HomeMy WebLinkAboutBoard of Commissioners - Minutes - 04/11/2006MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, April 11, 2006 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, April 11, 2006, at 9:31 a.m., at the Otter Tail County Government Services Center with Commissioners Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Bob Block, Syd Nelson, and Malcolm Lee present. Approval of Agenda Motion by Mosher, second by Nelson, and unanimously carried to approve the Human Services Board agenda of April 11, 2006, with the following changes: Cancel -Area Agency on Aging Program Update Add: Veterans Service Director, Jourdan Sullivan Authorization of 2006 Assurances and Agreements West Central Regional Juvenile Center Discussion Approval of Minutes Motion by Block, second by Froemming, and unanimously carried to approve the Human Services Board minutes of March 28, 2006, as mailed. Veterans Service Staff Replacement Motion by Mosher, second by Lee, and unanimously carried to authorize Veterans Service Director, Jourdan Sullivan, to hire a replacement for a Veterans Service Officer Position due to a resignation. Approval to Hire New Position Court Services Director, Chuck Kitzman, requested approval to hire a half-time Assistant Probation Officer. This new position would be responsible for ensuring that mandated pre- trial bail evaluations on adult defendants are completed. Other responsibilities would include supervision and drug testing of adult pre-trial supervision cases. Motion by Lee, second by Mosher, and unanimously carried to authorize the Court Services Director to hire a half-time Assistant Probation Officer, at a Grade 14, as recommended by the Government Management Group. West Central Regional Juvenile Center Advisory Board Meeting Mr. Kitzman reported that he and Commissioner Nelson attended an Advisory Board Meeting on April 6, 2006, at the Clay County Detention Center, and provided several handouts. Per Diem for CY 2006 is $170.00 for member counties. Otter Tail County's usage of the program was way down in CY2005. Shelter Care is doing well. Secure Detention is having some financial problems. OTC Board of Commissioners' Minutes April 11, 2006 Page 2 Local Public Health Act Funding 2006 Assurances and Agreements Motion by Nelson, second by Block, and unanimously carried, to authorize the Chair's signature on the 2006 Assurances and Agreements, which would give the ability to obtain funding from the Local Public Health Grant, Federal Maternal Child Health Grant, and Federal Temporary Assistance for Needy Families Grant, in the amount of $335,000. Request for Approval of Contract with MPAAT Motion by Lee, second by Block, and unanimously carried to authorize the Public Health Director's signature on the contract for the Minnesota Partnership for Action Against Tobacco (MPAAT), a Minnesota nonprofit corporation, and Otter Tail County Public Health Department. Grant funding will be used for staff time and informational materials regarding the Second Hand Smoke Ordinance. The grant is in the amount of $71,503.00. Informational Meeting Update Ms. Thorson gave an update on the informational meetings regarding the Smoke Free Ordinance. The turnout was good in both the New York Mills and Fergus Falls locations. There were strong positions and feelings both for and against the Smoking Ordinance. Discussion was held regarding the health impact on workers and patrons vs. the impact on businesses primarily bars and charitable gambling. The Advisory Committee will meet on April 13, 2006, and decide what direction to go with the Smoke Free Ordinance. Child Protection Annual Report Human Services Supervisor, Brad Vold, introduced his Child Protection staff. Mr. Vold reported that the largest allegation regarding Child Protection is neglect. Chemical Dependency is rampant with families that the Child Protection Teams work with. In 2005 there were a total of 118 cases; 24 were Meth related and 23 were Corrections cases. Human Services Director, John Dinsmore, stated that there could be Federal funding changes, called Child Welfare Targeted Case Management, which could reduce funding by $250,000, for Otter Tail County alone. Mental Health Initiative Human Services Supervisor, Jodi Wentland, reported on the Mental Health Initiative. Otter Tail County is part of this four-county initiative. Other counties involved are Becker, Clay and Wilkin Counties. Through this Initiative, Otter Tail County receives state grants that come directly for the four county planning. In addition, State staff are assigned to the Initiative so there is state staff providing mental health services in each of the four counties. The goal is to provide community-based mental health services to help reduce the length of time in hospitals. The Initiative started in 1995 and has experienced some success. Otter Tail County is the fiscal host agency that enters into the contractual agreements. Another goal is to increase housing for persons with mental illness, by matching a person's needs of supervision to the type of housing recovery supports. Governor's Mental Health Proposal Mr. Dinsmore summarized the Governor's Mental Health Proposal, which will redirect $59 million in government investments. The proposal would reform the financing and delivery of publicly funded mental health care services for children and adults to improve access, quality, care coordination and encourage identification and intervention. Fiscal Quarterly Report OTC Board of Commissioners' Minutes April 11, 2006 Page 3 Human Services Director, John Dinsmore, provided a copy of the Fiscal Quarterly Report, and