Statutory Meeting -Call to Order
Pursuant to Minnesota Statute, the Otter Tail County Board of Commissioners convened
Tuesday, January 3, 2006, at 9:31 a.m. at the Otter Tail County Government Services Center
with Commissioners Bob Block, Roger Froemming, Dennis Mosher, Syd Nelson, and
Malcolm Lee present.
Year 2006 Otter Tail County Board Chair
County Coordinator, Larry Krohn, requested nominations for the CY2006 Otter Tail County
Board Chair. Motion by Mosher, second by Block, and unanimously carried to elect
Commissioner Roger Froemming as the Otter Tail County Board Chair for 2006.
Year 2006 Otter Tail County Board Vice-Chair
Chairman, Roger Froemming, assumed the chair and requested nominations for the CY2006
Otter Tail County Board Vice-Chair. Motion by Nelson, second by Lee, and unanimously
carried to elect Commissioner Dennis Mosher as the Otter Tail County Board Vice-Chair for
2006.
Approval of Agenda
Motion by Froemming, second by Mosher, and unanimously carried to approve the County
Board agenda of January 3, 2006, with the following addition:
Request for Approval of Investment and Bank Depository Resolutions
Approval of Minutes
Motion by Mosher, second by Nelson, and unanimously carried to approve the County Board
minutes of December 27, 2005, as mailed. ·
Approval to Pay Bills
Motion by Lee, second by Block, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
2006 Snowmobile Grant-in-aid Supplements
Motion by Block, second by Mosher, and carried with Lee opposed, to approve the following
Amendments to the original Grant-in-aid Snowmobile Agreements, with the additional funding
provided by the snowmobile state trail stickers:
Lake Runners Trail Association (L.R.T.A.) Snowmobile Trail $3,686.80
Otter Country Trail Association (O.C.T.A.) Snowmobile Trail $5,937.00

Commissioner Lee stated that he would prefer that the State of Minnesota would contract
directly with the Snowmobile Associations.

Minnesota Trails Assistance Program
Performance Based Maintenance Grant Agreement
Otter Tail County Resolution No. 2006 -01
Commissioner Nelson offered the following resolution and moved its adoption:
WHEREAS, the Sponsor desires to maintain trails for the enjoyment of the public; and
WHEREAS, the Minnesota Trails Assistance Program provides grants to local units of
government for the maintenance of recreational trails pursuant to Minnesota Statutes Chapter
84.83; and
WHEREAS, the Sponsor has applied to the State for a grant for snowmobile trails and Otter
Country Trail Association has submitted the Minnesota Trails Maintenance Program's
application form, maps, and other appropriate materials.
NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County hereby approves the
proposed supplemental maintenance program including State funding for FY2006 in the
amount of $11,970.00.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that Otter Tail County authorizes the
signatures of the appropriate County officials to execute the Performance Based
Maintenance Grant Agreement.
Commissioner Mosher seconded the resolution, and upon being put to vote, it was
unanimously adopted.

Final Plat -"Big Pine Resort"
Motion by Nelson, second by Lee, and unanimously carried to approve the Final Plat of
Alpine Assets LLC, known as "Big Pine Resort", Section 15 of Pine Lake Township; Big Pine
Lake (56-130).
Proposed Ethanol Plant Discussion
Jerry Larson, Otter Tail Ag Enterprises President; Hans Ronnevik, Treasurer; and
Kent Mattson, Attorney; discussed the proposed Ethanol Plant. They introduced the concept
of the project, provided their Mission Statement and information of who is working on this
project behind the scenes. Mr. Larson talked about the economics of the project, the site
announcement scheduled for January 4th , and the prospectus for the project. They talked
about sources of funding and asked the County Board about the concept of assistance by
way of abatement bonds similar to the funding provided in Kandiyohi County for an Ethanol

Plant. Commissioners stated an interest to continue discussions regarding economic
assistance.
2006 Printing and Publishing Bids
After previously advertising for bids to be received for printing and publishing of the County
Board minutes, legal notices, delinquent tax list, and County's annual financial statement, the
County Auditor opened the following bids:

After consideration, motion was made by Nelson, seconded by Lee, and unanimously carried,
to designate the following papers for Otter Tail County's 2006 publishing and printing
requirements with the exception of the official publication for highway project advertisements
for bids, which will be posted to the Otter Tail County website as authorized by Minnesota
Statute 331A.12 Subdivision 2.

delinquent real estate parcels, that are published in the Delinquent Tax List, at $32.00 per
parcel.

