HomeMy WebLinkAboutBoard of Commissioners - Minutes - 12/26/2000{\ .....,, MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, December 26, 2000 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, December 26, 2000 at 9:34 a.m. at the Otter Tail County Courthouse with Commissioners Roger Froemming, Chair; ,Dennis Mosher, Vice-Chair; Syd Nelson, Malcolm Lee, and Virginia Partmann present. Approval of Agenda Motion by Mosher, second by Nelson, to approve the Human Services Board agenda of December 26, 2000 as mailed. Motion carried. Approval of Minutes •Motion by Partmann, second by Lee, to approve the Human Services Board minutes of December 12, 2000 as presented. Motion carried. Advisory Board Appointment -Motion by Lee, second by Partmann, to reappoint Richard Jenson, Second District, to the Otter Tail County Advisory Committee, for a three-year term. Motion carried. Other committee members . include: Bob Wilkowski, First District; Janyne Hoff, Third District; Bob Johnston, Fourth District; Donald Koester, Fifth District; and David Hauser, County Attorney. Statewide Supervision System Court Services Director, Chuck Kitzman, reported that as a part of the "Enterprise View", Minnesota Statute 299C.65 requires the development of a Statewide Supervision System that includes all offenders, pre and post trial that are under supervision in Minnesota. This includes both adult and juveniles on probation or in a detention facility. This information will be available to criminal justice professionals through an interactive web site. The Minnesota Department of Corrections requires all probation agencies, jails, workhouses, and juvenile detention facilities to report offender information in a standard format. Currently, probation agencies are required to report information via the annual probation survey and the detention agencies are required to report information in the Detention Information System. i Beginning January 1, 2001, the Department will be moving all probation agencies and all detention centers Qails, workhouses, and juvenile detention centers) toward reporting information electronitally to the Statewide Supervision System. The goal of this transfer is to: _ / • Provide a timely, accurate and complete listing of who is under supervision in Minnesota and who to contact to find out more about that supervision. • Make the information easily accessible to all criminal justice agencies through a secure interactive web site on the Internet. • Standardize and coordinate state agency requirements to allow counties/facilities to report to one state agency and have that state agency report the information to other state agencies. • Reduce duplicate data entry. The goal is to enter the information in one system and electronically pass that information to the Statewide Supervision System. ,No board action was needed. OTC Board of Commissioners' Minutes December 26, 2000 Page 2 • Minnesota Department of Health Home Visiting Contract Q Public Health Director, Diane Thorson, requested approval of the Minnesota Department of Health Home Visiting Contract for the TANF-PHN Home Visiting Program. The total amount of contract will not exceed $35,685, for services provided between July 1, 2000 to June 30, 2001. In FY02 and FY03 the amount will be established in written letters. At least 70 percent of these funds will be used for home visiting services, and up to 30 per cent can be used for outreach activities, staff training, and program evaluation, along with any administrative costs associated with these three activities. Motion by Partmann, second by Lee, to approve the Minnesota Department of Health Home Visiting Contract in the amount of $35,685, for services provided between July 1, 2000 to June 30, 2001. Motion carried. Otter Tail County Public Health -Organizational Structure Ms. Thorson and Marion Kershner, Public Health Nurse, provided a handout -'The Working Wheel", which shows the structure of the Public Health Department. This handout was part of the retreats that were done and included participation from the entire staff. "The Working Wheel" concepts included: citizens are the axle, the core reason why the public health department exists; County Board is the bearing, the authority to make the policies and approve financing; the Director is the hub, to direct the department; the Assistant Director, the link between the director and the staff; and staff implement the programs. The ultimate goal for Otter Tail County is a healthy community. All parts of the wheel must be in sync, if a section of the wheel is not doing their part, the tire is flat and does not allow the tire to go where it is needed. Approval of Vacant Nurse Position Q Motion by Partmann, second by Mosher, to approve filling the vacant nurse position in the Public Health Department, with the job description staying the same. Motion carried. Approval of Human Services Contracts Motion by Nelson, second by Partmann, to authorize the Chair's signature to execute the following Human Services contracts for January 1, 2001 through December 31, 2001: • Pioneer Home Assisted Living Program -unit cost shall be based upon the Case Mix level and Rate as reflected in the contract. • Adult Mental Health Services -Mental Health Initiative/Crisis Responder Program -contract provides for a maximum expenditure of $64,000. • Adult Mental Health Services -St. Williams Annex -Rule 14-Community Support Program Services -contract provides for a maximum expenditure of $43,400. • Adult Mental Health Services -St. Williams Annex -Rule 36 -for Adult Residential Treatment -contract provides for a maximum expenditure of $240, 184. Motion carried. Amendment 2000 -Provider Contracts Tom Jensen, Human Services Supervisor, reported that the Minnesota State Legislature has mandated that the Providers of Services identified in "Laws of Minnesota 2000", Chapter 488, Article 9, Section 29 as amended by Chapter 499 receive an increase in reimbursement rates effective July 1, 2000. Mr. Jensen requested approval to amend the contracts of providers who deliver the following services: • Home and Community Based Waivered Services for persons with mental retardation or related conditions • Home and Community Based Waivered Services for the elderly • Waivered Services under Community Alternatives for disabled individuals 0 OTC Board of Commissioners' Minutes December 26, 2000 Page 3 '-.) • Community Alternative Care Waivered Services • · Traumatic Main Injury Services • Nursing Services and Home Health Services • Personal Care Services and Nursing Supervision of Personal Care Services • Private Duty Nursing Services • Day Training and Habilitation Services for Adults with Mental Retardation and Related Conditions • Alternative Care Services • Adult Residential Program Grants • Adult Community Support Grants • Semi-independent Living Services. Motion by Mosher, second by Nelson, to approve the amendment to the contracts of providers who deliver services as stated above. Motion carried. Purchase of Service Agreement for Clay/Wilkin Opportunity Council, Inc. CCR & R Training for Otter Tail County Motion by Lee, second by Mosher, to authorize the Chair's signature to enter into an agreement with Clay/Wilkin Opportunity Council, Inc. for Child Care Resource and Referral to provide training .for child care providers from January 1, 2001 to December 31, 2001, in the amount of $6,745. Motion carried. Purchase of Service Agreement for Children's Mental Health Services iMotion by Lee, second by Portmann, to authorize the Chair's signature to enter into an agreement with Lakeland Mental Health Center, Inc., to provide children's mental health services from January 1, 2001 to December 31, 2001, for a maximum expenditure of $57,158. Motion carried. Renewal of Contract Lakeland Mental Health Center Motion by Nelson, second by Portmann, to renew the Lake Mental Health Center Contract - Outpatient Contract Format for CY2001, in the amount of $471,000, which reflects a 3 per cent increase from CY2000, subject to the approval from the County Attorney. This contract requires monthly reports from LMHC and specified billing. Motion carried. Bills and Claims Motion by Lee, second by Nelson, to approve the Human Services bills and claims as presented. Motion carried. 10 0 0 Approve Inter-fund Loan County Drainage Ditch No. 29 OTC Board of Commissioners' Minutes December 26, 2000 Page 5 Motion by Nelson, second by Mosher, to approve and inter-fund loan, in the amount of $700.00, with an interest rate of six per cent, from the General Revenue Fund to the County Drainage Ditch ·No. 29 account to cover the following expenditures: ONO Construction Roger and Sharon Krause Total Motion carried. $500.00 $200.00 $700.00 Commissioner Mosher offered the following and moved its adoption: Assessment Order for County Drainage System No. 29 Otter Tail County Resolution No. 2000-58 WHEREAS, the County Board of Otter Tail County, acting as the County Ditch Authority, had authorized Tiny Holm, Ditch Inspector to proceed with minor repairs/maintenance to County Drainage System No. 29, and WHEREAS, the Otter Tail County Board of Commissioners has approved expenditures in the amount of $700.00 for the repair/maintenance of County Drainage System No. 29 as follows: DND Construction. Roger and Sharon Krause Total $500.00 $200.00 $700.00 NOW THEREFORE, BE IT RESOLVED BY THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS, that a special assessment in the amount of $700.00, be levied against the benefited properties of County Drainage System No. 29, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the repair/maintenance in the amount of the assessment levied against it. BE IT FURTHER RESOLVED, that such assessments shall be payable in one installment. To the installment shall be added interest, at a rate of 6%, on the entire assessment from September 22, 2000 until December 31, 2001. BE IT ADDITIONAL RESOLVED, that the owners of any of the benefited properties so assessed may, on or before Wednesday, January 31, 2001 pay the entire assessment on such property to the County Auditor's office without interest. If payment is not received on or before Wednesday, January 31, 2001 then the unpaid balance, with interest as noted above, will be added to the payable 2001 property tax statement. OTC Board of Commissioners' Minutes December 26, 2000 Page 6 OTTER TAIL COUNTY BOARD OF COMMISSIONERS 0 Attest: i~'Fn ~ Larry Kron, Crk Commissioner Lee offered the following and moved its adoption: Assessment Order for Otter Tail-Wilkin Judicial Drainage System No. 2 Otter Tail County Resolution No. 2000-59 WHEREAS, Tiny Holm, Otter Tail County Ditch Inspector, has informed the Otter Tail County Board of Commissioners that a