Call to Order
The Otter Tail County Human Services Board convened Tuesday, April 25, 2006, at
9:31 a.m., at the Otter Tail County Government Services Center with Commissioners
Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Bob Block, Syd Nelson, and
Malcolm Lee present.
Approval of Agenda
Motion by Lee, second by Nelson, and unanimously carried to approve the Human Services
Board agenda of April 25, 2006, with the following addition:
Public Health Department Staffing Discussion
Approval of Minutes
Motion by Mosher, second by Block, and unanimously carried to approve the Human Services
Board minutes of April 11, 2006, as mailed.
Court Services Department
Motion by Block, second by Mosher, and unanimously carried to reappoint Yvonne Mariotti
and Janyne Hoff to the Court Services Advisory Committee effective January 1, 2005, for a
three-year term.
Court Services Director, Chuck Kitzman, reported that the County Probation Officer
Reimbursement will be 40% for CY2005. He reported that by statute, the State is supposed
to reimburse 50% of the Probation Officers salaries which would be $160,180.69. Actual
dollars to be received were reported as $128,144.55. The Minnesota Association of County
Probation Officers (MACPO) is lobbying to receive the full 50% reimbursement.
Mr. Kitzman presented Supervision Fees paid to-date. The report showed 76.06% collection
rate from the amounts assessed. These collections began September 1, 2003.
Pandemic Flu Planning
Public Health Director, Diane Thorson, provided a Pandemic Flu Planning handout. She
indicated that funding, in the amount of $12,114.00, is Otter Tail County's share for planning
purposes. Requirements of the planning include a County assessment, coordination with
emergency management and other agencies, technical assistance to schools and community
businesses, education and training, and an exercise to be completed this fall. Ms. Thorson
suggested that a current temporary assignment could be increased to August, 31, 2006, to
work on Pandemic Flu planning and requested that a Planning Team be developed including
the Public Health Director, Emergency Services Director, County Coordinator, and County
Attorney.

Increased Hours for Replacement Position
Motion by Mosher, second by Nelson, and unanimously carried to increase the hours for
Public Health Clerk position Gob code 2127) from 32 hours per week to 40 hours per week
and to authorize replacement of the position because of an upcoming retirement.
Foster Care Program
Human Services Foster Care Licensers discussed the Foster Care Program including the
funding, types of foster care homes, and challenges with relative foster care. Because May is
Foster Care Awareness Month, they requested approval of the following proclamation:

Commissioner Nelson offered the following and moved its adoption:
WHEREAS, the family, serving as the primary source of love, identity, self-esteem and
support, is the very foundation of our communities, our state, and our Country.
WHEREAS, in Otter Tail County licensed foster homes, there are over 41 children and youth
in foster care being provided with a safe, secure, and stable home along with the compassion
and nurture of a foster family, and
WHEREAS, Otter Tail County Human Services has licensed over 35 foster families, who
have opened their homes and hearts to children whose families are in crisis, play a vital role
helping children and families heal and reconnect and launching children into successful
adulthood, and
WHEREAS, there are over 96 adults in licensed adult family foster care homes, and
WHEREAS, there are over 46 licensed adult family foster care providers, who have opened
their homes to provide a family environment to individuals with developmental disabilities,
mental illness or who are elderly, and
WHEREAS, there are numerous individuals, public and private organizations who work to
increase public awareness of the needs of children and adults in foster care as well as the
enduring and valuable contribution of foster care providers.
NOW, THEREFORE, we, the Otter Tail County Human Services Board, by virtue of the
authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim
May as FOSTER CARE MONTH in Otter Tail County and urge all citizens to volunteer their
talents and energies on behalf of children/adults in foster care, foster parents, and the
professional staff working with them during this month and throughout the year.
Commissioner Mosher seconded the resolution and, upon being put to vote, was
unanimously adopted.

Children & Adult Mental Health Programs
Brad Erickson, member of the Children's' Mental Health Local Advisory Committee, updated
the Board regarding their activities and provided an LAC FY06 Work Plan. Luanne Hanson
and Fonda Knutson, Adult Mental Health LAC members, provided an update for the past
year. They requested approval of the May is Mental Health Month Proclamation.

