Approval of Agenda Motion by Froemming, second by Nelson, and unanimously carried to approve the County Board agenda of July 23, 2002, with the following change: 10:30 a.m., cancel -Highway Engineer, Rick West, Agenda Item Approval of Minutes Motion by Lee, second by Block, and unanimously carried to approve the County Board minutes of July 16, 2002, as mailed. · Approval to Pay Bills Motion by Lee, second by Block, and unanimously carried to approve payment of County Board bills per Attachment A of these minutes. . Agriculture Update Extension Educators, Doug Holen and Vince Crary, briefed the County Board on various Ag programs and activities. They provided several handouts and discussed the Dairy Diagnostics Program, the pilot project to reduce thistles, low milk prices, Johne's Cow Disease, and the soybean aphid (pest). Request to Change 911 Addressing Sign Richard Palen provided a written statement objecting to the signage of a private driveway that accesses his property as 47ih Avenue. He expressed concern regarding the public perceiving this driveway as a public road because it is named and signed. Mr. & Mrs. Palen requested that the 911 address signs be put back on County Highway 14. He felt that this would not hinder emergency personnel in finding someone in an emergency in this particular situation. GIS Coordinator, Brian Armstrong, stated that he viewed the property and believes that this situation follows the addressing design to find people in case of an emergency now, and in the future. If additional land in this area is platted and sold in the future, finding people in case of an emergency could be hindered by not addressing the private drive. Lengthy discussion continued. Chairman Mosher requested action. Motion by Block, to deny this addressing sign change based on past practice. Motion failed for lack of a second. Motion by Nelson, second by Froemming, and carried with Lee and Block opposed, to revert back to the E911 signage that was used prior to May 28, 2002, at the 48000 County Highway 14 location. Funding Request Chief Deputy, Mark Morris, requested authorization to give a donation to the Central Lakes Tracking Dog Association. The Association recently assisted in a search and rescue situation in OTC Board of Commissioners' Minutes July 23, 2002 Page2 the Eastern portion of the County. Motion by Lee, second by Froemming, and unanimously carried 0 to authorize the Sheriff's Department to give a donation of $250 to the Central Lakes Tracking Dog • · Association from the Sheriff's Search & Rescue Fund. Request for Approval of Bid Proposals Solid Waste Director, Mike Hanan, requested permission to request bids for replacement of two recyling collection trucks that would include the trucks, trailers, hooks, and boxes. The roll off containers will be increased in size from 15-yard containers to 30-yard containers. The estimate of cost is approximately $600,000 with the trade-in or sale value of the current equipment unknown at this time. Motion by Lee, second by Froemming, and unanimously carried to authorize the Solid Waste Director to execute a Request for Proposal (RFP) for the acquisition of two recycling collection trucks and equipment as described above. Mr. Hanan also requested authorization to execute a Request for Proposal for a tractor/loader at the Henning Transfer Station. Estimated cost is $25,000 and is included in the Capital Improvement Budget. Motion by Froemming, second by Lee, and unanimously carried to authorize the Solid Waste Director to request proposals for a tractor/loader for the Henning Transfer Station. Payment Approvals Motion by Lee, second by Nelson, and unanimously carried, to approve payment to Lake Region Healthcare, in the amount of $317.45, for services provided under the provision of Minnesota Statute 609.35. Motion by Mosher, second by Block, and unanimously carried to approve the following ditch 0 invoice: Otter Tail County Highway Department Ditch System No. 43 $720.42 Applications for Exempt Permit Motion by Lee, second by Block, and unanimously carried to approve, with no waiting period, the application for exempt permit as submitted by Pelican Rapids Chamber of Commerce for an event scheduled on Saturday, October 12, 2002, at the Blue Water Sports Bar. Motion by Lee, second by Froemming, and unanimously carried to approve, with no waiting period, the application for exempt permit as submitted by Pelican Rapids Ducks Unlimited for an event scheduled on Monday, August 12, 2002, at the Blue Water Sports Bar. Certificates of Correction to Plat Motion by Nelson, second by Froemming, unanimously carried to approve, as attached, the Land Surveyor's Certificates of Correction to Plat per Attachment B & C of the official minutes. Payment Approval Motion by Lee, second by Block, and unanimously carried to approve payment to the Fergus Falls HRA, in the amount of $2,862.72, for reimbursement of Section 8 Administrative Funds for the period of January 1, 2002, through June 30, 2002. 