Call to Order
The Otter Tail County Human Services Board convened Tuesday, December 13, 2005, at
9:30 a.m. at the Otter Tail County Government Services Center with Commissioners
Bob Block, Chair; Roger Froemming; Vice-Chair, Dennis Mosher, Syd Nelson, and
Malcolm Lee present.
Approval of Agenda
Motion by Froemming, second by Mosher, and unanimously carried to approve the Human
Services Board agenda of December 13, 2005, as mailed.
Approval of Minutes
Motion by Nelson, second by Lee, and unanimously carried to approve the Human Services
Board minutes of November 22, 2005, as mailed.
Lawsuit -Pretrial Bail Evaluation
Court Services Director, Chuck Kitzman, discussed a federal lawsuit filed against Becker
County for its handling of the Joseph E. Duncan sex offense case. He submitted the
Minnesota Statute regarding Pretrial Bail Evaluations along with a list of offenses requiring
judicial review. Discussion was held regarding the County's responsibility in these matters.
Mr. Kitzman will return to the Board with further recommendations.
Public Health Department
Public Health Director, Diane Thorson, reported that her department has been working on the
traffic safety grant, in the amount of $25,300.00, that has recently been received. There were
thirty-five individuals participating in a coalition looking at traffic fatality reviews with
cooperation between departments with the goal of decreasing deaths from alcohol use and
driving. Ms. Thorson also reported that there will be training for Medica to move to the
MNSHO product.
Human Services Contracts/Agreements
Motion by Nelson, second by Froemming, and unanimously carried to authorize Wadena
County to operate their Children's Day Treatment Program at the Deer Creek Elementary
School in Otter Tail County. The Freshwater Special Education District is the provider of this
service and Otter Tail County is approving only the physical location of this Day Treatment
Center.
Motion by Nelson, second by Mosher, and unanimously carried to authorize the Chairman's
signature to execute the following Human Services contract:

Mr. Dinsmore reported that notice has been received by Productive Alternatives from the
Department of Transportation informing them that they have been allocated funding to begin
a public transit service in Otter Tail County. Productive Alternatives is targeting July 1, 2006,

to begin public transit on a small scale and build from that point. An Advisory Group will be
developed to move this project forward.

Motion by Mosher, second by Lee, and unanimously carried to approve the Human Services
bills & claims as presented.
Ethanol Plant Meetings
Motion by Mosher, second by Lee, and unanimously carried to authorize Chairman Bob Block
to attend the community Ethanol Meetings.
Adjournment
At 10:30 a.m., Chairman Block declared the meeting of the Otter Tail County Human
Services Board adjourned until 9:30 a.m. on Tuesday, December 27, 2005.

11 :00 a.m. at the Otter Tail County Government Services Center with Commissioners

Approval of Agenda
Motion by Froemming, second by Mosher, and unanimously carried to approve the County

Motion by Froemming, second by Mosher, and unanimously carried to approve the County

Perham Resource Recovery Facility Update
Solid Waste Director, Mike Hanan, reported that the auxiliary boiler at the Perham Recovery
Facility is scheduled to be installed in late January of 2006. He also reported that the MPCA
gave a grant to the City of Perham to assess whether or not it makes sense to expand the
facility, using air emission equipment from the Fergus Falls Incinerator.

Safety Committee Recognition
Safety Director, Tiny Holm, presented a plaque entitled "2005 County of the Year" received
by Otter Tail County from the Minnesota Counties Insurance Trust. Mr. Holm recognized
members of the Safety Committee, who assisted in making this award happen. On behalf of
the Board, Chairman Block expressed his sincere thanks and congratulations to all
employees working towards a safe place to work.
Phelps Mill Fundraising & Other RC & D Projects
Dean Schmidt and Sheila Barsness from WesMin Resource, Conservation, and Development
briefed the County Board on the Phelps Mill Improvement Project. There is $25,845.40,
to-date, in cash and pledges for the permanent repairs of Phelps Mill, bathroom facilities, and
other park improvements. Some grant applications have been denied; however, there are
several other grant applications in the pending status. Ms. Barsness also discussed other
fundraising efforts which are underway. She also discussed several other programs available
and provided the new website, www.wesminrcd.org.