Otter Tail County Resolution No. 2006 -36
Commissioner Froemming offered the following and moved its adoption:
WHEREAS, the U.S. Surgeon General states that mental health is fundamental to health and
indispensable to personal well-being, family and interpersonal relationships, and contributes
to community and society; and
WHEREAS, the U.S. Surgeon General confirms that mental illness affects one in five
Americans every year, regardless of age, gender, race, ethnicity, religion or economic status;
and
WHEREAS, the U.S. Surgeon General has found that a range of treatment exists for most
mental disorders and the efficacy of mental health treatments are well documented; and
WHEREAS, Otter Tail County has made a commitment to community-based systems of
mental health care for all residents and has appointed Local Mental Health Advisory
Committee for children and adults.
WHEREAS, the guiding principles of community mental health care have always been
comprehensiveness, cost-efficiency, effective management and high-quality and consumer
responsive services, and these principles are now being adopted by private and public
healthcare payers; and
WHEREAS, the National Mental Health Association, the National Council for Community
Behavioral Healthcare and their national partners, the National Alliance for the Mentally Ill
and their local affiliates observe Mental Health Month every May. to raise aw.areness and
understanding of mental health and illness; ' ' · i
I THEREFORE, we, The Otter Tail County Human Services Board, by virtue of the authority
vested in us as County Commissioners of Otter Tail County, do hereby proclaim May 2006

Human Services Positions
Motion by Mosher, second by Lee, and unanimously carried to proceed with the hiring
process for a vacant Financial Worker position and to replace a Social Worker position due to
a retirement.
Legislative Update
Human Services Director, John Dinsmore, provided a Minnesota Association of County
Social Service Administrators (MACSSA) Legislative Update dated April 14, 2006. He
discussed the differences between the Governor's recommendation for the next two Fiscal
Years and the House and Senate Proposals as well as the County Based Purchasing vs.
PMAP.
Bills & Claims
Motion by Block, second by Nelson, and unanimously carried to approve the Human Services
bills & claims as presented.
Regional CD Treatment and Correctional Center Concept
County Coordinator, Larry Krohn, provided a handout from an April 21, 2006, Taskforce
Meeting of the BKV Group regarding discussion of a possible West Central C.D. Treatment
and Correctional Center with both non-secure and secure settings. Concepts and barriers of
a regional facility were discussed.

At 10:43 a.m., Chairman Froemming declared the meeting of the Otter Tail County Human

The Otter Tail County Board of Commissioners convened Tuesday, April 25, 2006, at
11 :01 a.m., at the Otter Tail County Government Services Center with Commissioners
Roger Froemming, Chair; Bob Block, and Malcolm Lee present. Commissioners Syd Nelson
and Dennis Mosher were present at 11 :04 a.m.
Approval of Agenda
Motion by Lee, second by Block, and unanimously carried to approve the County Board
agenda of April 25, 2006, with one addition as follows:

Approval of Minutes
Motion by Froemming, second by Lee, and unanimously carried to approve the County Board
minutes of April 18, 2006, as mailed.
Approval to Pay Bills
Motion by Lee, second by Block, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Planning Commission Recommendations
Conditional Use Permit-Senter Seven Inc.:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use
Permit to replace a damaged roof from the August of 2005 wind storm as presented. The
property is described as S 474' of GL 3 ex .6 AC tr in SW er. (4.4 AC) Section 16 of Dead
Lake Township; Dead Lake (56-383).
Conditional Use Permit-Steve & Tanis Wichmann:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional
Use Permit for a Massage Therapy and Raindrop Technique Home Business with conditions
as recommended by the Planning Commission. The property is described as Echo Ranch

Conditional Use Permit -Pat & Roxsie Schindler:
Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use
Permit to construct a driveway with a condition as recommended by the Planning
Commission. The property is described as 6.66 Ac tr in SE¼ SW¼ & in GL 3 AKA tr 12 Doc
#988269, Section 18 of Everts Township; Silver Lake (56-302).
Conditional Use Permit-Otter Tail County Highway Dept:
Motion by Mosher, second by Nelson, and unanimously carried to approve a Conditional Use
Permit to reconstruct CSAH 82 from TH 59 to Norway Pine Road which is approximately 4.27
miles. The project includes replacement of Bridge No. 8200 at the Pomme de Terre River.
This approval is subject to an amendment and extension for completion of the project as
recommended by the Planning Commission. The project location is as follows: From NW
cor, Section 6 of Tumuli Township to the NE cor of the NW¼ of the SE ¼, Section] 10 of
Tumuli Township. (CSAH 82 from TH 59 SE to Norway Pine Road, 4.27 miles); From ~talion

