Call to Order
The Otter Tail County Human Services Board convened Tuesday, September 26, 2006, at
9:30 a.m., at the Otter Tail County Government Services Center with Commissioners
Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Syd Nelson, Bob Block, and
Malcolm Lee present.
Approval of Agenda
Motion by Mosher, second by Block, and unanimously carried to approve the Human
Services Board agenda of September 26, 2006, as mailed.
Approval of Minutes
Motion by Nelson, second by Froemming, and unanimously carried to approve the Human
Services Board minutes of September 12, 2006, as mailed.
Court Services Department
Court Services Director, Chuck Kitzman, briefed the County Board on a recent tour of the MN
DOC Thistledew Forestry Camp located in Togo, MN. Six people went on the tour including
a couple of members of the Court Services Advisory Committee. Mr. Kitzman provided
pictures of the facility and stated that the camp was extremely well maintained. He briefed
the Board on the programs the DOC provides at the camp. The group was impressed with
the tour and the programs and Mr. Kitzman stated that the Otter Tail County Court Services
Department will continue to use the program.
Public Health Department
Public Health Director, Diane Thorson, introduced two Public Health Nurse interns who are
currently studying county development. Ms. Thorson updated the Board on the Emergency
Preparedness Drill that started on September 11, 2006. Key employees, emergency
responders, and law enforcement personnel were pulled together, the process for declaring
an emergency in the County was reviewed, and a drill for a mass clinic took place.
Ms. Thorson reported that a table top emergency preparedness exercise will take place at the
State level with the heads of the different State departments. One thing learned during the
drill is that there are limited Personal Protective Equipment (PPE) as far as masks in Nursing
Homes, Ambulances, and for Law Enforcement Personnel.

Family Child Care Provider Week -October 22 -28, 2006
Otter Tail County Resolution No. 2006 -72
Commissioner Nelson offered the following and moved its adoption:
WHEREAS, Otter Tail County has over 140 licensed family child care providers; and
WHEREAS, Otter Tail County family child care providers serve approximately 1,200 children
and their families; and

WHEREAS, children are Otter Tail County's most valuable asset and resource; and
WHEREAS, the care and education of Otter Tail County's children provided by licensed
family child care givers is an invaluable occupation; and
WHEREAS, many Otter Tail County families choose child care outside their own home; and
WHEREAS, licensed family child care providers are highly competent, dedicated, caring, and
concerned professionals.
NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners
hereby proclaims the week of October 22 -28, 2006, as Licensed Family Child Care
Provider Week in Otter Tail County, in honor of its many licensed family child care providers,
and asks the community to join in recognizing the valuable contributions these family child
care providers make to our community.
Commissioner Mosher seconded the motion, and upon being put to a vote, was unanimously
carried.

Mental Illness Awareness Week
Human Services Supervisor, Jody Wentland, introduced a member of the Local Adult
Advisory Council, Fonda Knutson. Ms. Knutson is also a member of the Education
Committee, which is a sub-committee of the LAC. She reported that Mental Illness
Awareness Week begins October 1, 2006, with an event at 2:00 p.m. at a Place to Belong.
Ms. Knutson briefed the Board on other activities taking place that week to increase
awareness of Mental Illness as well as other goals of the committee, such as marking the
graves at the Regional Treatment Center graveyard, where there are still about 3,000 graves
unmarked.
County Financial Worker and Case Aide Day
Otter Tail County Resolution No. 2006 -73
Commissioner Nelson offered the following and moved its adoption:
WHEREAS, County Financial Workers and Case Aides are dedicated to providing
outstanding services to the people of Minnesota through their administration of public
assistance programs; and
WHEREAS, County Financial Workers and Case Aides are responsible for the prudent
expenditure of millions of dollars annually and must meet very high standards of job
performance in determining eligibility for public assistance; and

WHEREAS, The duties performed by County Financial Workers and Case Aides require that
they be well versed in a number of areas in order to effectively provide services to public
assistance recipients, as well as to the general public; and
WHEREAS, The nature of federal and state welfare legislation dictates that County Financial
Workers and Case Aides continually improve their knowledge, skills, and expertise related to
their profession; and
WHEREAS, County Financial Workers and Case Aides are.key to the success of welfare
reform implementation as they help move Minnesota's low-income families toward self-
sufficiency; and
WHEREAS, It is important that all County Financial Workers and Case Aides recognize the
important services they provide to all Minnesota citizens.
NOW, THEREFORE, the Otter Tail County Board of Commissioners hereby proclaims

