Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, April 19, 2005, at
9:30 a.m. at the Otter Tail County Government Services Center with Commissioners
Bob Block; Chairman, Roger Froemming; Vice-Chair, Malcolm Lee, and Syd Nelson present.
Commissioner Dennis Mosher was absent.
Approval of Agenda
Motion by Froemming, second by Nelson, and unanimously carried to approve the County
Board agenda of April 19, 2005, with the following additions:
10:20 -10:30 -Ag Educator, Vince Crary
10:30 -10:40 -Public Health Director, Diane Thorson
Approval of Minutes
Motion by Froemming, second by Nelson, and unanimously carried to approve the County
Board minutes of April 12, 2005, as mailed.
Approval to Pay Bills
Motion by Lee, second by Froemming, and unanimously carried to approve payment of the
County Board bills per Attachment A of the official minutes.
4-H Update
4-H Coordinator, Janet Malone, briefed the Board on 4-H projects and emphasized the after
school 4-H ventures, which have been very successful. Ms. Malone reported that last year,
over 2,000 youth participated in a 4-H event in East Otter Tail County.
Proposed Veterans Museum
Lina Belar, EOT History Museum Director, updated the County Board on a proposed
Veterans Museum in Perham, MN. The Perham VFW Post 4020 donated their 12,000
square foot building on Main Street as a site for the proposed museum. Ms. Belar provided a
brochure and pictures of the facility and an oral guided tour of the proposed galleries. The
goal is to raise one million dollars and open in 2006.
Public Hearing Established
Motion by Froemming, second by Nelson, and unanimously carried to establish the required
Public Hearing (MS 340A.405), for the issuance of an Off-Sale Intoxicating Liquor License, at
11 :00 a.m. on Tuesday, May 10, 2005.
Boating Safety Supplement Grant Agreement
Motion by Lee, second by Nelson, and unanimously carried to approve the Federal Boating
Safety Supplement Grant Agreement between the State of Minnesota, acting through its
Commissioner of Natural Resources, Bureau of Information and Education and the Otter Tail
County Sheriffs Department and authorize the County Sheriff, County Board Chair, and the
County Coordinator to sign the agreement. The grant amount is $5,000.00.

Liquor License Application
Motion by Lee, second by Froemming, and unanimously carried to approve the following
application for license:
*Spanky's On-Sale Liquor and Sunday Liquor

* License is subject to the approval'of the County Sheriffs office and the County Attorney's office.
Ag Education
Ag Educator, Vince Crary, supplied the Board with handouts and a briefing on Compost Pack
Dairy Barns.
Arsenic Rapid Response Project
Otter Tail County Resolution No. 2005 -24
Commissioner Nelson offered the following and moved its adoption:
WHEREAS, a proposal entitled "Concentrations of arsenic in food products from Minnesota
cattle drinking water with elevated arsenic concentrations" was submitted to the Rapid
Agricultural Response Fund; and
WHEREAS, the proposal squarely addresses concerns raised by dairy producers and their
families in Otter Tail County. Dairy production provides significant economic impact in Otter
Tail County-as of February, 2005, Otter Tail County has 341 dairy farms, making Otter Tail
County the third largest dairy producing county in Minnesota; and
WHEREAS, the impact of the naturally occurring elevated water arsenic concentrations on
the safety of the food products produced from these dairy cattle is obviously of great
importance to both individual dairy producers and to the economy of Otter Tail County and
the region; and
WHEREAS, our citizens' concerns are escalating due to the January, 2006, implementation
of the EPA's new water standard of 10 ppb. As many as 10% of the wells in this nine-county
area, of which Otter Tail County is one, exceed this new standard and many are in the 100 to
150 ppb range; and
WHEREAS, producers need to know whether to treat water for the cows or only the water for
the house. This difference represents a significant economic outlay for the producers.
NOW, THEREFORE, BE IT RESOLVED that Otter Tail County enthusiastically supports the
Concentrations of arsenic in food products from .Minnesota cattle drinking water with elevated
arsenic concentrations study, because it is aimed at providing objective answers to the
question of whether elevated water arsenic concentration may impact the safety of food
products that are integral to the economic viability of our region.
Commissioner Froemming seconded the motion, and upon being put to vote, was
unanimously carried.

