MINUTES OF THE
OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Human Services Board convened Tuesday, April 9, 2002, at 9:33 a.m. at the
Otter Tail County Courthouse with Commissioners Dennis Mosher, Chair; Bob Block, Vice-Chair;
Syd Nelson, Malcolm Lee, and Roger Froemming present.
Approval of Agenda
Motion by Lee, second by Froemming, and unanimously carried to approve the Human Services
Board agenda of April 9, 2002, as mailed.
Approval of Minutes
Motion by Nelson, second by Froemming, and unanimously carried to approve the Human
Services Board minutes of March 26, 2002, as mailed.
New York Mills Office Update
Labor Management Committee Update
Human Services Director, John Dinsmore, reported that the Human Services Office in New York
Mills is in full operation. Furniture is in place and the last computer was installed yesterday for the
new financial worker.
Mr. Dinsmore reported that one topic the Human Services Labor Management Committee has
been discussing is delivery of services. He presented a copy of a survey sent to eleven counties
of comparable size relative to how their Human Services agencies deliver services/programs. He
will report back to the Board after the surveys have been returned. The LMC will also be working
with Lori Morrell from the Bureau of Mediation Services regarding the decision making process of
the Human Services Department and the role the LMC within the agency.
Department of Corrections Report
West Central Regional Juvenile Center Report & Other Correspondence
Court Services Director, Chuck Kitzman, presented a document entitled "Supervising Offenders in
Minnesota". The document presented facts and solutions about what works and what doesn't work
in the field of probation and supervision of offenders. Mr. Kitzman provided the West Central
Regional Juvenile Center 2001 yearly report, statistics from Minnesota Kids 2002 Databook, and a
report of the types of assessed fees other counties are charging for probation services.
Community Health Services Advisory Committee Appointments
Motion by Nelson, second by Froemming, and unanimously carried to appoint the following
individuals to the Otter Tail County CHS Advisory Committee for a two year term ending
December 31, 2003:

Letter of Support -MDH Bioterrorism Grant Q
Public Health Director, Diane Thorson, requested approval to send a letter of support to the
Minnesota Department of Health for a federal grant to be used for bioterrorism funding. The grant
proposal is being developed and will be sent to the Department of Health April 15, 2002. The
State is proposing $1.00 -$1.25 per capita for local bioterrorism planning. Ms. Thorson anticipates
hiring a part time person to work with the County's local bioterrorism planning after funds are
encumbered in May, 2002. Motion by Block, second by Mosher, to authorize the Public Health
Director to submit, to the MOH, the letter supporting federal bioterrorism grant funding as
presented. Chair Mosher called for a roll call vote:

Approval to Pay Bills & Claims
Motion by Block, second by Lee, and unanimously carried to approve the Human Services bills
and claims as presented.
Adjournment
At 10:48 a.m., Chair Mosher declared the meeting of the Otter Tail County Human Services Board
adjourned until 9:30 a.m. on Tuesday, April 23, 2002.

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, April 9, 2002, at 11 :20 a.m. at
the Otter Tail County Courthouse with Dennis Mosher, Chair; Malcolm Lee, Vice-Chair;
Syd Nelson, Roger Froemming, and Bob Block present.
Approval of Agenda
Motion by Froemming, second by Nelson, and unanimously carried to approve the County Board
agenda of April 9, 2002, with the following change:
Cancel Highway Engineer, Rick West's Agenda Item
Approval of Minutes
Motion by Block, second by Mosher, and unanimously carried to approve the County Board
minutes of April 2, 2002, as presented.
Approval to Pay Bills Q
Motion by Lee, second by Nelson, and unanimously carried to approve payment of County Board
bills per Attachment A of these minutes.

Letter of Intent to Enter into Solid Waste Contract
The County Attorney, read for the record, a letter of intent for the County to enter into a contract
with the City of Fergus Falls for.the incineration of approximately half of Otter Tail County's solid
waste. By consensus the County Board authorized the letter to be sent to the City of Fergus Falls
and other participating counties.
Ditch No. 17
Ditch Inspector, Randy Wasvick, met with three property owners to discuss the situation of flooding
in Section 9 & 10 of Blowers Township. The property owners would be willing to clean out Ditch
No. 17 in Section 10 at their own expense. Motion by Nelson, second by Froemming, and
unanimously carried to authorize Property Owners, David Siltala, Dick Siltala, and Wayne Putikka,
to clean out Ditch No. 17 in Section 10 of Blowers Township at their expense.
Ditch No. 19
Mr. Wasvick reported that he found information to support the fact that Ditch No. 19 flows all the
way to South Maple Lake as described by several gentlemen at the recent public hearing. Ditch
No. 19 does not end at private Ditch No. 9 as previously stated.
Certification of Wetland Easements
Motion by Froemming, second by Lee, and unanimously carried to certify the following wetland
easement acquisitions by the U. S. Fish and Wildlife Service for purposes of waterfowl

