Commissioners' Room Tuesday, April 26, 2005 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, April 26, 2005, at 9:31 a.m. at the Otter Tail County Government Services Center with Commissioners Bob Block, Chair; Roger Froemming; Vice-Chair, Dennis Mosher, Malcolm Lee, and Syd Nelson present. Approval of Agenda Motion by Mosher, second by Nelson, and unanimously carried to approve the Human Services Board agenda of April 26, 2005, with the following changes: Court Services Director -Contract Approvals Public Health Department -Tobacco Survey Human Services Department -Cancel -Mental Health Initiative Update Human Services Department -Cancel -Mental Health Program Overview Human Services Department-Add -Foster Care Proclamation, Adult Rehabilitative Mental Health Services Update & CD Update Approval of Minutes Motion by Froemming, second by Nelson, and unanimously carried to approve the Human Services Board minutes of April 12, 2005, as mailed. Keys to lnnervision Program Court Services Director, Chuck Kitzman, reported the supervision fees collected from September of 2003 to-date at $10,652.45. He reported that the Keys to lnnervision Program (handouts provided) was funded with caseload/workload reduction grant dollars. The grant dollars were reduced last year, and consequently, the program usage was reduced because of the cost to families. Mr. Kitzman requested that the supervision fee dollars be used to supplement the cost to families. Motion by Nelson, second by Lee, and unanimously carried to authorize the County to pay $225.00, from the Supervision Fees Program account and the remainder ($50.00) to be paid by the juvenile, in order to facilitate usage of this important program. Legislative Update Mr. Kitzman reported that the nickel per drink user tax bill would not pass through the legislative committee process. He updated the Board on an alternate bill proposed as the One Cent per Drink Tax. MCCC Member Deposit Mr. Kitzman reported that approximately $1,875.00 was being held in the MCCC account for managing the Court Services computer software. He reported that the dollars will remain in the fund to be applied towards user dues next year. OTCo. Board of Commissioners' Minutes April 26, 2005 Page 2 Contract Approvals Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chairman's signature to execute an agreement between the State of Minnesota and Otter Tail County for the Caseload/Workload and Remote Electronic Alcohol Monitoring programs for July 1, 2005 through June 30, 2008. The grant dollars are $115,493, each year, for the Caseload/Workload Agreement and $9,592, each year, for the REAM Agreement. West Central Regional Juvenile Center Motion by Nelson, second by Froemming, and unanimously carried to appoint Court Services Director, Chuck Kitzman, to the WCR Juvenile Center Advisory Board. Tobacco Survey Public Health Nurse, Marion Kershner, updated the Board on a survey completed by the Borders United for Smoke Free Air in an eight county area, including Otter Tail County. There were 601 households sampled. The objective of the survey was to assess attitudes relating to second-hand smoke and to form public policy. Survey statistics showed that Government's role is to continue to work towards effective ways to deal with second-hand smoke. The Public Health Department will begin by recognizing restaurants that have voluntarily gone smoke free. Foster Care Month Human Services Foster Care Licensors, Michelle Ehlert and Deb Sjostrom, presented the following Proclamation: Foster Care Month Otter Tail County Resolution No. 2005 -25 Commissioner Mosher offered the following and moved its adoption: WHEREAS, the family, serving as the primary source of love, identity, self-esteem and support, is the very foundation of our communities, our state, and our County. WHEREAS, in Otter Tail County licensed foster homes, there are over 50 children and youth in foster care being provided with a safe, secure, and stable home along with the compassion and nurture of a foster family, and WHEREAS, Otter Tail County Human Services has licensed over 38 foster families, who have opened their homes and hearts to children whose families are in crisis, play a vital role helping children and families heal and reconnect and launching children into successful adulthood, and WHEREAS, there are over 75 adults in licensed adult family foster care homes, and WHEREAS, there are over 44 licensed adult family foster care providers, who have opened their homes to provide a family environment to individuals with developmental disabilities, mental illness or who are elderly, and OTCo. Board of Commissioners' Minutes April 26, 2005 Page 3 WHEREAS, there are numerous individuals, public and private organizations who work to increase public awareness of the needs of children and adults in foster care as well as the enduring and valuable contribution of foster care providers. NOW, THEREFORE, we, the Otter Tail County Human Services Board, by virtue of the authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim May as FOSTER CARE MONTH in Otter Tail County and urge all citizens to volunteer their talents and energies on behalf of children/adults in foster care, foster parents, and the professional staff working with them during this month and throughout