OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 17, 2002, at
9:30 a.m. at the Otter Tail County Courthouse with Dennis Mosher, Chair; Malcolm Lee, Vice-
Chair; Syd Nelson, Roger Froemming, and Bob Block present.
Approval of Agenda
Motion by Froemming, second by Lee, and unanimously carried to approve the County Board
agenda of September 17, 2002, with the following additions:
Discussion -Refugee Services/Funding
Gary Bergem -Drainage Issue
Approval of Minutes
Motion by Lee, second by Block, and unanimously carried to approve the County Board minutes of
September 10, 2002, with a typographical correction.
Approval to Pay Bills
Motion by Nelson, second by Froemming, and unanimously carried to approve payment of County
Board bills per Attachment A of these minutes.
Bid Opening -Sale of Property in Rush Lake Township
After previously advertising for bids, Auditor, Wayne Stein, opened the following bid for
approximately two acres of property by Highway 78 in Rush Lake Township:
Richard & Veronica Bergeron $2,550.00
Motion by Nelson, second by Lee, and unanimously carried to award the bid of Richard & Veronica
Bergeron in the amount of $2,550.00 for the following described property:
Beginning at a point seven hundred thirteen (713) feet South of the East quarter corner Section ten (10)
Township one hundred thirty five (135) Range thirty nine (39), thence three hundred twenty three and four
tenths (323.4) feet West, thence three hundred (300) feet South, thence three hundred twenty three and
four tenths (323.4) feet East to the east line of Section ten (10) Township one hundred thirty five (135)
Range thirty-nine (39) thence three hundred (300) feet to the point of beginning including two (2) acres
subject to the existing public highway on and along the East side of said tract of land.
Discussion -County Ditch Systems
County Ditch No. 38:
Ditch lrispector, Randy Wasvick, reported that the redetermination of benefits for County .Ditch
No. 38 will require many maps. GIS Coordinator, Brian Armstrong, briefed the Board on the need
for computer parceling in order to continually use the data after a redetermination is complete. He
suggested a fee of $15 per parcel to complete parceling in this Ditch System which could reduce
the time spent actually viewing the properties. Mr. Wasvick reported that the DNR may require an
Engineer's study on the ditch. Mr. Armstrong will meet with Terry Lejcher of the DNR .to explain
the proposed parceling project. · ·

County Ditch No. 53 & 43: 1 ··,
Mr. Wasvick updated the Board on County Ditch System 53 and 43. A pipe has been installed in w
County Ditch No. 43, Indian Lake, and the water is currently flowing which has resulted in lowering
the water off of CR 33. The Highway Department will take elevations of the lake every two weeks
and provide that data to the DNR.
County Ditch No. 70:
Mr. Wasvick reported that County Ditch No. 70, Sewell Lake, has a tile system coming out of
Sewell Lake that is plugged. There is very little money in the Ditch System and he has been
unable to obtain an estimate from contractors. The lake is very close to running over. Discussion
followed. Motion by Mosher, second by Nelson, and unanimously carried to proceed with repairing
CD No. 70 on Sewell Lake.
Recess & Reconvene
At 10:34 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 10:40 a.m.
Road Name Change Request
GIS Coordinator, Brian Armstrong, addressed an issue regarding a name change request for 4251h
Street. This road was previously known as Fort Thunder Road. Mr. Armstrong explained that
425th Street fit the numbered grid of straight roads; therefore, Fort Thunder Road was not an option
for this road when developing the E911 system. In the appeal process, numbered roads were not
considered for road name changes because this grid of roads is the backbone of the E911 Road
Name System. James Osterfeld, representing Perham Township Board, requested that 4251h Q
Street be changed back to Fort Thunder Road because 1) Fort Thunder Road is better known, 2)
other "grid" roads have been changed because of extenuating circumstances, and, 3) Perham
Township had a motion recorded from 1976 that this road would be named Fort Thunder Road.
Motion by Nelson, second by Froemming, to change the road name of 4251h Street to Fort Thunder
Road on the five miles west from Hwy 78. Chair Mosher called for a roll call vote:

Motion passed.
Request to Advertise for Bids -Building Enclosure & Construction Package
Physical Plant Manager, Rick Sytsma, and Architect, David Shultz, presented documents
regarding the proposed RFP for the Building Enclosure and Interior Construction Package for the
Government Service Center at an estimated bid price of $5,300,000. Motion by Lee, second by
Block, and unanimously carried to authorize the Physical Plant Manager and Architect to advertise
for bids for the Building Enclosure and Interior Construction Bid Package for the Government
Service Center with a bid opening date of October 16, 2002.
Planning Commission Recommendations 0
Conditional Use Permit-Weslake Resort, lnc.lBJ Jensen, LLC: ..
Motion by Froemming, second by Nelson, and unanimously carried approve a Conditional Use
Permit to reconfigure this cluster development by removing manufactured homes and replacing

with cabins per drawing on file at the Land & Resource Management Office. The approval is
subject to the conditions as recommended by the Planning Commission. The property is
described as Pt GL 10 & 11 (12.70 Ac) & Pt GL 10 & 11 (4.60 Ac, Tract D), section 32 of Maine
Township; West Lost Lake (56-481 ).
Conditional Use Permit-Hunstad Tst:
Motion by Froemming, second by Lee, and carried with Mosher opposed, to deny a Conditional
Use Permit, as recommended by the Planning Commission, for annual family reunions in August of
each year. The property is described as Sandy Shore Development Lot 7A & 7B, Section 1 of
Everts Township; Otter Tail Lake (56-242).
Conditional Use Permit -Stephen & Crystal Johnson:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit to
build a driveway through the lower ditch and to the garage and fill around the garage with
conditions as recommended by the Planning Commission. The property is described as Island
View Lot 2 Blk 1, Section 16 of.Edna Township; Berger Lake (56-1149).
Conditional Use Permit-Whispering Pines Resort/Robert Corbin:
Motion by Nelson, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to expand 3 of the existing 12 cabins on the resort as presented. The property is described
as Martins Perfect Beach Lots 8-13, Section 31 of Corliss Township; Big Pine Lake (56-130).
Conditional Use Permit -Madsen's Resort, lnc./Eric Malmstrom:
Motion by Mosher, second by Froemming, and unanimously carried approve a Conditional Use
Permit to renovate an existing porch on their store as presented. The property is described as Pt
Outlot A 256' on Road x 309.4' on Lk (3.2 Ac), Section 1 of Everts Township; Blanche Lake
(56-240).
Conditional Use Permit-David Wieser:
Motion by Froemming, second by Nelson, and unanimously carried to approve a Conditional Use
Permit to operate a Real Estate Office with conditions as recommended by the Planning
Commission. The property is described as S.L. 4 of Gov. Lot 4 (.81 AC), Section 32 of Amor
Township; Otter Tail Lake (56-242).
Preliminary Plat -"McDonald View"/Robert Pawlowski:
Motion by Nelson, second by Block, and unanimously carried to approve a Preliminary Plat
consisting of 6 single family residential lots, 2 blocks with conditions as recommended by the
Planning Commission. The property is described as Pt of Gov. Lot 6 & Pt of Gov. Lot 7 (6.10 Ac),
Section 9 of Edna Township; Little McDonald Lake (56-328).
Conditional Use Permit -Rodney & Jill Hagen and Gary Johnson:
Motion by Lee, second by Block, and unanimously carried to approve a Conditional Use Permit to
provide a restrictive lake access easement for plats of Western Exposure & Southern Exposure
with conditions as recommended by the Planning Commission. The property is described as Lot 4
Ex Tr & NE¼ Ex Tr, GL 5 Ex Tr, Section 29 of Scambler Township; Pete Lake (56-941 ).
U Conditional Use Permit -Robert L. Hilde:
Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to construct a storage building for rental purposes with conditions as recommended by the

