Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, February 7, 2006, at
9:30 a.m., at the Otter Tail County Government Services Center with Commissioners
Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Bob Block, Syd Nelson, and
Malcolm Lee present.
Approval of Agenda
Motion by Mosher, second by Block, and unanimously carried to approve the County Board
agenda of February 7, 2006, with the following changes:

Commissioner Malcolm Lee was absent at 9:33 a.m.
Approval of Minutes
Motion by Froemming, second by Block, and unanimously carried to approve the County
Board minutes of January 24, 2006, as mailed.
Approval to Pay Bills
Motion by Mosher, second by Block, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
Sale of County Property
Otter Tail County Resolution No. 2006 -10
Commissioner Nelson offered the following and moved its adoption:
Whereas, the Otter Tail County Board of Commissioners approved the sale of the following
described property on Tuesday, December 27, 2005, and
Legal Description
That part of Lot A of Rothpletz's Addition to the Village of Perham, said plat is on file and of record in
the office of the Recorder in Otter Tail County, Minnesota, described as follows:
Beginning at an iron monument which designates the most easterly corner of said Lot A;
thence North 50 degrees 15 minutes 37 seconds West 6.16 feet on an assumed bearing
along the northeasterly line of said Lot A to an iron monument; thence South 39 degrees 51
minutes.41 seconds West 75.38 feet to an iron monument on the northeasterly right of way
line of County State Aid Highway No. 80; thence South 44 degrees 32 minutes 55 seconds
East 6.18 feet along the northeasterly right of way line of said County State Aid Highway No.

Perham Enterprise Bulletin (week of January 16, 2006), and
Whereas, the Otter Tail County Auditor's office also solicited bids by a direct mailing to the
adjacent property owner, and
Whereas, the deadline for submitting a sealed bid was 5:00 p.m. on Monday, February 6,
2006, and
Whereas, the Otter Tail County Auditor's office had received the following bid as of 5:00 p.m.

Otter Tail County Resolution 2006 -11
Commissioner Mosher offered the following and moved its adoption:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the Fergus Falls Hockey Association, Fergus Falls, MN, has made an application
to the Gambling Control Board for the purpose of conducting lawful gambling at the
Graystone On Ottertail, Inc., located at 35776 County Highway 72 in Everts Township of
Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the Fergus Falls Hockey Association, Fergus Falls, MN, at
the Graystone On Ottertail Inc., located at 35776 County Highway 72 in Everts Township of
Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Fergus Falls Hockey Association,
Fergus Falls, MN, at the Graystone On Ottertail Inc., located at 35776 County Highway 72 in
Everts Township of Otter Tail County, provided the applicant meets all the necessary criteria
for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to
the Township of Everts by sending them a copy of this resolution.
Commissioner Nelson seconded the motion, and upon being put to a vote, was unanimously
carried.

Request for Forgiveness of Interest
Motion by Nelson, second by Block, to deny the request of Heartland Title, LLC for the
abatement of $20.70 in interest charges for the month of February due to an incorrect
address in the State of Minnesota's Blue Book. Chairman Froemming called for a vote.
Motion carried 3-2 with Mosher and Lee opposed.
Solid Waste Hauling Services
Solid Waste Director, Mike Hanan, presented the following proposals for the purpose of
transporting Municipal Solid Waste from Fergus Falls, MN, to the Dakota Landfill in Gwinner,
ND, the Perham Incinerator, and the Elk River Landfill as follows:

Motion by Lee, second by Block, and unanimously carried to award the hauling of MSW from
Fergus Falls to the above-mentioned landfills to Ottertail Transportation, Inc., as
recommended by the Solid Waste Director, because the low bid of $340.00 to haul to the
Dakota Landfill in Gwinner, ND, is expected to be the main hauling destination, with minimal
loads being hauled to the other landfills. This award would be for a two year period.
Public Education Activity Update
Public Education Officer, Betsy Bjerklie, presented a Media Alert informing the public that
Otter Tail County Solid Waste is sponsoring environmental presentations in area schools to
inform children about "Trash" and "Recycling". Ms. Bjerklie provided the schedule of events
for the last week in February and invited the Commissioners to attend a program. The
program will reach Kindergartners through Sixth Grade. Motion by Block, second by Lee,