Lake Improvement District -Discussion Q
Tim and David Moenkedick, property owners on Little McDonald Lake, presented several handouts
and expressed opposition to lowering the lake levels of Devils, McDonalds, and Paul Lakes as was
described by Houston Engineering and the proposed Lake Improvement District. They expressed
concern for the environment and the actual cost to lower the lake levels. If the Lake Improvement
District is formed, David Moenkedick expressed a desire to be appointed to the Board of Directors
because of the large amount of land owned by his family.
Bid Award -Asbestos Removal at the RTC
After previously advertising for bids, Physical Plant Manager, Rick Sytsma, opened the following
bids for asbestos removal at the Regional Treatment Center building:

Architect, David Shultz, explained that the base bid would require less containment and the heat
pipes would be removed at the same time. That is an advantage if construction starts late
summer. The alternate plan provides the option to maintain heat if the construction process does
not start this summer. Mr. Sytsma recommended award of project to the low bidder. The low
bidder is prepared to begin the project April 18, 2002, and anticipates completion in one month.
Discussion followed. Motion by Lee, second by Block, and unanimously carried to award the
asbestos removal project to the low bidder, in the amount of $85,222 if the base plan is used, and
an additional $8,600 if alternate plan is used. The plan used will be a decision of the RTC
Remodeling Committee.
Motion by Block, second by Lee, and unanimously carried to authorize the Chair's signature to
execute a contract between the County of Otter Tail and Legend Technical Services, Inc. to
provide oversight and required documentation during the asbestos removal project at the RTC.
The estimated cost of these professional services is $8,800 based on an established cost of $550
per day and estimated completion of four weeks.
Public Meeting -Proposed Burkel Turkey Farms, Inc.
At 11:50 a.m., Chairman Mosher called the Public Meeting to order for the pending issuance of a
State of Minnesota General Livestock Production Permit for Burkel Turkey Farms, Inc. pursuant to
Minnesota Statute §116.07, Subd. 7. Burkel Turkey Farms, Inc. proposed location is the SW¼ of
the NE¼ of Section 35 in Edna Township, Otter Tail County. Jeffrey D. Pederson, Attorney
representing Burkel Turkey Farms, was present. With no one from the general public present, Q
Chairman Mosher closed the Public Meeting. . · ·

At 11 :55 a.m., Chairman Mosher recessed the meeting of the Otter Tail County Board of
Commissioners for lunch break and a committee meeting. The meeting was reconvened at
1:20 p.m.
Annual Boat and Water Safety Grant Contract & Supplemental Agreement
Motion by Nelson, second by Froemming, and carried, with Lee opposed because of the reduced
funding from the previous year, to authorize the Chair's signature to execute the Annual County
Boat and Water Safety Grant Contract, in the amount of $44,512 for CY2002.
Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chair's
signature to execute the CY2002 Supplemental Grant Contract between the State of Minnesota
and the County of Otter Tail, in the amount of $5,000 (federal funding), for additional evening water
patrols.
Credit Card Application
Payment Approval
Motion by Nelson, second by Froemming, and unanimously carried to approve the following
request for an Otter Tail County credit card:

Motion by Lee, second by Block, and unanimously carried to approve payment to Else Malbraaten,
in the amount of $500.00, for services provided under the provisions of Minnesota Statute 609.35.
Closed to the Public
Adjournment
At 1 :45 p.m., Chair Mosher declared the meeting of the Otter Tail County Board of Commissioners
closed to the public for purposes of discussing labor negotiation strategies relative to the County's
three Human Services collective bargaining units. Commissioners Nelson, Lee, Mosher,
Froemming, and Block were present along with the County Attorney, County Coordinator, and
Recording Secretary. At 2:47 p.m., upon conclusion of the closed session, Chair Mosher declared
the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on
Tuesday, April 16, 2002.