0 0 0 0 OTC Board of Commissioners' Minutes July 23, 2002 Page 3 Order and Findings for Ditch System No. 19 Motion by Froemming, second by Mosher, and unanimously carried to authorize the Chairman's signature to execute the County Ditch No. 19 Order and Findings as prepared by David Hauser, County Attorney. Applications for License Motion by Lee, second by Nelson, and unanimously carried to approve the following applications for license: Donald Hauck Otter Supper Club Ottertail, MN 56571 Eleanor Solien Waterfront Grocery Detroit Lakes, MN 56501 Tobacco Tobacco Recess & Reconvene At 10:59 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 11 :05 a.m. Bid Award -Demolition Package After previously advertising for bids Rick Sytsma, Physical Plant Manager, opened the following bids on Tuesday, July 9, 2002, for Demolition Package 1A at the building located at the Regional Treatment Center site: All Building Corp. $373,700 Cameo Homes $460,000 Champion Environmental $434,000 Comstock Construction $557,000 Diamond 5 Construction $583,000 Diversified Contractors $543,300 Veit Co., Inc. $496,900 Klassic Construction of Duluth $549,000 Motion by Lee, second by Block, and unanimously carried to award Demolition Package 1A for the building located at the RTC site to the low bidder, All Building Corporation of Fergus Falls, in the amount of $373,700, as recommended by the Physical Plant Manager and the Architect. Conditional Use Permit Application Bill Kalar, Land & Resource Director, explained that the CUP request of Matt & Brenda Hobbs was tabled at the July 16, 2002, County Board meeting for additional information. Highway Engineer, Rick West, and Mr. Kalar viewed the property. Mr. Kalar submitted photographs of the property and stated that he took a boat ride around the lake and there are several examples of retaining walls of various types and similar examples of what the Hobbs' are proposing. Rob Goral of Shoreland Solutions, stated that the Hobbs' proposal would reduce runoff toward the lake, filter and define what is currently washing into the lake and reduce erosion. Discussion took place regarding allowing the same benefits as the neighbors enjoy. Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use Permit to install a retaining wall and replace stairway with imbedded block steps per plans and drawings with the following conditions recommended by the Planning Commission: 1) The water from the roof of the house be directed away from the lake and, 2) Appropriate erosion control measures must be taken (i.e. exposed soil OTC Board of Commissioners' Minutes July 23, 2002 Page 4 must be covered from beginning to completion). The property is described as Lot 2, Block 1, Denwood Acres First Addition, Section 10, Maine Township, Pickeral Lake (56-475) Final Plats Motion by Froemming, second by Nelson, and unanimously carried to approve the Final Plat of Donald Dreyer known as "North Oaks" located in Section 1 of Otter Tail Township and Section 36 of Rush Lake Township on Buchanan Lake (56-209). Motion by Lee, second by Nelson, and unanimously carried to approve the Final Plat of Duane Sonnenberg known as "Long Lake Shores Fourth Addition" located in Section 28 of Hobart Township on Long Lake (56-388). Motion by Lee, second by Nelson, and unanimously carried to authorize Board Secretary, Kathy Domholt, to sign the Final Plats in the absence of Board Clerk, Larry Krohn. Closed to the Public Performance Evaluation 0 ' At 11 :30 a.m., Chair Mosher declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of MIS Director, Tim Brand, pursuant to M.S. §471.705 Subd. 1d(d). All five seated commissioners were present for the evaluation. A summary of performance conclusions will be provided at the next regular County Board meeting. At 12:05 p.m., upon conclusion of the closed session, Chairman Mosher declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1 :30 p.m. Q Seminar Attendance Motion by Froemming, second by Nelson, and unanimously carried to authorize Commissioners Block and Lee to attend a seminar at the Holiday Inn, Alexandria, MN, on September 5-6, 2002, entitled "County Responsibilities for Managing Land, Water, and Resources". Long Range Planning Recommendations Chair Mosher introduced members of the Long Range Planning Task Force as follows: Bob Ehlert (District 3), Chuck Davis (District 4), Ann Nelson (District 5), and Judy Babier (District 2). George Walter, representing District 1, was unable to be present. Mr. Mosher thanked the committee members for their work and attendance at meetings and presented the final Long Range Planning Task Force Report & Recommendations dated July 23, 2002. Chair Mosher, Committee members, and Department Heads discussed the recommendations. Motion by Lee, second by Froemming, and carried with Mosher abstaining, to approve the continuation of this Task Force to meet quarterly or when needed to continue to bring opinions from citizens in their respective areas.
