MINUTES OF THE
OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Human Services Board convened Tuesday, November 13, 2001, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Dennis Mosher, Chair;
Bob Block, Vice-Chair; Syd Nelson, Malcolm Lee, and Roger Froemming present.
Approval of Agenda
Motion by Lee, second by Froemming, and unanimously carried to approve the Human Services
Board agenda of November 13, 2001, as mailed.
Approval of Minutes
Motion by Nelson, second by Lee, and unanimously carried to approve the Human Services Board
minutes of October 23, 2001, as mailed.
West Central Regional Juvenile Center
Court Services Director, Chuck Kitzman, introduced WCRJC Director, Barry Steen, and
Shelter Care Program Director, John Farnberg. Mr. Steen offered a background of the facility and
programs and addressed the current financial deficit. He provided a handout which detailed the
reasons the center is experiencing a financial deficit and possible solutions to the financial issues.
A WCRJC pamphlet was distributed advertising the center's programs and a map showing their
service area. Commissioners urged Mr. Steen to research how their loan was structured and
explore refinancing their current debt. The WCRJC is considering a Chemical Dependency
Program located in the center through an outpatient agency called First Step. This is a 30-90 day
program with a potential for state consolidated funding. Mr. Kitzman reported that Otter Tail
County is eligible to receive a grant of $12,089 under the federal Juvenile Accountability Incentive
Block Grant (JAIBG). Motion by Nelson, second by Lee, and unanimously carried to notify the
Minnesota Department of Economic Security that Otter Tail County will not apply for available
JAIBG funding for CY2002 and request that the funding be made available to the West Central
Regional Juvenile Center.
Children's Justice Act Grant Award
Motion by Lee, second by Froemming, and unanimously carried to approve a Children's Justice
Act (CJA) grant, in the amount of $3,500, from the Minnesota Department of Human Services to be
used to begin a pre-trial mediation program to help alleviate workload in the court system. The
grant does not require a County match and the funds are available to reimburse expenditures
incurred from September 1, 2001, through September 30, 2002.
Declaration of Adoption Month -November, 2001
Otter Tail County Resolution No. 2001 -58
Commissioner Block introduced the following resolution and moved its adoption:
WHEREAS, the family, serving as the primary source of love, identity, self-esteem, and support, is
the very foundation of our communities, our state, and our country.

WHEREAS, adoption gives children who have been orphaned, abandoned, or abused a precious Q
second chance at happiness; a chance to love and be loved and to reach their full potential in a
secure, supportive environment.
WHEREAS, in 1998, there was an average of 957 children available for adoption, on any given
day, in the State of Minnesota.
WHEREAS, in 2001, there is an average of 673 children available for adoption, on any given day,
in the State of Minnesota.
WHERES, the majority of the families seeking children for adoption or pursuing the adoption of
younger children and the majority of the children available for adoption are 6-12 years of age.
WHEREAS, there is a continued need for an increased number of families in the State of
Minnesota and in Otter Tail County who will adopt older children with special needs.
WHEREAS, both the public and private sectors are working together as a "team" to find adoptive
homes for the children throughout the counties and the State of Minnesota.
NOW, THEREFORE, we, the Otter Tail County Human Services Board, by virtue of the authority
vested in us as County Commissioners of Otter Tail County, do hereby proclaim November as
ADOPTION MONTH in Otter Tail County and urge all citizens to volunteer their talents and
energies on behalf of children in adoptive placements, the adoptive parents, and the professional
staff working with them during this month and throughout the year.
Commissioner Froemming seconded the motion, and upon being put to vote, was unanimously
carried.

Approval of Contract Renewals
Motion by Nelson, second by Block, and unanimously carried to authorize the Chair's signature to
execute an agreement between PILL-ALERT-distributor of compumed automated medication
dispenser and Otter Tail County Human Services for CY2002. The agreement provides this
medical supply for clients who are determined eligible for AC/EW/CADI/TBI or CAC/MRRC waiver
by the county.

execute a Purchase of Service Agreement between the Otter Tail County Department of Social
Services and Perham Memorial Home Care for the period from July 1, 2001, through June 30,
2002, for home health care related services.