and unanimously carried to authorize payment, in the amount of $5,558.00, for 16
performances for Solid Waste Recycling Education for children.
Rocky Ridge Road Discussion
Highway Engineer, Rick West, opened discussion regarding CSAH No. 65 and, as a part of
that project, the Rocky Ridge Road Project was going to be included. Mr. West stated that
construction costs are up and estimated approximately $307,000.00 for surfacing Rocky
Ridge Road. The Township had agreed on paying 25% of the cost of a 7 ton road with the
County picking up the remainder of the cost. Mr. Hanan noted that the issue for the County is
that the cost was estimated at $180,000.00 for the County's portion of the cost and now, the
cost is $250,000.00. When considering the amount of traffic on the road, the increased cost
may not be warranted to pave this road. The Highway Engineer will meet with the Henning
Town Board on this issue. ·
Wetland & Habitat Easements
U.S. Fish & Wildlife Manager, Don Kleven, requested certification for two Wetland Easements
and one Habitat Easement.
Motion by Froemming, second by Nelson, and unanimously carried to certify the following

GIS Coordinators, Brian Armstrong and Sherry Leabo, requested permission to develop a
GIS Technician Lead Worker job description. Motion by Lee, second by Mosher, and
unanimously carried to grant the request to develop a job description for a Lead Worker in the
GIS Department.
Recess & Reconvene
At 10:25 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 10:31 a.m.

Final Plat Filing Date Extension
On behalf of Houston Engineering, Land & Resource Director, Bill Kalar, requested an
extension for the filing of the Final Plat of Hidden Acres. Motion by Mosher, second by Lee,
and unanimously carried to authorize a six-month extension until September 1, 2006, to file
the Final Plat for "Hidden Acres" on Stalker Lake, Section 32 & 33 of Tordenskjold Township.
Staffing Request
Mr. Kalar provided a handout and requested 2006 staffing changes. The handout included
rationale for the changes. He explained that the additional staff requests will cost
approximately $59,200.00, which could be ,paid for through increased permit fees.
He submitted a proposed fee schedule. Motion by Block, second by Mosher, and
unanimously carried to approve the Land S: Resource Department Proposed 2006 Fee
Schedule as presented. The motion also specified March 1, 2006, as the effective date for
the new Fee Schedule.
Motion by Block, second by Lee, and carried, with Mosher abstaining, to approve the
following Land & Resource Department Staff Changes:
1. Promote current Full-Time Receptionist to a Full-Time Permit Tech 1
2. Replace the Full-Time Receptionist Position
3. Add Full-Time Inspector
Staffing Request
Sheriff, Brian Schlueter, requested authority to replace two part-time Receptionist positions
with a Full-Time Records Technician position. Motion by Lee, second by Block, and
unanimously carried to approve the Sheriffs request to hire a Full-Time Records Technician
in place of the two Part-Time Receptionist positions.
Sheriffs Office 2005 Year End Report
Sheriff, Brian Schlueter, presented the Otter Tail County Sheriffs Office 2005 Year End
Report and stated that 2005 was the year of rebuilding because of many retirements and turn
over of staff. He felt the process went smoothly. There has also been continuing work with
facility planning and the mobile date computers project. Sheriff Schlueter reviewed some
statistics in the Year End Report including the removal of Otter Tail County from the 13 most
dangerous counties for DWI related injuries and death as well as a reduction in violent
crimes.
OTTER TAIL COUNTY
Otter Tail County Resolution No. 2006 -13
Upon a motion by Block, seconded by Lee, and unanimously carried, the following resolution
was adopted:
IT IS RESOLVED, that Otter Tail County enter into Mn/DOT Agreement No. 89269 with the
State of Minnesota, Department of Transportation for the following purposes:
To provide for payment by the State to the County for the use of County State Aid Highway
No. 52 as a detour route during the bituminous pavement reclamation and bituminous milling,
culvert work, turn lane, and guard rail construction and other associated construction to be
performed upon, along and adjacent to Trunk Highway No. 210 from Trunk Highway No. 78

to Trunk Highway No. 29 under State Project No. 5603-10 (T.H. 210=036) and State Project
No. 56-24-15 (T.H. 108=181).
IT IS FURTHER RESOLVED, that the Otter Tail County Board Chair and the Otter Tail
County Board Clerk are authorized to execute the Agreement and any amendments to the
Agreement.

