MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, October 2, 2001 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, October 2, 2001, at 9:31 a.m. at the Otter Tail County Courthouse with Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Syd Nelson, Malcolm Lee, and Bob Block present. Approval of Agenda Motion by Nelson, second by Lee, to approve the County Board agenda of October 2, 2001, with the following changes: Request for correction -9/18/01 Minutes Request for Approval of COPS in School Grant Request for Approval of E911 Contract Addendum Auditor Wayne Stein -Agenda Item Canceled Request for Approval of Parcel Mapping Contract Motion carried unanimously. Correction of Minutes -September 18, 2001 Motion by Lee, second by Block, and unanimously carried to approve the following correction to the September 18, 2001, County Board minutes: (Add the Italic data) Motion by Lee, second by Mosher, and unanimously carried to approve the Preliminary Plat known as "Kansas Point Passage" consisting of 5 lots (4 single family residential lots & 1 non-residential backlot) with conditions as recommended by the Planning Commission. Approval of Lake Improvement District Minutes Motion by Mosher, second by Lee, and unanimously carried to approve the September 19, 2001, Special Meeting minutes for the South Turtle Lake Improvement District public hearing. Military Leave Benefit Request Chief Deputy, Mark Morris, and Highway Engineer, Rick West, presented a handout and requested continued health insurance for employees called to active duty during a time of war. Discussion followed. County Attorney, David Hauser, referred to state statute and noted that the County is required to pay for wages and benefits for 15 days. Beyond that time, the County has no authority to pay for benefits; however, employees on a military leave may continue benefits for 18 months at their own expense under the federal COBRA law. All benefits are reinstated at the conclusion of military leave time. COPS in Schools Grant Award Motion by Mosher, second by Froemming, and unanimously carried to authorize the Sheriff to proceed with the COPS in Schools Grant for $125,000 to be awarded for a three year period with the fourth year being the responsibility of the County and to authorize the appropriate County officials' to sign the award documents. The motion also authorized the Sheriff's Department to proceed with hiring for a police officer. OTC Board of Commissioners' Minutes October 2, 2001 Page 2 -\ Amendment to 911 Agreement 0 Motion by Lee, second by Mosher, and unanimously carried to authorize the Chair's signature to · execute the second amendment to the 911 agreement between the County of Otter Tail and Park Region Mutual Telephone Company. Approval of Minutes Motion by Nelson, second by Mosher, and unanimously carried to approve the September 25, 2001, County Board minutes as presented. Approval to Pay Bills Motion by Mosher, second by Block, and unanimously carried to approve payment of County Board bills per Attachment A of these minutes which include the following lodging payments: Best Western Maplewood Inn Deputy Sheriff, Scott Koennicke Holiday Inn Office Manager, Jane Baumgartner Snowmobile Trails Agreements Motion by Lee, second by Nelson, and unanimously carried to authorize the Chair's signature to execute the following snowmobile maintenance agreements with the State of Minnesota Department of Natural Resources and the following trail associations for FY2002: Otter Trail Riders Trail Association $32,797.00 Otter Country Trail Association (O.C.T.A.) $27,816.00 Lake Runners Trail Association $18,434.00 Recess & Reconvene At 10:00 a.m., Chair Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for a Building Committee meeting. The meeting was reconvened at 10:45 a.m. Amendments to 2001 Provider Contracts Motion by Lee, second by Block, and unanimously carried to approve a cost of living increase (3% or 3½%) as mandated by the Minnesota State Legislature for providers who deliver the following services effective July 1, 2001: Home and Community Based Waivered Services for Home and Community Based Waivered persons with mental retardation or related conditions Services for the elderly Waivered Services under Community Alternatives for Community Alternative Care Waivered disabled individuals Services Traumatic Brain Injury Services Nursing Services and Home Health Services Personal Care Services and Nursing Supervision of Private Duty Nursing Services Personal Care Services Day Training and Habilitation Services for Adults with Alternative Care Services mental retardation and related conditions Adult Residential Program Grants Adult Community Support Grants Semi-independent Living Services 0 Professional Agreement with ProAct Resource Corporation Q Motion by Lee, second by Froemming, and unanimously carried to authorize the Chair's signature to execute an agreement between the County of Otter Tail Human Services Department and 0 0 0 OTC Board of Commissioners' Minutes October 2, 2001 Page 3 ProAct Professional Resource Corporation to facilitate two meetings regarding long term care services in Otter Tail County. Cost of the professional service is $40 per hour and mileage costs. Planning Commission Recommendations Preliminary Plat -"Adair Acres"/Patrick L. & Laurie Thompson: Land & Resource Director, Bill Kalar, stated that Adair Acres is near West Battle Lake and