Planning Commission. The property is described as Lot 4 Ex Liberty Beach & Ex Trs (42.64 Ac), Q.
Section 6 of Dunn Township; Pelican Lake (56-786). .
Conditional Use Permit-Tom & Lisa Leuthner:
Motion by Mosher, second by Nelson, and unanimously carried to approve a Conditional Use
Permit to replace a mobile home with a permanent dwelling with conditions as recommended by
the Planning Commission. The property is described as Lot 8 Ex Platted and Ex Trs, Section 2 of
Sverdrup Township; East Lost Lake (56-378).
CUP #5909 Extension Request-John & Sandy Karvonen:
Motion by Nelson, second by Froemming, and unanimously carried to extend Conditional Use
Permit #5909 until June 1, 2003, with conditions as recommended by the Planning Commission.
The property is described as Pt. Lot 6 Oakland Beach, Section 1 of Perham Township; Little Pine
Lake (56-142).
Extension Requests for Preliminary Plat & Conditional Use Permits
Motion by Nelson, second by Froemming, and unanimously carried to extend the date for filing the
Final Plat known as "Russ' Beach" on Little Pine Lake (56-142) until November 1, 2002.
Motion by Mosher, second by Block, and carried with Lee opposed, to extend Conditional Use
Permit# 5970 for Richard & Linda West on Swan Lake (56-781) until October 1, 2002.
Motion by Froemming, second by Lee, and unanimously carried to extend Conditional Use Permit
#5923 for Cynthia Vierkant on Otter Tail Lake (56-242) until November 1, 2002. Q
Contract Approval -S.A.P. 56-650-06 & Etc.
Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chair's
signature to execute a contract between the County of Otter Tail and Riley Bros. Construction, Inc.
of Morris, MN, for completion of S.A.P. 56-650-06 & Etc., Bridge Replacements on CSAH 50 and in
Gorman, Hobart, and Bluffton Townships, in the amount of $645,278.80, contingent upon the
approval of the County Attorney.
Drainage Discussion
Highway Engineer, Rick West, reported that the Highway Department measured some elevations
and reported that the plan to drain an area on Gary Bergem's property (Marion Lake) north to the
adjacent boggy area is workable. This is a Township road and the Township could install a
culvert/pipe in the right-of-way area to accomplish the project. Mr. Bergem will talk with the
Township to proceed with the project.
Wetland Credits
Highway Engineer, Rick West, briefed the County Board regarding the County's wetland bank.
Mr. West recommended that the cost to purchase wetland credits from the County be increased
from $.10 per sq. ft. to $.15 per sq. ft. and that wetland credits are sold only to private parties for
mitigation within Otter Tail County. Motion by Lee, second by Nelson, and unanimously carried to
increase the cost to purchase wetland credits to $.15 per sq. ft. and to authorize the sale of
wetland credits only for projects in Otter Tail County as recommended by the Highway Engineer. 0

At 12:07 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. At 1 :08 p.m., Chairman Mosher declared the meeting of
the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating
the performance of Public Health Director, Diane Thorson, pursuant to M.S. §471.705 Subd. 1d(d).
All five seated commissioners were present for the evaluation. A summary of performance
conclusions will be provided at the next regular Human Services Board meeting. At 1 :31 p.m.,
upon conclusion of the closed session, Chairman Mosher declared the meeting open to the public
with Commissioner Froemming absent.
Refugee Services
Lutheran Social Service of Minnesota has offices in Moorhead and Pelican Rapids that resettle
refugees and help with transition to life in American communities. Commissioner Lee stated that
the program has been funded through the state's Refugee Resettlement Office and beginning in
October, the state will no longer fund that service in the Northwest region. He expressed concern
as the program is very important in the Northwest region of the state.

-Motion by Mosher, second by Lee, and unanimously carried to request Commissioner Nelson to
attend the tour and meeting of the EOTSWCD on September 18, 2002.
Adjournment
At 1 :37 p.m., Chair Mosher declared the meeting of the Otter Tail County Board of Commissioners
adjourned until Tuesday, September 24, 2002.
