HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/16/2006MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, May 16, 2006 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, May 16, 2006, at 9:30 a.m., at the Otter Tail County Government Services Center with Commissioners Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Bob Block, Syd Nelson, and Malcolm Lee present. Approval of Agenda Motion by Lee, second by Nelson, and unanimously carried to approve the County Board agenda of May 16, 2006, with the following addition: 1 :30 p.m. -Jim Puchtel -Sewell Lake High Water Discussion Approval of Minutes Motion by Mosher, second by Block, and unanimously carried to approve the County Board minutes of May 9, 2006, as mailed. Approval to Pay Bills Motion by Block, second by Froemming, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. GIS Department Promotion Motion by Lee, second by Mosher, and unanimously carried to approve a new job description for a GIS Lead Developer (Job #2807) and a promotion from GIS Technician (Job #2804) to GIS Lead Developer effective June 1, 2006. Personnel Board of Appeals Motion by Mosher, second by Block, and unanimously carried to reappoint Charles Davis, effective January 1, 2005, and Virginia Portmann, effective January 1, 2006, to the Personnel Board of Appeals for three-year terms. Institutional Correctional Work Crew Sheriff, Brian Schlueter, reported that the ICWC Program depends on the sale of houses through the Otter Tail Wadena Community Action Council. Those sales have reduced in this area; therefore, the State of Minnesota is downsizing the program from about 12 participants to 8, which will result in reduced funding for Otter Tail County. Sheriff Department Staffing Motion by Nelson, second by Block, and unanimously carried to replace a Detention Officer position due to a termination and to authorize the Sheriff to develop an Eligibility List for Detention Officers. Motion by Lee, second by Mosher, and unanimously carried to hire a part time Dispatcher and to authorize the Sheriff to develop an Eligibility List for Dispatchers. OTC Board of Commissioners' Minutes May 16, 2006 Page 2 Motion by Nelson, second by Lee, and unanimously carried to replace a seasonal Boat and Water Position. Motion by Lee, second by Mosher, and unanimously carried to approve a position change from Clerk/Typist (Job #2318) to Records Technician with a salary grade change from Grade 8 to Grade 9. Property Tax Issue Tammy Anderson, Director of Children's Corner stated that Children's Corner is a non-profit 503(c) program. She stated that 12 infants are served at their infant site and 92 at their main site with other children scheduled for back up daycare. Ms. Anderson stated that last fall, the organization learned that their tax exempt status was being taken away and they would need to pay approximately $10,000 per year. She staled that they do not have the money, the program is critical for the children in the community, and Children's Corner is the only one of its kind in Fergus Falls and in the entire County. It is already difficult to find child care and she noted that the center would likely have to close if the property taxes were required. Lengthy discussion took place regarding the laws, the State's opinion letter, additional information that could be provided, valuation and classifications, and the process to defer the property taxes. Assessor, Bob Moe, responded that Children's Corner needs to show proof of what charities the organization is providing or what education is being provided. He mentioned scheduled classes and a curriculum that would be similar to a school. Mr. Moe stated that County subsidies are not a charity. County Attorney, David Hauser, stated that the decision of who qualifies for non-profit tax exempt status is the Assessor's decision. Motion by Nelson, second by Lee, and unanimously carried, that the Board of Commissioners' opinion is that this appears to be an exempt property and request the Assessor find Children's Corner a tax exempt property because of the organization's 503(c) status and required licensing which is the same as other schools. The County Attorney advised Ms. Anderson to apply for property tax abatement before July 1, 2006, and provided her with the County's abatement policy. Deferred Compensation Program Nationwide Retirement Solutions Deferred Compensation Program Director, Tom Jones, briefed the County Board on the Section 457 Retirement Program that is offered to County employees. He stated that Nationwide, formerly known as PEBSCO, is the largest deferred compensation provider in the country that focuses on governmental plans and he provided several interesting trends with Otter Tail County's program. He reported on the Loan Access program which can be set-up utilizing Automatic Withdrawal from employee's checking accounts to pay back the loans rather than payroll deduction. Otter Tail County does not currently have this option and Mr. Jones encouraged inclusion of that amendment to the County's plan. Recess & Reconvene At 10:54 a.m., Chairman Froemming declared the Otter Tail County Board of Commissioners meeting recessed for a short break. The meeting was reconvened at 11 :01 a.m. Planning Commission Recommendations Preliminary Plat & Conditional Use Permit-"South Shore"/Bluebi/1 Shores. LLC: Motion by Froemming, second by Mosher, and unanimously carried to approve a Preliminary Plat known as "South Shore" consisting of 11 lots for single family residential use and a Conditional Use Permit to construct a road to service the plat, with conditions as recommended by the Planning Commission. The property is described as GL 2 ex trs (16.19 Ac) & pt of GL 3 ... (3.98 AC) Section 7 of Otter Tail Township; Long Lake (56-210). Conditional Use Permit-Woodland Beach Resort Assoc .• LLC: Motion by Mosher, second by Froemming, and unanimously carried to approve a Conditional Use Permit to install new footings and foundation under an existing cabin and install new roof as presented. The property is described as Pt GL 3, Section 2 of Everts Township; Otter Tail Lake (56-242). Amendment of Conditional Use Permit-Woodland Beach Resort Assoc .