Robert Block, County Board Chair
Public Hearing Established
County Coordinator, Larry Krohn, was contacted by a Dane Prairie Township Supervisor,
who stated that some work has been completed on the road in Dane Prairie Township east of
Highway 210 that was recently closed. The road is now open and passable. Motion by Lee,
second by Nelson, and unanimously carried to establish a Public Hearing at 1 :00 p.m. on
Tuesday, May 24, 2005, in response to the formal complaint that was filed with Otter Tail
County.
Staffing Request
Public Health Director, Diane Thorson, reported that she has received a resignation for a 24-
hour per week Public Health Nurse position. She requested authorization to fill one full time
PHN position for the aforementioned 24-hour per week position and a 16-hour per week
tobacco reduction position, rather than two part time positions. Motion by Nelson, second by
Lee, and unanimously carried to authorize the Public Health Director to proceed with the
hiring process, through the Coordinator's office, for a full time Public Health Nurse to replace
a 24-hour per week PHN position and 16-hour per week tobacco reduction position.
Emergency Operations Center
Emergency Services Director, Tiny Holm, introduced Mr. Tom Cherney, State
Communications & Warning Officer and opened discussion regarding an Emergency
Operations Center in Otter Tail County. Mr. Cherney recommended the former
Commissioners room in the Courthouse be used as Otter Tail County's EOG because of its
survivability, sustainability with a 24 hour operation also located in the building, good parking,
kitchen and break area facilities, and close proximity to police and dispatch areas. Mr. Holm
requested the Commissioners to think about where they would like the EOG located.
CUP Approval Extension
Motion by Lee, second by Nelson, and unanimously carried to extend the Conditional Use
Permit approval for Hidden Acre Development on Leek Lake (56-532) until July 1, 2005,
because of some title deficiencies and other document issues.
Planning Commission Recommendations
Conditional Use Permit -Arnold Jonson:
Motion by Froemming, second by Lee, and unanimously carried to deny, as recommended by
the Planning Commission, an after the fact Conditional Use Permit, for installation of concrete
retaining wall and a walkway to the lake. Reason for denial is that erosion will be
exacerbated and also, other reasons as indicated in the April 13, 2005, Planning Commission
minutes. The property is described as Blaze's Beach Lot 21, Section 21 of Otter Tail
Township, Otter Tail Lake (56-242).

Preliminary Plat & Conditional Use Permit "Squires Estate"/John P. & Clark A. Squires:
Motion by Froemming, second by Lee, and carried with Nelson opposed, to approve the
original request for the Preliminary Plat known as "Squires Acres" consisting of 20 lots for
single family residential use and a Conditional Use Permit to construct a road to serve the
plat. The property is described as NE¼ NW¼ (39.5 AC) & Gov't Lot 3 except tracts (.43 AC),
Section 13 of Rush Lake Township; Rush Lake (56-141).
Preliminary Plat & Conditional Use Permit -"Big Pine Resort'1/Alpine Assets. LLC:
Motion by Nelson, second by Lee, and unanimously carried to approve the Preliminary Plat
known as "Big Pine Resort" consisting of 12 lots for single family residential use and a
Conditional Use Permit to construct a road to serve the plat with conditions as recommended
by the Planning Commission. The property is described as Part GL's 1 & 2, Section 15 of
Pine Lake Township; Big Pine Lake (56-130).
Preliminary Plat -"Quiet Creek Estates'1/Dennis & Maureen Richter:
Motion by Nelson, second by Lee, and unanimously carried to approve the Preliminary Plat
known as "Quiet Creek Estates" consisting of 5 lots for single family residential use as
presented. The property is described as Lot 1 Ex Tr & NW¼ NW¼, Section 33 of Corliss
Township and lots 1-2-3 Ex Platted Ex Trs, Section 32 of Corliss Township; Big Pine Lake
(56-130).
Preliminary Plat & Conditional Use Permit-"Silver Sands'1/Al/an Anderson & Jon Saetre:
Motion by Froemming, second by Nelson, and unanimously carried to approve the
Preliminary Plat known as "Silver Sands" consisting of 3 lots for single family residential use
and a Conditional Use Permit to construct a road to serve the plat with conditions as
recommended by the Planning Commission. The property is described as Part GL 3 Com
W¼ Car Sec 28, Section 21 and Part NW¼ NW¼ Com W¼ Car Section 28, Otter Tail
Township; Otter Tail Lake (56-242).
CUP #6151 Amended-Woodland Beach Resort, Otter Tail Lake (56-242/:
Motion by Froemming, second by Lee, and unanimously carried to clarify that CUP #6151
allow additions to existing cabins and also, allow a single roof as presented in a drawing
received by Land & Resource Management March 31, 2005.
Amend 1/12105 Approval-"North Turtle Lake Shores'1/ Bothun Properties LLC:
Motion by Froemming, second by Lee and unanimously carried to amend the 1/12/05
approval to include the construction of the driveway (between Lots 1 & 2) as shown on the
Preliminary Plat Map, at the time of construction of the road.
Shoreland Management Ordinance Revision Discussion
Land & Resource Director, Bill Kalar, asked the Board if they wished to revise the SMO.
Discussion followed regarding the need to make some changes. Commissioner Lee stated
his opinion that major changes shouldn't take place until a decision is received from the
Supreme Court. Continued discussion will take place.
Training for Planning Commission
Motion by Froemming, second by Nelson, and unanimously carried to approve per diem
($47.50 for CY2005) and mileage reimbursement ($.405 per mile) for Planning Commission
members interested in shoreland management training available in Alexandria, MN.

Blue Heron Bay -Environmental Impact Statement
Mr. Kalar provided a letter received from Attorney Robert Russell, to confirm that R. Murray is
ready to begin the process of preparing an EIS for Blue Heron Bay, while waiting for a
decision from the Minnesota Supreme Court. If the decision not to require an EIS is upheld
on appeal, Blue Heron Bay intends to terminate the EIS process.
Adjournment
At 12:15 p.m., Chair Block declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, April 26, 2005.
