HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/07/20010 0 0 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday,August7,2001 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, August 7, 2001, at 9:31 a.m. at the Otter Tail County Courthouse with Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Syd Nelson, Malcolm Lee, and Bob Block present. Approval of Agenda Motion by Block, second by Mosher, to approve the County Board agenda of August 7, 2001, with the following additions: Under Solid Waste Director, Mike Hanan: • Petty Cash Funds • "Processing Payments" Legislation Commissioner Lee: • Rural Health Network Motion carried unanimously. Approval of Minutes Motion by Lee, second by Mosher, and unanimously carried to approve the County Board minutes of July 31, 2001, as mailed. License Applications Motion by Froemming, second by Lee, and unanimously carried to approve the following application for license: Steven D. Hauck Tobacco Otter Supper Club Hwy 78, Box 268 Ottertail, MN 56571 Application for Exemption for Lawful Gambling Motion by Lee, second by Mosher, and unanimously carried to approve the application of Pelican River Pheasants Forever for exempt permit with a 30-day waiting period, and allows the Gambling Control Board to issue a permit after 30 days for an event scheduled for September 20, 2001, at the Blue Water Restaurant and Sports Bar in Pelican Rapids, MN. Assessment Levied Motion by Nelson, second by Block, and unanimously carried to direct the County Auditor, per the requirements of Minnesota Statute 145A.04, to levy a special assessment against the following described legal property for the following costs: 78-000-99-0078-000 E1/2 of the W1/2 of Block 2 Thoelke's Addition STS Work Performed on Richville Home Solid Waste Disposal Charges Total $278.18 133.30 $411.48 OTC Board of Commissioners' Minutes August 7, 2001 Page 2 Approval of Credit Card Applications Motion by Lee, second by Mosher, to approve the following credit card applications: Stephen Handegaard County Extension 1,000.00 Donna Geiser County Extension 1,000.00 Vincent Crary County Extension 1,000.00 Angela Berge County Extension 1,000.00 Douglas Holen County Extension 1,000.00 Jan Brooberg County Extension 1,000.00 Vicki Schwanke County Extension 1,000.00 Theresa Melmer Human Services 800.00 Tracey Lanus Janssen Human Services 1,000.00 After brief discussion, motion carried unanimously. Approval to Pay Bills Motion by Mosher, second by Nelson, to approve payment of bills per Attachment A of these minutes, which includes the following lodging payment: Grand View Lodge Veteran Service Officers, Jourdan Sullivan & Thomas Figluizzi Motion carried unanimously. Resolution to Apply for State Grant Otter Tail County Resolution No. 2001 -42 Commissioner Lee introduced the following resolution and moved its adoption: BE IT RESOLVED that Jourdan Sullivan, CVSO, act as the legal sponsor for project(s) contained in the County Veterans Service Officers Grant Application submitted on August 7, 2001, and that the County Veterans Service Officer is hereby authorized to receive grant funds from the Minnesota Department of Veterans Affairs for funding of this project on behalf of Otter Tail County. BE IT FURTHER RESOLVED that Jourdan Sullivan has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate construction, operation, maintenance, and replacement of the proposed project. BE IT FURTHER RESOLVED that Otter Tail County has not violated any Federal, State, or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other unlawful or corrupt practices. Commissioner Nelson seconded the motion, and upon being put to vote, was unanimously carried. Adopted this ih day of August, 2001. Dated:_-1.S,--___.1._/ ..L.'-1_--=-0_._J ___ _ OTTER TAIL COUNTY BOARD OF COMMISSIONERS Attest: ,&~~ (f£ LarryKroh, Ciel< 0 0 Q 0 0 0 Labor Management Training OTC Board of Commissioners' Minutes August7,2001 Page 3 County Coordinator, Larry Krohn, reported that training, lead by the Bureau of Mediation Services for new members of the Labor Management Committee is scheduled on August 23rd at the Prairie Wetland Center. In the past, this training was provided at no charge. Mr. Krohn stated that this year the cost is $25 per person (approximately 14 new members) and requested direction from the County Board regarding which budget the expenditure should come from. Additionally, the Co- chairs received training at a cost of $199 each, which is not budgeted. Discussion followed regarding the Labor Management Committee and the potential benefit of this training. Motion by Lee, second by Block, to authorize the Labor Management training sessions and payment for these expenses to be paid from the County Coordinator's budget. Motion carried with Nelson and Mosher opposed. Henning Township Road Discussion Mike Hanan, Solid Waste Director, introduced discussion regarding a