HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/05/20020 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, March 5, 2002 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 5, 2002, at 9:30 a.m. at the Otter Tail County Courthouse with Dennis Mosher, Chair; Malcolm Lee, Vice- Chair; Syd Nelson, Roger Froemming, and Bob Block present. Approval of Agenda Motion by Lee, second by Froemming, and unanimously carried to approve the County Board agenda of March 5, 2002, as presented. Approval of Minutes Motion by Nelson, second by Block, and unanimously carried to approve the County Board minutes of February 26, 2002, as mailed. · Approval to Pay Bills Motion by Froemming, second by Lee, and unanimously carried to approve payment of County Board bills per Attachment A of these minutes which includes the following lodging payments: Best Western Kelly Inn Land Title Specialist, Nancy Den Boer Vital Stats Deputy, Kristie Partain "Years of Service" Certificate Presentation Lanette Preim, Employees' Committee Chairperson, introduced other Employee Committee members. The committee members presented "Years of Service" certificates to employees with five to forty-five years of employment with Otter Tail County. Commissioners expressed appreciation for their dedication. Recess & Reconvene At 9:45 a.m., Chair Mosher declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 9:50 a.m. CriMNet System Report Detention Administrator, Gary Waskosky, presented the CriMNet System. CriMNet was established to improve the ability to share information. A process was developed where information is shared throughout the state with Law Enforcement, Public Defenders, Prosecutors, Probation, and the State Criminal Justice Agencies. The CriMNet System includes the following: • Livescan is the electronic finger print machine, which goes to the State electronically. • Photo Imaging, MRAP, (MN Registry of Arrest Photos), offers consistent photos from around the State. 0 • Network upgrade, Criminal Justice Data Network (CJDN) is the State lines coming into the law enforcement facility. • Court Information System (MNCIS) ties the court into this one general area. OTCo. Board of Commissioners' Minutes March 5, 2002 Page2 • • Statewide Supervision System (SSS) is where Probation enters their information on their Q people. When a name is entered it will give information such as who their probation agent is and the rules pertaining to their probation. • Predatory Offender Registration System, (POR), ties all the systems into one. • The Suspense File is where the Court enters the actual charges on an individual. The goal is for all information to become available for each of the different agencies. Request for Approval of Contracts Solid Waste Director, Mike Hanan, presented contracts for mobile household hazard waste collection. Motion by Lee, second by Froemming, and unanimously carried to authorize the Chair's signature to execute the following contracts: Contract agreement between Otter Tail County and the City of Battle Lake for the operation of a Mobile Collection for Household Hazardous Waste on August 27, 2002, at the Otter Tail County Highway Garage, Battle Lake, between the hours of 10 a.m. and 2 p.m. And Contract agreement between Otter Tail County and the City of Deer Creek for the operation of a Mobile Collection for Household Hazardous Waste on September 17, 2002, at the Deer Creek Fire Hall between the hours of 10 a.m. and 2 p.m. And Contract agreement between Otter Tail County and the City of Henning for the operation of a Mobile Collection for Household Hazardous Waste on July 23, 2002, at the Otter Tail County Highway Garage, Henning, between the hours of 10 a.m. and 2 p.m. And Contract agreement between Otter Tail County and the City of Pelican Rapids for the operation of a Mobile Collection for Household Hazardous Waste on August 7, 2002, at the Otter Tail County Highway Garage, Pelican Rapids, between the hours of 10 a.m. and 2 p.m. And Contract agreement between Otter Tail County and the City of Underwood for the operation of a Mobile Collection for Household Hazardous Waste on May 7, 2002, at the Underwood Fire Hall between the hours of 1 O a.m. and 2 p.m. Ash Disposal Agreement with Hennepin County 0 Solid Waste Director, Mike Hanan, presented a contract with Hennepin County for Ash Disposal. After discussion, Commissioners decided not to enter into the contract. Motion by Lee, second by Nelson, and unanimously carried to not enter into an agreement with Hennepin County for Ash n Disposal. Vii/I/ 0 0 OTCo. Perham, MN 56573 Jodie Rae Collins Collins Landing 31334 Stage Coach Dr. Dent, MN 56528 Renewal of Consumption & Display Permit Renewal for Consumption & Display Permit Tobacco Discussion -Sunday Liquor Hours Spare Time Bar & Grill has requested consideration by the County Board for extended Sunday liquor sales. The statute reads that liquor can be served at noon on Sundays; however, there is a provision that allows that after a hearing by a municipality this time could be changed by an ordinance to 10:00 a.m. The township would need to give notice of the hearing. Motion by Froemming, second by Lee, and unanimously carried to deny the request for consideration for extended liquor sales. Request for Payment Doug Holen, Extension Educator, received a scholarship to attend the Alfalfa Intensive Training Seminar scheduled for March 12-14, 2002. Half of the registration fee must be submitted by March 8, 2002. Motion by Block, second by Mosher, and unanimously carried to pay half of the registration fee for the Alfalfa Intensive Training Seminar in the amount of $250, which will be reimbursed by the University of Minnesota. Request for Approval -Photogrammetric Mapping Motion by Lee, second by Nelson, and unanimously carried to authorize the Highway Engineer to enter