HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/21/20000 0 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room -Floor 1-B Tuesday, November 21, 2000 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, November 21, 2000 at 9:35 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Roger Froemming, Vice-Chair; Syd Nelson, Dennis Mosher, and Malcolm Lee present. Approval of Agenda Motion by Nelson, second by Froemming, to approve the County Board agenda of November 21, 2000 as presented. Motion carried. Approval of Minutes Motion by Lee, second by Mosher, to approve the County Board minutes of November 14, 2000 as mailed. Motion carried. Ditch No. 41 Ditch Inspector, Tiny Holm, reported that Ditch No. 41 is by New York Mills and previously, the City of New York Mills paid Otter Tail County $5,000 to join the_ ditch system. The ditch now needs a '-. 1, ··-. partial clean out. The City of New York Mills is proposing that the city pay $1,000, the township pay $1,000, and the Ditch Authority pay $1,000 for the clean out. Motion by Nelson, second by Lee, to approve that the ditch authority take $1,000 out of the Ditch No. 41 fund to assist with clean out of a portion of the Ditch No. 41 system. Motion carried. E-911 Residential Marker Assessments GIS Spatial Manager, Brian Armstrong, presented 75 letters, for the record, that have been ,received in response to the E-911 Residential Marker Assessment Public Hearing. Mr. Armstrong •"explained that 29 letters were opposed to the assessment for cost of the sign, 6 letters objected to :the process used, 9 letters were concerns resulting from confusion, and 1 letter thanked the county •for the E-911 addressing system. He reviewed general concerns/comments and presented a letter to send in response to those individuals sharing concerns about the process or project. The GIS Department received 30 letters in favor of the addressing system; however, had individual concerns. These concerns will" be handled by the GIS Department staff. Commissioners discussed the fact that the cost of.the sign will be on the tax statements. There is no benefit to pay in advance because no interest accrues before the taxes are due. However, if an individual has their parcel number and they wish to pay for their residential marker sign before December 31, ·2000, the Auditor's office, Treasurer's office, as well as the GIS Department should colle,ct the money for this purpose. The GIS Depatment staff will pick up.the payments from the Auditor and Treasurer on a regular basis. Commissioner Lee offered the following and moved its adoption: Otter Tail County Assessment for E-911 Addressing Signs Otter Tail County Resolution No. 2000 -50 .WHEREAS, Otter Tail County has established an Enhanced 911 System, including new addressing, pursuant to the Otter Tail County Enhanced 911 Ordinance and Minnesota Statutes §403;and OTC Board of Commissioners' Minutes November 21, 2000 Page 2 • WHEREAS, as part of the addressing system, it was necessary to place individual address signs Q throughout the County; and WHEREAS, the County Board, by Resolution dated October 10, 2000, determined that the cost of installation of residential signage in Otter Tail County is $474,727.50; and WHEREAS, the property owners who could be assessed for the address markers were notified of the hearing pursuant to Chapter 429 of the Minnesota Statutes; and WHEREAS, on November 14, 2000, a public hearing was held pursuant to Minnesota Statute §429.031. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners determines that the County shall proceed with the E-911 addressing as a project for assessments pursuant to Minnesota Chapter 429. Commissioner Froemming seconded the motion and, upon being put to vote, was unanimously carried. Adopted this 21 st day of November, 2000. There were 18,980 letters sent out to the public for 21,099 assessed addresses. There were 75 letters of concern received as response to that letter which is less than 1 %. Motion carried. Investment Opportunity Commissioner Mosher presented an investment option relative to purchases of land by the U.S. Fish and Wildlife Service. Because a lump sum of money is received, the same amount of interest accrued if the land had stayed private could be available to the county and township. The additional interest accrued could be added to the principle amount and the money would continually grow. Currently, 100% of the interest earned is added to the settlement dollars for distribution to the county and township. Payment Approval Motion by Lee, second by Froemming, to approve payment to the Fergus Falls Medical Group PA, in the amount of $233.50, for costs incurred under the provision of Minnesota Statute 609.35. Motion carried. Motion by Nelson, second by Mosher, to approve payment as follows from the Minnesota Department of Veterans Affairs equipment grant: Otter Tail TelCom $385.31 0 0 Q 0 OTC Board of Commissioners' Minutes November 21, 2000 Page 3 GR Graphics Inc. $146.98 ($71.95 from grant funds) Motion carried. Tax Forfeited Sites Motion by Nelson, second by Lee, to turn back three tax forfeited sites (referred to as the New York Mills, Newton Township, and Rothsay sites) to the Minnesota Pollution Control Agency (MPCA). · Motion carried. Commissioner Lee offered the following and moved its adoption:. Temporary Snowmobile Trail Easement Otter Tail County Resolution No. 2000 -51 This Snowmobile Trail Easement is granted this 21 st day of November 2000, by the Otter Tail County Auditor, under the provision of Minnesota Statute 282.04, Subdivision 4, to the Otter Trail <Riders Snowmobile Club, for the purpose of establishing and maintaining a temporary seasonal 0 .1.ise snowmobile trail across the following described tax forfeited property situated in the County of Otter Tail, State of Minnesota, to wit: The East Half of the Southwest Quarter Except the West 1 O Rods of the North 16 Rods, all in Section 34 of Township 136 Range 40 -(79 Acres). That the Otter Tail County Auditor, per the provision of Minnesota Statute 282.04, Subdivision 4, in receipt of $1.00, hereby grants an easement, for a period not to extend past December 31, 2001, over and across the above described tax forfeited property as shown on the attached drawing subject to the following conditions: 1. Upon a 90-day written notice this easement shall terminate and will be cancelled by a resolution of the Otter Tail County Board of Commissioners if, a.)at any time the easement conflicts with any public use of the property, b.)at any time the Otter Trail Riders Snowmobile Club should cease to exist, c.)at any time the designated route is no longer used as a snowmobile trail, d.)at any time the above described tax forfeited property is sold/conveyed, and e.)at any time any of the conditions stated in this document are in default. 