HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/14/2006MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, November 14, 2006 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, November 14, 2006, at 9:30 a.m., at the Otter Tail County Government Services Center with Commissioners Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Bob Block, and Syd Nelson present. Approval of Agenda Motion by Mosher, second by Block, and unanimously carried to approve the Human Services Board agenda of November 14, 2006, as mailed. Approval of Minutes Motion by Froemming, second by Nelson, and unanimously carried to approve the Human Services Board minutes of October 24, 2006, as mailed. Court Services Department Court Services Director, Chuck Kitzman, provided a packet of information received at a conference in Duluth regarding Minnesota Drug Courts. Drug Court in Otter Tail County is in the planning stages only. Mr. Kitzman reported that the last funding cycle for training on the concept has past. Discussion continued regarding the pros and cons of Drug Courts, expense and funding of the process, and the potential need for uniformity. Public Health Department Public Health Director, Diane Thorson, reported that the County Public Health Department worked with the Henning School District to submit an application to BCBS for the Communities on the Move Grant Program. She stated that the Grant was received, in the amount of $24,485.00, to start a fitness center, and will be sent directly to the Henning School District. Ms. Thorson also reported that the Public Health Department has invested in software that provides individualized diet analysis to recommend an amount of exercise an individual needs to maintain, lose, or gain weight. This dietician service will be incorporated into this fitness program. MACSSA Legislative Priorities Human Services Director, John Dinsmore, presented the Minnesota Association of County Social Service Administrators 2007 Legislative Priorities. Mr. Dinsmore reviewed the top five legislative priorities of the Otter Tail County Human Services Agency as follows: Refinancing Child Welfare Minnesota Care Applications Processing Enhanced Revenue for Detox Continuation of Collaborative Services (funding) County Based Purchasing OTC Board of Commissioners' Minutes November 14, 2006 Page 2 Contract Renewal Motion by Nelson, second by Mosher, and unanimously carried to authorize the Chairman's signature to execute the following Assisted Living Contract and 2006 Provider Amendments: Some Place Special Contract Residential Services/Assisted Living Purchase of Service Agreement for elderly persons receiving services 11/01 /06-06/30/07 Perham, MN under AC/EW, CADI, or TBI Provider Contract Amendment Amendment to Contract for 2.2553% Wes & Denise Borneman increase to reimbursement rates for 10/01/06 Sebeka, MN Adult Foster Care New Horizons Amendment to Contract for 2.2553% Frazee, MN increase to reimbursement rates for 10/01/06 Assisted Livinq & Elderlv Services Bills & Claims Motion by Nelson, second by Block, and unanimously carried to approve the Human Services bills & claims as presented. OTC Board of Commissioners' Minutes November 14, 2006 Page 3 Crooked Lake Area Flooding Highway Engineer, Rick West, briefed the Board on Crooked Lake. Houston Engineering is working on an Engineering Study whereby the project would be an outlet from Crooked Lake to County Ditch #21. When completing field survey work, there were favorable comments from landowners downstream from Crooked Lake. There may be some repairs required to the Ditch System; however, the expense should be less than a grade raise on CH 18. Mr. West stated that when a draft copy of the Engineering Report is received, the Highway Department plans to petition to enter the Ditch. Commissioner Mosher requested that the Highway Engineer update Dennis Johnson on the progress of this project. Premise Permit Otter Tail County Resolution No. 2006 -79 Commissioner Froemming offered the following and moved its adoption: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, VFW Post 612, Fergus Falls, MN, has made an application to the Gambling Control Board for the purpose of conducting lawful gambling at Lenny's Dining and Dancing, located at 30255 Phelps Mill Road in Maine Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the application for a permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the VFW Post 612, Fergus Falls, MN, at Lenny's Dining and Dancing, located at 30255 Phelps Mill Road in Maine Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by VFW Post 612, Fergus Falls, MN, at Lenny's Dining and Dancing, located at 30255 County Highway 72 in Maine Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Maine by sending them a copy of this resolution. Commissioner Mosher seconded the motion, and upon being put to a vote, was unanimously carried. Dated: 11 / alt /01,p -~-+,~-+------OTTER TAIL COUNTY BOARD OF COMMISSIONERS OTC Board of Commissioners' Minutes November 14, 2006 Page 4 Payment Approvals Motion by Froemming, second by Nelson, and unanimously carried to approve payment to Blake Meland, in the amount of $3,650.00, from Account Number 14-507-6688 for costs associated with the removal and replacement of cement steps at the Phelps Mill House. Motion by Nelson, second by Mosher, and unanimously carried to approve payment to Gateway Companies, Inc., in the amount of $37,349.55, from the Human Services Capital Account for costs associated with the replacement of 30 computers. Proposed Fergus Falls Transfer Station Solid Waste Director, Mike Hanan, presented a packet of information and maps relative to the proposed Fergus Falls Transfer Station. He outlined the order of events, tasks completed by Otter Tail County, and citizen concerns/comments to the proposed location of the facility. The process to build a new Transfer Station started in 2004 when it was determined that the current facility located at the Regional Treatment Center would be closed. The property proposed to be used for a new Transfer Station is regulated by Fergus Falls Township and requires a special use permit. After request of a special use permit, a citizens group petitioned the Environmental Quality Board and the County proceeded with completion of an Environmental Assessment Worksheet. During this process, the MPCA received several requests for an Environmental Impact Statement on this project. The MPCA Citizen's Board meeting to decide on the need for an EIS is scheduled for November 28, 2006. Mr. Hanan requested approval of a draft letter to the MPCA regarding the proposed Transfer Station. Motion by Nelson, second by Mosher, and unanimously carried to authorize the Chairman's signature on the letter addressed to the MPCA Citizens Board as presented by the Solid Waste Director. Planning Commission Recommendations Conditional Use Permit -Jeffry M. Christenson: Land & Resource Director, Bill Kalar, explained that this Conditional Use Permit request is to convert an existing Duplex to a Single Rental Property to correct a violation of the Shoreland Management Ordinance. Mr. Christenson requested that this become effective the end of May, 2007, because there are two people living under leases at this property. Motion by Block, second by Nelson, and carried with Mosher opposed, to approve a Conditional Use Permit to convert an existing Duplex to a Single Rental Property as requested effective June 1, 2007. The property is described as Lot 6 Wall Lake Development #1, Section 33 of Aurdal Township; Wall Lake (56-658), GD. Conditional Use Permit -Mick & Kevin Moore: Motion by Mosher, second by Froemming, and unanimously carried approve a Conditional Use Permit to replace existing retaining walls with conditions as recommended by the Planning Commission. The property is described as Cedar Park Club Lot 4, Section 30 of Dane Prairie Township; Swan Lake (56-781 ), RD. '-Conditional Use Permit-Leaf River Properties, LLC/Bradley W. AndersonTst: Motion by Froemming, second by Block, and unanimously carried to approve a Conditional Use Permit to operate a crafting/scrapbooking business with conditions No. 2, 3. & 4 as described in the Otter Tail County Planning Commission minutes dated November 8, 2006. The property is described as Pt GL 4. (5 AC), Section 24 of Leaf Lake Township; East Leaf Lake (56-116), RD. The property is described as Pt of GL 4, (8.44 AC), Section 36 of Sverdrup Township; South Turtle Lake (56-377), RD. Preliminary Plat & Conditional Use F'ermit-"Maiestic Oaks of Rush Lake''/ Robert & Carol Martinson. Juanita Granda: Motion by Nelson, second by Mosher, and unanimously carried to deny the proposed Preliminary Plat known as "Majestic Oaks of Rush Lake" consisting of 20 single family residential lots