HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/25/2005MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, October 25, 2005 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, October 25, 2005, at 9:33 a.m. at the Otter Tail County Government Services Center with Commissioners Bob Block, Chair; Roger Froemming; Vice-Chair, Dennis Mosher, and Syd Nelson present. Commissioner Malcolm Lee was absent. Approval of Agenda Motion by Froemming, second by Mosher, and unanimously carried to approve the Human Services Board agenda of October 25, 2005, as mailed. Approval of Minutes Motion by Froemming, second by Nelson, and unanimously carried to approve the Human Services Board minutes of October 11, 2005, as mailed. Probation Supervision Fees Court Services Director, Chuck Kitzman, provided several handouts including MN Statute 244.18 Subd 2, which addresses Local Correctional Fees. He submitted the current probation supervision fees and additional proposed fees for adults and juveniles (handout dated 10/24/05). Mr. Kitzman stated that he will discuss the proposed fees with the judges. Motion by Mosher, second by Nelson, and unanimously carried to support the probation supervision fees as presented by the Court Services Director. Grant Application Request Mr. Kitzman requested approval to submit a grant application for a one time special projects grant that would benefit juvenile justice programming in Minnesota. Total grant dollars available were reported as $60,000. Motion by Nelson, second by Mosher, and unanimously carried to authorize the Court Services Director to submit a grant request application to the Minnesota Juvenile Justice Advisory Committee, in the amount of $4,000, to fund the Juvenile Restitution Work Program. Women, Infants, and Children (WICl Grant Contract Agreement Motion by Mosher, second by Froemming, and unanimously carried to authorize the Chairman's signature to execute a Minnesota Department of Health and Otter Tail County Grant Project Agreement for funding the WIC Program in Otter Tail County. Minnesota Senior Health Options Program (MSHOl Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chairman's signature to execute the Medica Health Plans & Otter Tail County Participation Agreement effective January 1, 2006. The purpose of the Agreement is to set forth the terms and conditions under which Otter Tail County will render Care Coordination services through its Human Services Agency and Public Health Agency to members who are enrolled for coverage under Medica's Dual Solution (Medica MSHO) through the Minnesota Senior Health Options Program. Otter Tail County Board of Commissioners' Minutes October 25, 2005 Page 2 Request to Submit SAMHSA Grant Application Public Health Director, Diane Thorson, presented a copy of a grant application in accordance with M.S 254.A07. She explained that the grant is for approximately $250,000.00 each year for two years with a potential for continued funding for an additional three years. The application would be.submitted by the Otter Tail Family Services Collaborative with the Public Health Department providing fiscal management and project oversight along with Peaceful Solutions. In future years, funding may be requested to support the costs of sustaining the Coalition Coordinator position for the proposed program. The grant focuses on alcohol use activities related to the youth population with a certain portion of time also spent on children at risk for methamphetamine usage. Motion by Nelson, second by Mosher, and unanimously carried to approve of submitting an application for a Substance Abuse Mental Health Services Administration grant for reducing alcohol and meth use by youth as described by the Public Health Director. Adoption Month -November, 2005 · Otter Tail County Resolution No. 2005 -66 Commissioner Mosher offered the following and moved its adoption: WHEREAS, the family, serving as the primary source of love, identity, self-esteem and support, is the very foundation of our communities, our state, and our Country. WHEREAS, adoption gives children who have been orphaned, abandoned, or abused a precious second chance at happiness; a chance to love and be loved and to reach their full potential in a secure, supportive environment. WHEREAS, in 2003 there was an average of 731 children waiting for an adoptive family, on any given day, in the State of Minnesota. WHEREAS, in 2004 there was an average of 701 children waiting for an adoptive family, on any given day, in the State of Minnesota. The decrease that has taken place in one year shows the dedication and commitment of the professionals and families working towards the permanency of children. WHEREAS, the majority of the families seeking children for adoption are pursuing the adoption of younger children. In 2004, of the children waiting to be adopted in the State of Minnesota, 38% were 12-18 years old; 29% were 6-11 years old; 33% were under 6 years old. 64% are siblings that need to be adopted together. 