• LLC: Motion by Mosher, second by Block, and unanimously carried to allow a rotation of the roof lines to run east and· _west to match the previously approved request and approve this amendment to CUP #6151. The property is described as Pt GL 3, Section 2 of Everts Township; Otter Tail Lake (56-242). Preliminary Plat and Conditional Use Permit -"Johnson Lake Estates First Addition"/Pinnacle Land Development, Inc: Land & Resource Director, Bill Kalar, stated that this request was recommended for denial by the Planning Commission for various reasons as documented. Glen Freeland, President of Pinnacle Land Development, LLC, stated that, contrary to the Planning Commission's problems with the storm water drainage plan, he felt it was a very well done plan that follows all Shoreland Ordinance regulations and stated that there is adequate building area on Lot 4. He requested approval of the plan as presented. Motion by Mosher, second by Lee, to deny, as recommended by the Planning Commission, the Preliminary Plat known as "Johnson Lake Estates First Addition" and the Conditional Use Permit to service the plat for the reasons as stated in the May 10, 2006, Planning Commission minutes. Chris Mccann of Interstate Engineering, stated that the MPCA rules must be followed in the erosion control plan and the plan was acceptable to them. Mr. Kalar expressed concern with the erosion control plan and the buildability of Lot 4 and the likelihood of a buyer of the property actually building in the area(s) indicated. Chairman Froemming called for a vote on the motion for denial. Motion carried unanimously. Inc: OTC Board of Commissioners' Minutes May 16, 2006 Page 7 Motion by Froemming. second by Block. and unanimously carried to approve a Conditional Use Permit to replace a roof as presented. The property is described as Pt GLS 3 & 5 (2.50 AC) Section 12 of Amor Township; Otter Tail Lake (56-242). Conditional Use Permit -Edna Township: Motion by Nelson, second by Lee. and unanimously carried to approve a Conditional Use Permit to install a new culvert subject to clarification of the October 7, 2005, letter from the DNR that this is an installation of an additional culvert not a replacement culvert. The property is located at Engstrom Beach Road (41680 Engstrom Beach Road) Section 30 of Edna Township; Archie Lake (56-1629) & Big McDonald Lake (56-386). Conditional Use Permit -Allen & Marion Antonsen: Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit to construct a road as presented. The property is described as SW¼ ex 2 rds, Section 9 of Hobart Township; Rose Lake (56-360). Conditional Use Permit -Otter Tail Ag. Enterprises, LLC: Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use Permit for construction of storm water drainage improvements and cooling water discharge for the proposed ethanol facility as presented. The property is located in Sections 17 through 20 of Fergus Falls Township; Pelican River (56-PR) and Unnamed Lake (56-859). Highway Contracts and Bonds Motion by Lee, second by Block, and unanimously carried to authorize the Chairman's signature to execute a contract between Otter Tail County and Morris Sealcoat & Trucking, Inc. for the 2006 Countywide Seal Coat Project (S.A.P. 56-604-13, Etc.), contingent upon the approval of the County Attorney. Motion by Nelson, second by Lee, and unanimously carried to authorize the Chairman's signature to execute a contract between Otter Tail County and AAA Striping Service Co. of Rogers, MN, for 2006 Countywide Traffic Marking, CP 06:TM & Etc., contingent upon the approval of the County Attorney. Motion by Lee, second by Mosher, and unanimously carried to authorize the Chairman's signature to execute a Contract between Otter Tail County and UAP Distribution, Inc. of Kasota, MN, for the 2006 Seasonal Supply of Herbicides. The purchase of Herbicides is from the State Bid, Contract #427847. Recess & Reconvene At 11 :51 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1 :08 p.m. Public Hearing Established Motion by Mosher, second by Block and unanimously carried to establish a Public Hearing at 1 :00 p.m. on Tuesday, June 13, 2006, to consider enactment of an Otter Tail County Business Subsidy Policy. OTC Board of Commissioners' Minutes May 16, 2006 Page 8 North & South Turtle Lake High Water Discussion Property Owner, Bryan Severson, stated that North Turtle Lake property owners would not accept additional restriction of the flow of water through the culvert that flows to South Turtle Lake. County Attorney, David Hauser, spoke in regards to the Storm Sewer Systems statute, which addresses control and disposal of rain water. The claim, in this situation, is that the high water is the result of many years of excess rain which is storm water. Disposal is an appropriate use of a storm water system. Mr. Hauser stated that DNR Hydrologist, Terry Lejcher, would need to document this fact for the County to proceed with disposal of excess rain water. The statute has requirements such as an engineered plan, special assessments, comprehensive plan, cost estimates, and the design needs to be based upon the relative benefits of the actual properties. Mr. Hauser stated that, unless there is a petition signed by all landowners subject to assessment, to proceed would require a 4/5ths vote of the County Board. Highway Engineer, Rick West, will review the current plan. Bricker Johnson of the South Turtle Lake LID, stated that the LID has applied for two grants, one for pumping costs and one for the permanent project. Motion by Mosher, second by Froemming, and unanimously carried to proceed with a feasibility study of a Storm Sewer System pursuant to M.S. 444.075 to drain storm water from the North and South Turtle Lake area. Membership Fee for the Center for Rural Policy and Development Motion by Block, second by Nelson, and unanimously carried to approve payment, in the amount of $250.00, payable to the Center for Rural Policy and Development for the annual membership investment. Adjournment At 2:10 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, May 23, 2006.
