Commissioners' Room Tuesday, November 16, 2004 9:30 a.m. Call to Order C The Otter Tail County Board of Commissioners convened Tuesday, November 16, 2004, at 9:30 a.m. at the Otter Tail County Government Services Center with Commissioners Syd Nelson, Chair; Bob Block, Vice-Chair; Roger Froemming, Dennis Mosher, and Malcolm Lee present. Approval of Agenda Motion by Froemming, second by Block, and unanimously carried to approve the County Board agenda of November 16, 2004, with the following addition: 10:30 a.m. -Personnel Committee Meeting Approval of Minutes -November 2, 2004 Motion by Mosher, second by Lee, and unanimously carried to approve the County Board minutes of November 2, 2004, as presented. Approval of Minutes -November 9, 2004 Motion by Froemming, second by Lee, and unanimously carried to approve the County Board minutes of November 9, 2004, as mailed. Approval to Pay Bills Motion by Lee, second by Mosher, and unanimously carried to approve payment of the County Board bills per Attachment A of the official minutes. Snowmobile Enforcement Grant Motion by Mosher, second by Lee, and unanimously carried to authorize the Chairman's signature to execute an agreement for Snowmobile Enforcement Grants between the State of Minnesota and the County of Otter Tail. The grant amount for FY2005 for Otter Tail County is $4,968.37. Request to Repurchase Tax Forfeited Property Otter Tail County Resolution No. 2004 -56 Commissioner Froemming introduced the following resolution and moved its adoption: RESOLVED, by the Otter Tail County Board of Commissioners of Otter Tail County, Minnesota, that WHEREAS, Gina R Miranda, owner, has made application to repurchase the following legally described parcel: OTCo. Board of Commissioners' Minutes November 16, 2004 Page2 Parcel No. 46-000-33-0126-010 Section 33 Township 134 Range 39 3.02Acres Part of Government Lot 1 -Commencing at the Northeast Corner of Section 33 South 200' to Beginning South 200' North 89 Degrees West 649' to Lake Northerly along shoreline to line 89 Degrees West from Beginning South 89 Degrees East 682' to Beginning Document Number 732748 .,, . Said property having forfeited to the State of Minnesota on the 12th day of July, 2004, for nonpayment of the 1998, 1999, 2000, 2001, 2002, and 2003 property taxes, and WHEREAS, an application to repurchase the above described property was timely submitted on Tuesday, November 9, 2004, and WHEREAS, the sum of $743.70 represents the aggregate of all delinquent and current taxes, penalties, costs, assessments, and fees as of November 16, 2004, that would have been due and payable had the above described parcel not forfeited to the State of Minnesota, and WHEREAS, the applicant has requested that the Otter Tail County Board of Commissioners consider her application to repurchase the above-described parcel and has requested that the Otter Tail County Board of Commissioners approve the applicant's request to repurchase the above-described property. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the repurchase of the above described tax forfeited property, and BE IT FURTHER RESOLVED, that the Otter Tail County Board of Commissioners hereby finds that the repurchase is in the best public interest, that it will relieve any undue hardship which has result from the forfeiture. Board of Commissioners' Minutes November 16, 2004 Page 3 Motion by Lee, second by Mosher, and unanimously carried to approve payment to Egge Construction, Inc., in the amount of $778.47, for backhoe services provided on Otter Tail County Drainage System No. 12. Motion by Mosher, second by Lee, and unanimously carried to approve payment to Richard Bergquist, in the amount of $368.99, for ditch viewer expenses. Motion by Lee, second by Mosher, and unanimously carried to approve payment to Houston Engineering, Inc., in the amount of $997.50, for services provided on the Oscar Lake Outlet Project. Recess & Reconvene At 10:26 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners recessed for a Personnel Committee meeting. The meeting was reconvened at 10:36 a.m. Approval to Hire Temporary Appraiser Motion by Mosher, second by Lee, and unanimously carried to authorize the Assessor to hire a Temporary Appraiser as needed. Recess & Reconvene At 10:38 a.m., Chairman Nelson declared the meeting ,of the Otter Tail County Board of Commissioners recessed for a Highway Committee meeting. The Chairman reconvened the meeting at 11 :00 a.m. Planning Commission Recommendations Conditional Use Permit -Bradley & Tracy Offutt: Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit to construct a driveway as presented. The property is described as Pt of GL 5, Section 28 & Pt GL 8, Section 29 of Hobart Township; Long Lake (56-388). Conditional Use Permit-John G. & Kathryn A. Krueger: Motion by Nelson, second by Mosher, and unanimously carried to approve a Conditional Use Permit for a commercial use (Bed & Breakfast) as presented. The Bed & Breakfast will consist of 2 bedrooms and 1 bathroom with a kitchenette & family room separating the bedrooms. The kitchenette will not be used to make meals; it will serve as a snack area. The property is described as Pt of GL 2, Lot A, Section 15 of Pine Lake Township; Big Pine Lake (56-130). Preliminary Plat & Conditional Use Permit-Ellis E. Peterson: Motion by Lee, second by Block, and unanimously carried to deny the Preliminary Plat known as "Peterson's Point" and a Conditional Use Permit to construct a road to service the proposed plat as recommended by the Planning Commission. The reasons for the denial are as documented in the November 10, 2004, Planning Commission minutes. The property is described as GL 2 ... (8.31 AC), Section 26 & Lot 1 ex trs (3.8 AC) & S 125' of N 323' of Lot 1 ex E 84', Section 27, Dunn Township; Franklin Lake (56-759). OTCo. The property is described as Pt GL 2, 3 & 4, Section 19 of Hobart Township; Long Lake (56-388). Conditional Use Permit-Joshua Brekke: Motion by Lee, second by Mosher, and unanimously carried to approve a Conditional Use Permit to construct a driveway with conditions as recommended by the Planning Commission. The property is described as Lot 9 Block 1, Jacobson's Pelican View Subd., Section 9 of Dunn Township; Pelican Lake (56-786).