Temporary Snowmobile Trail
Motion by Froemming, second by Lee, and unanimously carried to approve the granting of
the Temporary Snowmobile Trail Easement as provided in Attachment B.

, Appointment -HRA Board
Motion by Mosher, second by Nelson, and unanimously carried to appoint Attorney,
Nick Heydt, to the Housing and Redevelopment Board effective January 1, 2006. This
replaces the Board position held by Oscar Sorlie.
4-H Update
4-H Coordinator, Janet Malone, briefed the County Board on after school programming,
bread making project, and Quilt Qwest. She talked about the positive influence a child often
feels after completing a project.
Recess & Reconvene
At 11 :59 a.m., Chairman Block declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1 :00 p.m.
DNR Land Acquisitions
Viking Valley Hunt Club Owner, Les Bensch, discussed the required mitigation area around
shooting ranges that is a part of recent legislation. He stated that he is opposed to poorly
planned urban development. If an individual moves near an existing shooting range, they
should take responsibility to put in noise depression. Mr. Bensch presented a map showing
his hunt club in orange and a piece of property adjoining his property highlighted in green.
This property completely surrounds a Church. The property is in Section 16 of Eagle Lake
Township and was donated to Pheasants Forever, then transferred to the DNR. Mr. Bensch
stated that the DNR is planning to open this area to public hunting. Mr. Bensch expressed
concern with controlling encroachment from public hunting. He stated concern with safety
and liability issues. He also spoke in opposition of the reduced tax collected on the property
after five years. Mr. Bensch's opinion is that local government units should become involved
in these purchases. He spoke in opposition of dedicated funding for the DNR without
involvement of the local units of government. Mr. Bensch stated that the County needs well
balanced Wildlife Management Areas with equal balance of taxation. Commissioners
suggested that Mr. Bensch discuss the issue with Dan Larson from the Minnesota Rural
Counties Caucus.
Final Payment-Four Tandem Axle Dump Trucks
Motion by Lee, second by Froemming, and unanimously carried to authorize Final Payment,
in the amount of $262,365.04, payable to Hall GMC, Inc. pursuant to Purchase Order No.
64556 for four tandem axle dump trucks.
Snowplow Equipment
Motion by Mosher, second by Lee, and unanimously carried to approve purchase of
Snowplow Removal equipment, including blades, boxes, and sanders for four Snowplow
Trucks, from J-Craft of Kimball, MN, in the amount of $336,578.34 pursuant to Purchase
Order Number 64577.
Approval for Temporary Employee
Motion by Nelson, second by Mosher, and unanimously carried to approve a temporary
position for the Highway Department in the clerical area for approximately two weeks during
Christmas college break.