and a Conditional Use Permit to construct a road to service the plat. The reasons for denial are as stated in the Otter Tail County Planning Commission minutes dated November 8, 2006. The property is described as Pt of GL's 1, 2 & 3, Section 17 and Pt of GL 4, Section 18 of Otto Township; Rush Lake (56-141 ), GD. Preliminary Plat & Conditional Use Permit-"Lake Hills Ranch" I Will Blasczyk: Motion by Mosher, second by Nelson, and unanimously carried to approve the Preliminary Plat known as "Lake Hills Ranch Estates" consisting of 10 single family residential lots and 1 lake access lot and a Conditional Use Permit to construct a road to service the plat with conditions as recommended by the Planning Commission. The property is described as All Lot 13 W of creek N of slough & section line, Section 1 and GL 11 ex tr, Section 2 of Dunn Township; Little Pelican Lake (56-76'1 ), RD. Preliminary Plat -"Waterford Heights''/Steven Gease: Motion by Mosher, second by Block, and unanimously carried to approve the Preliminary Plat known as "Waterford Heights" consisting of 2 single family residential lots as presented. The property is described as Pt SE1/4 NW1/4 com SE cor SE1/4 NW1/4 N 1283.55' to pt bg, S 545.02', (5.35 AC), Section 8 of Dane Prairie Township; Unnamed Lake (56-626), NE. Conditional Use Permit-Vacationland Resort/ Lynn Johnson: Motion by Mosher, second by Froemming, and unanimously carried to approve a Conditional Use Permit to replace a mobile home with a condition as recommended by the Planning Commission. The property is described as Pt GL 2, tr bet Lots 1 & 2 & W 1/3 of 3 of Pleasure Bch Resort & T. H. #78, Section 2 of Everts Township; Otter Tail Lake (56-242), GD. Conditional Use Permit -Gary & Monica Kaiser: Motion by Block, second by Nelson, and unanimously carried to deny a Conditional Use Permit to operate a Real Estate Office with a previously approved Gift Shop as recommended by the Planning Commission. The reasons for denial are as stated in the Otter Tail County Planning Commission minutes dated November 8, 2006. The property is described as Pt NW1/4 SW1/4 & Pt NE1/4 SW1/4, Pt GL 4 & Pt GL 5 (5.02 AC), Section 20 of Dunn Township; Lake Lizzie (56-760), RD. Conditional Use Permit -David Chase: Motion by Nelson, second by Froemming, and unanimously carried approve a Conditional Use Permit to expand a commercial business as presented. The property is described as Pt GL 4, (4.17 AC), Section 5 of Rush Lake Township; Marion Lake (56-243), GD. The reasons for denial are as stated in the Otter Tail County Planning Commission minutes dated November 8, 2006. The property is described as Lot 7 Black Lab Beach, Section 34 of Dunn Township; Franklin Lake (56-759). Conditional Use Permit -Brian Fronninq: Motion by Mosher, second by Froemming, and unanimously carried to approve a Conditional Use Permit to rebuild a road to meet Buse Township specifications with a condition as recommended by the Planning Commission. The property is described as Lot 2 & E½ NE¼ ex tr, Section 22 of Buse Township; Horseshoe Lake (56-834), NE. Conditional Use Permit -Crystal Lida Resort/Mike McNabb: Motion by Nelson, second by Mosher, and unanimously carried to approve a Conditional Use Permit to allow two existing screened porches on Units #2 and #19 to remain with no changes as recommended by the Planning Commission. Purchase of Property for Sheriffs Department Outpost Motion by Block, second by Mosher, and unanimously carried to authorize the appropriate County officials' signatures to execute a purchase agreement between the County of Otter Tail and RD Offutt Co. and authorize payment for the purchase of the property for the proposed Sheriff's Department Outpost Building with an approximate purchase price of $48,606.09 Big Stone Project Motion by Block, second by Nelson, and unanimously carried to authorize the County to send a letter in support of the Big Stone II Transmission Line Project. Non-Union Employer Benefit Contribution Motion by Mosher, second by Froemming, and unanimously carried to approve $750 per month for Otter Tail County's non-union employer benefit contribution effective January 1, 2007. Coordinator's Office Positions Motion by Block, second by Nelson, and unanimously carried to authorize the County Coordinator to hire a temporary support staff person and to proceed with filling the position of Benefits/Safety Specialist.
