OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Human Services Board convened Tuesday, May 14, 2002, at 9:31 a.m. at
the Otter Tail County Courthouse with Commissioners Dennis Mosher, Chair; Malcolm Lee, Vice-
Chair; Syd Nelson, Roger Froemming, and Bob Block present.
Approval of Agenda
Motion by Lee, second by Froemming, and unanimously carried to approve the Human Services
Board agenda of May 14, 2002, as mailed.
Approval of Minutes
. Motion by Nelson, second by Froemming, and unanimously carried to approve the Human
Services Board minutes of April 23, 2002, as mailed.
Discussion -Public Transportation
Human Services Director, John Dinsmore, introduced Wadena County Commissioner Paul Nolte,
Human Services Director, Paul Sailer, and Kevin Anderson of the Mn DOT. Discussion took place
previously as it relates to Wadena County's research in developing a transportation system that
could serve portions of East Otter Tail County. Part of this follow-up meeting is to request a letter . .
of support for their application(s) for funding to develop a public transportation system. Mr. Sailer
stated that it appears that the Wadena County application is the only potential application for
funding in year 2003. Mr. Sailer questioned whether or not a multi-county application would be
.possible. Mr. Dinsmore stated that, on a philosophical basis, Otter Tail County is in favor of a
public transportation system; however, the County needs to do more research on the issue before
recommending inclusion with a multi-county funding application. Lengthy discussion continued
regarding challenges Otter Tail County would experience with a public transportation system
because of the County's large, rural size. Motion by Lee, second by Block, and unanimously
carried to offer a letter of endorsement of Wadena County's efforts in their development of a public
transportation system. The County Board directed the Otter Tail County Human Services Director
to draft the letter of support.
Minnesota Family Investment Program
Human Services Supervisor, Bev Schoon, updated commissioners regarding the MFIP. Otter Tail
County has several families that will be reaching their 60-month deadline for receiving MFIP
benefits. Discussion followed.
Daycare Providers -.. Fire Marshal Update
Human Services Supervisor, Jodi Wentland, reported that Otter Tail County acts on behalf of the
State in the licensing activities of child care providers. Some child care providers need a fire
marshal inspection in order to be licensed; however, effective May 1, 2002, the State Fire Marshal
Division will no longer accept requests for the inspection of child care facilities because of drastic
budget cuts in FY2003. There is currently an amendment being proposed in the legislature that
would allow local fire code inspectors to conduct the inspection and also, a legislative proposal that

would mandate the State Fire Marshal Division to conduct these inspections. Ms. Wentland is 0
keeping new child care applicants aware of this situation.
Approval of Addendum for Pioneer Retirement Purchase of Services
Motion by Froemming, second by Mosher, and unanimously carried to authorize the Chair's
signature to execute an addendum to the Pioneer Senior Cottages/Pioneer Retirement Purchase
of Service Agreement from May 1, 2002, to June 30, 2002, to include a second site located at
1317 South Maybelle, Fergus Falls, MN.
Grant Agreement -Health Screening for Tuberculosis and Foreign Born Persons
Motion by Nelson, second by Block, and unanimously carried to authorize the Chair's signature to
execute an agreement between the County of Otter Tail and the Minnesota Department of Health
for $1,251.00 for health screening and follow-up services for tuberculosis and for foreign born
persons pursuant to Minn. Stat. §144.0742.
Agreement for Family Planning Services
Secondhand Smoke Information
Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chair's
signature to execute a Purchase of Service Agreement between the County of Otter Tail Public
Health Department and Ottertail-Wadena . Community Action Council, Inc. for the period of
January 1, 2002, to June 30, 2003. The County has received a Family Planning Special Project
Grant, in the amount of $60,307.80, and contracted with the CAC to provide services.
Public Health Director, Diane Thorson, provided information recently held at the annual
Conference of Pediatric Academic Societies that suggest that high levels of exposure to
secondhand smoke impairs children's learning ability.
Approval to Pay Bills & Claims
Motion by Nelson, second by Froemming, and unanimously carried to approve the Human
Services bills and claims as presented.
Performance Evaluation Summary
Motion by Lee, second by Froemming, and unanimously ca"rried to approve the positive
performance evaluation summary of Human Services Director, John Dinsmore, and to direct that
the summary be placed in his personnel file.
Adjournment
At 10:36 a.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 9:30 a.m. on Tuesday, May 28, 2002.

