HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/04/2005• MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, October 4, 2005 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, October 4, 2005, at 9:30 a.m., at the Otter Tail County Government Services Center with Commissioners, Bob Block, Chair; Roger Froemming, Vice-Chair; Dennis Mosher, Syd Nelson, and Malcolm Lee present. Approval of Agenda Motion by Froemming, second by Mosher, and unanimously carried to approve the County Board agenda of October 4, 2005, with the following additions: 9:50 a.m. -Kent Mattson, canceled 9:50 a.m. -Court Services Director, Chuck Kitzman 10:40 a.m. -Auditor, Wayne Stein 10:45 a.m. -Land & Resource Director, Bill Kalar Approval of Minutes Motion by Mosher, second by Nelson, and unanimously carried to approve the County Board minutes of September 27, 2005, as presented. Approval to Pay Bills Motion by Lee, second by Nelson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Lakes Testing Program for 2005 Carolyn Herron, Environmental Affairs Officer with the Otter Tail Coalition of Lakes Associations, and President, Greg Hayes, presented a summary report . of the lakes monitoring program. Ms. Herron stated that there are 57 lakes now in the testing program and the annual report includes results from 1996 to the present. She explained the testing process and the four areas of testing completed for each lake. Lengthy discussion took place regarding the affect of water quality in the lakes from rivers and streams, shoreland rules, lakescaping projects, and second tier development. Reclassification Request Court Services Director, Chuck Kitzman, indicated that a substantial change in job duties has taken place in the Court Services Administrative Assistant's position and he requested permission for reclassification. Motion by Mosher, second by Lee, and unanimously carried to approve a reclassification request for the Court Services Administrative Assistant position (job #1505) as requested by the Court Services Director. Equitable Sharing Agreement Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chairman's signature to execute an agreement between the County of Otter Tail and the Federal Government entitled "Federal Equitable Sharing Agreement" valid through September 30, 2008. The agreement regulates shared assets on forfeitures. Recess & Reconvene OTC Board"of Commissioners Minutes October 4, 2005 Page 2 At 10:00 a.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. At 10:10 a.m., with Chairman Block absent, Vice-Chair Froemming assumed the Chair and reconvened the Board of Commissioners' meeting. Bid Award -S.P. 56-599-53 After previously advertising for bids, Highway Engineer, Rick West, opened the following bids for Grading, Surfacing, and Bridge Removal and Construction for a bridge on 245th Street at 1 :00 p.m. September 7, 2005: Structural Specialties, Inc. $715,267.85 Hutchinson, MN Redstone Construction Co., Inc. Mora, MN Robert R. Schroeder Construction, Inc. Glenwood, MN Korby Contracting Co, Inc. Fergus Falls, MN $734,168.93 $778,151.75 $834,843.00 Wanzek Construction, Inc. $930,133.1 O Fargo, ND Motion by Lee, second by Mosher, and unanimously carried to award this project (S.P. 56-599-53) to the low bidder, Structural Specialties, Inc. of Hutchinson, MN in the amount of $715,267.85, as recommended by the Highway Engineer. Construction Update Highway Engineer, Rick West, provided a construction update on projects being completed this fall. County Road No. 12 Mr. West reported that a draft engineering study on siphoning vs. pumping has been completed by Ulteig Engineers in response to high water on County Road 12. The preliminary recommendation is to set up a pump system that would drain off approximately 1 ft. per month, not including evaporation or in-flow. The water would be pumped to the north and east eventually flowing into the Pomme de Terre River. Approximate cost of a leased pump system was estimated at $60,000 to $80,000 for a 2-year lease arrangement. Motion by Mosher, second by Nelson, and unanimously carried to authorize the Highway Engineer to proceed with pumping Johnson Lake after research is finalized and landowners contacted. Highway Maintenance Worker Position Motion by Nelson, second by Mosher, and unanimously carried to replace a Highway Maintenance Worker position because of a recent retirement. , OTC Board of Commissioners Minutes October 4, 2005 Page 3 Request to Sell Sheriffs Department Vehicle Motion by Nelson, second by Lee, and unanimously carried to authorize the Sheriff to sell a salvaged 2003 Ford Crown Victoria squad car with an approximate value of $3,200. Governor's Banquet Motion by Mosher, second by Froemming, and unanimously carried to appoint Commissioner Nelson to attend the Governor's Big Buck Banquet at Playtime Sports near Perham, MN, on Friday, November 4, 2005. Premise Permit Otter Tail County Resolution No. 2005 -62 Commissioner Lee offered the following and moved its adoption: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Elizabeth Fireman Relief Association, Elizabeth, MN, has made an application to the Gambling Control Board for the purpose of conducting lawful gambling at Ye Olde School House, located at 24028 Emery Drive in Friberg Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the application for a permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Elizabeth Fireman Relief Association, Elizabeth, MN, at Ye Olde School House, located at 24028 Emery Drive in Friberg Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Elizabeth Fireman Relief Association, Elizabeth, MN, at Ye Olde School House, located at 24028 Emery Drive in Friberg Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Friberg by sending them a copy of this resolution.