2. The right-of-way of the snowmobile route shall be open to the general public only for snowmobile use. 3. The State of Minnesota and the County of Otter Tail shall at all times have the right to enter upon the above described property and upori said right-of-way for any purposes necessary for the performance of our lawful powers and duties. 4. The State of Minnesota and the County of Otter Tail shall have the right to close said right-of- way during any emergency. When practical the Otter Tail Riders Snowmobile Club will be notified. 5. This easement is for a 16' width over the route to be used as a seasonal use snowmobile trail. OTC Board of Commissioners' Minutes November 21, 2000 Page4 6. Signage by the Otter Trail Riders Snowmobile Club of the trail to direct the use and safety of 0 the trail across the above referenced property is encouraged. If the temporary snowmobile trail easement is not renewed the Otter Trail Riders Snowmobile Club prior to December 31, 2001, must remove all signage or Otter Tail County shall have the right to remove the signs and the costs for such removal will be the responsibility of the Otter Trail Riders Snowmobile Club. 7. The Otter Trail Riders Snowmobile Club shall indemnify the County against any claim arising from the use of the property as a snowmobile trail and will maintain insurance, as required by the separate Snowmobile Trail Agreement held with the County. Perham Resource Recovery Facility Update Solid Waste Director, Mike Hanan, reported that the Perham City Council approved the Otter Tail County Board's action of last week as documented in Otter Tail County Resolution No. 2000-49. The Perham City Council has accepted responsibility and liability for the merchant capacity waste. Discussion followed. Commissioner Lee offered the following and moved its adoption: Variance Request-Project No. S.P. 56-624-10 Otter Tail County Resolution No. 2000 -52 WHEREAS, Otter Tail County wishes to reconstruct County State Aid Highway No. 24 from Jct. T.H. 59 in Erhard, West and South 7.0 miles to the South Jct. CSAH No. 21; AND WHEREAS, the Otter Tail County Commission has requested assistance utilizing Federal Aid and State Aid Funds for the above referenced project; AND WHEREAS, there are two (2) locations on the roadway where the design speed does not equal or _exceed the legal posted speed limit due to the proximity of the two (2) existing houses to the roadway. The vertical curve located at Sta. 460+00 meets a design speed for stopping site 0 Q 0 0 0 OTC Board of Commissioners' Minutes November 21, 2000 Page 5 distance of 45 MPH and the vertical curve at Sta. 475+00 meets a 50 MPH design speed for stopping site distance; AND WHEREAS, Mn/DOT State Aid rules 8820.920 Geometric Design Standards; Rural and Suburban undivided; new or reconstruction projects, require the design speed must equal or exceed the legal speed limit on the roadway; AND WHEREAS, Otter Tail County agrees to defend at its expense any claim of whatever character as a result of granting said variance; AND NOW, THEREFORE, BE IT RESOLVED, Otter Tail County hereby requests this variance as supported by the attached documentation. BE IT FURTHER RESOLVED, that Otter Tail County Board of Commissioners indemnifies, saves, and holds harmless the State and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the granting of said variance. This award was for the county's Enhanced 911 Addressing project and was granted because of the teamwork throughout Otter Tail County that made this project successful. Commissioners expressed special gratitude for all of the external committee people that worked with the county on this project. Flexible Benefits Plan Service Agreement Motion by Lee, second by Froemming, to authorize the Chair's signature to execute the Flexible Benefits Plan Service Agreement between the County of Otter Tail and Stanton Group (formerly DCA, Inc.). The administrative fee for the FSA administration will be $3.85 per participant per month for year 2001, which is the same as last year. Motion carried. Insurance Rates for Year 2001 County Coordinator, Larry Krohn, reviewed the insurance rates for Year 2001. Health insurance rates are increasing 9.5%, with dental rates increasing from $13 for single insurance in year 2000 to $19 in Year 2001 and from $32 for family insurance in year 2000 to $50 for family insurance in year 2001. Mr. Krohn reported that he would be Chairing an Insurance Advisory Committee through the Lakes Country Service Cooperative. The committee will specifically be working on common benefit plans for the city/county pool. OTC Board of Commissioners' Minutes November 21, 2000 Page 6 Personnel Committee Q Commissioner Froemming appointed Commissioner Dennis Mosher to the Personnel Committee to replace Commissioner Partmann. Defibrillator Access Commissioner Lee expressed a desire to have a defibrillator in the courthouse. The Sheriffs Department may be an appropriate place for one in case someone passes out. Discussion followed. Disbursement Approval Motion by Nelson, second by Froemming, to release $3,000 to the History Museum of East Otter Tail County from this year's budget. The funds will be used for the following items: Microfilm printer/reader -Cannon PC 70 $2,200 Vendor -Zytron Industries Digital files of Mason's History of Otter Tail County $ 800 and Otter Tail County in the World War Vendor -Northern Micrographics Motion carried.
