Call to Order
The Otter Tail County Human Services Board convened Tuesday, November 27, 2001, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Dennis Mosher, Chair;
Bob Block, Vice-Chair; Syd Nelson and Roger Froemming present. Commissioner Malcolm Lee
was absent.
Approval of Agenda
Motion by Froemming, second by Nelson, and unanimously carried to approve the Human
Services Board agenda of November 27, 2001, as mailed.
Approval of Minutes
Motion by Froemming, second by Nelson, and unanimously carried to approve the Human
Services Board minutes of November 13, 2001, as mailed.
Court Services Caseload Statistics
Court Services Director, Chuck Kitzman, provided monthly adult and juvenile offender caseload
statistics. Mr. Kitzman expressed concern with higher caseloads during October, 2001.
Lake Region Halfway Homes Contract
Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chair's
signature to execute a Consolidated Chemical Dependency Treatment Purchase of Service and
Host County Contract between the Otter Tail County Department of Social Services and Lake
Region Halfway Homes, Inc., for the period of January 1, 2002 through December 31, 2002, with a
3% per diem increase to $59.43 ($46.43 for program per diem and $13.00 Room & Board per
diem).
Affirmative Action Plan
Motion by Mosher, second by Block, and unanimously carried to adopt the Minnesota Merit System
plan guidelines as the Human Service Agency's Equal Opportunity/Affirmative Action Plan which
establishes minimum standards to recruit under the Merit System. Further, the motion requires
approval, by the County Board, of a recommendation for Guideline Requirement No. D of the Otter
Tail County Human Services Equal Opportunity Affirmative Action Guidelines dated November 27,
2001.
Approval of Bills & Claims
Motion by Froemming, second by Nelson, and unanimously carried to approve the Human
Services bills and claims as presented.

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, November 27, 2001, at
10:59 a.m. at the Otter Tail County Courthouse with Roger Froemming, Chair; Dennis Mosher,
Vice-Chair; Syd Nelson, Malcolm Lee, and Bob Block present.
Approval of Agenda
Motion by Lee, second by Mosher, and unanimously carried to approve the County Board agenda
of November 27, 2001 with the following additions:
Request for Approval of Final Plats
11 :45 a.m. -Ditch Inspector -County Ditch System No. 4
Approval of Minutes
Motion by Lee, second by Nelson, and unanimously carried to approve the County Board minutes
of November 20, 2001 as mailed.
Approval to Pay Bills
Motion by Mosher, second by Nelson, and unanimously carried to approve payment of County
Board bills per Attachment A of these minutes which include lodging payments as follows:
Comfort Inn Communications Officer, Matthew Jensen
Best Western Maplewood Inn Deputy, Scott Koennicke
Four Points Sheraton Sheriff. Gary Nelson
Planning Commission Recommendations
Preliminary Plat -Huddleston Addition to Loon Lake/Harry Huddleston:
Motion by Lee, second by Mosher, and unanimously carried to approve the Preliminary Plat known
as "Huddleston Addition to Loon Lake" consisting of 3 single family residential lots with conditions
as recommended by the Planning Commission. The property is described as Part of Sublet A of
Gov. Lots 3 & 4, Section 35, Candor Township; Loon Lake (56-523).
Preliminary Plat -Wegscheid Addition to Paul Lake/Stephen Wegscheid & Rev. Wegscheid:
Motion by Nelson, second by Lee, and unanimously carried to approve the Preliminary Plat known
as "Wegscheid Addition to Paul Lake" consisting of 2 single family residential lots as presented.
The property is described as Lots 4, 5, 6, & 7 of Gulliver's Travels, Section 10 of Edna Township;
Paul Lake (56-335).
Conditional Use Permit -Hidden Haven/Earl & Linda Foss:

Permit for No. 1 & 2 on the Conditional Use Application subject to the conditions as recommended """"11
by the Planning Commission and the required variance and to deny request No. 3 on the
Conditional Use Application. The property is described as Sublet 5 & 6, GL's 3 &4 in Section 23 of
Rush Lake Township; Rush Lake (56-141).

Conditional Use Permit -Bruce & Elsie Braaten:

Land & Resource Director, Bill Kalar, explained that this request failed on a 4-4 vote and the
Planning Commission offered no alternative motion. Bruce Braaten stated that the SWCD Tech
·Board, DNR, and Army Corps of Engineers have approved filling the area. He stated that this is
the only access to the lake and there will be no impact to the environment. Mr. Kalar noted that
this is an after the fact permit request. This is a wetland and a ditch plug has been put in and is
being monitored by the SWCD so the slough is not draining. Motion by Lee, second by Nelson, to
approve a Conditional Use Permit to fill a maximum of 100 yards (80 new) provided none of the fill
goes into the existing wetland and that, at the discretion of the Land & Resource Management
Office, a culvert is installed. Motion carried 4 -1. The property is described as Pt. of Gov. Lot 1
(tracts X & Y) in section 23 of Dora Township; Hoffman Lake (56-1627).
Jay Maki expressed opposition to the Braaten CUP request and referred to a letter sent to the
County Board. County Attorney, David Hauser, read the letter from Lorna Jacobson, a neighbor to
the Braatens. The letter also expressed opposition to the Braaten CUP request.
Conditional Use Permit -Eagle Lake Township:
Motion by Mosher, second by Block, and unanimously carried to approve a Conditional Use Permit
for an after the fact permit to raise the grade of a township road (140th St.) with conditions as
·recommended by the Planning Commission. The project is located on 140th St. along the south Q side of Hancock Lake in Section 13 of Eagle Lake Township; Hancock Lake (56-255).

