HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/22/20010 0 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-8 Tuesday, May 22, 2001 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, May 22, 2001, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Roger Froemming, Chair; Dennis Mosher, Vice-Chair; Syd Nelson, Malcolm Lee, and Bob Block present. Approval of Agenda Motion by Block, second by Nelson, and unanimously carried to approve the Human Services Board agenda of May 22, 2001 as mailed. Approval of Minutes Motion by Mosher, second by Lee, and unanimously carried to approve the Human Services Board minutes of May 8, 2001 as mailed. Statewide Survey of Immunization Levels Pursuant to Minnesota Statutes, Public Health Director, Diane Thorson presented the results of the statewide survey showing the immunization status of children enrolled in licensed child care centers and children in grades K-12. Otter Tail County's statistics are better than the statewide average in most categories. Health Alert Network Grant Agreement Ms. Thorson recommended contracting with the Minnesota Department of Health to allow Otter Tail County to become a part of the Health Alert Network. This network will be used to respond to MDH Health Alerts. Motion by Mosher, second by Nelson, and unanimously carried to authorize the Chair's signature to execute a grant agreement between the Minnesota Department of Health and County of Otter Tail to allow Otter Tail County to become part of the Health Alert Network system. The state will provide $4,200 for FY 2001 from federal funds through the Centers for Disease Control. Minnesota Family Investment Program (MFIP) Human Services Supervisor, Bev Schoon, provided a handout detailing the Minnesota Family Investment Program which has replaced the previous welfare program. MFIP encourages employment and supplements families with low incomes by assisting with childcare and health insurance to keep them employed. Ms. Schoon discussed the five-year benefit limitation under MFIP and the relating sanctions. Language Assistance Protocol Ms. Schoon presented the Otter Tail County Human Services Language Assistance Protocol. This guideline is to assist staff when obtaining interpreters for various nationalities. The State of Minnesota has mandated that a language efficiency protocol must be developed and followed. The policy follows Title VI of the Human Rights Act with additional guidelines to assist staff. Motion OTC Board of Commissioners' Minutes May 22, 2001 Page 2 by Lee, second by Block, and unanimously carried to approve the Otter Tail County Human Q Services Language Assistance Protocol dated 4/1/01 as presented. CSSA Community Meetings Human Services Director, John Dinsmore, provided a schedule of CSSA community planning meetings to be ,held in various towns throughout the County. Productive Alternative Contract Productive Alternatives Inc. Director, Steve Skauge, and HS Supervisor, Tom Jensen, requested approval of a rate increase for the Day Training and Habilitation program .. Mr. Skauge briefed the Board on increased costs and noted that this program has not received a per diem increase for several years. Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chair's signature to execute the Rate Variance Request that recommends a per diem increase for Productive Alternatives, Inc. Day Training and Habilitation Program from $51.64 per day to $59.10 per day effective January 1, 2001. · , Bills & Claims Motion by Mosher, second by Lee, and unanimously carried to approve the Human Services bills and claims as presented. Q 0 0 0 OTC Board of Commissioners' Minutes May 22, 2001 Page 3 Planning Commission Recommendations Preliminary Plat -Oppegard Estates 3rd Addition/ Charles Oppegard: Motion by Froemming, second by Nelson, and unanimously carried to approve the Preliminary Plat of "Oppegard Estates 3rd Addition" with conditions as recommended by the Planning Commission. The property is described as part of Gov. Lot 2, Section 25 of Leaf Lake Township, East Leaf Lake (56-116). Preliminary Plat & Conditional Use Permit -Grand Oak Estates/Donovan Olson: Motion by Mosher, second by Lee, and unanimously carried to approve the Preliminary Plat of "Grand Oak Estates" consisting of 6 single family residential lots and a Conditional Use Permit to construct a cul-de-sac to service the proposed plat as shown on the plan dated April 17, 2001, and per all conditions as recommended by the Planning Commission. The property is described as Pt. NE1/4 SW1/4, SE1/4 SW1/4, SW1/4 ,SE1/4 & Gov. Lot 3 of Sec. 29; and Pt Gov. Lot 1 & SE1/4 SW1/4 of Sec 32 of Dane Prairie Township, Swan Lake (56-781 ). Conditional Use Permit -Otter Tail County Highway Department: Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use Permit for S.P. 56-624-10, Reconstruction of CSAH No. 24, with conditions as recommended by the Planning Commission. The project location is described as follows: From a point 9.82 ft. south and 450.25 ft. east of the south ¼ corner in Sec. 28 of Trondhjem Township to a point 33.31 ft. north and 1199.39 ft. west of the southeast corner of Sec. 21 in Erhards Grove Township, Hovland Lake (56-1014) and Nelson Lake (56-1015). Conditional Use Permit -Scott R. Wellnitz: Motion by Lee, second by Mosher, and unanimously carried to approve a Conditional Use Permit to expose the remaining block on the 24 foot section of the existing home· for a walk-out basement with conditions as recommended by the Planning Commission. The property is described as Lot 3 Olson's Maplewood-Lida Beach, Section 32, Lida Township, South Lida (56-747). Conditional Use Permit -Red Lantern Resort/ Darryl & Terry Enerson: Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional Use Permit for 8 total campsites and to convert 2 adjacent