COUNTY FINANCIAL WORKER AND CASE AIDE DAY

Motion by Lee, second by Mosher, and unanimously carried to approve payment of the
County Board bills per Attachment A of the official minutes.
Interactive Television
MIS Director, Tim Brand, submitted a request to purchase a Tandberg 880MXP
Videoconference System with 50" Plasma Display at a cost of $17,596.84 and $3,379.00 for
a 3 year AdvanceCare Onsite Maintenance proposal. The equipment would be located in the
Government Services Center. Human Services would benefit greatly from the ITV equipment
for meetings; therefore, the BCOW Adult Mental Health Initiative will provide $4,000 towards
the purchase. Mr. Brand reported that Phase II would be a smaller ITV unit for the New York
Mills offices.
Contract Amendment
GIS Coordinator, Brian Armstrong, reported that the GIS Department had budgeted for parcel
drafting this past year. The contract was capped at a certain dollar amount; however, since
that time the Land Record Modernization Program has raised funds and augmented the

budget to get parceling completed. He requested that an amendment be added to the
contract, not to exceed $70,000.00. Motion by Block, second by Mosher and unanimously
carried to approve Amendment "A" dated 9/26/06 to the Auto-Cadd Parcel Drafting
Agreement which increases the total contract amount for parcel drafting not to exceed
$70,000.00.
Liquor License Compliance Checks
County Attorney, David Hauser, reported that there were sixteen liquor license violations
during a recent compliance check in Otter Tail County and criminal violations will result for
the individuals making the sale. The license holder can be fined up to $2,000. Discussion
took place regarding license holder fines. This issue will be placed on the next County Board
agenda for further discussion of where the fine money goes and how it is used.
Planning Commission Recommendations
Preliminary Plat & Conditional Use Permit-The Palms of Lida First Addition/OS Investments:
Motion by Lee, second by Mosher, and unanimously carried to approve the Preliminary Plat
of Bruce Qvammen known as "The Palms of Lida First Addition" consisting of 28 Single
Family Residential Lots and a Conditional Use Permit to construct a road to service the plat
with conditions as recommended by the Planning Commission. The property is described as
Lots 5, 6 & 7 ex trs & pt platted ex 6.72 Ac Hwy RM/, Section 9 & Lots 1, 2 & NW¼ NW¼

Motion by Mosher, second by Lee, to deny, as recommended by the Planning Commission,

Residential Lots and a Conditional Use Permit to construct a road to service the plat.
Developer, Neil Lewis, requested that the request for the Preliminary Plat and CUP be tabled.
Land & Resource Director, Bill Kalar, responded that substantive changes would require a
new application with notice going out to surrounding property owners so they have the ability
to review the changes and make comments. Motion carried unanimously. The reasons for
denial are as documented in the September 20, 2006, Planning Commission minutes. The

Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use

Conditional Use Permit-"Woodland Beach Resort Assoc. LLC:
Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use
Permit to replace and expand a cabin as presented. The property is described as Pt of GL 3,

Conditional Use Permit-Melva Jean Nyberg Trust:
Motion by Froemming, second by Lee, and unanimously carried to deny a Conditional Use
Permit, as recommended by the Planning Commission, to construct a driveway. The reasons
for the denial are as documented in the September 20, 2006, Planning Commission minutes.

Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use

recommended by the Planning Commission. The property is described as Scalp Trail
between Dusty Trail and East Lake Seven Road, Section 7 of Hobart Township; Scalp Lake

Conditional Use Permit -''Treasured Bay Resort'1/Lester & Kristine Kellogg and James
Development, Inc:
Mr. Kalar stated that the Planning Commission is recommending approval with conditions for
this resort to a Common Interest Community conversion. He stated that since the Planning
Commission meeting, a letter was received from Douglas Grouws, property owner on the
east boundary, and he read the letter for the record. Mr. Kalar stated that the requests in

Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use
Permit to change the usage as a Resort status to a 5 unit Common Interest Community for
singe family residential usage with conditions as recommended by the Planning Commission.

Conditional Use Permit -Daniel M. Sillerud:
Motion by Mosher, second by Block, and unanimously carried to approve a Conditional Use
Permit to restore a wetland area with conditions as recommended by the Planning

Blue Heron Bay Adequacy Decision
Motion by Mosher, second by Nelson, and unanimously carried to establish a special meeting
for the Otter Tail County Board of Commissioners on Tuesday, October 31, 2006, at
9:30 a.m. for the Blue Heron Bay Final EIS Adequacy Decision. Other County Board agenda
items will not be scheduled unless the item is a high priority issue.
Conditional Use Permit -"The Preserve at Echo Bay"
Attorney for Homeland Investments, Paul Jenson, formally requested vacation of Conditional
Use Permit #6346 for The Preserve at Echo Bay and explained that a new Application for
Conditional Use has been filed with the Land & Resource Office and will be considered by the
Planning Commission in October. Motion by Lee, second by Mosher, and unanimously
carried to approve withdrawal, as requested by applicant, of Conditional Use Permit #6346
which includes the cluster development proposal for The Preserve at Echo Bay and
acknowledging that the road(s) that have been constructed were performed under a valid
CUP and was appropriate work under the permit.