the year. Dated:_...,,,5'--...... l..._(1'-'----<~=(9c...,0.,_,5 __ _ OTTER TAIL COUNTY HUMAN SERVICES BOARD By:------'-~--'--=="-'--t'U.c,J-=-=--=------ Robert Block, Human Services Board Chair Attest: /~~ ~ La{ry Kr n,lerk , Mental Health Month Human Services Social Worker, Margaret Williams, presented the following Proclamation: May is Mental Health Month Otter Tail County Resolution No. 2005 -26 Commissioner Nelson offered the following and moved its adoption: WHEREAS, the U.S. Surgeon General states that mental health is fundamental to health and indispensable to personal well-being, family and interpersonal relationships, and contributes to community and society; and WHEREAS, the U.S. Surgeon General confirms that mental illness affects one in five Americans every year, regardless of age, gender, race ethnicity, religion or economic status; and WHEREAS, the U.S. Surgeon General has found that a range of treatment exists for most mental disorders and the efficacy of mental health treatments are well documented; and WHEREAS, Otter Tail County has made a commitment to community-based systems of mental health care for all residents and has appointed Local Mental Health Advisory Committee for Children and adults. WHEREAS, the guiding principles of community mental health care have always been comprehensiveness, cost-efficiency, effective management and high-quality and consumer- OTCo. Board of Commissioners' Minutes April 26, 2005 Page 4 responsive services, and these principles are now being adopted by private and public healthcare payers; and WHEREAS, the National Mental Health Association, the National Council for Community Behavioral Healthcare and their national partners, the National Alliance for the Mentally Ill and their local affiliates observe Mental Health Month every May to raise awareness and understanding of mental health and illness; THEREFORE, we, The Otter Tail County Human Services Board, by virtue of the authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim May 2005 MENTAL HEALTH MONTH in Otter Tail County. As County Commissioners of Otter Tail County, we call upon all citizens, government agencies, public and private institutions, businesses and schools to recommit our community to increasing awareness and understanding of mental illness and the need for appropriate and accessible services for all people with mental illness. Motion by Mosher, second by Lee, and unanimously carried to approve Mike Voorhees and Jeanne Jaros as consumer and family Adult Mental Health LAC Advisory Board appointees. LuAnne Hanson, Co-Chair for the AMH Local Advisory Council, and Social Worker, Margaret Williams briefed the County Board on the activities of the LAC during 2004. Adult Rehabilitative Mental Health Services Update LuAnne Hanson of Lakeland Mental Health Services provided an ARMHS Consumer Satisfaction Survey and a brief description of services provided by this program. A total of thirty-one individuals were served in 2004. Detox Building Human Services Supervisor, Brad Vold, updated the Board on Productive Alternative's progress relative to building plans for the detox center. He also reported that Productive Alternative, Inc. will provide transportation, until the new building is completed, to other detox centers at a cost of $200 per ride. OTCo. Board of Commissioners' Minutes April 26, 2005 Page 5 Support for Perham Program Motion by Nelson, second by Froemming, and unanimously carried to approve a letter of support for development of a halfway house and treatment program in the Perham area. Financial Worker Position Motion by Mosher, second by Froemming, and unanimously carried to approve recruitment for Financial Worker positions. Bill & Claims Motion by Mosher, second by Froemming, and unanimously carried to approve the Human Services bills and claims as presented. Conditional Use Permit-U.S. Fish & Wildlife Service: Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use Permit for development of a U.S. Fish & Wildlife Service Headquarters Site with conditions as recommended by the Planning Commission. The property is described as N½ NE¼ Ex Tr, Section 23 of Buse Township; Unnamed Lake (56-832). · Conditional Use Permit -Charlie Grunewald: Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use Permit to construct a road for-_ingress egress e<:1sement with conditions as recommended by the Planning Commission.· The. property is described as S½ NW¼ Ex Tr, Part of N½ NW¼ ... Conditional Use Permit-Naterra Land Inc. & Roderick & Genie Hendrick: Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use Permit to construct a roadway to provide access to 8 parcels of land with the following conditions: 1. The approach meets the approval of the Otter Tail County Highway Engineer. (Mr. West stated that standard MnDOT requirements should be applied to the project as it relates to approaches joining County roads.) 