49% have been chronically neglected or abused. 34% have been diagnosed with a psychological or medical disability. WHEREAS, there is a continued need for an increased number of families in the State of Minnesota and in Otter Tail County who will adopt older children with special needs. WHEREAS, both the public and private sectors· are working together as a "team" to find adoptive homes for the children throughout the Counties and the State of Minnesota. NOW, THEREFORE, we, The Otter Tail County Human Services Board, by virtue of the authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim November as ADOPTION MONTH in Otter Tail County. In honor of this event, we encourage community agencies, religious organizations, businesses and others to celebrate adoption, Otter Tail County Board of Commissioners' Minutes October 25, 2005 Page 3 honor families that grow through adoption, further an awareness of the changes and issues in adoption, and focus attention on those children who live in the shadow of an uncertain future while they await permanent families. She stated that there are older children who need homes; many of these are children of color. In placing these children, siblings must be kept together, so there often are families of four or more children that need permanent placement. Curt Melecha talked to the Board about his adoption experiences having adopted a family of three children and a family of six children. He stated that adoption has been very rewarding and Board members thanked him for caring about children. Human Services Contract and Amendment Approvals Motion by Nelson, second by Mosher, and unanimously carried to authorize the Human Services Director's signature to execute a contract between Otter Tail County and Rural Minnesota CEP to provide FSET (food support employment training) funded services. The contract period is for October 1, 2005 through September 30, 2006. Motion by Froemming, second by Mosher, and unanimously carried to authorize the Chairman's signature to execute the following amendments to the 2005 Provider Contracts for a 2.2553% increase in reimbursement rates effective October 1, 2005. Whereas, sixty one percent (61 %) of Otter Tail County residents who have received chemical dependency treatment services in 2004 compared to 38% of all State residents who have received chemical dependency services have reported use of methamphetamines, and Whereas, the Otter Tail County Human Services, Otter Tail County Detention Center, Lakeland Mental Health Center, Fergus Falls Regional Treatment Center, and Lake Region Halfway House representatives have met to develop and submit a grant application proposal due on November 18, 2005, and · Whereas, the proposed program will seek funding of $200,000.00 per year for two years (2006 -2007) to fund three positions that will serve as a community outreach team providing intensive follow-up services to 30 methamphetamine users who have completed, or are near completion of a chemical dependency treatment program, and Whereas, the community outreach team will be comprised of a social worker with chemical dependency expertise (Lakeland Mental Health Center) a licensed alcohol counselor (Lake Region Halfway House) and a licensed practical nurse (Fergus Falls Regional Treatment Center), and Whereas, Otter Tail County Human Services will serve as the fiscal host of the proposed grant application and subsequent contract. Recess & Reconvene in Closed Session At 10:35 a.m., Chairman Block declared the Otter Tail County Board of Commissioners' meeting recessed for a short break. At 10:38 a.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of Public Health Director, Diane Thorson, pursuant to M.S. Chapter 13D.05 Subd. 3. Commissioners Block, Froemming, Mosher, and Nelson were present for the evaluation. A summary of performance conclusions will be provided at the next regular County Board meeting. No one from the public was present; therefore, no comment was offered. Chairman Block closed the Public Meeting at 11 :12 a.m. Update Phelps Mill R, C, & D Board member, Norm Fjestad, stated that an update will be made relative to the R, C, & D. He stated that there has been about $13,000 collected for the Mill at the Phelps Mill Park which is held in a Bank in Alexandria in hopes of gaining additional contributions. Final Plat Motion by Mosher, second by Froemming, and unanimously carried to approve the Final Plat of Milt and Jeffrey