Commissioners' Room Tuesday, January 4, 2005 9:30 a.m. Statutory Meeting -Call to Order Pursuant to Minnesota Statute, the Otter Tail County Board of Commissioners convened Tuesday, January 4, 2005, at 9:30 a.m. at the Otter Tail County Government Services Center with Commissioners Syd Nelson, Bob Block, Roger Froemming, Dennis Mosher, and Malcolm Lee present. Oath of Office County Attorney, David Hauser, stated that three Commissioners had been re-elected and since this is the start of a new year, 2005, these officials needed to be sworn in. Commissioners Syd Nelson, Bob Block, and Dennis Mosher took the Oath of Office. Year 2005 Otter Tail County Board Chair County Attorney, David Hauser, requested nominations for the CY2005 Otter Tail County Board Chair. Motion by Mosher, second by Nelson, and unanimously carried to elect Commissioner Bob Block as the Otter Tail County Board Chair. Year 2005 Otter Tail County Board Vice-Chair Commissioner, Bob Block, assumed the chair and requested nominations for the CY2005 Otter Tail County Board Vice-Chair. Motion by Mosher, second by Lee, and unanimously carried to elect Commissioner Roger Froemming as the Otter Taii County Board Vice-Chair. Approval of Agenda Motion by Lee, second by Nelson, and unanimously carried to approve the County Board agenda of January 4, 2005, as presented. , Approval of Minutes Motion by Froemming, second by Nelson, and unanimously carried to approve the County Board minutes of December 28, 2004, as mailed. Approval to Pay Bills Motion by Mosher, second by Lee, and unanimously carried County Board bills per Attachment A of the official minutes. Hardship Discussion • l to approve payment of the Commissioner Mosher reported that he had received a phone call from an individual who has a business that does well if there is snow. The individual stated that there are programs to help the agricultural sector if there is a drought or flooding, but no programs available for businesses that rely on snow. Discussion followed, no action was taken. • Grant Funding for the Region Emergency Services Director, Tiny Holm, reported that Region IV is made up of 16 counties in the Emergency Management field. The Region has received 2005 grant dollars in the amount of $500,000. Region IV is asking County Boards in each of the 16 counties to OTC Board of Commissioners' Minutes January 4, 2005 , Page 2 cooperate with a spending plan for the $500,000 that it does have. Motion by Mosher, Q second by Froemming and unanimously carried to cooperate with the Region IV spending plan for the 2005 Grant program. Approval of Highway Agreement Highway Engineer, Rick West, reported that there are new federal regulations concerning demolition of asbestos and regulated waste for various bridges in Otter Tail County. Braun lntertec was contacted to present a proposal to provide an assessment and cost estimates. The estimated cost for each. bridge that will be demolished is $1,528.70. There are six bridges in Otter Tail.County that .will.be replaced: Motion. by. Mosher, second by Froemming, and unanimously carried to enter into an agreement with Braun lntertec of Fargo, ND,! ahd the County of Otter Tail, for providing services and cost estimates for pre-demolition asbestos and regulated waste assessments for various bridges in Otter Tail County, at an estimated cost per bridge of $1,528.70. · Payment Approval -MCIT Motion by Nelson, second by Mosher, and unanimously carried, to approve payment on an Auditor's Warrant, for the following invoices received from Minnesota Counties Insurance :Trust (MCIT):, · ... 1 , · Invoice 21864· BLK , 2,752.00 Credit ·· .. Otter Tail County Resolution No. 2005-01 Commissioner Nelson offered the following and moved its adoption: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that The sum of.thirty cents ($.30) be paid out of the General Revenue Fund of Otter Tail County for every pocket gopher killed in said County during the year 2004 in cases where the township in which the pocket gophers were so killed shall provide for the payment of at least an additional bounty of forty cents ($.40) for each pocket gopher so killed. RESOLVED further that said payment of such County shall be made by the County, Auditor upon certificates executed by the Chairman and/or Clerk of the Town,Board of said Township setting forth that the township had issued and delivered to each claimant a payment for at least seventy cents ($.70) for each pocket gopher so killed. · · Commissioner Mosher seconded the motion, and upon being put to a vote, was unanimously carried. OTTER TAIL COUNTY BOARD OF COMMISSIONERS . ~y: Rob~rt ~t~air~ . 0 0 0 • • • OTC Board of Commissioners' Minutes January 4, 2005 Page 5 Calendar Year 2005 Tax Forfeited Land Sale Apportionment Resolution Otter Tail County Resolution No. 2005-02 Commissioner Lee offered the following and moved its adoption: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, it is provided in Minn. Stat. 282.05 for the apportionment of proceeds from the sale of tax forfeited lands, and WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing district pursuant to Minn. Stat. 282.08 and WHEREAS, Minn Stat. 282.08 (4) (b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the property have been paid, for acquisition and maintenance of county parks and recreational areas, and WHEREAS, Otter Tail ~aunty has a park and recreational area, which would benefit by such an apportionment. NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds to be disbursed according to law. Commissioner Mosher seconded the motion, and upon being put to vote, was unanimously carried. Adopted at Fergus Falls, MN this 4th day of January 2005. Motion by Lee, second by Nelson, and unanimously carried to approve the attendance of Commissioner Froemming at the Agriculture Advisory Meeting held in Stearns County on January 10, 2005. Closed to the Public At 10:27 a.m. Chairman Block declared the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of discussing labor negotiation strategies relative to the Collective Bargaining Units in the Sheriffs Department. Present were all five seated Commissioners, the County Attorney, County Coordinator, and Board Secretary. Adjournment Upon conclusion of the closed session, at 10:37 a.m., Chairman Block declared the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, January 11, 2005.
