Call to Order
The Otter Tail County Human Services Board convened Tuesday, August 23, 2005, at
9:30 a.m. at the Otter Tail County Government Services Center with Commissioners
Bob Block, Chair; Roger Froemming; Vice-Chair, Dennis Mosher, Malcolm Lee, and
Syd Nelson present.
Approval of Agenda
Motion by Froemming, second by Lee, and unanimously carried to approve the Human
Services Board agenda of August 23, 2005, as mailed.
Approval of Minutes
Motion by Nelson, second by Mosher, and unanimously carried to approve the Human
Services Board minutes of August 9, 2005, as mailed.
Court Services Update
Court Services Director, Chuck Kitzman, reported the County's Secure Detention costs, to-
date, at $28,422.00. The total budgeted amount for secure detention for 2005 is $54,000.00.
He discussed the upcoming West Central Regional Juvenile Center Advisory Board meeting
and the Open House at Valley Lake's Boys Home in Breckenridge, MN.
Public Health Staffing
Motion by Mosher, second by Lee, and unanimously carried to authorize the Public Health
Director to hire a temporary Public Health Nurse from August 17, 2005 through December 31,
2005, and January 1, 2006, through June 30, 2006, to replace maternity leaves.
Motion by Lee, second by Mosher, and unanimously carried to authorize the Public Health
Director to hire a Public Health Nurse, who will be based out of the New York Mills building,
at a Step 3 rather than Step 2. The basis of this variance is because of the experience the
candidate has in private sector employment, specifically, experience with the new Minnesota
Senior Health Options program.
Potential Funding to Reduce Youth Substance Abuse
Ms. Thorson reported on a meeting held at the Best Western regarding funding available
through the Health and Human Services Department to reduce substance abuse related to
youth. The first year of the grant, a community readiness survey dealing with youth alcohol
issues would be required, and year two and three would be the implementation of prevention
programs. She provided a handout of programs that could be considered. Some community-
wide, meth prevention education could be incorporated. Ms. Thorson stated that with this
grant, the County would need to show funding available in the future for a Coordinator
position for five years. The potential grant amount is $250,000.00 per year for five years.
The grant is federal dollars given out by the State OHS and the application deadline is
October 7, 2005. County Attorney, David Hauser, suggested that the United Way group be

made aware of this as they are currently surveying community members to obtain ideas for
dealing with Meth issues, specifically for Otter Tail County.

Resolution for Advance Encumbrance of
Town Bridge Funds
Otter Tail County Resolution No. 2005 -50
Commissioner Lee offered the following and moved its adoption:
WHEREAS, Otter Tail County intends to construct one or more township bridges, which will
require Town Bridge Funds in excess of those currently available in the County's State Aid
Town Bridge Account;
NOW, THEREFORE, BE IT RESOLVED, that the Commissioner of Transportation is hereby
requested to approve this request to advance funds from the general fund balance of the
Town Bridge Account for financing the construction of these township bridge projects, in the
amount of up to $100,000.00, in accordance with Minnesota Rules 8820.1500, Subpart 9a.
Furthermore, the County agrees to the following terms and conditions in accepting these
advance funds:
1. The County agrees to execute a contract for construction of all township bridge
projects identified by the Commissioner as having been approved for funding with
advance Town Bridge Account funds prior to the next Town Bridge fund allocation.
2. If, after receiving notice of project approval, using advance Town Bridge Account
funds and prior to execution of a contract, the project is delayed until after the next
allocation, the County will notify the Commissioner as soon as practical after the
delay is known and release the advanced funds.
3. The County agrees to repay the advanced funds from subsequent year's accruals
to the County's Town Bridge Account, using 100% of the County's annual
apportionment until the advance is repaid.
Commissioner Mosher seconded the motion, and upon being put to a vote, was unanimously
carried.

