Call to Order
The Otter Tail County Human Services Board convened Tuesday, March 14, 2006. at
9:35 a.m. at the Otter Tail County Government Services Center with Commissioners
Roger Froemming. Chair; Dennis Mosher, Vice-Chair; Malcolm Lee, Syd Nelson, and
Bob Block present.
Approval of Agenda
Motion by Mosher, second by Lee, and unanimously carried to approve the Human Services
Board agenda of March 14, 2006, as mailed:
Approval of Minutes
Motion by Nelson, second by Block, and unanimously carried to approve the Human Services
Board minutes of February 28, 2006, as mailed.
Court Services Department
Court Services Director, Chuck Kitzman, reported that Governor Pawlenty is promoting Town
Hall meetings to talk about underage drinking. A Town Hall meeting on this topic will be held
at 7:00 p.m. on March 28, 2006, at the Otter Tail Power rooms in Fergus Falls. He stated
that there may also be a meeting held in the East side of the County; however, that meeting
is not currently scheduled. Mr. Kitzman stated that his office will be participating in these
meetings.
Human Service Department 2005 Annual Report
John Dinsmore, Human Services Director, presented the Human Services Department 2005
Annual Report and highlighted the most important statistics. Areas of discussion included the
TANF Program, federal poverty guidelines, food support, and Medical Assistance, which is
the largest expense in the Human Services Budget. The majority of the Medical Assistance
dollars are spent for long term care in nursing homes.
Child Abuse Prevention Proclamation
Otter Tail County Resolution No. 2006 -20
Commissioner Mosher offered the following and moved its adoption:
WHEREAS, child abuse prevention is a community problem and finding solutions depends on
involvement among people throughout the community;
WHEREAS, the effects of child abuse are felt by whole communities and need to be
addressed by the entire community.
WHEREAS, effective child abuse prevention succeeds because of partnerships created
between parents, practitioners, schools, faith communities, health care organizations, law
enforcement agencies, and the business community;

WHEREAS, family-serving, youth-focused prevention programs offer positive alternatives for
young people and encourage parents and youth to develop strong ties to their communities;
WHEREAS, all citizens need to be more aware of child abuse and neglect and its prevention
within the community, and be involved in supporting parents to raise their children in a safe,
nurturing society.
NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners
hereby proclaim April 2006 as Child Abuse Prevention Month in Otter Tail County, and call
upon all citizens, community agencies, religious organizations, medical facilities, and
businesses to increase their participation in efforts to prevent child abuse and neglect,
thereby strengthening the communities in which we live.
Commissioner Block seconded the motion, and upon being put to a vote, was unanimously
carried.

Volunteer Transportation Program Update
Volunteer Transportation Program Coordinator, Laurie Hillman, reported that the program
consists of about 66 volunteer drivers, who use their own vehicles and rely on their own
vehicle insurance. The transportation provided is for medical appointments and serves
Medical Assistance and Prepaid Medical Assistance Program clients and the elderly over the
age of 65. Ms. Hillman stated that over 380,000 volunteer transportation miles were logged
last year.

Motion by Block, second by Nelson, and unanimously carried to authorize the Human

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, March 14, 2006, at
10:30 a.m. at the Otter Tail County Government Services Center with Commissioners
Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Malcolm Lee, Syd Nelson, and
Bob Block present.
Approval of Agenda
Motion by Mosher, second by Lee, and unanimously carried to approve the County Board
agenda of March 14, 2006, with the following addition:

Approval of Minutes
Motion by Nelson, second by Block, and unanimously carried to approve the County Board
minutes of March 7, 2006, as mailed.
Approval to Pay Bills
Motion by Lee, second by Mosher, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
Employment Expansion in City of Fergus Falls
City of Fergus Falls Economic Development Director, Harold Stanislawski, briefed the County
Board on a company named Vinco, Inc. that is expanding from Forest Lake to the Fergus
Falls area. They have located a piece of property in Aurdal Township, purchased a building,
and will be renovating the building, with a potential of adding up to 20 jobs in the community.
Mr. Stanislawski reported that Aurdal Township has agreed to the use of the JOBZ Program
for this proposed expansion and he requested approval of the following resolution to
accommodate the expansion:

Otter Tail County Resolution No. 2006 -20
Commissioner Lee offered the following and moved its adoption:
WHEREAS, the Otter Tail County Board of Commissioners, on September 9, 2003, passed a
resolution approving certain County parcels to be included in a regional application for a Job
Opportunity Building Zone; and
WHEREAS, the City of Fergus Falls was a participant in the regional Job Opportunity
Building Zone application done by the West Central Initiative Fund; and

WHEREAS, the regional application submitted by the West Central Initiative Fund was
approved by the Department of Employment and Economic Development; and
WHEREAS, the City of Fergus Falls wishes to modify the acreage in their Job Opportunity
Building Subzone; and
BE IT RESOLVED, the Otter Tail County Board of Commissioners, upon careful
consideration and review, hereby approve the modifications as identified in the following
table:

