Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, December 23, 2003, at
9:35 a.m. at the Otter Tail County Government Services Center with Commissioners
Malcolm Lee, Chair; Syd Nelson, Vice-Chair; Dennis Mosher, Roger Froemming, and
Bob Block present.
Approval of Agenda
Motion by. Froemming, second by Mosher, and unanimously carried to approve the County
Board agenda of,December 23, 2003, with the following additions:

Approval of Minutes
Motion ·by Mosher, second by Froemming, and unanimously carried to approve the County
Board minutes of December 16, 2003, as presented .
Approval to Pay Bills
Motion by Nelson, second· by Mosher, and unanimously carried· to approve payment of
County Board bills per Attachment A of the official minutes.
County-Wide Emergency Management Plan·
Emergency Management Director, Tiny Holm, requested approval of the Otter Tail County-
Wide Emergency Operations Plan. Motion by Block, second by Froemming, and
unanimously carried to approve the County-Wide Emergency Operations Plan dated
November, 03, as presented with a few minor changes. The Operations Plan will qualify
Otter Tail County for some emergency management grant dollars.
Highway Department Project Update
Highway Engineer, Rick West, presented and reviewed highway construction and design
projects for the past construction season.
Agreement for S.A.P. 56-599-54
Motion by Mosher, second by Froemming, & unanimously carried to authorize the Highway
Engineer's signature to execute an agreement between the County of Otter Tail Highway
Department and Braun lntertec for geotechnical evaluation for a proposed bridge
replacement on Ridgewood Circle in Dane Prairie Township.
Final Payment for GSC Building
Motion by Block, second by Lee, and unanimously carried to approve Final Payment to
OffiSource, Inc. of Minneapolis, MN, in the amount of $1,285.00, for interior furniture at the
GSC building, 'project no. 0202.

WHEREAS, the Otter Tail County Board of Commissioners recognizes the requirement to
adopt Otter Tail County's final payable 2004 Gross and Net Property Tax Levy no later than
Friday, December 26, 2003, and the Otter Tail County Board of Commissioners is required to
certify Otter Tail County's final payable 2004 Gross and Net Property Tax Levy to the County
Auditor's office on or before Monday, December 29, 2003.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby levies for the payable year 2004, upon the taxable net tax capacity of the property of
Otter Tail County, the following amounts as detailed below:

adoption of the calendar year 2004 budget for the General Fund, for the Budgeted Special
Revenue Funds, and for the Debt Service Fund.
WHEREAS, the Otter Tail County Board of Commissioner held the required public hearing on
Thursday, December 4, 2003 at 5:15 p.m. in the Otter Tail County Commissioners' Room for
the purpose of considering, reviewing, discussing, and receiving public input regarding the !
proposed calendar· year 2004 budget for the General Fund, for · the Budgeted Special

Discussion Regarding:.Charles Orvik Property
Auditor, Wayne Stein, presented a request from Charles Orvik to assign parcel numbers to
his property based on classification rather than legal description. Motion by Froemming,
second by Block, and carried with Mosher abstaining, to deny Mr. Orvik's request to assign
parcel numbers based on classification, and to suggest one of the following options to
facilitate his financing issues; 1) subdivide the property· according-to the· rules of the
Subdivision Controls Ordinance, 2) cease commercial use of the property, or 3) challenge the
classification of the property through the appropriate appeal process,

Otter Tail County Resolution No. 2003 -75
Commissioner Froemming offered the following and moved its adoption:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the' Minnesota Gambling
Control Board; and ·
WHEREAS, the Ottertail Lions Club, Ottertail, MN, has made an application to the Gambling
Control Board for the purpose of conducting lawful gambling at Elmer's Texas Bar-B-Que,
located at 27896 State Highway 78 in Girard Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the Ottertail Lions Club, Ottertail, MN, at Elmer's Texas
Bar-B-Que, located at 27896 State Highway 78 in Girard Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Ottertail Lions Club, Ottertail, MN, at
Elmer's Texas Bar-B-Que, located at 27896 State Highway 78 in Girard Township of Otter
Tail County, provided the applicant meets all the necessary criteria for the licenses and
permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to
the Township of Girard by sending them a copy of this resolution. '