Conditional Use Permit -Graystone on Otter Tail, Inc.:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional Use
Permit to expand/remodel with conditions as recommended by the Planning Commission. The
property is described as Lots 14 & 15, Blk 4 of Bonita Beach, Bonita Beach Rearr Res 1-2-3, Lot A
Blk 3 and Lot 1 Blk 1, Round Lake Beach First Addition (unrecorded plat), Section 5, Everts
Township; Otter Tail Lake (56-242).
Conditional Use Permit -David Stock:
Motion by Mosher, second by Lee, and unanimously carried to approve an after the fact
Conditional Use Permit to install tile as presented. The property is described as SE¼ & E½SW¼
in Section 12 of Western Township; Faunce Lake (56-954), NE & Unnamed Tributary (56-TR).
Final Plats
Haugen's Point First Addition:
Motion by Lee, second by Nelson, and unanimously carried to approve the final plat of Christine H.
Malmstrom, trustee of Douglas C. Haugen Family Trust, known as "Haugen's Point First Addition"
located on Gov. Lots 2 & 3 of Section 17, Township 137N, Range 42W, Dunn Township, Bass
Lake.
Pleasant Grove First Addition:
Motion by Froemming, second by Mosher, and unanimously carried to approve the Final Plat of
Beverly Enterprises known as "Pleasant Grove First Addition" located on Gov. Lot 1, Section 32,
Township 134N, Range 40W, Amor Township.

County Ditch System No. 4
County Ditch System No. 18
Ditch Inspector, Randy Wasvick, briefed the Board on the County Ditch System No. 4 project.
Motion by Mosher, second by Lee, and unanimously carried to authorize Landowners, Kevin
Froemming, Angela Berge, and John Leitch to install 8 inch tile along side the existing tile and
remove the old tile in Ditch System No. 18. The cost of the project is to be paid by the landowners
with no expense to the County.
Tax Appeal Settlements
Motion by Nelson, second by Lee, and unanimously carried to authorize the Chair's signature to
execute the Stipulation for Tax Appeal Agreement between the County of Otter Tail and Curtis L. &
Dora Nyman.
Motion by Block, second by Mosher, and unanimously carried to authorize the Chair's signature to
execute the Stipulation for Tax Appeal Agreement between the County of Otter Tail and Broadway
Apartments in Fergus Falls.
Agreement for Transfer of Regional Treatment Center Building
Motion by Lee, second by Mosher, and unanimously carried to authorize the Chair's signature to
execute a Joint Powers Agreement for the Transfer of Land and Buildings from the State of
Minnesota to the County of Otter Tail. Q
Flexible Spending Account Provider for CY2002
Motion by Froemming, second by Lee, and unanimously carried to approve MIi Life Incorporated
as the provider of the County's Section 125 Flexible Spending Account through MIi's
SelectAccount at an administrative fee of $2,500 and an on-going administration fee of $2.45 per
participant per month.
Recess & Reconvene
At noon, Chair Froemming declared the meeting of the Otter Tail County Board of Commissioners
recessed for lunch break. The meeting was reconvened at 1 :04 p.m. with Commissioners
Froemming, Lee, Mosher, and Block present. Commissioner Syd Nelson was absent.
Extension Update
Extension Educator, Steve Handegaard, updated the Board on the 4-H Leadership Program, 4-H
Awards and Recognition Program, and upcoming plans to staff Extension activities differently on a
state level.
Ash Disposal Agreements
Motion by Froemming, second by Mosher, and unanimously carried to authorize the Chair's
signature to execute two Ash Disposal Agreements between the County of Otter Tail, County of
Wadena and City of Perham and the County of Otter Tail, County of Todd, and City of Perham
whereby the County of Otter Tail will provide ash residue disposal. The users will reimburse all
costs including financial assurance costs required by the Minnesota Pollution Control Agency. Q

Parking Lease Agreement

Motion by Froemming, second by Lee, and unanimously carried to authorize renting additional
parking spaces from the First Lutheran Church for a total of 54 parking spaces at $19.50 per space
per month effective January 1, 2002.

At 1 :51 p.m., Chair Froemming declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, December 11, 2001.
