Main Avenue, New York Mills, MN Tuesday, June 14, 2005 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday. June 14, 2005, at 9:31 a.m. at the New York Mills Courtroom with Commissioners Bob Block, Chair; Roger Froemming; Vice-Chair, Dennis Mosher, Malcolm Lee, and Syd Nelson present. Approval of Agenda Motion by Mosher, second by Lee, and unanimously carried to approve the Human Services Board agenda of June 14, 2005, as mailed. Approval of Minutes Motion by Froemming, second by Lee, and unanimously carried to approve the Human Services Board minutes of May 24, 2005, as mailed. Keys to lnnervision Contract Court Services Director, Chuck Kitzman, requested approval of a contract to provide the Keys to lnnervision Program, which is an eight-week cognitive restructuring program for juveniles and their families. Motion by Froemming, second by Lee, and unanimously carried to authorize the Chairman's signature to execute an agreement between the County of Otter Tail and Lakeland Mental Health Center, for the period of July 1, 2005, through June 30, 2006, to provide the Keys to lnnervision program. Cost of the program will be paid out of the Supervision Fees Fund, in the amount of $225.00, and $50.00 will be paid by the adolescent and family. Commissioners requested a review of the program in one year. Probation Officer Salaries Mr. Kitzman stated that County Probation Officer counties will receive an additional $500,000 this year for Probation Officer salary reimbursement. If the funding is split by population, Otter Tail County would receive an additional $31,500 over last year, which would provide almost 50% reimbursement of Probation Officers salaries in Otter Tail County. National Conference Motion by Lee, second by Mosher, and unanimously carried to authorize two Fraud Investigators to attend the National Conference on Fraud in Des Moines, Iowa and support a Fraud Investigator to be a representative on the National Board if elected. Recess & Reconvene At 10:00 a.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10: 13 a.m. lnteragency Special Education Addendum Motion by Mosher, second by Lee, and unanimously carried to authorize the Chairman's signature to execute an Addendum to the original Purchase of Service Contract between the Otter Tail County Department of Human Services and the Fergus Falls Area Special Education Cooperative #935 and Lakeland Mental Health Center for the period of January 1, OTC Board of Commissioners' Minutes June 14, 2005 Page 2 2005 to June 30, 2005. This agreement provides a school based day clinical treatment program for children and the Addendum is a reduction in funding due to staff reduction. Human Services Contract Approvals Motion by Froemming, second by Nelson, and unanimously carried to authorize the Chairman's signature to execute an lnteragency Agreement between Otter Tail County Human Services and the Fergus Falls Area Education Cooperative #935 for the period of July 1, 2004 through June 30, 2005, which provides school based mental health family outreach to children and families. This program started July of 2004 with no county funding involved for child case management and the County is now billing the state for the program. Approval of Minutes Motion by Lee, second by Froemming, and unanimously carried to approve the County Board minutes of June 7, 2005, as mailed. Correction -May 17, 2005 Minutes Motion by Lee, second by Nelson, and unanimously carried to approve the following correction in the May 17, 2005, Board of Commissioners' Minutes, Page 7, under the Heading of "Conditional Use Permit -Vic Haugrud", which should read as follows: Motion by Lee, second by Nelson, and unanimously carried to approve a Conditional Use Permit to raise the grade on the south side of an existing building for a proposed addition as presented. Harris, Et Al. vs. Gary P. Ruehmann. This was a result of a Dead Lake Township election issue which Commissioner Mosher does not feel that the County should be responsible to pay; however, state statute requires payment. The motion was seconded by Commissioner Lee and the motion was carried unanimously. Credit Card Approved Motion by Mosher, second by Lee, and unanimously carried to approve issuance of an Otter Tail County Credit Card with Express One Master Card to the following employee: Cheryl D. Ranum Human Services Department $500.00 limit Bid Award -S.A.P. 56-601-45 & Etc. Construction, Inc. for work performed on CSAH 12, 2½ miles East of Dalton, C.P. 04:12RG. Recess & Reconvene At 10:48 a.