2. The driveway for the existing farmstead must be eliminated from CSAH 3 and be relocated to connect to the proposed road. Conditional Use Permit -Michael & Shannon Neustel: Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use Permit for shoreland restoration with conditions as recommended by the Planning Commission. The property is described as Sunlight Beach Lot 3 Block 1, Section 3 of Dunn Township; Pelican Lake (56-786). Conditional Use Permit-Tom Gardner Et Al & Sverdrup Township: Land & Resource Director, Bill Kalar, stated that the Planning Commission recommended denial of this CUP request. Applicant, Tom Gardner, requested that the Board table this request as there is a group of people working together to accomplish this road relocation project. Mr. Gardner waived the 60 day rule. Motion by Mosher, second by Nelson, and unanimously carried to refer this Conditional Use Permit request back to the Planning Commission for further study, and will be reviewed at the June 8, 2005, Planning Commission meeting. The property is described as Pt of GL 6 (Parcels A, B, C, D, E, F & G), Lot 9 ex 4.63 Ac & portion of 273rd St., Section 1 of Sverdrup Township; East Lost Lake (56-378). OTCo. Board of Commissioners' Minutes Apnl26, 2005 Page 7 Conditional Use Permit-Mike Haugrud: Mr. Kalar stated that the Planning Commission recommended CUP approval to build up a driveway as indicated on a map dated 3/22/05, marked in green; however did not approve the build up in the area marked in yellow. Mr. Kalar provided a map showing these two areas. Attorney, Kris Svingen, stated that the Town Board passed a resolution approving the project as a private road subject to the condition that the road be built so emergency vehicles can travel over it. Moore Engineering representatives stated that the road would be built 16' wide, which would accommodate emergency vehicles. Mike Haugrud provided pictures of the areas. Planning Commission member, Joe Maske, explained that the area marked in green was approved to provide Mr. Haugrud with a road to his home and the Commission felt that the area marked in yellow needs to be dealt with in a separate application. Mr. Svingen noted that his clients are building the road for Mr. Haugrud and themselves, as a joint project; if only one area is approved, it is likely that the project would not be completed. Discussion followed. Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use Permit to build up an existing driveway and place rip rap in the area marked in green (map dated 3/22/05) and the area marked in yellow, with the condition that the applicant must work with the Land & Resource Management office. The property is described as Pt of GL 7 & pt of GL 8 ... (9 AC), Section 1 of Norwegian Grove Township; Grove Lake (56-952). Conditional Use Permit-Nidaros Township/East Battle Lake: Motion by Froemming, second by Nelson, and unanimously carried to approve a Conditional Use Permit to reshape a turn around and improve access to a lot with conditions as recommended by the Planning Commission. The property is described as West 200 feet of Bush Hill Road including easement over a portion of Lot 7 Bush Hill Country Bay, Section 2 of Nidaros Township; East Battle Lake (56-138). Conditional Use Permit-Nidaros Township/Clitherall Lake: Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional Use Permit to install a culvert and raise grade on an existing township road with a condition as recommended by the Planning Commission. The property is described as Pt of GL 6, Section 1 of Clitherall Township and Section 6 of Nidaros Township & west ¼ mile of Erickson Road beginning at TH 210, Section 1 of Clitherall Township; extending north and east into Section 6 of Nidaros Township; Clitherall Lake (56-238). Potential Ordinance Changes Mr. Kalar provided a handout entitled "Potential Changes to Otter Tail County's Shoreland Management Ordinance" dated April 26, 2005. Final Plat-"SunnyBend" Motion by Froemming, second by Mosher, and unanimously carried to approve the Final Plat known as "SunnyBend", a two lot subdivision located in Section 36 of Maine Township. Proposed Transportation Legislation Highway Engineer, Rick West, briefed the County Board on proposed transportation funding legislation. OTCo. Board of Commissioners' Minutes April 26, 2005 Page 8 Recess & Reconvene At 12:01 p.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners meeting recessed for lunch break and committee meetings. The meeting was reconvened at 1 :35 p.m. Steer Skid Operators Motion by Lee, second by Nelson, and unanimously carried to advertise, for sale, two 1989 bobcats (643 and 773 models). Approval of Settlement Agreement Motion by Mosher, second by Froemming, and unanimously carried to enter into a settlement agreement between Otter Tail County and Brian Fox resolving a veterans preference challenge. Boat & Water Patrol Position Motion by Mosher, second by Lee, and unanimously carried to replace a temporary Boat and Water Patrol position in the Sheriffs Department. Dispatch Supervisor Motion by Lee, second by Mosher, and unanimously carried to approve a Dispatch Supervisor Position, to be filled by a current Dispatcher at a pay grade 15. Credit Card Approved Motion by Lee, second by Mosher, and unanimously carried to authorize issuance of an Otter Tail County Credit Card with Express One Master Card to Ryan C. Cheshire in the County Attorney's office, for a maximum amount of $1,000.00. Payment Approval Motion by Nelson, second by Lee, and unanimously carried to approve payment, to Lake Region Healthcare, in the amount of $450.00, for services provided under the provisions of Minnesota Statute 609.35 (Case No. 05004901).