Case Aide Position

Motion by Mosher, second by Lee, and unanimously carried to authorize the Human Services
Director to proceed with submitting a new Case Aide job description to MAXIMUS. This position
was budgeted in CY2001.
Safety Net Redesign Update
Human Services Director, John Dinsmore, provided a letter from the Co-Chairs of the Safety Net
Redesign Committee. This committee includes participation of 17 counties, Regional Treatment
Center officials, and Department of Human Services officials. The committee is researching how
chemical dependency services are being delivered and if campus based services staffed by state
employees could be delivered in other location(s). The committee will meet December 10, 2001, at
9:30 a.m. at the Shooting Star Casino in Mahnomen. State and local officials have been invited to
participate. The intent for this meeting will be for the DHS to draft language regarding delivery of
CD services for legislative consideration. Discussion followed regarding the RTC Reuse
Committee and the City of Fergus Fall's request that the county provides some funding to research
uses for the RTC buildings. Motion by Block, second by Lee, and unanimously carried to
appropriate $2,000 from the Human Services budget to research continued uses of the RTC
facilities including the possibility of continuing to provide Human Service and Mental Health
services/programs at the RTC campus.
Home Visiting
Youth Risk Behavior Application
Public Health Director, Diane Thorson, acknowledged notification of funding to be received, in the
amount of $49,627, for CY2002 for family home visiting targeted for individuals at or below 200%
of poverty, teen parents, and families to age 21.
Ms. Thorson reported that $70,400 will be received by Otter Tail County for CY2002 for youth risk
behavior. This funding is from the tobacco settlement and requires two plans; 1) related to
reducing alcohol usage by teenagers, and 2) teen pregnancy prevention.
Approval of Agreement for Public Health Director
Ms. Thorson explained to the County Board that the new personnel rules do not apply to
Department Heads and presented an employment agreement between the County of Otter Tail
and Diane Thorson. Motion by Nelson, second by Lee, and unanimously carried to re-appoint
Public Health Director/CHS Administrator, Diane Thorson, per the agreement_ presented on
November 13, 2001, with the following change: "This contract shall remain in effect until
September 30, 2002."
Approval of Bills & Claims
Motion by Nelson, second by Froemming, and unanimously carried to approve the Human
Services bills and claims as presented.
Appointment to the Lakeland Mental Health Center Board
Motion by Froemming, second by Nelson, and unanimously carried to appoint Ellen Palmer of
Parkers Prairie to the LMHC Board to replace the term of Laurel Nelson.

At 11 :12 a.m., Chair Mosher declared the meeting of the Otter Tail County Human Services Board

11 :18 a.m. at the Otter Tail County Courthouse with Roger Froemming, Chair; Dennis Mosher,
Vice-Chair; Syd Nelson, Malcolm Lee, and Bob Block present.
Approval of Agenda
Motion by Lee, second by Block, and unanimously carried to approve the County Board agenda of
November 13, 2001 with the following addition:

Motion by Lee, second by Nelson, and unanimously carried to approve the County Board minutes
of November 6, 2001 as mailed.

Law Enforcement Retirement Plaque
Deputy, Al Frank, spoke on behalf of the Otter Tail County Peace Officers Association. One goal
for the association is to complete the retired officers' plaque and display the plaque in the lobby of
the courthouse. Motion by Mosher, second by Froemming, and unanimously carried to authorize
the Peace Officers' Association to display the retired law enforcement officers' plaque in the
courthouse and to work with Physical Plant Manager, Rick Sytsma, relative to location.
Certification of Wetland Easements
Motion by Lee, second by Mosher, and unanimously carried to certify acquisition of land by the
U.S. Fish and Wildlife Service for a waterfowl easement as follows:

Agriculture Update

Extension Educator, Doug Holen, reported on a recent meeting in Albany where discussion with
other counties and industry representatives took place regarding the concept of Ag Friendly
Counties. He presented a news release from the MN Department of Agriculture inviting farmers
and rural leaders to Wilmar November 21 st to continue discussion on stimulating the rural
economy.
Snowmobile Safety Enforcement Grant Agreement
Motion by Mosher, second by Froemming, and unanimously carried to authorize the Chair's
signature to execute a snowmobile safety enforcement grant agreement between the State of
Minnesota DNR and the County of Otter Tail for the period of July 1, 2001 through June 30, 2002,
with a total compensation from the state of $6,151.09.
Recess & Reconvene
At 11 :56 a.m., Chair Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. Chair Froemming reconvened the meeting at 1 :00 p.m.
with all commissioners present.
Veterans Service Office Update
Veterans Service Officer, Jourdan Sullivan, briefed the Board on staff activities. There are
currently 216 pending actions. He expressed concern for the continuity of the clinic currently
located at the Veterans Home. Mr. Sullivan and Mayor Kelly Ferber will be working to keep this
clinic in its current location.
Ditch System Discussion
Ditch System No. 19:
Ditch Inspector, Randy Wasvick, began discussion regarding Ditch No. 19. He stated that the
Department of Natural Resources (DNR) checked the OHWL of Horsehead Lake and determined
that the lake is 1½ ft. over the OHWL. Therefore, a culvert could be put in to lower Horsehead
Lake 1½ ft. A culvert under C.R. 138 would need to be cleaned out and a culvert installed in a
driveway on the property of Marcus Jankowski with Parkers Prairie Township (road authority)
paying for the cost of installing the culverts. DNR Hydrologist, Terry Lejcher, suggested using
sandbags to regulate the flow of water. County Attorney, David Hauser, stated that a petition to
enter the ditch system, a public hearing, and a determination of benefits for the properties entering
the ditch system would be necessary. Mr. Wasvick will meet with the Town Board to discuss the
situation and potential liabilities.
Ditch System No. 37:
On behalf of Vernon Johansen, Mr. Wasvick requested authorization to unplug and re-tile, if
necessary, an area on his property in Ditch System No. 37 at his own cost. The County Board
agreed by consensus.
Ditch System No. 4:
Moench Excavating has submitted an invoice for $12,500 for work completed from the starting
point east of Highway 29 to the Sao Line Railroad west of Highway 29. Motion by Froemming,
second by Mosher, and unanimously carried to approve a partial payment to Moench Excavating,
in the amount of $11,250, (10% retainage) for services on County Drainage System No. 4.

Commissioner Nelson introduced the following resolution and moved its adoption:
WHEREAS, the Commissioner of Natural Resources of the State of Minnesota, has made
application under authority of Minn. Stat. §282.01, subd. 1, on behalf of the Department of Natural
Resources, a state agency, for release of the following described lands from the trust in favor of
the taxing district:

The North Half of the Southwest Quarter (N½SW¼) of Section
Eleven (11), Township One Hundred and Thirty-seven (137) North,
Range Thirty-eight (38) West.
WHEREAS, it appears that there is need for such lands and the applicant desires
to obtain such lands for conservation purposes:
NOW, THEREFORE, BE IT RESOLVED, that the petition of said Commissioner of Natural
Resources of the State of Minnesota, be granted and that the above described lands be and
hereby are released from the trust in favor of the taxing district to the State of Minnesota,
Department of Natural Resources.

WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;
and

WHEREAS, the Dent Lions Club, Dent, MN, has made an application to the Gambling Control
Board for a premise permit to conduct lawful gambling at the Cozy Cove Resort, in Dead Lake
Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a
premise permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the
conduct of lawful gambling by the Dent Lions Club, Dent, MN, at the Cozy Cove Resort, in Dead
Lake Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at Cozy Cove
Resort, in Dead Lake Township of Otter Tail County, provided the applicant meets all the
necessary criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the
Township of Dead Lake by sending them a copy of this resolution.
Commissioner Mosher seconded the motion, and upon being put to vote, was unanimously
carried.

Approval of Final Payment -Snowplow Dump Trucks
Motion by Lee, second by Block, and unanimously carried to approve final payment, in the amount

snowplow dump trucks.
Probationary Period
Motion by Lee, second by Froemming, and unanimously carried to authorize the probationary
period of Assistant County Attorney, Devin Nice, to 6 months rather than one year as the 6 month
probationary period is standard in the Personnel Rules.

At 2:20 p.m., Chair Froemming declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, November 20, 2001.
