricultural value of the land rather than the market value. Mr. Moe provided an example of how Green Acres is intended to work. Discussion took place regarding the process when a property under Green Acres is sold, criteria determining when Green Acres should be considered, and varying real estate taxes from county to county. Motion by Mosher, second by Block, and unanimously carried to authorize the County Assessor to proceed with outsourcing the printing and mailing of the assessment notices at a cost of $0.37 per notice, which is approximately $20,000.00 annually. Computerized Fire Arms Training System {FATS) Sheriff, Brian Schlueter, explained that a FATS is the equivalent of a flight simulator for law enforcement and military combat situations. He stated that use of force is a large issue and this system encompasses everything from a verbal request on up to deadly force. It incorporates the judgment part of these decisions. It is a scenario based interactive simulator. The simulator is portable and would be accessible at the State Colleges in Fergus Falls or Moorhead at all times. Motion by Nelson, second by Block, and unanimously carried to authorize the Otter Tail County Sheriff to enter into an agreement with the MSCTC, Fergus Falls PD, Clay County Sheriffs Department, and Moorhead PD to purchase a Computerized FATS as presented with Otter Tail County's cost of $10,000.00 to be paid from existing Forfeiture Funds and Gun Permit Funds. Certificate of Real Estate Value Motion by Froemming, second by Block, and unanimously carried to approve payment from the Otter Tail County Compliance Fund (Account No. 01-2752) to the Commissioner of Revenue, in the amount of $7,500.00, for Otter Tail County's contribution to the development of the eCRV System. Applic.1tion for Exempt Permit Motion by Froemming, second by Mosher, and unanimously carried to approve with no waiting period. the LG220 Application for Exempt Permit as submitted by the Pelican Rapids Jaycees for an event scheduled for November 24, 2006 at The Club located at the junction of Highway 59 and County Road 4. Motion by Nelson, second by Mosher, and unanimously carried to''approve payment from Account 14-063.6687 to Election Systems and Software, in the amount of $56,260.97, for the remaining ·10% · balance due on the 2006 election equipment purchase (ES&S Model 1 00's and ES&S AutoMARKS. GSC Office Hours Motion by Nelson, second by Froemming, and unanimously carried to require all departments in the Government Services Center to be open to the public at 8:00 a.m. effective January 1, 2007. Property Valuation Concern David Johnson, appearing on behalf of his son, Douglas Johnson, presented a photo with a red x indicating water on the bottom edge of the property. He stated that this will be considered additional lake shore frontage and will cause an increase in market value. Mr. Johnson indicated that the yellow line on the map is quite low in areas and he stated that there isn't a way to get to the area considered for lake shore frontage valuation. He also stated that the water sometimes does not touch his son's property depending on water levels and whether or not the tile in that area is working properly. Assessor, Bob Moe, explained that any body of water that has a DNR number assigned to it creates a reclassification. He stated that it doesn't matter if a road can be built to the area or not; however, if this is a family farm, the owner could apply for Green Acres. The valuations being completed at this time are subject to appeal. The Board requested that Mr. Johnson and the Assessor look at this specific situation in more detail. Final Plat -Swanson Acres Motion by Nelson, second by Block, and unanimously carried to approve the Final Plat known as Swanson Acres, GL 2 of Section 25, Gorman Township, Little Pine Lake. Safe Communities Coalition Grant Motion by Block, second by Nelson, and unanimously carried to authorize the Board Chairman and the Public Health Director to sign the Safe Communities Grant Agreement between the Minnesota Commissioner of Public Safety and the County of Otter Tail as presented by the Public Health Director. The grant, in the amount of $20,500.00, will be used to decrease traffic accidents through education related to alcohol impaired driving, seat belt use, and safe driving. Recess & Reconvene At 11 :10 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for a Personnel Committee meeting and lunch break. The meeting was reconvened at 1 :00 p.m. Exit Audit Conference State Auditor, Bob Johnson, presented the CY2005 Otter Tail County Financial Audit. He stated that a full County Board Exit Conference is a required communication. The State Audit was completed and the County's Financial Statements were deemed materially correct. Mr. Johnson reviewed Fund Balances which were within accepted averages based on required auditing standards. Bill from Everts Township OTC Board of Commissioners' Minutes November 21, 2006 Page 5 County Attorney, David Hauser, provided copies of a bill received from Everts Township for upgrading a Township road near South and'North Turtle Lakes. Mr. Hauser will research the facts of the issue and return to the Board with additional information. Wetland Appeal Mr. Hauser stated that on December 5, 2006, the County Board is holding a special meeting to hear a Wetland Appeal. He provided the Minnesota Wetland Conservation Act Sequencing Findings of Fact information to be followed for a local government appeal. RESOLUTION OF SUPPORT FROM SPONSORING AGENCY Otter Tail County Resolution No. 2006 -81 Commissioner Mosher offered the following and moved its adoption: BE IT RESOLVED: that Otter Tail County act as sponsor for a "Transportation Enhancements" project identified as County Highway No. 1 Trail and acknowledges herewith that it is willing to be the project sponsor; knowing full well that such sponsorship includes a willingness to secure and guarantee the local share of costs associated with this project and responsibility for seeing this project through to its completion, with compliance of all applicable laws, rules and regulations. BE IT FURTHER RESOLVED THAT: Richard K. West, County Engineer, is hereby authorized to act as agent on behalf of this applicant. Commissioner Block seconded the motion and upon being put to a vote, the above resolution was unanimously adopted: Adjournment At 2:16 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, November 28, 2006.