Closed to the Public -Performance Evaluation
The Otter Tail County Board of Commissioners convened Tuesday, May 14, 2002, at 10:40 a.m. at
the Otter Tail County Courthouse with Dennis Mosher, Chair; Malcolm Lee, Vice-Chair;
Syd Nelson, Roger Froemming, and Bob Block present. At this time, Chair Mosher declared the
meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of
evaluating the performance of GIS Coordinator, Brian Armstrong, pursuant to M.S. §471. 705
Subd. 1d(d). A summary of performance conclusions will be provided at the next regular County
Board meeting.
Open to the Public
Approval of Agenda & Minutes
At 11 :05 a.m., Chair Mosher· declared the meeting of the Otter Tail County Board of
Commissioners opened to the public. Motion by Froemming, second by Nelson, and unanimously
carried to approve the County Board agenda of May 14, 2002, as mailed. Motion by Block, second
by Lee, and unanimously carried to approve the County Board minutes of May 7, 2002, as
presented.
Approval to Pay Bills
Motion by Lee, second by Froemming, and unanimously carried to approve payment of County
Board bills per Attachment A of these minutes which include the following lodging payments:

Planning Commission Recommendations
Preliminary Plat & Conditional Use Permit: -"Governor's Point Estates'1/Leonard Ma/berg Jr:
Motion by Lee, second by Nelson, and unanimously carried to approve a Preliminary Plat for
"Governor's Point Estates" for single family residential use and a Conditional Use Permit to
construct a road per County regulations. This approval is subject to the conditions as
recommended by the Planning Commission. The property is described as 10.02 Ac tract being
part of sub 1_ & A of GL 3, 4, &.5 ii) Section 35 of Candor Township; Loon Lake (56-523).
Preliminary Plat -"Koep's Subdivision'1/Joseph & Eileen Koep:
Motion by Mosher, second by Froemming, and unanimously carried to approve the Preliminary Plat
known as "Koep's Subdivision" to be used as 5 single-family residential lots with conditions as
recommended by the Planning Commission. The property is described as Lot 5 except tr to Bible
Camp, except tr & lot 6 in Section 17 of Leaf Mountain Township; Spitzer Lake (56-160).
Conditional Use Permit -Hobart Township c/o Otter Tail County:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit to
replace a deficient bridge (No. L0874), located at the crossing of Black Diamond Road and the
Otter Tail .River in Section 24 of Hobart Township; Otter Tail River (56-ORA).
Conditional Use Permit -Eugene & Paulette Klein:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit to
build a 26' x 30' building to operate a commercial kitchen for catering purposes as presented. The
property is described as Pt. GL 2 & 3 (5.03 Ac) in Section 6 of Rush Lake Township; Marion Lake
(56-243).