the Planning Commission recommended approval of the plat with six conditions. Chair Froemming opened discussion to the public. Attorney Kris Svingen, representing the developers, reviewed the process since last May wherein the developers addressed concerns regarding the plat. He spoke in favor of the Planning Commission's recommendation and requested that the County Board approve the Commission's recommended action. Attorney Steve Rufer, representing lake property owners on the other side of the road of this development, presented concerns with increased crowding on the road and acceptable factors for 2nd and 3rd lier development. He requested that the County Board consider this before making a decision. Discussion followed. Motion by Froemming, second by Mosher, and unanimously carried to approve the Preliminary Plat known as "Adair Acres" consisting of 13 single family residential lots with conditions as recommended by the Planning Commission. The property is described as Pt of SE1/4 of the NE1/4, Section 31 and Pt of S1/2 of the NW1/4, Section 32 of Girard Township; West Battle Lake (56-239). Conditional Use Permit -Bruce & Nan Carlisle: Motion by Lee, second by Block, and unanimously carried to approve a Conditional Use Permit to contour part of the lot to develop a building pad with conditions as recommended by the Planning Commission. The property is described as Pt GL 6 & Pt NE1/4 NE1/4, Section 10 of Dunn Township; Pelican Lake (56-786) Conditional Use Permit -Ron Buckhouse: Motion by Nelson, second by Mosher, and unanimously carried to approve a Conditional Use Permit to construct a patio and retaining walls with conditions as recommended by the Planning Commission. The property is described as Pine Lake Shores Lot 1 Blk 1, Section 35 of Gorman Township; Little Pine Lake (56-142). Conditional Use Permit -John & Sandy Karvonen: Motion by Nelson, second by Lee, and unanimously carried to approve an After-the-Fact Conditional Use Permit to repair erosion due to high water by means of rip rapping with conditions as recommended by the Planning Commission. The property is described as Lot 7 & Pt Lot 6 Oakland Beach, Section 1 of Perham Township; Little Pine Lake (56-142). Conditional Use Permit -Boosalis Trust: Motion by Lee, second by Mosher, and unanimously carried to permit topographical alteration of the site required for the construction of a home and driveway with conditions as recommended by the Planning Commission. The property is described as Blyberg's Point First Addition, Lot 3 Blk 1, Section 17 of Dunn Township; Fish Lake (56-768). · Conditional Use Permit -Three Season's Lodge: Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use Permit to remove a cabin and build a 2nd residence as presented. This resort will consist of 14 rental units and 2 residences. The property is described as All That Part of GL 2, Section 32 of Amor Township; Otter Tail Lake (56-242). OTC Board of Commissioners' Minutes October 2, 2001 Page 4 Conditional Use Permit -Joe & Carrie Spaude: O Motion by Mosher, second by Nelson, and unanimously carried to approve a Conditional Use Permit to landscape the lot and riprap shoreline with conditions as recommended by the Planning Commission. The property is described as Survey Lots of SL 3 of Sub-Div of GL 1, 2, 3, 4 145' on Lk (called Lot A), Section 14 of Clitherall Township; Clitherall Lake (56-238). Conditional Use Permit -Wil-O-Wood Resort/Timothy & Heide Lambertson: Heide Lambertson of Wil-O-Wood Resort, stated that her resort is on Rush Lake and the original request was for a total of 36 units (RV spots). She stated that the only request approved was the replacement of an old mobile home. If the Planning Commission did not approve all 36 units, she thought they would consider some units. Heidi presented a replacement plan that scaled down the number of requested RV units from 36 to 29. Motion by Nelson, second by Lee, and unanimously carried to send this CUP request back to the Planning Commission. Ms. Lambertson waived the 60-day ruling requirement. RequestforletterofSupport Ron Anderson, resident of Paul Lake, briefed the Board on a grant request through the DNR, for Paul, Little McDonald, and Devil Lakes. The grant would be used to lower the water level in the three lakes basin. He explained the project and requested a letter of support from the County for the project. Motion by Nelson, second by Lee, and unanimously carried to authorize a letter of support from the Otter Tail County Board of Commissioners to support this Lakes Drainage Proposal and encourage the DNR to provide financial assistance for the plan's implementation. Ditch Viewers Per Diem Motion by Nelson, second by Mosher, and unanimously carried to authorize the per diem for Ditch Viewers work at $80 per day effective January 1, 2001. Recess & Reconvene At 11 :43 a.m., Chair Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1 :00 p.m. Agreement for Parcel Mapping Services Motion by Lee, second by Block, and unanimously carried to authorize the Chair's signature to execute an agreement between the County of Otter Tail and Pro-West & Associates, Inc. of Walker, MN, for professional parcel mapping services for two townships in the amount of $18,900. Adjournment At 1 :07 p.m., a motion was offered by Lee and seconded by Block, to adjourn the meeting of the Otter Tail County Board of Commissioners until Tuesday, October 9, 2001. Motion carried.
