Call to Order
The Otter Tail County Human Services Board convened Tuesday, August 22, 2006, at
9:30 a.m., at the Otter Tail County Government Services Center with Commissioners
Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Syd Nelson, and Malcolm Lee present.
Commissioner Bob Block was absent.
Approval of Agenda
Motion by Mosher, second by Nelson, and unanimously carried to approve the Human
Services Board agenda of August 22, 2006, as mailed.
Approval of Minutes
Motion by Froemming, second by Mosher, and unanimously carried to approve the Human
Services Board minutes of August 8, 2006, as mailed.
Court Services Facility Tour
Court Services Director, Chuck Kitzman, briefed the Board regarding an upcoming facility
tour at Thistledew Forestry Camp.
Public Health Conference
Public Health Director, Diane Thorson, briefed the Board regarding the annual 2006 Public
Health Conference scheduled for September 27, 2006, through September 29, 2006.
Child Support Program Overview
Human Services Supervisor, Brooks Anderson, presented several handouts regarding child
support facts and figures in the State of Minnesota and compared statewide statistics to
collections in Otter Tail County. He reported the total net County cost for the Child Support
Program as $270,822 for CY2005. Mr. Anderson reported that the federal government has
recalculated how the County receives reimbursement resulting in about an $88,000 loss in
funding beginning in 2007. At the end of FY2005, there were 249,300 cases in the State of
Minnesota and 2,453 open cases in Otter Tail County. Further discussion took place
regarding new Child Support Guidelines, which should set support payments in a more
reasonable manner, and enforcement levied for non-payment.
Other Human Services Handouts
Human Services Director, John Dinsmore, submitted handouts entitled OLA Human Services
Administration dated June 2006 and MFIP and CCSA Program Services for January 1, 2006
to December 31, 2007.

Motion by Lee, second by Mosher, and unanimously carried to approve the County Board

Approval of Minutes
Motion by Froemming, second by Nelson, and unanimously carried to approve the County
Board minutes of August 15, 2006, as presented.
Approval to Pay Bills
Motion by Lee, second by Mosher, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.

Temporary Clerical Position
Motion by Nelson, second by Lee, and unanimously carried to approve an extension for the

2006.
Application for Cleaning County Road Ditch
Motion by Mosher, second by Lee, and unanimously carried to approve an Application for
Cleaning County Road Ditch on County Highway No. 118 in Oscar Township as presented by
Ted Hegseth.
2005 -2006 Winter Snow Costs
Highway Engineer, Rick West, reported 2005-2006 winter snow costs for the County at
$1,118,213.06, increased substantially from the previous winter season when costs were
reported as $786,768.62.
Leadership Cohort Pilot Project
AMC Executive Director, Jim Mulder, addressed the Board regarding change in the way
government delivers services in the future. He shared a vision that counties move forward
and outline ideas that would assist in being in charge of what happens in the future.
Mr. Mulder presented several handouts and focused on the Association of Minnesota
Counties Leadership Cohort Program Pilot Project, October 2006 -February, 2007. The
purpose of the pilot project is to build leadership capacity within a county or group of counties
to improve effectiveness of county government and to assist in creating team environments
within and among communities to expand professional networks. The pilot project is to
provide an opportunity for five counties to participate with 4-6 people selected for each
county. Otter Tail, Clay, Douglas, Pope, and Stevens County are invited to participate in this
regional leadership for the future project. Discussion continued. Motion by Nelson, second
by Lee, and unanimously carried to authorize $5,000 to the Association of Minnesota
Counties for Otter Tail County's participation in the AMC Leadership Cohort Program Pilot
Project as presented by the AMC Executive Director.