Smedsrud known as "Stalker Lake Golf View Shores" consisting of 6 lots in Section 34 of Tordenskjold Township; Stalker Lake (56-437). , CUP Extension Request Motion by Nelson, second by Mostie~. a_rid µnanimously carried t_o extend the Conditional Use Permit approved on October 18, 2005, for Nicholas Ill & Janice Schmit until November 30, 2005. Application for Exempt Permit Motion by Nelson, second by Froemming, and unanimously carried to approve, with no waiting period, the Pelican Rapids Jaycees LG 220 Application for Exempt Permit for an event scheduled for November 25, 2005 at The Club located at th_e intersection of Highway 59 N and County Road 4. Otter Tail County Board of Commissioners' Minutes October 25, 2005 Page 7 Assessment Certified Motion by Nelson, second by Mosher, and unanimously carried to certify as a payable 2006 special assessment the following: Parcel 38-000-27-0202-002 Public Health Abatement of $10,694.06 at a 6% Interest Rate Tobacco Compliance Program Motion by Nelson, second by Mosher, and unanimously carried to approve payment, in the amount of $2,856.81, to the Otter Tail County Department of Public Health for the 2005 Tobacco Compliance Program. Purchase of Vehicles Chairman Block requested information regarding the County's purchasing policies relative to purchase of vehicles. Auditor, Wayne Stein, explained that if the County does not purchase off the State Contract, a competitive bidding process would need to take place or, if the cost is less than $25,000, quotes from local dealers can also be accepted. If the lowest responsible quote is submitted from a local dealer, the purchase would be made from that dealer. Dealers also have an opportunity for competitive bidding for the State Contract. Recess & Reconvene At 11 :44 a.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners recessed for a Personnel Committee meeting and lunch break. The meeting was reconvened at 1 :05 p.m. Discussion -EIS Scoping for Blue Heron Bay Development County Attorney, David Hauser, opened discussion regarding the Environmental Impact Statement Scoping decision for the Blue Heron Bay Development. He stated that a decision is to be made 15 days after the end of the comment period. Discussion took place regarding a consultant that both the proposer and the Dead Lake Association would agree upon to work on the EIS. Mr. Hauser stated that the County can ask the proposer for information and the proposer would be responsible to provide the information and pay for that expense. However, a third party, such as a consultant, is often used as the consultant may be more neutral when gathering information. The County Board, as the Responsible Government Unit, will need to make a decision on what needs to be in this EIS. Next week, a proposed scoping document will be presented for the Board to consider. Norway Lake & Ditch No. 37 Ditch Inspector, Randy Wasvick, showed the Board a map of Norway Lake north of Underwood and stated that the township road has been built up and the DNR said it cannot be built up further because it is creating a dam and problems for other people. When the wind blows from the west, the water blows over the road and several people have expressed concerns about doing something to bring Norway Lake down. Mr. Wasvick stated that in the late 1970's, Vernon Johansen ran a tile from the wetland over to Onstad Lake which is the beginning of Ditch No. 37. Ditch No. 37 flows to Wall Lake. From the wetland to go into the 8" tile that is already there, wouldn't be a long ways. Mr. Wasvick was hoping this would help the Highway Department because CR 35 is in danger of flooding. However, to enter a Ditch System would require a Public Hearing. Assistant County Highway Engineer, Chuck Grotte, stated that the Highway Department is planning to raise CR 35 about three feet. The road is about 1 ½ feet below the current lake level, so if the township road wasn't there, CR 35 would Otter Tail County Board of Commissioners' Minutes October 25, 2005 Page 8 be under water. Lengthy discussion continued regarding requirements for entering a ditch system as an outlet or as a lateral process. The County Attorney suggested that a Public Information Meeting be held with the property owners affected by the high water (Norway Lake) and Ditch No. 37. Secretarial Position for the MSHO Program Motion by Mosher, second by Nelson, and unanimously carried to authorize the Public Health Director to advertise to fill a secretarial position for the Minnesota Senior Health Options Program. This is a grant funded position budgeted in the proposed 2006 Public Health Budget. _ Adjournment At 1 :54 p.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. Tuesday, November 1, 2005.
