HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/02/2006MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, May 2, 2006 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, May 2, 2006, at 9:31 a.m., at the Otter Tail County Government Services Center with Commissioners Roger Froemming, Chair; Dennis Mosher. Vice-Chair; Bob Block, Syd Nelson. and Malcolm Lee present. Approval of Agenda Motion by Block, second by Nelson, and unanimously carried to approve the County Board agenda of May 2, 2006, with the following additions: 10:35 a.m. -Bill Kalar -Final Plat High Water Discussion -Added to Rick West's Agenda Items Approval of Minutes Motion by Lee, second by Froemming, and unanimously carried to approve the County :Board minutes of April 25, 2006, as mailed. Approval to Pay Bills Motion by Lee, second by Nelson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Appreciation Plague Chairman Froemming presented an Appreciation Plaque to Norman Fjestad for 24 years of service representing Otter Tail County on the WesMin RC & D and the WOT Soil & Water Conservation District. Mr. Fjestad talked about the good things that were accomplisred in the past with these conservation organizations and thanked the County for their support. Ethanol Plant Project Attorney for Otter Tail Ag Enterprises, Kent Mattson, provided a handout dated May 2, 2006, regarding an Ethanol Project update. The estimated total project cost was reported as $95,500,000.00 with Sources of Funds and Uses of Funds detailed on the handout. , Otter Tail Ag Enterprises requested that Otter Tail County move forward on the $5,000,000.00 bond for the project. The current plan is to be processing 2007 corn. Further discussion took place regarding staffing, amount of corn needed, and financing. Otter Tail Ag Enterprises President, Jerry Larson, presented the site design and engineering that is taking place at the Ethanol Plant site. Commissioner Mosher asked about the equity drive. Mr. Mattson stated that 10% down was required for all equity pledges with enforceable promissory notes in1 place that are payable June 15, 2006. The Environmental Assessment Worksheet has beeri filed. Discussion took place regarding the specifics of the bonding which could include bonding for infrastructure and reducing the term of the loan. Commissioners suggested that Mr. Mattson work with Highway Engineer, Rick West, and Gordon Hydukovich regarding grants that are available and the process to apply for those grant dollars. Commissioner Lee suggested using a burner to provide the energy needs of the project. He suggested using the current transfer facility to haul garbage to the landfill until waste could be utilized for energy. OTC Board of Commissioners' Minutes May 2, 2006 Page 2 Commissioner Nelson absent at 10:10 a.m. Boat and Water Grant Funding Motion by Mosher, second by Lee, and carried with Nelson absent, to authorize the Chairman's signature to execute a Grant Agreement between the State of Minnesota DNR and Otter Tail County which authorizes $5,000.00 supplementary funding for additional boat safety patrol hours for Otter Tail County for FY2006 Motion by Lee, second by Block, and carried with Nelson absent, to authorize the Chairman's signature to execute a Grant Agreement between the State of Minnesota DNR and Otter Tail County which authorizes $42,191.00 for boat and water safety funding for FY2006. Commissioner Nelson returned to the Board meeting at 10:14 a.m. RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT Otter Tail County Resolution No. 2006 -38 Commissioner Mosher offered the following and moved its adoption: BE IT RESOLVED, that Otter Tail County enter into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety, for the project entitled SAFE & SOBER COMMUNITIES during the period from October 1, 2006 through September 30, 2007. The Sheriff of Otter Tail County is hereby authorized to execute such agreements and amendments as are necessary to implement the project on behalf of the Otter Tail County Sheriffs Office and to be the fiscal agent and administer the grant. Commissioner Lee seconded the motion and upon being put to a vote, the resolution was unanimously adopted with all five commissioners present. Adopted this 2nd day of May, 2006. Renewal of 3.2 Off Sale Malt Liquor Underwood, MN I OTC Board of Commissioners' Minutes May 2, 2006 Page 3 Modifications to the 2006 Court Services Expenditure Budget Motion by Nelson, second by Block, and unanimously carried to approve the following modification to the 2006 Court Services Expenditure Budget: 1 From $753,999 to $775,577 an increase of $21,578 for the addition of a part-time Assistant ' Probation Officer. Recess & Reconvene At 10:17 