Cooperative Construction Agreement -Wilkin County
Motion by Mosher, second by Froemming, and unanimously carried to authorize the
appropriate County officials' signatures to execute a Cooperative Construction Agreement for
Otter Tail County SAP 56-611-15 and Wilkin County SAP 84-621-10.
Highway Maintenance Worker Eligibility List
Motion by Lee, second by Mosher, and unanimously carried to authorize the Highway
Engineer to proceed with developing a Highway Maintenance Worker eligibility list.
Reclassification Approved
Motion by Lee, second by Mosher, and unanimously carried to approve a reclassification for
the Veterans Service Administrative Assistant position.
Final Plats
Motion by Lee, second by Froemming, and unanimously carried to approve the Final Plat
known as "Jets #6 Addition" in Section 2 of Scambler Township, Duck Lake (56-925) and
Pelican Lake (56-786).
Motion by Lee, second by Nelson, and unanimously carried to approve the Final Plat known
as "Sandy Beach Estates First Addition" in Section 36 of Scambler Township, Sand Lake
(56-942).
Motion by Mosher, second by Froemming, and unanimously carried to approve the Final Plat
known as "Pelican River Estates", Lots 1, 2 & 3 of Section 17, Fergus Falls Township,
Pelican River.
Echo Bay CUP Timeline
Mr. Kalar stated that the County Board issued a negative declaration for an EIS for Echo Bay
on November 29, 2005. Once that decision was made, the 60-day rule began in which the
County needs to make a decision on the Conditional Use Permit that was provided in
November of 2003. The County must make a decision by January 27, 2006. The Planning
Commission will meet on January 4, 2006, and their recommendation would be provided at
the January 10, 2006 County Board meeting.
Limited Use Snowmobile Trail
Otter Tail County Resolution No. 2005 -72
Commissioner Froemming offered the following and moved its adoption:
WHEREAS, the Commissioner of Transportation of the State of Minnesota has made
available certain Trunk Highway right-of-way as shown in red and green on exhibit "A" in
Limited Use Permit, attached hereto, and made part thereof, for the purpose of constructing,
maintaining, and supervising a snowmobile trail, and
WHEREAS, the County of Otter Tail desires to make available to its citizens and visitors,
such an area for the aforementioned purposes, in harmony and keeping with its recreational
plan, and,
WHEREAS, the County of Otter Tail is willing to operate, maintain, and safeguard the facility
as set forth in the Limited Use Permit, attached hereto, and make a part thereof,

NOW, THEREFORE, BE IT RESOLVED, that the Chairperson of the Board of County
Commissioners execute the aforesaid Limited Use Permit.
Commissioner Mosher seconded the resolution and, upon being put to vote, was
unanimously adopted.

Reappointments -Planning Commission
Motion by Froemming, second by Lee, and unanimously carried to reappoint Ken Erickson
and David Trites to the Otter Tail County Planning Commission effective January 1, 2006, for
a three year term.
Blue Heron Bay Consultant
Mr. Kalar reported that he requested proposals from consultants for the Blue Heron Bay
project and received proposals from three vendors. Mr. Kalar stated that all proposers have
good qualifications, are highly respected in their field of work, and could be a benefit to the
County and helpful in the EIS process. He stated that the main difference in the proposals is
the length of time proposed for completion of the EIS. Blue Heron Bay Developer, Jim
Erickson, requested additional time to meet with the Dead Lake Association before a decision
is made. Doug Martin, representing the Dead Lake Association, spoke in favor of Wenck
Associates. County Attorney, David Hauser, stated that the County did not provide the
Proposals to the Dead Lake Association or Mr. Erickson. The proposals were obtained from
the Vendors. Mr. Kalar stated that an EIS Preparation Notice must be issued by
January 3, 2006.
Shoreland Best Management Practices
Shoreland Rules Revision Discussion
Mr. Kalar provided a handout entitled "Top Ten Shoreland Best Management Practices" from
the Minnesota Lakes Association Reporter, dated November of 2005. He stated that the
information is pertinent to SMO change discussion. On November 15, 2005, the County
Board indicated that changes to the Shoreland Management Ordinance were necessary.
Discussion took place regarding proposed changes. Resort Owner, Cheryl Harris, presented
a handout entitled "Resort Recommendations for Shoreland Ordinance Changes" dated
December 13, 2005. On behalf of existing Resort Owners, Ms. Harris asked the Board to
incorporate the recommendations for existing resorts into the Otter Tail County SMO.
Commissioner Mosher referred to No. 5 of the resorter's recommendations and suggested
changing the deadline for earthmoving in the fall from September 1st to November 1st.
Several Commissioners expressed support for the existing resort recommendations.
Chairman Block stated that the Internal Shoreland Rules Revision Committee will meet and
return to the County Board regarding SMO changes.