letter dated July 12, 2001, from the Henning Township Board regarding the Transfer Station road. Mr. Hanan reviewed several short and long term solutions that the Town Board identified in their letter to reduce dust, reduce the number of nails picked up, and address the Town Board's concern with the entrance into the transfer station. The letter identifies a long-term solution of tarring the road to the transfer station if the short-term solutions do not eliminate the problems. The letter did not identify the percentage the Township is willing to pay if the road is tarred. Lengthy discussion took place regarding the County's share of maintenance of the road, County funds spent in the past on this road, and funding options. Commissioners directed Mr. Hanan to draft a letter to the Henning Town Board outlining the County's position and return to the next County Board meeting. Petty Cash Funds Motion by Lee, second by Mosher, and unanimously carried to authorize the Pelican Rapids and Parkers Prairie redemption centers to keep $50 in the petty cash funds rather than $25 to prevent running out of money when making change at the beginning of the day. "Processing Payments" Legislation Mr. Hanan and Service Fee Systems Administrator, Michele Petterson, reported that the 2001 Legislature has created a Mixed Municipal Solid Waste Processing Payment Program for counties that process waste. The law was enacted as Special Session 2001 Chapter 2, Sec. 124, Subd. 2. The legislation allows counties to apply quarterly, for $5 per ton for every ton of waste Otter Tail County sends to processing facilities. The funds are to be used to reduce tipping fees paid at the incinerators. Mr. Hanan and Ms. Petterson are proposing that the Solid Waste Service Fee be reduced by $5 per household countywide to reflect lowering the tipping fee by $5 per ton to be sure the customer who pays disposal costs would receive the benefit of the state legislated "Processing Program". Motion by Froemming, second by Mosher, and unanimously carried to send the proposal to the Minnesota Office of Environmental Assistance dated August 7, 2001, to apply for the state funds under the new legislative program, credit revenues to the ·solid Waste Revenue Budget, and reduce the service fee collected to reflect lowering the tipping fee by $5 per ton. Budge't Discussion _ Commissioner Nelson reported on progress of the Budget Committee: He noted that it may be difficult to keep the budget down to required levy limits if all requests are granted. Further review will take place at the next Budget Committee meeting. OTC Board of Commissioners' Minutes August 7, 2001 Page4 Recess & Reconvene Q At 11 :09 a.m., Chair Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed. The meeting was reconvened at 1 :00 p.m. with all five seated commissioners present. Request to Keep E-911 Road Name of Lyden's Beach Property owners, Cyndi Lyden and Betty Jean Pyle, requested that the road initially named Lyden's Beach Road during the E-911 addressing process and recently changed to Boe's Drive be changed back to Lyden's Beach Road. Ms. Pyle stated that there are year around residents located at Lyden's Beach and there are no year around residents located at Boe's Beach. She presented a letter from Dunn Township that did not oppose a change by the County Board. Discussion followed regarding the changing opinion of Dunn Township, the recorded plat of Boe's Beach, road name appeal and notice procedures, etc. Motion by Block, second by Nelson, to reverse previous action to change Lyden's Beach Road to Boe's Drive and leave the road name Lyden's Beach Road as initially named during the E-911 addressing system. Chair Froemming called for a roll call vote: Commission District 5 Block Yea Commission District 2 Lee Nay Commission District 4 Froemming Nay Commission District 1 Nelson Yea Commission District 3 Mosher Abstain Motion failed. Ditch System No. 4 Discussion Acting Ditch Inspector, Tiny Holm, reported that he has contacted Duane Munch for a bid to clean out to CR 136 through Mr. Olson's property beyond the railroad track. The area is about 1½ miles. The Ditch Viewers have not completed their work at this time. Property owners, Roy Olson and Delmer Schmidt, spoke in favor of cleaning out the additional mile and one half as discussed. Mr. Schmidt stated that one big problem is the culvert on Highway 136 which wasn't installed in the original location. Mr. Holm stated that the culvert is the original size; however, ii was moved to the east when Highway 136 was rebuilt and the water does not flow naturally. Mr. Holm will research this issue further and return to the Board next week with additional information. Adjournment At 2:27 p.m., a motion was offered by Froemming, seconded by Block, and unanimously carried to declare the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, August 14, 2001.