portion of the Otter Tail-Wilkin Judicial Drainage Systems No. 2 has been repaired/maintained in 2000 and that plans have been made for additional repair/maintenance work to continue in 2001, and WHEREAS, the benefited properties located within Otter Tail County are responsible for 47.05% of the total repair/maintenance expenditures incurred by the Otter Tail-Wilkin Judicial Drainage System No. 2 and, WHEREAS, in 1999 and 2000 a total of $18,065.46 has been expended on the repair/maintenance of Otter Tail-Wilkin Judicial Drainage System No. 2 leaving a balance in the Otter Tail-Wilkin Judicial Drainage System No. 2 account of $145.58, and WHEREAS, the cost of the repair/maintenance work scheduled for completion in 2001 is estimated at approximately $40,000 of which the benefited properties located within Otter Tail County are responsible for $18,820.00 or 47.05%. NOW THEREFORE, BE IT RESOLVED BY THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS, that a special assessment in the amount of $20,000.00, be levied against the benefited properties located within Otter Tail County for the repair/maintenance of Otter Tail-Wilkin Judicial Drainage System No. 2, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed repair/maintenance in the amount of the assessment levied against it. BE IT FURTHER RESOLVED, that such assessments shall be payable in equal annual installments extending over a period of 5 years. To the first installment shall be added interest, at a rate of 6%, on the entire assessment from the date of this resolution until December 31, 2001. To each subsequent installment when due shall be added interest, at a rate of 6% for one year on the unpaid balance. 0 BE IT ADDITIONAL RESOLVED, that the owners of any of the benefited properties so assessed may, on or before Wednesday, January 31, 2001 pay the entire assessment on such property to the County Auditor's office without interest and, the owners of any of the benefited properties so Q assessed may, at any time after Wednesday, January 31, 2001, pay to the County Auditor's office the principal balance remaining at the end of the current payable year without interest so long as the payment is received on or before November 15, of the current payable year. He presented proof of giving an address change to the county on May 3Q1h; however, the tax statement was sent to the previous address. Motion by Nelson, second by Froemming, to forgive the penalty of $73.44 on parcel #07-000-18-0120-005 because of county error due to evidence submitted that Mr. Rapatt had applied for an address change. Motion carried. Commissioners' Compensation Discussion took place regarding Commissioners' salary and per diem rates. Motion by Q ·Froemming, second by Mosher, to approve a 2.5 per cent salary increase effective January 1, · 2001, to an annual salary of $17,904.00. Motion carried. By consensus, Commissioners agreed to eliminate the half-day per diem. Commissioners' Compensation Otter Tail County Resolution No. 2000 • 62 Commissioner Nelson offered the following and moved its adoption: WHEREAS, Minnesota Statutes 375.055 and 375.06 provides that County Commissioners shall receive compensation of annual salaries and, in addition, may receive per diem payments and reimbursement for necessary expenses incurred in the performance of duties of their office, as set by a resolution of the County Board; and WHEREAS, the current base annual salary of the County Board of Commissioners is $17,457.28, as set by a resolution of the County Board approved December 28, 1999, which took effect on January 1, 2000, and has been in effect for one year; and WHEREAS, a two and one-half percent cost-of-living increase in the Commissioners' base salary for 2001, which is the same cost-of-living increase that is being provided to county employees, will be a modest and justifiable change in their compensation. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Commissioners shall receive a two and one-half percent increase in their annual base pay salary for 2001, to a new amount of $17,904.00. BE IT FURTHER RESOLVED that the per diem rate shall be $45.00. BE IT FURTHER RESOLVED that per diems are authorized in accordance with Minnesota Statute 375.055 and an Opinion of the Attorney General dated April 28, 1994, for the following activities: For service of individual County Commissioners on any board, including regular County Board meetings, committee, or commission of county government, including committees of the board; for the performance of services by individual County · Commissioners required by law; and for other official duties specifically authorized, in advance, by the County Board. (Members of the County Board shall not receive a per diem for service on the Board of Auditors, the Board of Equalization, or the Canvassing Board.) BE IT FURTHER RESOLVED that pursuant to Minnesota Statutes 375.055, 375.06, and the Attorney General's Opinion dated April 28, 1994, County Commissioners shall be reimbursed for actual and necessary traveling expenses for travel incurred in the discharge of committee work; in attending meetings of the County Board; and for the discharge of official duties authorized, in advance, by the County Board. The mileage rate for reimbursement of Commissioners shall be set at 34½ cents per mile, the same rate set for other county mileage reimbursement.