Performance Based Pay Formula Proposal
Human Services Director, John Dinsmore, updated the Board on the status of the
performance based . alternative salary plan implemented for-himself as a "pilot project"
effective March 1, 2003. Motion by Mosher, second by Froemming·, ,and unanimously carried
not to continue this outcome based performance "pilot project" for 2004. Motion by Mosher,
second by Lee, and unanimously carried to authorize payment, in the amount of $1,776.00,
out of a total possible dollars of $2,960.00, based on performance outcomes. The amount of
$2,960.00 had been withheld from Mr. Dinsmore's salary during CY2003 during this "pilot
project".
Approval of Final Plat
Motion by Lee, second by Nelson, and unanimously carried to approve the Final Plat of
Deanna & Conrad Olson known as "Olson's Oak Haven Subdivision" located in· Section 23 of
Scambler Township, Tamarac Lake (56-931).
Planning Commission Appointments for 2004
Motion by Lee, second by Froemming, and unanimously carried to re-appoint the following
individuals to the Otter Tail County Planning Commission effective January_ 1, 2004, for three
year terms:

At 12:10 p.m., Chairman Lee declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1 :23 p.m.
Perham Resource Recovery Facility
Solid Waste Director, Mike Hanan, updated the Board on a recent meeting of the Resource .
Recovery Facility's Coordinating Committee. He reported that the Coordinating Committee
has asked Bob Louiseau to negotiate the "180 day out clause" out of the proposed Bongard's
agreement for Bongards and the City & Counties. Commissioners agreed that they did not

wish to move forward with additional ciction regarding the facility until the City of Perham and Q
Barlow Group have both ·responded to Otter Tail County's request to re-negotiate their
contracts. '.· · ,·
i ' Budget Discussion . .
Commissioner Lee presented a document entitled "Proposals for 2004 Budget". Accountant,
Mitzi Pederson, explained and answered questions· regarding the six budget proposals.
Additional budget reducing proposals were discussed. Motion by Mosher, second by Block,
to reduce per diem~ from $50 ._to $45, effectiye January 1, 2004, and then, reinstate by
increasing to ·$47.50 in 2005, $50.00 in· 2006, $52.50 in 20Q7, and $55 in 2008. Chairman

Commissioner Block agreed with the budget proposals presented by the Chairman and
added that the Sheriff Department personnel should not be reduced for CY2004; however,
should not be increased either and that Detention Facility personnel changes be considered
separately. ·
Commissioners' Compensation
Otter Tail County Resolution No. 2003 -76,
Commissioner Nelson offered the following and moved its adoption:
WHEREAS, Minnesota Statute 375.055 provides that County Commissioners shall receive
compensation of annual salaries and, in addition, may receive per diem payments and
reimbursement for necessary expenses incurred in the performance of duties of their office,
as set by a resolution of the County Board; and
WHEREAS, the current base annual salary of the County Board of Commissioners is
$25,200.00, as approved by the County Board on December 24, 2002, which took effect on
January 1, 2003, and has been in effect for one year; and ·
WHEREAS, the County Board of Commissioners has elected no Cost of Living Adjustment
(COLA) for Calendar Year 2004 for their base annual salary because of a budget shortfall;
and
NOW, THEREFORE BE IT RESOLVED, that the Otter Tail County Commissioners shall
receive the same annual base salary as they received in 2003 of $25, 200.00 for 2004; and
BE IT FURTHER RESOLVED, that the per diem rate shall be decreased from $50.00 to
$45.00; and
BE IT FURTHER RESOLVED, that the mileage rate for reimbursement of Commissioners
transportation expenses shall be set at 33 cents per mile, the same rate set for other county
employees for mileage reimbursement.
Commissioner Froemming seconded the motion, and upon being put to vote, was carried
with Mosher opposeg. · · • '