Planning Commission Recommendations
Conditional Use Permit-Dwayne & Lisa Augustus:
Motion by Froemming, second by Nelson, and carried with Mosher opposed, to deny a
Conditional Use Permit, as recommended by the Planning Commission, to build a storage
facility for boats and repair boats, engines, & trailers. The property is described as Pt of GL 3
(6.46 AC), Section 16 of Leaf Lake Township; West Leaf Lake (56-114).
Conditional Use Permit -Orin Bolstad, et al:
Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use
Permit to prepare a building site and construct a driveway to the site as presented. The
property is described as NE¼ SW¼ & GL 3 S of Rd Ex Trs & NE 375' of GL 3, Section 35 of
Tordenskjold Township; Stalker Lake (56-437).
Conditional Use Permit-PAC Investment Properties:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional
Use Permit to combine an existing driveway and public access road to create a town road as
presented provided that the use of the public access to remove boats this season (2006) be
allowed. The property is described as Pt GL 2 and E ½ SE ¼ & Lots 3 & 4, Sec 19, Amor
Township; Twin Lakes (56-382).
Conditional Use Permit Erica Pederson & Eugene Pederson:
Motion by Mosher, second by Nelson, and unanimously carried to approve a Conditional Use
Permit to prepare a building site for a walkout basement and construct a driveway to the
proposed building site with conditions as recommended by the Planning Commission. The
property is described as: All that Pt of GL 4, Commencing at NE Cor GL 3, Section 16 of
Sverdrup Township; Unnamed Lake (56-459).
Blue Heron Bay
Mr. Kalar reported that last Tuesday, August 15, 2006, the public comment period for the
draft EIS for Blue Heron Bay ended at 4:30 p.m. He reported that twenty-two timely
responses and three late responses were received. The Consultant, working with the County
Attorney and the Land & Resource Director, will work on completing a final EIS for Blue
Heron Bay considering the comments that have been submitted.
Filing Extension for Final Plat
Motion by Lee, second by Nelson, and unanimously carried to approve an extension for filing
the Final Plat of Robert & Linda Honer known as "Beaver Dam Shores" located on Star Lake
until December 31, 2006, because of an issue clearing the title to the property.
Extension Request for Conditional Use Permit
Motion by Nelson, second by Lee, and unanimously carried to approve an extension for
Conditional Use Permit #6070 until September 26, 2008. This CUP is for replacement of
mobile homes on Head Lake Camp.

Correction to Filing Date for the Final Plat of "Lakeside Timber Estates"
Motion by Froemming, second by Mosher, and unanimously carried to clarify Page 6 of the
August 15, 2006, Board of Commissioners minutes to approve an extension for filing the
Final Plat known as "Lakeside Timber Estates" until December 1, 2006. The property is
located in Section 10 of Parkers Prairie Township; Horsehead Lake (56-22). The previous
motion erroneously documented the extended filing date as September 1, 2006.
Classification of Tax Forfeited Land and Request for DNR Approval
Otter Tail County Board Resolution No. 2006 -61
Upon a motion by Nelson, second by Mosher, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, The County Board of Commissioners of the County of Otter Tail, State of
Minnesota, desires to offer for private sale the following described parcels of land that have
forfeited to the State of Minnesota for non-payment of taxes:

Tax Forfeited July 2, 2003
WHEREAS, said parcels of land have been considered and viewed by the County Board of
Commissioners and has been classified as non-conservation lands as provided for in
Minnesota Statutes 282.01, and
WHEREAS, based on certification from the City of Perham the highest and best use of the
above described property can only be achieved by adding it to an adjoining parcel thereby
increasing the usability and value of one of the adjoining properties, and
WHEREAS, based on certification from the City of Perham, the property described above
does not meet current minimum standards for development under the City of Perham's
zoning regulations;
NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners
hereby certifies that the above referenced parcel of land has been considered, visually
viewed on a map and complies with the provisions of Minnesota Statutes 85.012, 92.461,
282.01 Subd. 8 and 282.018 and other statutes that require the withholding of tax-forfeited
lands from sale.
BE IT FURTHER RESOLVED, That the Otter Tail County Board of Commissioners hereby

Premise Permit
Otter Tail County Resolution No. 2006 -62
Commissioner Lee offered the following and moved its adoption:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the Becker County Humane Society, Detroit Lakes, MN, has made an
application to the Gambling Control Board for the purpose of conducting lawful gambling at
Heisler's Campground and Pub, located at 31870 County Highway 130 in Candor Township
of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the Becker County Humane Society, Detroit Lakes, MN, at
Heisler's Campground and Pub, located at 31870 County Highway 130 in Candor Township
of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Becker County Humane Society,
Detroit Lakes, MN, at Heisler's Campground and Pub, located at 31870 County Highway 130
in Candor Township of Otter Tail County, provided the applicant meets all the necessary
criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to
the Township of Candor by sending them a copy of this resolution.

Payment Approvals
Motion by Nelson, second by Froemming, to approve final payment to Woessner
Construction, Inc., in the amount of $4,543.93, for a portion of the remodeling completed for
Court Administration. Commissioner Nelson and Froemming withdrew the motion and
second respectively and requested that the Building Committee review change orders on the
project.
Motion by Mosher, second by Lee, and unanimously carried to approve payment to Shultz
and Associates for the following:
a. Ottertail Operations Center Design Development $12,400.00
b. Jail/Courthouse Planning Planning $ 4,000.00
Further discussion is needed prior to additional expenses relative to the Ottertail Operations
Center.
Clean up of Tax Forfeited Property
Motion by Lee, second by Nelson, and unanimously carried to authorize the STS Program to
complete a general cleanup of the following property:

Approval of Findings and Order for Dog Bite Hearing
Motion by Froemming, second by Lee, and unanimously carried to approve the Findings of
Fact and Order as prepared by the County Attorney for Dustin Bender, regarding a serious
dog bite incident involving Mr. Bender's dog named Smokey.
Recess & Reconvene
At 12:14 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners' meeting recessed for lunch break. The meeting was reconvened at
1:15p.m.
Resolution To Participate And Designate Property For Tax Free Zone Designation
Otter Tail County Resolution No. 2006 -63
WHEREAS, the Perham Economic Development Authority has a desire to promote economic
development within the city boundaries, and
WHEREAS, the State of Minnesota through the Minnesota Department of Employment and Economic
Development has created the Job Opportunity Building Zones to promote economic development in
rural Minnesota, and

WHEREAS, the Perham Economic Development Authority has been authorized a total of 389.56
acres of JOBZ designation, and
WHEREAS, the State of Minnesota allows JOBZ designation to be transferred to undesignated

WHEREAS, the Perham EDA will seek authorization from the City of Perham, Perham-Dent School
Board, Otter Tail County and Perham Hospital District to transfer JOBZ designation to the 19.5 acre
parcel currently in Perham Township, undergoing annexation into the City of Perham.

Ditch No. 68
Ditch Inspector, Randy Wasvick, stated that Ditch No. 68 in Henning, Inman Township, starts
on the township line at Section 33 and goes north of Henning. He provided a map of where
the ditch flows and highlighted a section of the ditch in Sections 19 and 20. Section 20 on the
East side of the road is US Fish and Wildlife land and has about 2 ft. of water and the other
side of the road is dry, so water is not moving. David Heard is requesting that the County
clean out a mile of the ditch as indicated in red on the map. Mr. Wasvick reported that the
ditch is in good shape downstream. Discussion followed regarding cost, assessments and
the number of landowners. Motion by Froemming, second by Mosher, and unanimously

carried to authorize the Ditch Inspector to proceed with cleaning out this portion of Ditch
No. 68 as presented on the map.
Ditch No. 41
Mr. Wasvick stated that Ditch No. 41 is in Newton and Otto Townships and starts out
northwest of New York Mills. It is a large Ditch System and has been in disrepair for quite
some time. Property owner, Rick Cichy would like to see something done with the system
because every spring he gets flooded out. Motion by Nelson, second by Froemming, and
unanimously carried to establish the date and time for a Public Informational Meeting for
Ditch No. 41 at 7:00 p.m. on Monday, September 25, 2006, at 118 N. Main, New York Mills
Offices.
Request for Forgiveness of Penalty
Motion by Mosher, second by Nelson, and unanimously carried to deny the request for
Forgiveness of Penalty for late payment of real estate taxes, in the amount of $310.70, for
DakBev, LLC for Parcel #R 71003991432005, as there was not a County error identified.
Northeast Landfill Demolition Site
Solid Waste Director, Mike Hanan, discussed the situation with the demolition cells at the
Northeast Landfill. He requested authorization to request quotations from qualified bidders to
build cell No. 5 rather than bids as the construction needs to be completed this year. Motion
by Froemming, second by Nelson, and unanimously carried to authorize the Solid Waste
Director to proceed with requesting quotations for Construction of Cell No. 5 and capping
Cell Nos. 1 & 2 at the Northeast Landfill to allow completion of this project this year. By state
law, bids are not required for solid waste projects.
Part Time Corrections Officers
Motion by Froemming, second by Lee, and unanimously carried to authorize the Detention
Facility Administrator to hire 2-3 additional part time Corrections Officers.
Support of Scambler Township Request to Enact a Gravel Tax
Otter Tail County Resolution No. 2006 -65
A RESOLUTION IN SUPPORT OF SCAMBER TOWNSHIP'S RESOLU_TION #2006-01 TO
REQUEST THE STATE LEGISLATURE TO ENABLE SCAMBLER TOWNSHIP, OTTER
TAIL COUNTY TO IMPLEMENT AND COLLECT GRAVEL EXTRACTION TAX.
Commissioner Froemming offered the following and moved its adoption:
WHEREAS, Scambler Township has large deposits of aggregate within the township.
WHEREAS, Scambler Township boarders Clay and Becker County, both of which have
enacted a gravel extraction tax.
WHEREAS, A major part of the road used to haul aggregate material goes through Scambler
Township.

WHEREAS, Otter Tail County has declined to enact a county wide gravel extraction tax
because the County Commission feels it may adversely affect some smaller operations in
Otter Tail County.
WHEREAS, Aggregate Industries, the only mining company currently extracting aggregate in
Scambler Township, has indicated that it is in favor of an extraction tax in Scambler
Township.
NOW, THEREFORE BE IT RESOLVED, That the Otter Tail County Board of Commissioners
of Otter Tail County, Minnesota, does hereby request that the state legislature enact
legislation pursuant to Minnesota Statutes Chapter 298, allowing Scambler Township to
implement a gravel extraction tax as requested in the Scambler Township Resolution
#2006-01.
Commissioner Lee seconded the motion, and upon being put to a vote, was carried as