Spring Safety Training
Motion by Block, second by Mosher, and unanimously carried to require all employees to
attend safety training offered this spring called "Last Call". This is a collaborative educational
effort presented by the Public Health and Sheriff Departments.
Performance Evaluation Summary
Motion by Lee, second by Block, and unanimously carried to approve the positive
Performance Evaluation Summary of GIS Coordinator, Brain Armstrong, as presented, and to
direct that the summary be placed in his personnel file.
Public Meeting
At 10:40 a.m., Chairman Froemming called the Public Meeting to order for the pending
issuance of a Minnesota Pollution Control Agency Permit for a swine barn on the
Eric Roberts Farm in Amor Township. No one from the public was present; therefore, no
comment was offered. Chairman Froemming closed the Public Meeting at 10:45 a.m.
Reclassification Request
Land & Resource Director, Bill Kalar, reported that he has met with the Budget and Personnel
Committees regarding reclassification of the positions in his department. He stated that he
has received affirmative responses from the committees and requested approval from the
County Board. Motion by Mosher, second by Lee, and unanimously carried to proceed with
the reclassification process for all positions in the Land & Resource Department.
Blue Heron Bay EQB Request
Mr. Kalar provided copies of a letter received from the Environmental Quality Board dated
March 8, 2006, regarding the EQB adequacy decision for the Blue Heron Bay EIS. A letter
was sent to the EQB, from Otter Tail County, stating that the County has no objection to their
assumption of the adequacy decision. The letter from the EQB dated March 8, 2006,
requests that the County Board appoint a representative to attend the March 16 EQB meeting
wherein this will be discussed. Motion by Froemming, second by Block, and unanimously
carried to request the Land & Resource Director to attend the March 16 EQB meeting
regarding the Blue Heron Bay EIS on behalf of Otter Tail County.

Doug Martin, representing the Dead Lake Association (DLA), provided a sample copy of a
resolution which he requested that the County Board approve to make a stronger statement
in favor of the EQB assuming the adequacy decision on the EIS. Discussion followed. No
action was taken.
Blue Heron Bay Land Company Contract
Motion by Nelson, second by Mosher, and unanimously carried to authorize the appropriate
County officials' signatures to execute an EIS Reimbursement Agreement between the Blue
Heron Bay Land Company and the County of Otter Tail relating to the· participation for the
Environmental Impact Statement. The contract requires 50% of the total proposed cost of the
EIS to be provided by the Blue Heron Bay Land Company before work can be started.
Sidewalk/Bike Path -City of Underwood
Highway Engineer, Rick West, reported that he received a letter from the City of Underwood
requesting that Otter Tail County pay for the paving of a bikeway that runs from downtown to
Highway 210. Mr. West did not recommend paying for this service because of other
construction needs throughout the County and the rising cost of other projects.
Commissioner Mosher requested the estimated cost of the paving. Motion by Mosher,
second by Froemming, and unanimously carried to table a decision in regards to paving the
City of Underwood bike path.
Final Payment-C.P. 05:TM
Motion by Block, second by Mosher, and unanimously carried to approve Final Payment per
Estimate No. 9, in the amount of $9,576.39, payable to AAA Striping Service Co. for the
completion of the 2005 traffic marking work.
Bailiff Per Diem Increase
Motion by Mosher, second by Block, and unanimously carried to increase the per diem for the
Bailiffs from $60.00 per day to $70.00 per day effective January 1, 2006.
Detention Facility Inspection Report
Detention Facility Administrator, Richard Akerman, provided a Detention Facility Inspection
Report issued by the Minnesota Department of Corrections relative to an inspection
performed on January 24, 2006.
Closed to the Public
At 11 :27 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss litigation relative to the Barlow Projects lawsuit
as authorized by attorney-client privilege, Chapter 13D.05 Subd. 3b. Present were all five
seated Commissioners; Assistant County Attorney, Kurt Mortenson; County Coordinator;
Board Secretary; and the Solid Waste Director.
Recess & Reconvene for Video Conference
At 11 :50 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed and reconvened at noon at the Star Lake Room at the County
Courthouse. Public Health Director, Diane Thorson, provided a video conference by the
Minnesota Department of Health regarding the possibility of a Pandemic Flu because of the
current worldwide situation with the avian (bird) flu. Discussion took place regarding
procedures, quarantine & isolation possibilities, need for volunteers and hospital beds, and
the responsibility of state and local government. The federal guidelines are provided on the

following website -www.pandemicflu.gov. The video conference was completed at
1 :00 p.m., at which time the Board members returned to the County Board room at the
Government Services Center for the remainder of their agenda items.
Wetland Easement
At 1 :22 p.m., Chairman Froemming reconvened the Board of Commissioners meeting. US
Fish & Wildlife Realty Specialist, Don Kleven, requested certification of a waterfowl
management easement. Motion by Froemming, second by Nelson, and unanimously carried
to certify the following waterfowl management easement as requested:

Motion by Lee, second by Block, and unanimously carried to approve the purchase of a new
75 Horse Power Harris-Badger Baler for the Recycling Center, at a cost of $257,895, as
recommended by the Recycling Center Manager. This bid includes purchase and installation
of the baler.
Proposed Fergus Falls Transfer Station
Solid Waste Director, Mike Hanan, briefed the County Board on a recent meeting of the
Fergus Falls Town Board, which included a request for issuance of a Conditional Use Permit
for the proposed Transfer Station site. A Citizen's Group previously filed a petition requesting
that an Environmental Assessment Worksheet (EAW) be completed. The proposed Transfer
Station does not require a mandatory EAW; however the Environmental Quality Board (EQB)
has been petitioned to require that Otter Tail County complete an EAW. The EQB will turn
the decision over to the Minnesota Pollution Control Agency (MPCA). Motion by Lee, second
by Nelson, and unanimously carried to direct the Solid Waste Director to voluntarily complete
an EAW for the proposed Fergus Falls Transfer Station site.