reported that expenses are as budgeted for the quarter, but revenue for the quarter is down. Otter Tail County Detox Sliding Fee Schedule Motion by Nelson, second by Lee, and unanimously carried to approve the updated Detox Sliding Fee Schedule as presented by the Human Services Director. Bills & Claims Motion by Mosher, second by Block, and unanimously carried to approve the Human Services bills & claims as presented. ' Approval of Agenda Motion by Mosher, second by Block, and unanimously carried to approve the County Board agenda of April 11, 2006, as mailed. Approval of Minutes Motion by Block, second by Nelson, and unanimously carried to approve the County Board minutes of April 4, 2006, with the following correction: Under the heading -Physical Plant Operations Staffing Motion by Lee, second by Mosher, and unanimously carried to authorize the Physical Plant Manager to proceed with the hiring process for a permanent, 32-hour per week, housekeeping position. The hours should be 30 hours per week, not 32 hours per week. Approval to Pay Bills Motion by Mosher, second by Froemming, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. OTC Board of Commissioners' Minutes April 11, 2006 Page4 Request to Replace Vacant Positions Motion by Mosher, second by Lee, and unanimously carried to authorize the Assessor to hire and replace the Secretary Assessment Tech II position and an Appraiser position. Years of Service Commissioner Mosher reported that he had attended the West Otter Tail SWCD meeting. Norm Fjestad had received a plaque for his 24 years of service for serving as Otter Tail County's representative on the WesMN RC&D. Commissioner Mosher requested that Otter Tail County acknowledge Mr. Fjestad as well. County Coordinator, Larry Krohn, will have a plaque ordered that will be presented to Mr. Fjestad at a later County Board meeting. Jail Expansion Motion by Block, second by Mosher, and unanimously carried to retain Attorney, Kent Mattson, to contact property owners near the current jail regarding the possibility of purchasing property and expanding the Detention Center. Ditch No. 38 Ditch Inspector, Randy Wasvick, reported on a request by property owner, Bob Sonnenberg. Mr. Sonnenberg would like to add a Control Structure in Ditch No. 38, which is on his property, to raise the wetland. If the control structure was kept at 1412.5 or 30" above the invert of the culvert under Highway 67 the high water would not cause difficulty to other property owners. County Attorney, David Hauser, stated that according to statute 103.227, Mr. Sonnenberg would need to petition to do this and a Water Use Permit and a bond would be required. A Public Hearing would also need to be held. Mr. Wasvick will contact the property owner with this procedure. Ditch No. 43 Mr. Wasvick had received a request from Dwight Hittermeister to replace a culvert in Ditch No. 43 which is in Dane Prairie Township that is located on his property. The culvert is plugged and backing up water. Motion by Mosher, second by Nelson, and unanimously carried to authorize Property Owner, Dwight Hittermeister to replace a culvert in Ditch No. 43 located on his property. Mr. Wasvick will follow up with Terry Lecher to establish an ordinary high level. Ditch No. 63 Ditch No. 63 is located in Elizabeth and Oscar Township. The valuation of the Ditch System is $64,000. Cost to repair one mile of the system would be approximately $63,000.00 for just one mile. To repair the entire Ditch System would be $570,000.00. The ditch system could be abandoned but property owners still want the ditch system. Mr. Wasvick requested approval to hire three Ditch Viewers for a day to re-determine activity on the ditch system. Motion by Lee, second by Block, and unanimously carried to authorize the Ditch Inspector to hire three Ditch Viewers to review the benefits of a few parcels in the Ditch No. 63 System, which was redetermined in 1997. After this review, the Ditch Inspector will return to the County Board with a recommendation. Recess & Reconvene At 12:00 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1 :00 p.m. OTC Board of Commissioners' Minutes April 11, 2006 Page 5 Fergus Falls Transfer Station Discussion Solid Waste Director, Mike Hanan, reported that the Environmental Assessment Worksheet has been submitted to the MPCA. A Findings of Fact will need to be completed. Mr. Hanan requested approval to have a flyer printed and sent out in the newspaper with the intention of answering some of the questions that exist and to clear up some of the misconceptions that may also exist regarding the transfer station. Discussion followed. Commissioners gave approval for informational flyers to be sent out in local newspapers. Joint Resolution Between Otter Tail County and the City of Pelican Rapids Otter Tail County Resolution No. 2006 -29 Pelican Rapids River Park and Restoration 2010 Transportation Enhancement Project • . : Upon a motion by Lee, seconded by Nelson. and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the City of Pelican Rapids was successful in receiving an Enhancement Grant thru the West Central Transportation Partnership for the Pelican Rapids River Park and Restoration project and, WHEREAS, Otter Tail County acted as the sponsor for this grant as a requirement of the grant application and, WHEREAS, Otter Tail County by acting as the sponsor of the grant is responsible for the local share funding and the future maintenance costs of this project located in the City of Pelican Rapids. NOW THEREFORE BE IT RESOLVED by the City of Pelican Rapids and Otter Tail County that all local share project costs