Conditional Use Permit-Otter Tail County Highway Dept:
Motion by Mosher, second by Froemming, and unanimously carried to approve a Conditional
Use Permit to replace deficient Bridge No. 56509 located on CSAH No. 83 in Everts
Township over the Otter Tail River as presented with the completion date being extended to
October 1, 2006. The project is located as follows: Crossing of CSAH No. 83 and the Otter
Tail River in SW ¼, Section 5 and NW ¼, Section 8 of Everts Township: Otter Tail River
(56-OTR) Deer Lake (56-298).
Conditional Use Pennit -Paul & Martha Pfeifle:
Land & Resource Director, Bill Kalar, stated that this Conditional Use Permit request is for a
marine business (storage of boats, pontoons, etc.) and a maintenance and repair business.
He noted that the Planning Commission recommended approval with several conditions.
Neighbor, Gerald Crissler spoke in opposition of the project citing a serious drainage issue
and a commercial use in a residential area. Mr. Kalar stated that there is potential for
drainage concerns and that is the reason for the requirement to provide a drainage plan.
Motion by Lee, second by Block, to approve a Conditional Use Permit for a proposed new
building and operation of a boat, pontoon, & car storage, and maintenance and repair
business, with conditions as recommended by the Planning Commission.
Further discussion took place. Jim Schreiner spoke in opposition of the project and
expressed concerns with the flow of the water into Lake Lida and his belief that there isn't
enough acreage for the proposed project. County Attorney, David Hauser, explained that
size requirements are dependent upon when the lot of record was created. Gerry Schreiner
questioned vehicles and boats being stored outside and the safety of the entrance because
of the hill. Applicant, Paul Pfeifle, stated that the entrance issue was not addressed at the
Planning Commission meeting: however, could be addressed by the County Highway
Department requesting a reduced speed zone from the State of Minnesota.

center of the lot with a condition as recommended by the Planning Commission. The

Conditional Use Permit -Raymond & Melissa Rogers:
Motion by Mosher, second by Nelson, and unanimously carried to approve a Conditional Use
Permit for a 2-unit cluster development and for construction of a road to serve the
development with conditions as recommended by the Planning Commission. The property is
described as Lot 1 ex trs & tri tr in NW cor of SE ¼ NW ¼ .. (20.29 AC) Section 32 of Dane
Prairie Township; Swan Lake (56-781).
Conditional Use Permit -Shady Grove Resort/Wes & Theresa Jeltema:
Motion by Froemming, second by Nelson, and unanimously carried to approve a Conditional
Use Permit to add 2 campsites to the resort as presented. The property is described as Lots
3 & 4 of Snodgrass Basswood Grove and Pt of GL 1 ... ,Section 26 of Rush Lake Township;
Rush Lake (56-141).
Conditional Use Permit-Sverdrup Township:
Motion by Block, second by Mosher, and unanimously carried to approve a Conditional Use
Permit to reconstruct a road with conditions as recommended by the Planning Commission.
The project location is as follows: Pony Road located in the SW¼, Section 12 of Sverdrup
Township; Horseshoe Lake (56-455).
Conditional Use Permit -James & Penny Schaeffer:
Motion by Mosher, second by Nelson, and unanimously carried to deny a Conditional Use
Permit, as recommended by the Planning Commission, to bring in 1,800 yds of fill for
landscaping for the reasons as staled in the April 19, 2006, Planning Commission minutes.
The property is described as Swenson Beach Lot 1 Block 1, Section 7 of Nidaros Township;
Clitherall Lake (56-238).
Stump Removal from the 2005 Wind Storm
Commissioners discussed clean-up of brush and slump removal that is continuing to take
place as a result of the wind storm last summer. Motion by Nelson, second by Mosher, and
unanimously carried to waive the permit fee for storm-related stump removal.
Recess & Reconvene
At 11 :59 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1 :00 p.m. I

Proposed Grant Applications -Ethanol Project :
Gordon Hydukovich met with the Board and discussed grants that are available, ,up to
$700,000, from the State of Minnesota for the proposed Ethanol Plant. Mr. Hydukovich
offered to write the grants on behalf of Otter Tail County. Discussion took place regarding
matching funds and the proposed bonding arrangement. The County Board requested
further research on this matter.