Calendar Year 2006 Pocket Gopher Bounty Resolution (M.S. 348.12 and 348.13)
Otter Tail County Resolution No. 2006 -02
Commissioner Nelson offered the following resolution and moved its adoption:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
The sum of thirty cents ($.30) be paid out of the General Revenue Fund of Otter Tail County
for every pocket gopher killed in said County during the year 2005/2006 in cases where the
township in which the pocket gophers were so killed shall provide for the payment of at least
an additional bounty of forty cents ($.40) for each pocket gopher so killed.
RESOLVED further that said payment of such County shall be made by the County Auditor
upon certificates executed by the Chairman and/or Clerk of the Town Board of said Township
setting forth that the township had issued and delivered to each claimant a payment for at
least seventy cents ($.70) for each pocket gopher so killed.
Commissioner Lee seconded the resolution, and upon being put to vote, it was unanimously
adopted.
Adopted at Fergus Falls, MN, this 3rd day of January, 2006.

Calendar Year 2006 Tax Forfeited Land Sale Apportionment Resolution
Otter Tail County Resolution No. 2006 -03
Commissioner Lee offered the following resolution and moved its adoption:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, it is provided in Minn. Stat. 282.05 for the apportionment of proceeds from the
sale of tax forfeited lands, and
WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing district
pursuant to Minn. Stat. 282.08, and
WHEREAS, Minn. Stat. 282.08 (4) (b) provides that the County Board may set aside 20% of
the proceeds remaining after the value of public improvements, special assessments, and
bond issues levied on the property have been paid, for acquisition and maintenance of
County parks and recreational areas, and
WHEREAS, Otter Tail County has a park and recreational area, which would benefit by such
an apportionment.

NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds
from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational
areas from the proceeds to be disbursed according to law.
Commissioner Mosher seconded the resolution, and upon being put to vote, it was
unanimously adopted.

Motion by Mosher, second by Lee, and unanimously carried to convene the County Board of
Appeal and Equalization on Wednesday, June 14, 2006, at 9:00 a.m. and to reconvene the
County Board of Equalization for final action on Tuesday, June 27, 2006 (Minn. Stat. 274.14).

to Western Area Cities Counties Organization (WACCO) for 2006 annual membership dues.

on December 20, 2005, for work on Otter Tail County CSAH 11 and Wilkin County CSAH 21:

a bid price of $842,885.18. Otter Tail County and Wilkin County will split the cost of this
project on a 50/50 basis.

Recess & Reconvene
At 10:43 a.m., Chairman Froemming, declared the Otter Tail County Board of
Commissioners' meeting recessed for a short break. The meeting was reconvened at
10:50 a.m.
Resolution for Acreage Modification in the Fergus Falls JOBZ Subzone
Otter Tail County Resolution No. 2006 -04
Commissioner Mosher offered the following and moved its adoption:
WHEREAS, the Otter Tail County Board of Commissioners, on September 9, 2003, passed a
resolution approving certain County parcels to be included in a regional application for a Job
Opportunity Building Zone; and
WHEREAS, the City of Fergus Falls was a participant in the regional Job Opportunity
Building Zone application done by the West Central Initiative Fund; and

WHEREAS, the regional application submitted by the West Central Initiative Fund was
approved by the Department of Employment and Economic Development; and
WHEREAS, the City of Fergus Falls wishes to modify the acreage in their Job Opportunity

BE IT RESOLVED, the Otter Tail County Board of Commissioners upon careful consideration
and review hereby approve the modifications as identified in the following table:

National Association of Counties Membership Dues
Motion by Nelson, second by Mosher, and carried with Lee opposed, to approve the 2006
annual membership dues to the National Association of Counties (NACO) in the amount of
$1,085.00.
Statutory Elected Officials Salaries Established
Otter Tail County Resolution No. 2006 -07
Commissioner Mosher offered the following and moved its adoption:
WHEREAS, Minnesota Statutes 384.151, 385.373, 386.015, 387.20, and 388.18, require that
the County Board of Commissioners, prior to the first date on which applicants may file for
office of County Auditor, County Treasurer, County Recorder, County Sheriff, and County
Attorney, shall set, by resolution, the minimum salary to be paid for the terms next following,
and
WHEREAS, the Statutes also provide that in counties with 40,000 or more inhabitants, that
the minimum salary shall not be less than $8,000.00 per year, and
WHEREAS, Otter Tail County has adopted a standard pay policy, which includes elected
officials; and
NOW, THEREFORE, BE IT RESOLVED, that the minimum salaries for the next terms for
Elected Officials are as follows:

Closed to the Public
At 11 :20 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss pending litigation relating to the Echo Bay
Negative EIS Decision, Pelican Lake Property Owners vs. Otter Tail County. The closed
session is authorized by attorney-client privilege, Chapter 130.05 Subd. 3b. Present were all
five seated Commissioners, the County Attorney, County Coordinator, Board Secretary, and
the Land & Resource Director.
Adjournment
At 11 :58 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, January 10, 2006.