and all future maintenance costs associated with this project are the sole responsibility of the City of Pelican Rapids. NOW, THEREFORE, BE IT RESOLVED by the County Board of Commissioners of the County of Otter Tail that the Board of County Commissioners for the County of Otter Tail is hereby designating the definite location of County State Aid Highway No. 82 in Sections 4, 5, 6, 9 and 10 in Township 131 North, Range 42 West and Sections 31 and 32 in Township 132 North, Range 42 West, of the 5th Principal Meridian as shown on the five sheets of OTTER TAIL COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 16. OTTER TAIL COUNTY BOARD OF COMMISSIONERS , Attest ~ a Larry Kron, Clerk mg, Board of Commissioners Chair High Water Discussion Highway Engineer, Rick West, introduced discussion on the North Turtle and South Turtle Lakes situation as it relates to County Highway 122 (Whiskey Road). There is an abandoned railroad grade with a culvert which is restricted somewhat and flowing full. There is also a culvert under County Highway 122. Water level on both lakes is very high. Mr. West had met with Terry Lejcher, Area Hydrologist with the DNR. Mr. Lejcher suggested that since the culvert under County Highway 122 was the control structure, it should be restricted to half its capacity. South Turtle Lake Association has been given permission to pump into wetlands that the U.S. Fish & Wildlife Service has an easement on from now until the end of April. Commissioner Mosher suggested that maybe the County could help with the cost of pumping of South Turtle Lake. Commissioner Mosher suggested that a letter be sent to the U.S. Fish & Wildlife Service to allow a longer period of time to pump into the wetland. Mr. West will draft a letter. Request for Approval -Red River Valley Water Supply Project Resolution Otter Tail County Resolution No. 2006 -32 Upon the motion of Lee, seconded by Nelson, and unanimously carried, the County Board of Commissioners adopts the following resolution: WHEREAS, the United States Department of the Interior, Bureau of Reclamation, and the State of North Dakota propose to develop and deliver a bulk water supply to meet the long- OTC Board of Commissioners' Minutes April 11, 2006 Page 10 term water needs of the Red River Valley in North Dakota, which is known as the Red River Valley Water Supply Project; and WHEREAS, a Draft Environmental Impact Statement has been prepared to evaluate alternatives to meet the long-term water supply needs of the Red River Valley in North Dakota and three cities in Minnesota; and WHEREAS, one of the options would be to draw water from aquifers that sit in Otter Tail County known as the Pelican River Sands Aquifer and the Otter Tail Outwash Aquifer. An estimated 129 wells would be drilled in the aquifers, and the water would be piped west to the Red River Valley. The two aquifers cover 696 square miles, and the wells and pipe system would cover a large portion of Otter Tail County and would affect the communities of Vergas, Perham, Dent, Ottertail, Battle Lake, Pelican Rapids and many rural areas within the County; and WHEREAS, in reviewing the Draft EIS, many of the assumptions related to the impact on water quantity are based upon average data for the period 1931 to 2001. In measuring the impact of the drought with the magnitude of the 1930's, the surface water quantity data for the Red River and Sheyanne is noted. No similar data regarding the impact of drought conditions on the proposed ground water supplies in Otter Tail County are included in the report; and WHEREAS, this is a serious oversight as the affect of the additional pressure on ground water resources in the area during a severe drought are not well documented. Soil conditions in Otter Tail County consist primarily of course to fine textured loams and sands. The soils have low water holding capacity. The soil types and textures directly affect the movement and rate of water percolation; and WHEREAS, almost all agricultural, residential and industrial water uses in the County are from ground water sources. Surface water is primarily used for recreaiional purposes and ground water recharge. There is considerable ground and surface water interaction in the area; and WHEREAS, accounts from local residents indicate that many of the lakes and other surface waters in the area were dry or suffered significant reductions of 20 to 30 or more feet below their normal high water marks for a sustained period of years during the drought of the 1930's. Given the soils conditions and interaction between ground water and surface water, one could reasonably expect similar drops to occur in ground water in the surrounding area; and WHEREAS, data collected during the preparation and implementation of the City of Perham's Wellhead Protection Plan indicated that there are high nitrate concentrations in the upper portions of the aquifer in the Perham area, that pumping of high capacity wells changes the normal flow of ground water significantly increasing the vertical exchange of water in the aquifer and the nitrates and other pollutants currently confined in the upper reaches of the aquifer could mix with the clean water deeper in the aquifer; and WHEREAS, the drilling of 100 or more water wells will multiply these impacts throughout a significant portion of Otter Tail County; and OTC Board of Commissioners' Minutes April 11, 2006 Page 11 WHEREAS, Otter Tail County's recreational resources of over 1,000 lakes, several state parks and numerous state and national wildlife management and l(Vaterfowl production areas would be seriously impacted by a drought of the