NACE Conference
Motion by Nelson, second by Lee, and unanimously carried to authorize the County Highway
Engineer to attend the NACE Conference in Grand Rapids, Ml.
Phelps Mill Bridge Restoration
Mr. West provided copies of the Transportation Enhancement Program Application Form for
the Phelps Mill Bridge Restoration Project. Mr. West stated that the County will receive
funding in 2010 through the Federal _Enhancement Program for restoration of the Phelps Mill
Bridge and it will remain a pedestrian bridge. The County has put $60,000.00 in a
Contingency Fund to ensure full participation from the Federal Program.

At 11 :34 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of Land &
Resource Director, Bill Kalar, pursuant to M.S. Chapter 13D.05 Subd. 3. Commissioners
Nelson, Mosher, Froemming, and Block were present for the evaluation. A summary of
performance conclusions will be provided at the next regular County Board meeting.
Recess & Reconvene
At 11 :50 a.m., upon conclusion of the Performance Evaluation, Chairman Froemming
declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch
break. The meeting was reconvened at 1 :26 p.m., after lunch and several committee
meetings.
Ditch No. 63
Ditch Inspector, Randy Wasvick, briefed the County Board on the situation with Ditch No. 63.
He reported that a local contractor estimated that the cost to repair this Ditch System could
be up to $571,000.00. When the benefits of this Ditch System were last redetermined, the
value was $62,000.00. The process of abandoning a Ditch System was discussed. An
Informational Meeting regarding a request for repair of County Ditch No. 63 is scheduled at
7:00 p.m. on February 15, 2006, at the Government Services Center in Fergus Falls.
Mutual Self-Help Housing Project
By consensus, the County Board authorized the Chairman to sign the draft letter to the
WesMN RC& D supporting the Mutual Self-Help Housing Project in Parkers Prairie.
Grant Agreement
Motion by Block, second by Mosher, and unanimously carried to authorize the Chairman's
signature to execute a Grant Agreement, (No. SPAP-05-0017-P-FY06) between the State of
Minnesota DEED and the County of Otter Tail that provides $500,000.00 to local
governmental units as reimbursement for expenses related to the June, 2005, windstorm.
Reclassification Request
The County Coordinator reported that a position in the Court Services Department was
submitted for reclassification and it did not qualify for an increased pay grade; however, there
was an increase in total points assessed.
Approval of Part-Time Detention Officer Replacement
Motion by Block, second by Lee, and unanimously carried to authorize the Sheriff to hire a
Part-Time Detention Officer, which is a replacement because of a recent termination.
Feedlot Ordinance
Commissioner Lee stated that the proposed Ethanol Plant is a big operation and with feed
being a byproduct of the production of Ethanol, he expressed concern that the County does
not have a Feedlot Ordinance. Commissioner Lee offered a motion instructing the County
Attorney to draft a Feedlot Ordinance for the County Board's consideration by October 1,
2006. The motion died for lack of a second as other Commissioners expressed satisfaction
with the MPCA handling feedlot regulation.

Request for New Position
Court Services Director, Chuck Kitzman, requested approval for a Part-Time Case Aid
position that is not included in his 2006 Budget. The position would be from 7:30 a.m. to
11 :30 a.m. and the purpose of the position would be to gather background information for the
Judge to make a decision on what kind of a risk the defendant is and how much bond is
needed. Motion by Nelson, second by Block, and unanimously carried to authorize the Court
Services Director to develop a Position Description for the proposed Part-Time Case Aid,
obtain a Classification (pay grade) and meet with the Personnel Committee.
Request for Filling a Vacated Position
Motion by Mosher, second by Lee, and unanimously carried to replace a vacated Human
Services Support Specialist position as recommended by the Human Services Director.
Committee Appointment Correction
The Commissioners serving on Lake Region Community Partners for 2006 were reported as
Commissioners Block and Mosher and should have been Commissioners Nelson and Block.

At 2:19 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, February 14, 2006. ·