Conditional Use Permit-John Rose/South Turtle Lake LID:
Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use Permit
to install a 6700 gal/min Crisofalli Pump to lower South Turtle Lake to its OHWL to the extent that
the County has jurisdiction as recommended by the Planning Commission. The property is
described as NE¼ SW¼ & GL 6 & 7 & SE¼ SW¼ ex trs. in Section 6 of Clitherall Township; South
Turtle Lake (56-377).
Conditional Use Permit -Arvin Leabo:
Motion by Lee, second by Froemming, and unanimously carried to construct a 50' x 96' pole
building as presented. The property is described as Lot 1 Blk 1 Winger's Orchard in Section 33 of
Aurdal Township; Spring Lake (56-682).
Conditional Use Permit -Jim & Amber Fitzgerald:
Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use
Permit for a small used car lot with conditions as recommended by the Planning Commission. The
property is described as Pt. E½ NE¼ (5 Ac) in Section 29 of Maplewood Township; Crystal Lake
(56-739).
Conditional Use Permit -Travis Houck/Philip Clyde & Gayle Ann Vanschepen:
Motion by Nelson, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to construct an 18' wide driveway with conditions as recommended by the Planning
Commission. The property is described as Pt. of GL 2 (tracts Y & Z) in Section 33 of Hobart
Township; Long Lake (56-388).
Preliminary Plat & Conditional Use Permit -"Sugar Maple Shores'1/Northern Lakes Co:
Land & Resource Director, Bill Kalar, reported that the Planning Commission recommended
approval with conditions of the Preliminary Plat known as "Sugar Maple Shores" on Round Lake on
April 10, 2002. On April 16th , the County Board referred the request back to the Planning
Commission to listen to additional information. The Planning Commission affirmed their motion of
April 10, 2002, and released the developer of prohibition of a mounds septic system because it
complies with the Subdivision Controls Ordinance. Chairman Mosher acknowledged the copies of
letters and petition in opposition of this request. Brian Bladow spoke in opposition of the approval
of the plat because of overcrowding, impact on environmental natural resources, and concern for
Timber Hills Road because of its fragile condition. Mike Kiess spoke in concern of further damage
to the access road. Attorney, Tom Gedde, representing developer, Northern Lakes Company,
spoke in support of the project because it meets every requirement of the County's ordinances.
Planning Commission members, Mr. Sha and Mr. Maske staled that the road condition is a
township issue and the plat meets all of the County's requirements. Discussion continued.

Motion by Mosher, second by Lee, and carried with Nelson opposed, to approve the Preliminary
Plat known as "Sugar Maple Shores" consisting of single family residential lots and a Conditional
Use Permit to construct a road to service the plat with conditions as recommended by the Planning
Commission per their motion of April 10, 2002, with the following exception: To release the
developer from the prohibition of the mound septic system because the request complies with the
requirements of the SCO of Otter Tail County. The property is described as all that part of GL(s) 4,
5, & 6, Section 5 of Everts Township; Round Lake (56-297). Q

Conditional Use Permit -Jeff Hillius:
Motion by Lee, second by Froemming, and unanimously carried to deny a Conditional Use Permit
for-Request #2 because a revised plan has not been provided as recommended by the Planning
Commission. The property is described as Crystal Springs First Addition Lot 6 Blk 2 in Section 3 of
Lida Township; Franklin Lake (56-759).
Discussion Regarding Various Ditches
Ditch Inspector, Randy Wasvick, reported that he had a request for redetermination of benefits on
Judicial Ditch No. 2. County Attorney, David Hauser, will research the issue to determine if the
request requires a petition.
Mr. Wasvick reported that the previous plan to dig down to determine the original elevation of
Indian Lake will not work; however, the County can lower the lake to the OHWL without a permit
from the DNR. Discussion continued regarding bringing Indian Lake down slowly through the
summer by putting in a standpipe. Mr. Wasvick will return to the County Board with a plan.

Reconvene -Closed to the Public
At 12:15 p.m., Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. At 1 :15 p.m., Chair Mosher declared the meeting of the
Otter Tail County Board of Commissioners reconvened and closed to the public for the purpose of
evaluating the performance of Highway Engineer, Rick West, pursuant to M.S. §471.705 Subd.
1d(d). All five seated commissioners were present A summary of performance conclusions will
be provided at the next regular County Board meeting.