Jail Space Planning
Physical Plant Manager, Rick Sytsma, discussed jail planning space issues. For future
planning purposes, he proposed that the County Board acquire properties adjacent to the
Courthouse as it becomes available.
Sewell Lake Flooding Discussion
Sewell Lake Property Owner, Pat Puchtel, stated that when their property was purchased in
1996, they were able to mow their lakeshore and use the property even though there was a
lot of snow in 1997. She noted that after the past four years, when new tiling was put in by
the farmers in the area, they have not been able to use their land. Ms. Puchtel provided
pictures of their flooded property as well as other neighbors in the area with similar problems.
They stated that they are trying to sell their property and cannot accept the property being
destroyed because of tile put in by the farmers which increases the flow of water into Sewell
Lake. Property Owner, Gerhard Knutson, reviewed lake levels back to 1935. His building is
about 25 ft. from the edge of the water at this time with ½ of his original property under water
and not usable. He provided pictures of water elevations. He requested that some tile be
eliminated that flows into Sewell Lake and that the outflow be repaired. Jim Puchtel
expressed concerns that the farmers are creating pollution to the lake and that they should be
accountable to correct the problem. Ditch Inspector, Randy Wasvick, showed a map of Ditch
System No. 70 and explained that the outlet flows into the ditch system. He stated that the
outlet is running full and the water is running over the top. A property owner on the east side
of Sewell Lake concurred with the issue that there is too many inlets to Sewell Lake and not
enough outlet. He stated that originally, there were three inlets and one outlet and now there
are eleven inlets. He also indicated that the public access is beginning to flood and his
property may soon be unusable. County Attorney, David Hauser, stated that the property
owners are asking for an improvement and there are procedures to do that. This would not
be a repair or cleanup. The farmers are entitled to use the ditch system; however, when the
system is altered to increase the flow, they have made improvements that may not have been
appropriate. Mr. Wasvick explained that the County cannot pay towards the improvement.
The cost would be assessed to the entire ditch system. The County Attorney discussed
possible authority to reduce flood damage and stated that he would do further research in the
matter.
Correctional Officer's Week
Otter Tail County Resolution No. 2006 -37
Commissioner Mosher offered the following and moved its adoption:
WHEREAS, one week each May is officially designated as Correctional Officer's Week by the
American Jail Association. This year, Correctional Officer's Week is May 7-13, 2006; and
WHEREAS, the Sheriffs Office supports the proposition that the men and women who
perform the difficult task of supervising the County's inmates deserve this recognition; and
WHEREAS, the Sheriffs Office recognizes that detention staff are professionals equal in
status and importance to other professionals in the effective administration of justice; and

THEREFORE, BE IT RESOLVED, that we, the Otter Tail County Board of Commissi6ners,
do hereby acknowledge the week of May 7-13, 2006, as "Correctional Officer's Week" in
Otter Tail County in honor of the dedicated professionals who supervise the County's inmate
population.
Commissioner Block seconded the resolution and, upon being put to vote, was unanimously
adopted.

Motion by Mosher, second by Lee, and unanimously carried to authorize the Chairman's
signature to execute the following highway project contracts contingent upon the approval of
the County Attorney:

Seasonal Supply of Hot Mix Bituminous Material '
(North, West, & East Otter Ta_il _County)
High Water -North & South Turtle Lake
Highway Engineer, Rick West, reported that water is being pumped out of South Turtle ;Lake;
however, the pumping rate is less than the in-flow rate. He reported that the County has
prepared the permit application to restrict the flow of water by the highway culvert between
North and South Turtle Lakes at approximately 50% by sandbagging. Motion by Mosher,
second by Froemming, and unanimously carried to proceed with the proposal to slow

down
the flow of water into South Turtle Lake by sandbagging the culvert between the lakes.
Commissioners acknowledged that this is a short term, temporary measure and a long term
solution will need to be developed collectively from the people living around the two lakes.

County Highway 116 Project I
Motion by Lee, second by Block, and unanimously carried to authorize the Highway Engineer
to proceed with defining the scope of the CH116 project to service the proposed Ethanol
Plant so the cost of the project can be accurately estimated. 1
Commissioner Block was absent at 2:30 p.m. in order to attend a Family Services Collaborative
meeting.
Highway Maintenance Union Contract
Motion by Lee, second by Mosher, and unanimously carried to authorize the Chairman's
signature to execute a Labor Agreement between Otter Tail County and the American
Federation of State, County, and Municipal Employees, AFL-CIO, Local Union No. 1830 for
the period of January 1, 2006 through December 31, 2008. I

Correction Regarding Telecommunications Contract
Motion by Lee, second by Nelson, and unanimously carried to clarify that the two-year
Communication Services Agreement between the County of Otter Tail and Otter Tail Telcom
for telecommunications services was effective January 1, 2006, rather than the previously
documented date of August 15, 2005, as recorded in the January 10, 2006, Board of
Commissioners' minutes.
Correction to the April 11, 2006, Board of Commissioners' Minutes
Motion by Froemming, second by Nelson, and unanimously carried to approve the following
correction on Page 4 of the April 11, 2006, Board minutes under the heading Ditch No. 63:
Motion reads "Motion by Lee, second by Block, and unanimously carried to authorize the Ditch
Inspector to hire three Ditch Viewers to re-determine the activity on Ditch No. 63." should
read as follows: "Motion by Lee, second by Block, and unanimously carried to authorize the
Ditch Inspector to hire three Ditch Viewers to review the benefits of a few parcels in the Ditch
No. 63 System, which was redetenmined in 1997. After this review, the Ditch Inspector will
return to the County Board with a recommendation."
