Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, November 30, 2004, at
9:30 a.m. at the Otter Tail County Government Services Center with Commissioners
Syd Nelson, Chair; Bob Block, Vice-Chair; Roger Froemming, Dennis Mosher, and
Malcolm Lee present. · ·
Approval of Agenda'
Motion by Froemming, second by Mosher, and unanimously carried to approve the County
Board agenda of November 30, 2004, with the following additions:
10:40 a.m. -Auditor, Wayne Stein
1 :30 p.m. -Closed Session for Discussion of Labor Negotiation Strategies
Approval of Minutes
Motion by Froemming, second by Lee, and unanimously carried to approve the County-Soard
minutes of November 23, 2004, with the following correction:
On Page 5 under the heading "Forgiveness of Penalty Request" the motion reads "Motion by
Froemming, second by Nelson, and unanimously carried to deny a request frqm Terry & Jan
Elkins for forgiveness of penalty, in the amount of $100.62, for property located in Otter Tail
City of Otter Tail Township". This motion is corrected to read "Motion by Froemming, second
by Nelson, and carried with Mosher opposed, to deny a request from Terry & Jan Elkins for
forgiveness of penalty, in the amount of $100.62, for property located in Otter Tail City of Otter
Tail Township". ·
Approval to Pay Bills,
Motion by Lee, second by Block, and unanimously carried to approve payment of the County
Board bills per Attachment A of the official minutes.
Approval of Final Plats
Motion by Nelson, second by Lee, and unanimously carried to approve the Final Plat of
Johnson, Hopkins, & Canfield known as Big Sandy Beach located in Section 31 of Corliss
Township; Big Pine Lake (56-130).
Motion by Nelson, second by Lee, and unanimously carried to approve the Final Plat of
Herbert & Arlene Wilschewski known as Herb's Ridge located in Section 29 of Hobart
Township; Long Lake (56-388).
Motion by Mosher, second by Froemming, and unanimously carried to approve the Final Plat
of Donald Kersten and Taylor Investment Corporation known as Bailey's Beach located in
Section 1 of Sverdrup Township; East Lost Lake (56-378) .
Solid Waste Issues
Solid Waste Director, Mike Hanan, reported that the Fergus Falls Resource Recovery Facility
may close in the near future. He discussed several options including the possibility of

constructing a Solid Waste ,Transfer Facility in the -Fergus Falls area. Commissioner Mosher Q
expressed the need to design a transfer ~acility with the potential for expansion as increases
in population are increasing solid waste in the County. Chai_rman Nelson directed Mr. Hanan
to meet with the Solid Waste Committee to identify a potential building site and return to the
County Board with recommendations. · .. ~ . . -
Reclassification
Solid Waste Director, Mike Hanan, requested that two Solid. Waste Attendants working at the
.Peiican .Rapids .facility be reclassifi~d as Certified SoHd Waste Attendants. . "fhey have
completed the ,,certification training required b~cause t~e _Pelican Rapids, facility will be
accepting a broader material base. Motion by Lee, second by Mosher, and unanimously
carried to reclassify the two Pelican Rapids Solid Waste Attendants, John Good and Gordon
Gugal, from Solid Waste Attendants (Grade 6) to Certified Solid Waste Attendants (Grade 8),
effective January 1, 2005. ,-..•..

Request for Approval of Hig'tiway Agreement
Motion by Lee, second· by Mosher, and unanimously c~rried .to autho_rize · the Highway
Department to enter into an agreement with Braun lntertec of Fargo, ND, (Proposal FA-04-
07736) for the proposed overlay of CSAH No. 1 .. (S.A.P. 56-601-45) and the proposed
replacement of the Bridge on 245th Street over the Otter Tail River (S.P. 56-599-53), in the
amount of $6,835.00. ,,

After previously advertising· for bids, Highway Engineer, Rick West, opened the bids for Q
crushing Salvaged Bituminous Mix Material at 1':00 p.m. on November 24, 2004 as follows:

Highway Engineer,. Rick West, explained_ that the recommendation for award is by unit bid
and the bid of Mark Sand & Gravel is $1.915fTon if the MN sales tax is factored out of the
bid .. Because of a verbal miscommunication, Mark Sand & Gravel added ttie MN sales tax to
their bid while the other vendors did not based on the bid documents/specification·s. Motion
by-Lee, second by Block,, and unanimously carried to award the bid for crushing Salvaged
Bituminous Mix Material to Mark Sand a'nd Gravel Comp?ny, in· the unit bid of, $1.915/Ton,
which does not include MN sales fax, as recommende_d by the. l;lighway Engineer. · · ·

Motion by Lee, second by Block, and unanimously carried to approve the CY2005 Lakes
Country Service Cooperative membership dues in the amount of $250.00.

amount of $1,045.00, payable to Herzog Roofing, Inc. of Detroit Lakes, MN, for completion of
Project #0202, Bid Package 7A, roofing at the Government Services Building.
Annual Performance Evaluation
At 10:46 a.m., Chairman Nelson, asked Jourdan Sullivan, Veterans Service Director, if he
wanted the meeting closed for the purpose of his Annual Performance Evaluation pursuant to
M.S. Chapter 13D.05 Subd. 3. Mr. Sullivan requested an open meeting. All five seated
Commissioners were present for the evaluation. A summary of performance conclusions will
be provided at the next County Board meeting on December 14, 2004.
Recess & Reconvene
At 11 :01 a.m., upon the conclusion of the performance evaluation, Chairman Nelson declared
the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The
meeting was reconvened at 12:31 p.m.
Detoxification Program Discussion
Human Services Director, John Dinsmore, presented a handout with historical statistics and
data regarding the Detoxification Treatment rates and total costs. He reported that Otter Tail
County Human Services posted a Request for Proposal (RFP) for the program. One
response was submitted by the current provider, the Fergus Falls Regional Treatment
Center. Their proposal, effective January 1, 2005, includes a 49% rate increase. Lengthy
discussion took place regarding options to use other vendors and related transportation
issues. The County Board requested that the Human Services Director negotiate an
extended contract for 180 days with the FFRTC to allow for continued research of the issues
and options.

Closed to the Public -
At 1 :30 p.m., Chairman Nelson declared the meeting of thEf Otter Tail County Board of
Commissioners closedi"to the public for purposes of discussing labor negotiation strategies
relative to the Public Health Nursing Unit and Human Services Units. Present were the five
seated commissioners, the County Attorney, County Coordinator, Board Secretary, Public
Health Director; Public Health Financial Manager, Human Services Director, and the Human
Services Business Manager. .'
Adjournment
At 3:10 p.m., upon completion of the closed session, Chairman Nelson declared the meeting
of the Otter Tail County Board of Commissioners adjourned until Tuesday, December 14,
2004.