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners' recessed for a short break. Chairman Block reconvened the meeting at 11 :00 a.m. for the remainder of the scheduled agenda items. Planning Commission Recommendations Conditional Use Pennit-Sverdrup Township/Tom Gardner et al: Motion by Mosher, second by Froemming, and unanimously carried to approve a Conditional Use Permit to construct a road and three driveways, and remove an existing road (273rd Street) as submitted on the revised request, with conditions as recommended by the Planning Commission. The property is described as Pt of GL 6 (Parcels A, B, C, D, E, F, & G) Lot 9 ex 4.63 Ac & portion of 273rd St., Section 1 of Sverdrup Township; East Lost Lake (56-378). Preliminary Plat & Conditional Use Permit "Bagley Bay First Addition" Nancy Lynn Hanson & Marty A. Hanson: Land & Resource Director, Bill Kalar, reported that he had received a letter from Chris Svingen, the Applicant's attorney, requesting that action on this plat and CUP be tabled until the next regular County Board meeting (June 21•\ Motion by Mosher, second by Froemming, and unanimously carried to table consideration of the Preliminary Plat of "Bagley Bay First Addition" until 11 :00 a.m. on Tuesday, June 21, 2005. OTC Board of Commissioners' Minutes June 14, 2005 Page 6 Preliminary Plat-"Harmony Hil/'1/Marion Anderson: Motion by Lee, second by Mosher, and unanimously carried to approve the Preliminary Plat of "Harmony Hill" consisting of three (3) single family residential backlots as presented. The property is described as Outlot B, Whispering Springs Replat, Section 12 of Elizabeth Township; Long Lake (56-784). Preliminary Plat & Conditional Use Permit "Blue Heron Bay'1/Connor F. Schmidt & R. Murray Partnership, LLP: Mr. Kalar explained that this plat exceeds the mandatory Environmental Assessment Worksheet (EAW) thresholds in the number of residential lots proposed (54) and the conversion of acreage to residential lots. Motion by Nelson, second by Lee, and unanimously carried to proceed with the mandatory EAW process as recommended by the Planning Commission. The property is described as Lot 4 (43.10 Ac) & Lot 6 (10.50 Ac) in Section 19 & Lot 3 ex N 660' to State & all Lot 5 (54.61 Ac) & Lots 6 & 7 (46.99 Ac) & Lots 8 & 9 (80.97 Ac) & Lot 10 (3.90 Ac) in Section 20 & Lot 1 (18.37 Ac) in Section 29 & Lot 1 (1.60 Ac) in Section 30 of Dead Lake Township; Dead Lake (56-383). Approval of Extension Requests Motion by Mosher, second by Lee, and unanimously carried to authorize an extension, until August 15, 2005, for the performance bond from Bruce Carr for the "West Lost Lake Addition" road project. Completion of the road has not been possible because of the recent excessive rainy weather. Motion by Lee, second by Froemming, and unanimously carried to grant an extension, until July 15, 2005, for filing the Final Plat of "Jamie Lind Shores". The extension is required because of a wetland issue. Final Plat Approval Motion by Nelson, second by Lee, and unanimously carried to approve the Final Plat of Terry A. and Mary C. Karkela known as "North Shore Addition" located in Section 35, Twp. 137N, R39W; Little Pine Lake (56-142). Shoreland Management Revision Discussion Mr. Kalar handed out a list entitled "Potential Changes to Otter Tail County's Shoreland Management Ordinance" dated April 26, 2005. June 28, 2005, is the last day that the County will be accepting recommendations for changes to the SMO. County Attorney, David Hauser, stated that the County needs to address the concerns of the dissenters in the Supreme Court decision on Blue Heron Bay, which indicated zones were not adequately addressed in the County's current SMO. The concerns could be addressed by creating zones or one or more districts. Mr. Kalar stated that, in the past, the DNR did not require that the County separate out the zones. The Planning Commission should consider twelve different items for each Conditional Use Permit request. Mr. Hauser stated that current development and use of land needs to be considered. The five types of districts include; 1) protection, 2) residential, 3) high intensity residential which would allow clusters, 4) commercial shoreland use to allow water related businesses and commercial clusters, and 5) general. Chairman Block requested that a small committee of County Coordinator, Larry Krohn, County Attorney, David Hauser, Land & Resource Director, Bill Kalar, Land & Resource Office Manager, Marsha Bowman, a representative from the DNR, and Chairman Block draft amendments to the SMO after the comment period ends. The draft would then be presented to the OTC Board of Commissioners' Minutes June 14, 2005 Page 7 Shoreland Revision Committee and the County Board before a public hearing is scheduled. Mr. Kalar requested that the Commissioners provide direction regarding the items on the list they would like addressed.