Certification of Wetland Easements
At 1 :36 p.m., Chairman Mosher declared the meeting open to the public for the remainder of the
agenda items.
Motion by Froemming, second by Nelson, and unanimously carried to certify the following
acquisition of land by the U.S .. Fish & Wildlife Service for waterfowl easement purposes:

Coalition of Lake Associations
SWCD Board
Gary Cruff, representing the COLA, presented the Ottertail County Coalition of Lake Associations
(COLA) 2001 Water Quality Data Manual. He stated that the Association tries to put everything
that would be important for water quality in the book. Because of a grant received by the COLA,
they will add 11 lakes to their testing and have over 50 lakes tested this year.
Mr. Cruff reported that he is also on the SWCD Board and invited all commissioners to the SWCD
District meetings. ·

Performance Evaluation Summary Q
Motion by Lee, second by Block, and unanimously carried to approve the positive performance
evaluation summaries of Solid Waste Director, Mike Hanan, and Land & Resource Director,
Bill Kalar, and to direct that the summaries be placed in their respective personnel file.
Motion by Block, second by Lee, and unanimously carried to authorize the Chair's signature to
execute a contract between the County of Otter Tail and the Solid Waste Director, Mike Hanan,
which applies the provisions of the Otter Tail County Personnel Rules to the Solid Waste Director.
Otter Country Trail Association
Otter Tail County Resolution No. 2002 -32
Commissioner Froemming offered the following and moved its adoption:
WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and
WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the
review and approval of the County Attorney.
THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In-Aid
Trail Systems as they exist for Otter Country Trail Association and proposed extensions of
Grant-In-Aid Trails with the aforementioned condition.
Commissioner Lee seconded the resolution and, upon being put to vote, was unanimously 0
adopted.

Proposed Vining Extension to Grant-In Aid Trail
Otter Tail County Resolution No. 2002 -33
Commissioner Froemming offered the following and moved its adoption subject to amending the
current contract between the County of Otter Tail and Otter Country Trail Association to include the
proposed Vining Extension Trail in the contract:
WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and
WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the
review and approval of the County Attorney, and Q
WHEREAS, County sponsorship is required to obtain funding for trail extension, and
WHEREAS, proposed trail extension is on the ground with all needed permits acquired.

Reappointments -Otter Tail Water Management District Board
Motion by Froemming, second by Lee, and unanimously carried to approve the reappointments of
Ray Mounts and Clarence Bladow to four-year terms on the Otter Tail Water Management District
Board effective August 1, 2002.
Payment Approval
Motion by Nelson, second by Froemming, and unanimously carried to approve payment to Steve's
Sanitation, Inc., in the amount of $90.00, for the placement of a 30-yard dumpster at the Rush
Lake Tax Forfeited site.
Transfer of Funds
Motion by Nelson, second by Lee, and unanimously carried to approve the closing of the Sheriff's
Severance Pay Special Revenue Fund to the General Fund. This· Fund was established by
resolution December 29, 1986, to meet a requirement of a provision contained in Article XX of the
Labor Agreement between the County and Law Enforcement. This fund has never been used _and

the language referenced in the aforementioned agreement does not appear in post 1987 Q
agreements and funding for this liability is designated within the General Fund.
Petition Accepted
The County Auditor presented a petition concerning the LPD Lake Improvement District for
additional consideration by the County Board.
Recess
Reconvene -Public Hearing for Redistricting
At 2:51 p.m. Chairman Mosher declared the meeting of the Otter Tail County Board of
Commissioners recessed for a five-minute break. The meeting was reconvened at 2:56 p.m. as a
Public Hearing to consider plans for redistricting of County Commission Districts. The County
Auditor previously advertised and provided notice to the public regarding the Public Hearing. No
one from the public was present for the _hearing and. no written comments were received. Several
plans were presented to the Commissioners and considered. Motion by Froemming, second by
Nelson, to choose the plan that moves Dead Lake Township from the 1st District into the 2nd District
and Rothsay City and Trondhjem Township from the 2nd District into the 3rd District. Chairman
Mosher called for a vote. The motion carried 3-2 with Block and Lee opposed. Discussion
followed. Motion by Froemming, second by Mosher, to reconsider the previous motion. Chair
Mosher called for a vote. The motion carried unanimously.
Redistricting Plan
Otter Tail County Resolution No. 2002 -34
Commissioner Froemming offered the following and moved its adoption:
Resolved by the Board of County Commissioners of Otter Tail County Minnesota, that
WHEREAS, the 2000 Federal Decennial Census has been certified, and
WHEREAS, congressional and legislative districts affecting Otter Tail County have been finalized,
and
WHEREAS, Minnesota Statute 2048.135 Subdivision 2 establishes the timeline for completing
redistricting activities, and
WHEREAS, Pursuant to Minnesota Statute 375.025 Subdivision 1, County Commissioner Districts
shall be contiguous, compact and as equal in population as possible, and
WHEREAS, Pursuant to Minnesota Statute 375.025 Subdivision 1, Notice of Public Hearing and
Intent to Consider Plan(s) for Redistricting of County Commissioner Districts was given in the
Fergus Falls Daily Journal on Thursday, April 25, 2002, on Thursday, May 2, 2002, on Thursday
May 9, 2002 and on Saturday May 11, 2002 and notice was also given during the week of May 6,
2002 in the following weekly papers:

Review Enterprises, Inc.
Parkers Prairie Independent
Perham Enterprise Bulletin
Henning Advocate
New York Mills Herald, and
WHEREAS, upon proper notice being given, the Otter Tail County Board of Commissioners

WHEREAS, the Chair of the Otter Tail County Board of Commissioner call three times for public
comments before the public hearing was closed to the public. (note -no one attended the public
hearing), and
WHEREAS, the Otter Tail County Board of Commissioners reviewed, considered and discussed
various options both prior to and at the public hearing which would comply with the provision and
requirements of Minnesota Statute 375.025 Subdivision 1.

2002 County Wide Mowing Contracts
Motion by Nelson, second by Froemming, and carried with Lee opposed, to authorize the Chair's
signature to execute the 2002 -2003 Roadside Mowing Contracts for Area A, C, & G between the
County of Otter Tail and Myron Cordes of Henning, MN.
Minnesota State Transportation Fund Resolution
for Construction of County Bridge No. 56531
Project No. S.A.P. 56-610-10
Otter Tail County Resolution No. 2002 -35
Commissioner Lee offered the following and moved its adoption:
WHEREAS, Otter Tail County has applied to the Commissioner of Transportation for a Grant from
the Minnesota State Transportation Fund for the Construction of County Bridge No. 56531 (Project
No. S.A.P. 56-610-10) over the Pelican River, And;
WHEREAS, the amount of the grant has been determined to be $318,102.93 by reason of lowest
responsible bid.
NOW, THEREFORE, BE IT RESOLVED, that County of Otter Tail does hereby affirm that any cost
of the bridge in excess of the grant will be appropriated from the funds available to the County of
Otter Tail, and that any grant monies appropriated for the bridge but not required, based on the
final estimate, shall be returned to the Minnesota State Transportation Fund.
Commissioner Block seconded the resolution and, upon being put to vote, was unanimously
adopted.
Adopted at Fergus Falls, Minnesota, this 14th day of May, 2002.

Log House at the Phelps Mill Park
Motion by Nelson, second by Froemming, and unanimously carried to authorize the Highway
Engineer to proceed with the sale of the log house located at the Phelps Mill Park property.
Pesticide Application
County Coordinator, Larry Krohn, reported that the FAA requires that West Central Aerial Sprayers
receive authorization from the local unit of government where they are planning to spray. Motion
by Mosher, second by Block, and unanimously carried to approve a letter of support for the
County's lake associations in controlling forest tent caterpillars using the services of West Central
Aerial Sprayers. Otter Tail County has no applicable ordinances that regulate pesticide
application.
Approval of Collective Bargaining Agreement
Motion by Lee, second by Block, and unanimously carried to authorize the Chair's signature to
execute the Labor Agreement between Minnesota Teamsters Public and Law Enforcement
Employees' Union, Local No. 320, representing the Human Services Department Professional Unit
and the County of Otter Tail for the period of January 1, 2002 through December 31, 2004.
Adjournment
At 3:44 p.m., Chair Mosher declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 9:30 a.m. on Tuesday, May 21, 2002.