single family cabins into resort use with conditions as recommended by the Planning Commission. The property is described as W. 50' of Lot 13, All Lot 14, All Lot 15, Shirley Beach: Lot C North of Lots 12, 13, 14, & 15 Shirley Beach; Shirley Beach Resurvey Res 1 & 2 WLY 50' Lot 13 & All Lot 14, Section 22, Amor Township, Otter Tail Lake (56-242). Environmental Advisory Committee (Water Plan Committee) Motion by Nelson, second by Lee, to approve a resolution authorizing the Soil & .water Conservation Districts responsibility for the preparation of the Comprehensive Water Plan. Discussion followed regarding the current committee membership. Commissioner Nelson and Lee rescinded· the motion and second respectively. Motion by Lee, second by Froemming, and unanimously carried to appoint Land & Resource Director, Bill Kalar, to the Environmental Advisory Committee effective immediately. Comprehensive Local Water Plan Otter Tail County Resolution No. 2001 -27 Commissioner Nelson offered the following and moved its adoption: OTC Board of Commissioners' Minutes May 22, 2001 Page 4 WHEREAS, Otter Tail County has established a Comprehensive Local Water Plan pursuant to Q Minnesota Statute §103B.311; and WHEREAS, the Soil and Water Conservation Districts of Otter Tail County, the East Otter Tail County Soil and Water Conservation District, and the West Otter Tail County Soil and Water Conservation District are local units of government with the expertise in water planning and management, and are willing to monitor, review, and update the plan; and WHEREAS, pursuant to Minnesota Statue §103B.311, Subd. 2, the County may delegate all or part of the preparation of the plan to local units of government, but remains responsible for adopting and assuring implementation of the Comprehensive Water Plan. NOW, THEREFORE, BE IT RESOLVED that Otter Tail County hereby delegates to the East Otter Tail County Soil and Water Conservation District and the West Otter Tail County Soil and Water Conservation District responsibility for preparation of the Comprehensive Water Plan, including monitoring, reviewing, and updating the local water plan and making reports to the County Board. Commissioner Lee seconded the motion, and upon being put to vote, was unanimously carried. Adopted this 22nd day of May, 2001. Approval to Pay Bills Motion by Lee, second by Froemming, and unanimously carried to approve payment of bills per Attachment A of these minutes. · Discussion -Courthouse Hours Commissioner Nelson briefed the Board regarding a discussion item of the Labor Management Committee to change the hours the Courthouse is open to the public from 8 a.m. to 5 p.m. to 9 a.m. to 4:30 p.m. The Labor Management Committee had surveyed other counties and found that many counties are open from 9 a.m. to 4:30 p.m. Lengthy discussion followed. The consensus of the Commissioners was a reluctance to change the Courthouse hours because the public is satisfied with the current hours and each department can work on a flex schedule for employees that works for their specific job duties. Recess·& Reconvene At 11 :58 a.m., Chair Froemming declared the Otter Tail County Board of Commissioners' meeting recessed for lunch break. The Chair reconvened the meeting at 1:10 p.m. 0 0 0 OTC Board of Commissioners' Minutes May 22, 2001 Page 5 Resolution Authorizing Sponsorship of Trails Operated by Otter Trail Riders Snowmobile Club Otter Tail County Resolution No. 2001 -29 Commissioner Lee offered the following and moved its adoption: BE IT RESOLVED that Otter Tail County act as the legal sponsor for an application for funding to the State of Minnesota Department of Natural Resources for snowmobiling of snowmobile trails managed by Otter Trail Riders Snowmobile Club. BE IT FURTHER RESOLVED that upon approval of its application by the state, Otter Tail County may enter into an agreement with the State of Minnesota for the above referenced project and that it will comply with all applicable laws and regulations as stated in the agreement. BE IT FURTHER RESOLVED that Otter Tail County Land & Resource Director, Bill Kalar, is authorized to sign such an agreement with the Department of Natural Resources. · BE IT FURTHER RESOLVED that Otter Tail County is hereby authorized to serve as the fiscal agent for the above referenced project. Commissioner Block seconded the motion, and upon being put to vote, was unanimously carried. Adopted this 22nd day of May, 2001. Payment Approval Motion by Nelson, second by Froemming, to approve payment, in the amount of $627.20, to the Otter Tail County Department of Solid Waste from the Tax Forfeited Fund for acceptance of the following materials removed from tax forfeited property located within the City of Clitherall: Municipal Waste $12.50 Whitegoods 16.00 Demolition 541.20 Car tires 7.50 Televisions 12.00 Chairs 19.00 Mattresses 19.00 Total $627.20 Motion carried. Motion by Nelson, second by Mosher, and unanimously carried to approve payment to Ness Backhoe Service, in the amount of $2,497.50, for 29.5 hours of backhoe work on County Ditch No. 29 and to approve assessing the cost to the benefited landowners on the payable 2002 property tax statement. Ditch No. 25 Ditch Inspector, Tiny Holm, reported that he received an estimate of $800 to repair the culvert that blew out in the Ditch No. 25 system. Motion by Nelson, second by Mosher, and unanimously carried to repair the culvert in Section 25 of Dora Township, NE of the SE quarter, on the Ditch No. 25 system as it leaves Archie Lake. The motion authorizes $800 for the repair to be paid out of the Ditch No. 25 fund. Veterans Service Office Update VSO, Jourdan Sullivan, presented a quarterly briefing regarding the operations of the VSO office including the Hospital Van and VA health care programs.