Motion by Lee, second by Froemming, and unanimously carried to approve a Preliminary Plat

Conditional Use Permit -Paul Baarson et al:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use
Permit to construct a year-round dwelling to replace a seasonal dwelling with a condition as
recommended by the Planning Commission. The property is described as Pt GL 1 com NW
cor GL 1 S 2575.96' to beg S 136.97' E 135' to lake NL Y 137' W 139' to beg (.43 AC),
Section 26 of Rush Lake Township; Rush Lake (56-141).
Shoreland Rules Revision Internal Committee Update
Land & Resource Director, Bill Kalar, briefed the Board on the Shoreland Rules Revision
Internal Committee meeting held on August 18, 2005. Discussion took place regarding
grandfather dates, second dwelling on a lot issue, recommending that towers be prohibited in
the Shoreland area, not having a timeframe for completion for 20 cubic yards of fill or less,
requiring that decks exceeding 100 sq. ft. receive a permit, and allowing the Land &
Resource Office to make decisions regarding extensions of Conditional Use Permits relative
to earthmoving projects. The next meeting is scheduled on Thursday, August 24, 2005.
Environmental Impact Statement -Blue Heron Bay
County Attorney, David Hauser, reported that the developers of the Blue Heron Bay project
wish to proceed with an EIS. Discussion followed.
Purchase Agreement -Land for Transfer Station
Motion by Froemming, second by Mosher, and unanimously carried to authorize the
Chairman's signature to execute a purchase agreement between the County of Otter Tail and
Genevieve Strande for approximately 30 acres of land located in Section 31 of Fergus Falls,
Township, at a cost of $6,500 per acre. The intended use for this property is for a solid waste
transfer station
Payment Approval for Boiler
Motion by Nelson, second by Froemming, and carried with Mosher opposed, to authorize
payment, in the amount of $74,000.00, to the City of Perham as the first installment for a new
boiler at the Perham Resource Recovery Facility.
Recess & Reconvene
At 12:01 p.m., Chairman Block declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1 :22 p.m. after a
Building Committee meeting.
Sheriff's Department Award Presentation
Sheriff, Brian Schlueter, presented a plaque and letter of commendation to Deputy,
Dean Nelson, for exceptional work in saving a man's life. Commissioners, several Sheriff
Department employees, and family expressed their appreciation.
Office at the Underwood Fire Department
Motion by Mosher, second by Froemming, and unanimously carried to allow the Sheriff's
Department to open an office at the Underwood Fire Station as presented by the Sheriff. The
office is being donated by the Fire Department with the County responsible for furnishings
and a telephone line.

Conditional Use Permit -"Pleasure Land Estates"/Rick Heinle
Land & Resource Director, Bill Kalar, presented a request of Rick Heinle that the 20 unit
single family unit cluster development have a ten (10) year completion date for the project,
not the three (3) year date condition that was applied at the July 26, 2005, County Board
meetin~. Lengthy discussion took place regarding confusion in the previous discussion at the
July 26 h meeting. Motion by Nelson, second by Mosher, and unanimously carried to change
two of the previous conditions for the Conditional Use Permit of Rick Heinle for Pleasure
Land Estates as follows: One RV is allowed on-site for personal use only for a three year
period while developing the project, and to change the three (3) year project completion date
to a ten (10) year project completion date with the stipulation that buyers of any lots be told
about the condition of ten years to complete the project. The motion also authorizes a
workable septic system at the common buildings to replace the request for outhouses at two
locations.
Credit Card Approvals
Motion by Nelson, second by Froemming, and unanimously carried to authorize the following
employees to be issued an Otter Tail County Credit Card with Express One Master Card:

Private Sale of Tax Forfeited Property
Auditor, Wayne Stein, requested establishment of a date for the private sale of parcel
#46-000-99-0157-000 and a minimum bid price to be set at $9,300.00. Discussion followed.
Motion by Block to establish $8,500.00 as the minimum bid price for this parcel. Motion failed
for lack of a second. A motion was then offered by Froemming, seconded by Nelson, and
unanimously carried to offer, at a private sale scheduled for 9:00 a.m., on Friday,
September 30, 2005, the following described parcel of tax forfeited property and to establish
the opening/minimum bid price at $7,500.00:

loan between the General Fund and the County Ditch No. 38 account, in the amount of
$46,673.70, with interest calculated at the statutory rate.
Resolution Adopting Assessment Order for County Drainage System No. 38
Otter Tail County Resolution No. 2005 -51
Commissioner Nelson offered the following and moved its adoption:
WHEREAS, the County Board of Otter Tail County, acting as the Otter Tail County Drainage
Authority, ordered on Tuesday, August 6, 2002, a re-determination of benefits for County
Drainage System No. 38,
WHEREAS, the County Board of Otter Tail County, acting as the Otter Tail County Drainage
Authority, held a public hearing on Tuesday, April 20, 2004 in New York Mills, to review and
discuss the Ditch Viewers' Report of Re-determination of Benefits for Otter Tail County
Drainage System No. 38, and
WHEREAS, the County Board of Otter Tail County, acting as the Otter Tail County Drainage
Authority, on Tuesday, June 1, 2004, issued the order re-determining benefits for Otter Tail
County Drainage System No. 38, and
WHEREAS, the County Board of Otter Tail County, acting as the Otter Tail County Drainage
Authority, on Tuesday, December 14, 2004, issued an order to authorize the repair of County
Drainage System No. 38, and
WHEREAS, the Otter Tail County Board of Commissioners as of August 23, 2004 has
approved expenditures for the re-determination of benefits and for the repair of Otter Tail
County Drainage System No. 38 totaling $61,818.70 as stated below:

WHEREAS, the Otter Tail County General Fund has advanced to the County Drainage
System No. 38 Account, on behalf of the benefited property owners, the funds necessary to
cover the above noted cost,
WHEREAS, the benefited property owners are responsible for the advanced funds plus
accumulated interest, and
WHEREAS, the Otter Tail County Ditch Inspector has noted that additional maintenance work
will be required in 2005 to County Drainage System No. 38 (removal of at least six beaver
dams).

NOW THEREFORE, BE IT RESOLVED BY THE OTTER TAIL COUNTY BOARD OF
COMMISSIONERS, that a special assessment in the amount of $73,000, be levied against
the benefited properties of County Drainage System No. 38, as listed in the Auditor's Tabular
Assessment dated August 23, 2005, a copy of which is on file in the County Auditor's office is
hereby accepted and shall constitute a lien against the lands named therein, and each tract
of land therein included is hereby found to be benefited by the repair/maintenance in the
amount of the assessment levied against it.
BE IT FURTHER RESOLVED, that such assessments shall be payable in annual
installments extending over a period of 5 years. To the first installment shall be added
interest, at the statutory rate, on the entire assessment from August 23, 2005 until
December 31, 2006.
BE IT ADDITIONALLY RESOLVED, that the owners of any of the benefited properties so
assessed may, on or before Monday, October 31, 2005, pay the entire assessment on such
property to the County Auditor's office without additional interest.
Commissioner Lee seconded the motion, and upon being put to a vote, was unanimously
carried.

Gravel Tax Discussion
County Auditor, Wayne Stein, updated the Board regarding a gravel tax survey. Mr. Stein
stated that ten counties had responded to the survey and he provided statistics received.
Mr. Stein suggested that a meeting be held with operators and townships to explain how the
gravel tax will be applied. Commissioners requested that Mr. Stein attend the East and West
Otter Tail Township annual meetings and share information about a gravel tax. A public
hearing could be held after the Township's annual meetings.
Application for Exempt Permit
Motion by Froemming, second by Nelson, and unanimously carried to approve, with no
waiting period, the LG220 Application for Exempt Permit as submitted by the Leaf Valley
Toms for an event scheduled for Friday, October 28, 2005, at the Peak Supper Club.
Special Assessment
Motion by Mosher, second by Lee, and unanimously carried to defer the following special
assessment, which was originally certified on Tuesday, October 5, 2004, contingent upon the
successful completion of the agreement as drafted by the County Attorney's office:

Agreement Regarding Special Assessment
Motion by Mosher, second by Froemming, and unanimously carried to authorize the
Chairman's signature to execute a payment agreement relative to a judgment against