magnitude of the 1930's. · It is highly unlikely the any drought would be confined to the Red River Valley and would likely have impact throughout the Red River Basin. Lowering the ground water levels would further magnify the impact on a wide variety of local and migratory wildlife populations that would already be under stress; and WHEREAS, the Draft EIS does not address the long-term impact from the operational requirements of using ground water located some 60 miles away and what effects it would have on the supply area. Wells in the well field will need to be operated on a regular basis in order to make sure that they will work properly when needed. The water pumped from the aquifers during non-drought conditions will likely become part of the "base supply" for those areas to be served by the Red River Valley Water Supply Project. This will further encourage water consumption and enlarge the water supply deficit in the future; and WHEREAS, the EIS does not address the impacts of having a user-controlled system being in place to determine when the system should be placed in full operation. With user- controlled systems in place and the impacts difficult to measure and see, the Otter Tail County supply alternative presents a greater chance for adverse impacts when compared with the more definable and measureable impacts associated with the preferred alternative; and WHEREAS, based upon the information presented in the Draft Environmental Impact Statement, it appears import of water from the Garrison Diversion Unit import to the Sheyenne River alternative is the most effective alternative. An extensive investment has already been made in some of the facilities needed to implement this alternative. The proposed biota treatment facility would reduce the probability that exotic species would be transported from the Missouri River Basin to the Red River Basin; and WHEREAS, the Draft EIS provides satisfactory answers regarding the potential impact on Otter Tail County's wetlands, grasslands, woodlands, riparian areas and wildlife and aquatic communities; and WHEREAS, there is great concern for the agricultural industry which rely on the ground water for irrigation and livestock and would be under stress in drought conditions. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby opposes the use of ground water resources in the Otter Tail Outwash and Pelican River Sands Aquifers as a source of water for the Red River Valley Water Supply Project. BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners questions the adequacy of the Environmental Impact Statement upon the foregoing grounds and specifically lack of information how the project would affect the County in drought conditions. The meeting was reconvened at 2:20 p.m. Commissioner Lee absent. Shoreland Rules Revision Committee Discussion Land & Resource Director, Bill Kalar, had handed out a draft copy dated 2-24-06 of the Proposed Changes to the Shoreland Management Ordinance last week. These were the items that the County Board had previously identified as needing to have language drawn up and brought back to the 45-person committee for discussion and comment. A majority of the committee felt that Buffer Strips should be looked at and be included in any Ordinance Revision. It was suggested that Commissioners look at the new DNR rules, which is a reference to the Alternative Standards. Buffer Strips are identified and addressed in these rules. If Commissioners are interested, the DNR could put on a presentation of the Alternative Standards. Mr. Kalar stated that a condensed outline with just topics had been presented at a previous County Board Meeting. Issues that were raised but the County Board was not interested in including in the revised ordinance at that time included: buffer strips, conservation plats, aquatic vegetation, procedures for applications, docks, surface water controls, roads, and updating sewage systems at time of sale. Some of these items the County Board should reconsider. Items that the 45-member Committee felt the County Board should consider: • Land Use Districts -Mr. Kalar stated that this had been addressed in a resolution that was passed a couple months ago • Multiple Classification of Lakes -Mr. Kalar felt this did not need to be in the ordinance because there is a procedure through the DNR to address this. Mr. Kalar stated that whatever changes are made in the Shoreland Ordinance has to be approved by the DNR and be in compliance with statewide rules. Mr. Kalar also suggested that these changes should not be made during the construction season as this could cause some confusion in writing and inspecting permits. Commissioner Mosher suggested a special meeting be scheduled to go through the Minnesota Alternative Shoreland Management Standards dated December 12, 2005. Mr. Kalar provided a handout from Becker County regarding an Environmental Review Panel. The Panel consists of the Land & Resource Director, members from the SWCD, DNR, MPCA, Planning Commission, and Watershed Districts. The Panel reviews proj~cts prior to a survey being completed. Commissioners discussed the possibility of, Otter· Tail County implementing an Environmental Review Panel. Mr. Kalar stated that if the Shoreland Ordinance is effective, then the need for Environmental Assessment Worksheets and Environmental Impact Statements would be limited, since the Ordinance would address most of the issues. THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In- Aid Trail Systems as they exist for the Henning Snow Cruisers and proposed extensions of Grant-In-Aid Trails with the aforementioned condition.