into an agreement between the Otter Tail County Highway Department and MARKHURD for Photogrammetric Mapping services for CSAH 74 Reconstruction project, in the amount of $12,000. Request for Approval -Final Payment for 2000 Seal Coat Project Motion by Nelson, second by Froemming, and unanimously carried to approve final payment per estimate No. 6 in the amount of $32,044.67, payable to ASTECH Corporation for completion of 2000 Seal Coat Project. ·· Request for Approval of Final Payment Motion by Lee, second by Block, and unanimously carried to approve final payment per estimate No. 3 in the amount of $9,861.56, payable to Traffic Marking Services, Inc. for completion. of County Wide -Traffic Marking. Board of Commissioners' Minutes March 5, 2002 Page 4 Request for Approval of Final Payment 0 Motion by Nelson, second by Froemming, and unanimously carried to approve final payment per estimate No. 4 in the amount of $4,598.64, payable to Landwehr Construction, Inc. for completion of Box Culverts, Grading, and Aggregate Surfacing (S.A.P. 56-599-47 & 56-599-48). Recessed Closed to the Public At 10:55 a.m., Chair Mosher declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting reconvened at 11 :00 a.m. Chair Mosher closed the meeting to the public for purposes of discussing labor negotiation strategies relative to the Human Services Professional and Support Specialist collective bargaining units. All sealed Commissioners were present along with the County Coordinator, County Attorney, Human Services Director, Public Health Director, and Recording Secretary. At 12:10 p.m., Chair Mosher declared the closed meeting recessed for lunch. The meeting of the Otter Tail County Board of Commissioners was reconvened at 1 :05 p.m. Discussion -Norway Lake High Water Levels Ag/Ditch Inspector, Randy Wasvick, and property owner Doug Green, reported that Norway Lake is roughly two feet over high water mark. Mr. Green is losing land and his driveway is almost under water. He has built the driveway up twice. The township road has been built up twice and washes out easily. The township has received money from FEMA for road repair. At the present time, Norway Lake is backed up into a slough, then a township road, then another slough, and then Nelson Lake. This is now one body of water. Norway Lake has come up six feet in the last 0 6-7 years, there is no outlet. To correct the problem, a lateral would have to be created to either Ditch No. 21 or a lateral to Ditch No. 37. The most economic route would be to create a lateral to Ditch No. 21. The next step would be to start the petition process to join the ditch system to formally come before the Board. The County Attorney stated that two things are needed. First an entity is needed to have a ditch system to use the other ditch as an outlet. The next step is to find out how many would benefit. Twenty-six percent of the landowners would need to want the lateral to Ditch No. 21, or twenty-six percent of the land would need to benefit for the petition process. Another petition is needed for an outlet, and then a public hearing would have to be set up. Ditch No. 19 A hearing date was scheduled for Wednesday, April 3, 2002, at 7:00 p.m. at the City Hall 1n Parkers Prairie for Ditch No. 19. Ditch Viewers Appointed Motion by Nelson, second by Froemming, and unanimously carried to appoint Richard Carlund and Elder Kugler as Ditch Viewers contingent upon their certification. Recommendation Physical Plant Manager, Rick Sytsma, reported that the asbestos survey of the RTC has been completed. The estimated abatement cost was estimated at $128,000. The architect made a recommendation to write a bid spec and advertise for bids. Motion by Lee, second by Block, and unanimously carried to authorize the Physical Plant Manager to contact Legend Technical Services to develop bid spec and advertise for bids. 0 0 0 OTCo. Board of Commissioners' Minutes March 5, 2002 Pages RTC Coalition Members Appointed Motion by Lee, second by Block, and unanimously carried to appoint Mark Morris, John Dinsmore, and David Hauser to serve on the Regional Treatment Center Coalition committee. Contract Renewal Motion by Lee, secon_d by Block-,·and unanimously carried to renew a .contract with Maximus for ongoing maintenance and job descriptions as needed. The cost is $160 per reclassification and $120 per new job description. Tax Court Settlements Motion by Lee, second by Froemming, and unanimously carried to approve the tax court settlements of Colonial Village Investments and Broadway Apartments. Quit Claim Deed Motion by Lee, second by Mosher, and unanimously carried to authorize the Chair's signature to execute a Quit Claim Deed to joint tenants, Robert J. Lee and Norma C. Lee, partial release of Highway Easement for CSAH No. 16 located in Government Lot 1 of Section 25-T133N-R40W. The property is described as follows: That part of Government Lot One (1), Section Twenty-five (25), Township One Hundred Thirty-three (133), Range Forty (40), Otter Tail County, Minnesota, lying north of the following described line: Commencing at the northeast corner of said Government Lot 1; thence on an assumed bearing of South, along the east line of said Government Lot 1, a distance of 822.46 feet; thence North 77 degrees 59 minutes 14 seconds West a distance of 414.39 feet; thence North 4 degrees 28 minutes 54 seconds East a distance of 610.24 feet to the point of beginning of the line to be described; thence easterly on a non-tangential curve concave to the north, having a radius of 1381.81 feet and a delta angle of 11 degrees 32 minutes 47 seconds, and a chord bearing of North 85 degrees 6 minutes 7 seconds East, for an arc distance of 278.47 feet; thence North 79 degrees 20 minutes 20 seconds East a distance of 82.07 feet to said east line of Government Lot 1 and there terminating.