Motion by Nelson, second by Block, and unanimously carried to approve the Final Plat of
Dennis E. Courneya known as "Pine Crest", Section 8 of Hobart; Unnamed Lake (56-359) &

Shoreland Seminar
County Attorney, David Hauser, reported that several County officials attended a meeting in
Detroit Lakes regarding Shoreland Issues. He briefed the County Board on proposals to
have mandatory requirements for EAW's and/or EIS's for shoreland developments as small
as 20 units. Mr. Hauser recommended that if the development is in a shoreland area,
requiring an EAW and/or an EIS may be a good choice. Mr. Hauser also informed the Board
that recent State Legislation now allows existing non-conforming structures to be repaired,
maintained, or replaced provided the appropriate permit is acquired. The non-conforming
structure can be replaced on the basis of the same size (same height, length, & width) and
same location.
Recess & Reconvene
At 11 :59 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1 :15 p.m.
County Highway 122 Culvert-North & South Turtle Lakes
Assistant County Highway Engineer, Charles Grotte, reported that the water is currently
flowing between North and South Turtle Lakes and there is a request that the County
sandbag to block the culvert on CH 122 and monitor the situation. Commissioner Mosher
stated that this is a temporary measure which is part of a long range permanent plan to
control flooding. Motion by Mosher to close off the culvert on CH 122 when the pumping on
South Turtle stops, and if damage occurs to properties around North Turtle as a result of the
County's blockage of the culvert, the County will accept the responsibility. Lengthy
discussion took place regarding the timing of the permanent pipe installation in the spring,
unknown moisture accumulations over winter, right of way acquisitions needed for the
project, the need to complete a Storm District Designation and hold a Public Hearing.
Commissioner Mosher withdrew his motion. Motion by Nelson, second by Block, and
unanimously carried to close off the culvert on CH 122 by sandbagging, subject to monitoring
the situation so damage upstream does not occur and the appropriate action would be taken
if needed.

Hearing for the issuance of an Off-Sale Intoxicating Liquor License to an exclusive liquor
store at 9:30 a.m. on Tuesday, October 17, 2006: Parcel 77-000-99-0251-001, South so· on

Tax Forfeited Property
Motion by Nelson, second by Block, and unanimously carried to establish Friday,
December 1, 2006, as the sale date for the private sale of the following described parcel of
tax forfeited property and to establish the opening bid price at $9,900.
Payment Approval
Motion by Block, second by Mosher, and unanimously carried to approve payment to Wenck
Associates, Inc., in the amount of $13,511.90, for the Blue Heron Bay Development EIS
Project.
Wright Express/Fleet Services Credit Cards
Motion by Froemming, second by Mosher, and unanimously carried to delay the
implementation of Otter Tail County Wright Express/Fleet Services Credit Card User
Agreement from October 1, 2006, until November 1, 2006, to allow the County Auditor an
opportunity to consider possible modification to the policy which would perhaps make the
policy more workable for the Otter Tail County Sheriffs Departm_ent.
Absentee Ballot Board
Motion by Nelson, second by Lee, and unanimously carried to appoint the following
individuals to the Absentee Ballot Board for the November 7, 2006, State General Election
and to set the compensation for the services provided at $9.00 per hour plus mileage:

Auto-Cadd Parcel Drafting Agreement
Motion by Block, second by Mosher, and unanimously carried to authorize the Chairman and
GIS Addressing Coordinator to sign the Auto-Gadd Parcel Drafting Agreement and
Amendment "A" dated 09/26/06.
Interactive Videoconference System
Motion by Mosher, second by Lee, and unanimously carried to approve purchase of a
Tandberg 880MXP Videoconference System at a cost of $17,596,84 and $3,379.00 for the
Maintenance Agreement less State Funds of $4,000.00 for a net cost of $16,975.84. In
addition, the motion approves the net cost to be paid from the Capital Improvement Fund.
Speed Limit Enforcement Grant
Motion by Froemming, second by Block, and unanimously carried to authorize the
appropriate County officials' signatures to execute a Grant Contract between the State of
Minnesota Public Safety Division and the County of Otter Tail. The Grant amount is $1,500
for Speed Limit Enforcement from August 21, 2006, through September 30, 2006.
Children's Mental Health Services Addendum
Motion by Lee, second by Mosher, and carried with Block abstaining, to authorize the
Chairman's signature to execute an Addendum to the Purchase of Service Agreement
between the County of Otter Tail and Lakeland Mental Health Center which increases the MA
Bundled Rate for Children's Mental Health Services to $430.00 per month. The addendum is
effective from September 1, 2006, through December 31, 2006.
Annual Candlelight Vigil
County Coordinator, Larry Krohn, reported that the Annual Candlelight Vigil for Domestic
Abuse awareness will be held Thursday, October 5, 2006, at 7:00 p.m. on the County
Courthouse grounds or in the first floor foyer of the Courthouse in case of inclement weather.
Correspondence Acknowledged
Commissioners acknowledged a letter received regarding the Recorder's Office and
requested that a meeting be set up to discuss the correspondence.
Vending Machine Request
Commissioner Mosher stated that he received a request for a vending machine at the 505