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:29 a.m, Public Health Department Position 1 Motion by Mosher, second by Lee, and unanimously carried to authorize the Public Health Director to advertise for an eligibility list for vacancies that have occurred due to retirement. Discussion -Conditional Use Permit Approval Process County Attorney, David Hauser, discussed the Conditional Use Permit process with the Board of Commissioners. Final Plat -"The Palms of Lida" Motion by Lee, second by Nelson, and unanimously carried to approve the Final Plat known as "The Palms of Lida", Section 16 and Section 17 of Lida Township; Lake Lida (56-747). Discussion -Blue Heron Bay Land & Resource Director, Bill Kalar, reported on a meeting with the Dead Lake Association and the Consultant, Wenck & Associates regarding the Blue Heron Bay EIS process. Bid Award -S.A.P. 56-665-07 & Etc. After previously advertising for bids, the following bids were opened at 1 :00 p.m. April 5, 2006 for S.A.P. 56-665-07 & Etc., CSAH 65 overlay, CH 134 overlay, and paving of the Henning Garage parking lot: Bauerly Bros., Inc. Sauk Rapids, MN Mark Sand & Gravel Co. Fergus Falls, MN Central Specialties, Inc. Alexandria, MN $ 932,938.13 $1,153,503.10 $1,177,960.17 Motion by Froemming, second by Mosher, and unanimously carried to award S.A.P. 56-665- 07 & Etc., overlay on CSAH 65 to Bauerly Bros., Inc. of Sauk Rapids, MN as the low bidder at the bid price of $726,567.89. The award of Rocky Ridge Road, C.P. 05:130B, in the amount of $206,370.24 is contingent upon Henning Township approval. Speed Zone Study Request A segment of CSAH No. 27, near Jewett Lake Otter Tail County Resolution No. 2006 -39 Motion by Lee, seconded by Block, and unanimously carried to adopt the following resolution: WHEREAS, a group of residents have requested by petition that the County of Otter Tail take such action as may be necessary in order to pursue a reduced speed limit on the segment of County State Aid Highway No. 27 in the area of Wee Villa Resort and Jewett Lake, AND, WHEREAS, the County of Otter Tail believes that a speed zone reduction would be beneficial in this area. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that this area be studied by the Minnesota Department of Transportation to determine the need for a reduced speed zone, if any. BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive. He reported that the culvert between North and South Turtle Lakes has been sandbagged; however, ii needs additional sandbagging to restrict the flow at 50%, which is planned to be completed today. Mr. West stated that the Townships are meeting with property owners living around North & South Turtle Lakes to discuss a long term solution to the high water issue. Verlyn Dornburg, property owr:,er on South Turtle Lake, stated that since the culvert was opened, he had 125' of property and ' now, has only 50' and they have lost 5-6 ft. of depth. He requested that the culvert be closed to save the houses around South Turtle Lake. Property owner, Bert Kinzler, stated •that it costs $6,000 per month to run the pump out of South Turtle; however, if the culvert keeps flowing, the pumping isn't gaining and he expressed concern that by the time something is done, the houses are already going to be flooded. Lengthy discussion continued regarding a Joint Powers Agreement between Sverdrup and Everts Township, restricting the culvert between North and South Turtle Lakes at 100% for a temporary solution, using Ditch-37 to move water from North Turtle Lake to the Pomme de Terre River, and potential emergency action for a temporary solution. Motion by Froemming, second by Nelson, and unanimously carried to authorize the Highway Engineer to apply for a permit from the Minnesota Department of Natural Resources to restrict the culvert between North and South 1Turtle Lakes at 100% as a temporary solution to prevent flooding homes on South Turtle Lake while a long term solution can be developed. West Central CD Treatment and Correctional Center Initiative Motion by Froemming, second by Mosher, and unanimously carried to approve sending a letter regarding the 10-county West Central CD Treatment and Correctional Center initiative to legislators as presented. · Reappointment -Highway Engineer Motion by Nelson, second by Lee, and unanimously carried to reappoint County Highway Engineer, Rick West, for a four-year appointment and to authorize approval of Mr. West's current contract with an amendment. Motion by Lee, second by Mosher, and unanimously carried to direct that an excellent summary evaluation be placed in Mr. West's personnel file. Adjournment At 12:25 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, May 9, 2006.
